Sir,

In the name of Services Interaction, DRDO has service officers from all three wings of the armed forces. The officers are posted on a tenure basis.

It is observed that in DRDO more than 90% services officers are assigned logistic/ administrative jobs like Security Officer, Motor Transport Officer, Estate Manager, Material Management and managing scientists officers mess/canteen requirements, etc.

Some smart services officers who are involved in DRDO’s scientists’ bluff game are able to get permanent absorption in the organization and enjoy services as well as the scientist sticker.

But sincere services officers face a lot of embarrassment from the corrupt scientist herd. They face unprecedented transfers in their short tenure, negative remarks on their service records only because they perform the job assigned honestly. For all these unfair means DRDO takes help of senior services officers who are permanently absorbed and are enjoying all kinds of benefits along with the corrupt scientists.

Since the last 30 years, DRDO has not been able to quote a single services officer who has contributed to any remarkable technical contribution to the nation through DRDO (except the services doctors).

The important part of these absorbed services officers is that they are promoted unduly without contribution to the nation or services. Only thing that they protect are the bluffers.

Only one example to prove the aforementioned is Maj. Gen. Ajay Gupta, present Director, VRDE, DRDO, Ahmednagar. If anyone sees his journey in DRDO, he will know how blessed the Maj. Gen. is because of saving culprit scientist as long as he was serving tenure as Director Vigilance, DRDO, HQ. Of the hundreds of complaints filed, he stopped or delayed multiple cases. This reveals the truth about how corruption flourishes in DRDO with the help of service officers.

Maj. Gen. Ajay Gupta, present Director, VRDE, DRDO, Ahmednagar made mockery of Indian Army reputation on 15^th February 2018.

It is a very serious matter that active Army Maj. Gen, who was earlier served as Director Vigilance & Security. DRDO HQ for long tenure did this misadventure.

As per Sakal Times “When contacted, Maj Gen Gupta said, “I did not conduct any meeting with those foreign nationals. They came to VRDE without any clearance, which is why I went to the gate to turn them back.”

Above statement of Maj Gen Gupta is totally wrong because as per evidences for telling no for meeting he can pass the massage through Security or if he wants to say no personally, how come conveying the same took 30 minutes.

Second one most important evidence not highlight in news clip that is at 10:44:44 hrs, 15^th Feb 2018 Cam – 3 of Dhound gate recorded that some stuff was dumped in foreigner’s white car by VRDE personals, Maj Gen Ajay Gupta was present there in meeting with foreign national.(Evidence – 12)

As per CCTV recording one local vehicle dealer was present in above said meeting as per sources he was only organized the meeting which itself explanatory that Maj Gen Ajay Gupta very much involve personally with vendors/dealer etc.

Therefore, for the clean reputation of Indian Army a serious inquiry is needed, CBI, IB, MI are have their own course but Army Headquarter should deal this matter in high level. Because the Maj Gen Ajay Gupta approached DRDO Hqrs to send a denial to media on this issue fortunately it did not work since Maj Gen Ajay Gupta was enjoying the post of Dir. Vig & Security for a long time and have lot of inputs of wrong doings of high level DRDO official so he will try to bury the incident and influence the enquiry.

As a citizen of India and tax payer I request you to take appropriate action on above said incident and set exemplary precedent for service officers who are serving in DRDO and working against national interest. Hope we will soon be able to see our grate army practice to dealt such serious security/corruption matter which can dent our national interest

Christopher proves that he cannot face any honest DRDO official

Since 2011, Sh Prakash Singh, SAO-I continuously fighting against the corrupt official lobby of DRDO. It is true that in the passage of time our government organizations are turned into black hole for public funds and whenever any official in government of India tries to correct the system are always harassed miserably by top bosses.
DRDO is also like other government organization, having huge corruption records, fortunately DRDO take escape route in the name of secrecy. