Def Minister’s inquiry in DRDO’s TOT could open can of worms

“Many old TOTs by DRDO given to industries will be under the scanner.”

The inquiry was ordered after a news report about the repetitions of TOT by DRDO at the Defence Expo held at Chennai in April.

Similiarly, in year 2013, one of the TOTs in question of an explosive device kit prepared by High Enegy Material Laboratory (HEMRL) Pune received a lot of media attention after the signing of MoU with a US-based company.

Sakal Times has found out that a propaganda of TOT was promoted in order to boost the image of DRDO after the corruption and nepostism in it was exposed by the audit report of Comptroller General of Defence Accounts (CGDA) in 2012.In order to Boost the image of DRDO Avinash Chander,the then director of DRDO in year 2013 served the old wine in new bottle and created a propoganda for reverse technology transfer to USA by forged TOT of explosive device kit prepared at HEMRL, Pune.

According to documents with Sakal Times, the patent for EDK was falsified and a memorandum of understanding (MOU) was signed with one South Carolina-based company – which was actually a car accessories’ company with only two employees.

Murky background
HEMRL developed the EDK technology and applied to patent it in March 1996. In February 2010, the EDK was patented in the name of its inventors – Rabindra Kumar Sinha, Jaman Singh Gharia, Usha Devi Ramchandran Nair and Hira Lal Yadav.

Despite this, HEMRL falsely credited the innovation on the name of another scientist who was not the inventor – Reny M Roy – and was sent to America. The letter from HEMRL stated that she is the team leader and her presence in USA for the demonstration is necessary.

Roy claims this is wrong information. “The team had not completed their work, it was us who made it operational. Nothing is on anybody’s name, please don’t do such things as DRDO is doing good work,” she said.

Sinha, one of the inventors of EDK, said, “We completed the project and we don’t know why our name has not come and it doesn’t affect us.”

The DRDO director in 2013, when the MOU was signed, Avinash Chander, is currently based in Hyderabad and defended his actions saying, “I am not responsible for this, I was not the head of HEMRL lab. You should ask the concerned director.”

Propaganda and repeated MOU of TOT

  • 2011: HEMRL signed the first MOU with Crowe and Company, a Summerville,South Carolina-based car accessory and consulting services company with annual revenue of USD 1 lakh and has two employees. The MOU was signed between the then HEMRL director Shubhanand Rao and Fay Crow, who was the president of Crowe and company. It is significant to note that before signing the MOU with Crowe and company, DRDO signed a licensing agreement for EDK with a NOIDA based company by the name of Vantage Integrated Security Solutions-which used to deal in the assembling of CCTV Cameras
  • 2012: Controller General of Defence Accounts audit reveals large scale corruption in DRDO projects and VK Saraswat, the then Director General was relieved from his services. The new Director Avinash Chander again signed an MOU with Crowe and Company in Washington DC.
  • 2013:The new Director Avinash Chander again signed an MOU with Crowe and Company in Washington DC. A big function was organized by the DRDO at US Chamber of Commerce building. A dinner party was also hosted by the then Indian Ambassador to Amercia Nirupama Roy for DRDO official and family members of Fay Crowe. A delegation of a dozen scientist including Chander, Roy and Satish Naik, a Technical officer took part in the event.
  • 2015: Chander was sacked by the then Defence Minister, Manohar Parrikar. DRDO team comprised Chander, Reny Roy and Satish Naik, technical officer in addition to nine officials

DRDO’s explanation

  • Though DRDO claims that no explanation was demanded from them, Directorate of Public Interface (DPI) of DRDO has sent an explanatory letter to Defence Minister dated April 23.
  • The letter stated that TOT’s were not repeated during the Defence Expo 2018, and that earlier the technology was demonstrated to clients and later a proposal for TOT was sent to them.
  • DRDO spokesperson Manish Bhardwaj told Sakal Times, “No such inquiry has been ordered by Honourable Raksha Mantri on this matter. The news report refereed by you is factually incorrect. A rebuttal was already sent to the concerned media by the Directorate of Public Relations (DPR), Ministry of Defence.”

BIO-TOILETS STINK AS COMMUTERS, AUTHORITIES PLAY BLAME GAME

Bio-toilets that were fitted in train coaches amid much fanfare are already stinking, with some passengers complaining that the stench is so foul that it is unbearable for those sitting near the toilets.

biotoilet mumbai mirrorAccording to Central Railway’s (CR) official data, of the 4,000 coaches of the long-distance CR trains, 450 were fitted with bio-toilets. The project had gathered momentum after Prime Minister Narendra Modi launched the Swachh Bharat Abhiyan and urged authorities to maintain cleanliness in trains and on tracks. A few coaches in the Rajdhani Express trains of Western Railway (WR) were also provided with bio-toilets.

Unlike traditional train toilets that discharge waste on the tracks, the new system treats the waste inside a tank with the help of bacteria and converts it into harmless gas and water. The Railways had signed MoU with the Defence Research and Development Organisation (DRDO) for the project, and the anaerobic bacteria were procured from Antarctica.

Commuters, however, are far from impressed. Nitin Parmar, secretary of Karjat Railway Passenger Association, said, “In most trains with bio-toilets, the stench is unbearable — not only near the toilet but also within the coaches. This is not a one-off thing. I have been observing this often. Biotoilets have been fitted in random coaches, and they all have this foul smell. Passengers sitting near the door have to keep their noses covered all the time. The activist travels between Mumbai and Pune regularly and has done a survey of trains with bio-toilets.

In fact, a maintenance worker to whom Mumbai Mirror spoke, also complained about the unbearable stench. “The technology is good but it is not being maintained the way it should be. There are a lot of processes to maintain but train coaches cannot be practically detained for such a long time as they are always scheduled for runs. If clean toilets are giving out foul smell, there must be something wrong,” he added, on the condition of anonymity.

Another staffer said, “If any foul smell is detected after the removal of waste and cleaning of the toilet, the tank has to be topped up with nearly 15 litres of bacteria. A check is conducted after a week and samples are the n sent for lab testing.”

A former member of the national railway passenger committee, Shailesh Goyal, said, “Bio-toilets are not a practical idea for trains. At many WR stations, the train is back on track within two hours. There is no time to clean the toilets. Also, bio-toilets require hi-end mechanism and a dedicated staff to keep them clean.”

Subhash Gupta, a member of the divisional railway users consultative committee, said he will raise the issue at the official railway forum next week.

While railway officials refused to speak on record, a senior official said, “Not only are all new coaches to be fitted with bio-toilets but the workshops are being instructed to fit in bio-toilets in old trains, taken up for maintenance, as well.” Another staffer said the biggest problem were the commuters themselves. “Many bio-toilets have become choked because passengers dump anything from water bottles to gutkha pouches and polythene in them. The bio-digester bins have turned into garbage bins. We will intensify awareness campaigns to avoid this,” said an official.

Shri Avinash Chander, DG, DRDO, SA to RM and Secretary, DRD is retiring on 28 November 2014 at age of 64 after getting two unconstitutional & unrequired extensions of two-two years.

As a matter of fact and requirement under FR & SR, a retired Government servant cannot be appointed as Head of the Organisation with all administrative and financial powers after his retirement on contract. There is provision of appointing retired Government servant on need basis following with due prescribed procedure under rules keeping in view of transparency and open opportunity for all eligible persons.

DRDO is very prestigious organisation  for Defence related indigenous R&D with budget of Rs. 15283 crore for FY 2014-2015 but what is fate of 90% + projects of DRDO, Government, media and public knows very well.

DRDO is better known as “Delay Research & Derailed Organisation” and you are committed to revamp DRDO. The whole nation especially the scientific community appreciated your steps and measures taken for DRDO in present and planned for future.

Appointment of Hon’ble Manohar Parrikar, an eminent engineer from IIT as Defence Minister by you was very much appreciated by nation, media and scientific community.

That will definitely help overhauling and revamping of DRDO by eradication of corruption from DRDO, maintain accountability and transparency in DRDO.

The integrity and moral fibre are two main attributes of Government servant but unfortunately Shri Avinash Chander could not maintain these two in his tenure from 31st May 2013 to 28 Nov 2014 as DG, DRDO, SA to RM and Secretary, DRD which is very much evident from the various complaints pending against him before PMO and Cabinet Secretariat.

In his tenure, number of court cases increases in many fold,  Sh Chander set example to promoting and recruiting incompetents (Ms Tesy Thomas promotion to Sc H and her husband CMDR S K Patel‘s appointment as Sc G and after few days he was made Director, QRS). This act follows discontentment among the senior scientists of DRDO.

The number of SC/ST and minorities complaints increased.

Not able to manage media instead of two crores budget for Public Interface.

There was not a single mentionable product/technology delivered instead Sh Chander tried to show the old products again like EDK the MoU was already signed by DRDO in 2012, Chander spends crores of rupees for that in US visit for unacceptable technology, no evidence are of reorganizations of said product internationally because there are  numerous advance technologies are available.

Secondly, the Bio digester, DRDO three times earlier dedicated this to nation and interestingly it is not as said by DRDO spin off technology it is mere only gobar gas plant in the name of innovation of DRDO the said microbes are already found in cow dunk.  One senior scientist from DRDO itself already exposes this propaganda of DRDO to CVC

The contractual appointment after retirement has also been challenged by some citizens before Government and media also highlighted the pro & cons of this matter.

Therefore, it is requested to Hon’ble Sir to cancel the post retirement contractual appointment of Shri Avinash Chander, DG, DRDO, SA to RM and Secretary, DRD before 30th November, the date of his retirement and not continue him further in DRDO in interest of nation and scientists of DRDO.

“This kit has a much better field deployable position than other items. We have just signed an agreement with a US company to take the technology to South America. The technology would be presented to the Columbian Defense Ministry and to Panama and across the world,” Crowe said.

It is India which holds the patent on the technology, and Crowe has paid an unspecified amount to commercialise it in the US and would also pay royalty on the EDK kits sold.

“Yes”, she said when asked if Boston bombings could have been prevented if the technology was available in the US at that time.

“I believe that it could have been deployed in Boston and with proper training if the kits were in use…at large events, it would every easy to implement a posture where you can detect explosives,” she said.

US Firm Signs Pact to Acquire DRDO’S Technology for Explosive Detection Kit

A USA based firm Crowe & Company, LLC has entered into a licensing agreement with DRDO to acquire the technology of Explosive Detection Kit developed by the High Energy Material Research Lab (HEMRL), Pune, one of the constituent laboratories of DRDO. An MoU to the effect was signed by Dr. Subhananda Rao, Director HEMRL on behalf of DRDO, and Ms. Faye Crowe, President, Crowe & Company, LLC, USA here today.

HEMRL has developed the kit for quick detection and identification of explosives that can detect and identify explosives based on any combination of nitro esters, nitramines, trinitrotoluene (TNT), dynamite or black powder. The testing requires only 3 to 5 mg of suspected sample and only 3 or 4 drops of reagents. The explosive detection kit comes packed in a box the size of a vanity case and in miniature vials that can be kept in shirt pockets. It contains reagents capable of detecting explosives, even in extremely small, trace quantities.

Crowe & Company had approached FICCI under DRDO-FICCI, ATAC programme to enter into MoU for licensing agreement with DRDO for the said technology. In the past FICCI has also facilitated a similar kind of licensing agreement for explosive detection kit between DRDO an Indian company, named, Vantage Integrated Security Solutions (P) Ltd. The DRDO – FICCI Accelerated Technology Assessment & Commercialisation (ATAC) programme is a unique initiative that aims for commercialisation of cutting edge technologies developed by various labs of DRDO for civilian applications.

Speaking on the occasion Dr. Prahlada, Distinguished Scientist & Chief Controller R&D (Aeronautics & Services Interaction), DRDO, the key architect of DRDO-FICCI ATAC initiative, said “the ATAC programme has achieved a major milestone with the US Company taking DRDO technology for use by US homeland security and for international markets.” Dr Prahlada further said that the present technology can also be helpful to control illegal trafficking of the explosive materials as it can equally detect and identify explosive materials in the pre- and post-blast scenarios.

Mr S. Sundaresh, Distinguished Scientist & Chief Controller R&D (Armaments & Combat Engg.) stated that the technology is very effective and is in use by Indian security forces and would now help the international community also. Speaking on the occasion Dr. Subhananda Rao, Distinguished Scientist & Director HEMRL, Pune informed that through the explosive detection kit, the security forces can instantly identify the explosive that was used for the detonation in the aftermath of a blast. They just have to take a sample of the residues from the scene of the crime and test it against the chemicals given in the kit. The change in colour tells them if the explosive used is RDX, TNT, PETN or any other chemical. Highlighting the features of the technology Mr S. Radhakrishnan, Director, DIITM, DRDO informed that the present technology is being widely used by the bomb detection squads of the Indian Army, paramilitary and police in Jammu and Kashmir, Assam, Maharashtra, Gujarat, Andhra Pradesh and Tamil Nadu. Mr Radhakrishnan further informed that the present licensing agreement with M/s Crowe & Company is a major milestone and it also signifies DRDO solution for a global problem.

Ms Faye Crowe, President of Crowe & Company said that after getting the necessary approvals from the US regulatory institutions they are planning to introduce the explosive detection kit to the US army and US homeland security forces and in other international markets.

On the occasion of the signing of MoU, Mr Nirankar Saxena Director, FICCI said that he was delighted to see DRDO technology entering into the international domain for addressing one of the major concerns related to homeland security.

All these MoU’s are futile exercises only thing that the persons behind these MoU’s gets short term personal gains.

Vision 2020

India became a nuclear state with underground explosion on 18th May 1974, known as Pokhran-I (Smiling Buddha). The economic condition then did not permit this misadventure as the fallout was international sanction.

Sh. Atal Bihari Bajpai, then opposition leader expressed his view in the parliament “A hunter went for hunting the lion in the deep & dense forest on a bullock cart, when the lion appeared and roared the hunter in hurry asked his subordinate to load the gun, the helping hand said sorry sir, in a hurry we forgot to bring the gun but license is with us. The hunter requested the lion please give me some time to bring the loaded gun and then I assure you a decisive fight”

What Sh Bajpai said then was proved during KARGIL WAR 1999, the active defence asked for latest arsenal from DRDO and in return DRDO showed them the license.

DRDO bosses show the licenses instead the loaded gun (Product) and when the user demand they always seek more time. This mockery will continue until a firm accountability is implemented and user active participation in project/ program is made mandatory.

User requirements if not met in time then concerned officers who participated in developmental process should be made accountable.

Until these steps are taken, DRDO will only show the licenses of doing research even if country faces next KARGIL like scenario.

DRDO needs similar determination in development projects/programs like the US & Russia. When Americans developed the mother of bomb GBP-43/B with blast yield 11 Ton in 2003, then in 2007 Russia produced Father of Bomb (ATBIP) with blast yield 44 Ton. And now US produced MOP (Massive Ordinance Penetrator) which penetrate 60 feet thick concrete wall bunker and will reach the target with satellite guidance.

SA to RM is not only to enjoy the personal gym which was constructed and procured at Development enclave under project funds but he is also supposed to accelerate the developmental efforts in frontline technologies having 20 years life.

The constitutional limitation of SA to RM is such that he is not able to take timely decision/action to save the image of DRDO like Sh T Mohan Rao, Director, GTRE’s massage parlour episode; he has overlooked GTRE lab which is running without suitable and committed head since May 11, 2011. Similarly like Dr Arun Kumar, DOP, lots of cases/complaints pending against him with documentary evidences right from Defence Minister, CVC, Women Cell, Court etc but SA to RM does not bother about the image of DRDO.

This type of corrupt team of DRDO are becoming role model for the young scientists and in the process sincere scientists leaving DRDO.

The decision made for extension of service is without any analysis. The incompetency is growing, the deserving are the sufferers, the team lead by aspiring seniors stop working and result no output is poor tax payer of the country is ultimate looser.

The PMO, the Finance Minister is not able to find the hole in their GDP. In last 20 years technology import by DRDO has bypass all the procurement policy. For DRDO Directors “money is flowing”. The government has show leniency and the technology being imported is on its peak. 90% of the sanction budget for DRDO is being spent on 15 years old abandon technology of developed nations.

The experts from DRDO justify the procurement as the supplier agents offers them massage parlour to hefty commissions, good food, spa and stay in a 5 stars for a brief period.

The obsolete technology are imported as custom built item and 5 to 10 times higher cost and paid in Indian currency. The global tenders placed two to three times until the desired supplier decides the percentage of commission with journey to country from where technology is being imported. Further in the name of AMC signed MOU to ensure their periodical personal inputs and this periodical revenue is the sole cause of extension in service.

With this attitude of DRDO top brasses and MoD’s inability to handle the situation can we imagine to ever see the Vision – 2020? It is a big question?

Epitome of DRDO’s Dealing with Explosive

Honorable Sir,

The recent serial bomb blast in Mumbai made a big question about the easy availability of such rare explosive RDX & TNT to terrorist outfit.

Please find enclosed document which shows the casual approach of HEMRL, DRDO, Pune the premier and one of the best explosive production facility of India.

While going through the document evidence and audit objection of auditor of JCDA, I found the loose end of HEMRL, DRDO, which may be one easy source for NaxaliteMaoist and Terrorist outfit to learn how to make explosive and also chance to pilferage the explosive may add to pilferage.

After receiving the document I have personally visited the place in the last June and observe the possibility and find out that the working method of HEMRL to make the explosive.

  1.  HERML having practice to hire outside manpower to produce explosive and the companies involved in this business is related to ex- DRDO senior officials. Dr Hardwar Singh, Ex- Director HEMRL & present director M/s Viswaat Chemicals Pvt Ltd since 2006), the sources said that earlier he was sleeping partner (his son Bunty was inducted in the firm as an employee) when he was active Director, HEMRL.
  2. The same company is involved in all the branches of HEMRL like ACEM, Nasik, where recently you visited on 29th June 2011 and as per press release of DRDO Dr Hardwar Singh was also present there. The company is working since 2000 under Government Owned Company Operated (GOCO) projects with Advance Systems Laboratory (ASL), SF Complex, Jagdalpur.
  3. Mr S A Borkar, Manager, M/s Viswaat Chemicals Pvt Ltd, is only person responsible to hire the manpower and he is doing purely in unprofessional manner by asking HEMRL employees to bring any person of their contact. No police verification is needed. He used to submit a list to police station and after depositing Rs 100/- get a receipt and that receipt is deposited in HEMRL security and they do not wait for police verification, that applied receipt note solve the formality. On the basis of this the casual labour gets the biometric entry card from HEMRL security. No proper entry mechanism is available in HEMRL or any other places.
  4. The records are only maintained with Mr SA Borakar’s office which was situated in old building of HEMRL. Why it is not maintained in HEMRL security because the number of persons in daily required or as per order is need never comes in and the payment bill was always placed as per order. This practice is also observed by local auditor and mentioned his audit objection.
  5. 5.    HEMRL having 1200 work force but as per local audit objection  for HYE 09/2009 & 03/2010 para (e)  “ As per clause 10 of tender specification HEMRL had provided expertise to train the contractors personal up to production stage and raw material formulate the production of TATB  (Triaminotrinitrobenzene explosive) to the contractor. In view of the above please intimate that why the production activity was not undertaken by in house HEMRL”
  6. As per para (D) of audit objection “Attendance: As per clause of MOU the contractor has to provide total 173 workmen. On scrutiny of documents it is revealed that no uniform system exists for maintaining the attendance by the Lab in respect of deployed Manpower. As per clause 1.5 of General Terms & Conditions the vendor shall ensure that In and Out records of all personals/workers are maintained at the security gate during the contract period. However the same is not being done.”
  7. As per para B of audit objection” Kindly refer to your letter No HEMRL/MMD/ 3044/SRP 09-10/34 Dt 01-02-10 under which the contractor was asked to submit the License for carrying out explosive and for operation of propellant facility. Please intimate the reasons for asking the requisite license after the commencement of the contract and how the contract was   awarded in absence of the requisite license. Unfortunately, till date the contractor has failed to produce the requisite license as promised in their letter date 01-02-10. The action taken by your Lab may be intimated to audit.”
  8. As per para (d) of audit objection” The documentary proof of raw material being brought inside the HEMRL through security gate by the contractor for the production of TATB  (Triaminotrinitrobenzene explosive) and the nominal roll of the employees deployed entire operation schedule of production activity may be made available to audit for verification”  There is no such records  available in HEMRL.
  9. As per para (d) of audit objection” Please intimate the costing formula adopted for fixing the price of TATB  (Triaminotrinitrobenzene explosive) @ Rs 11,000/- per KG and whether any concurrence have been obtained from Audit authorities.” The contract rates the working methodology is designed and formulated by Dr Hardwar Singh and Dr A Subhanand Rao, DS & CC R&D – DRDO for siphoned the poor tax payer’s money.

Sir, if you just inquire the file you will find n numbers of mechanism to made money like the product is made in house and the firm only providing the manpower but in their bill they are charging 8.24% excise duty and 4 % VAT, a big question because they are working in DRDO. Who can dare to check? The HEMRL not detecting 10% TDS from the firm in the name of providing specialize service.

The entire nation is aggrieved and as loyal citizen it is our responsibility to protect our country and the national interest. In the name of defence establishment even through employees have noticed the modus operandi they are not coming out because of CCS rules.

The Scientific Adviser’s office is become a black hole. Information/ feedbacks are regularly sent by all Labs and establishments but papers are tear off and put in the dustbin.

Yours sincere effort is needed to clean the DRDO.
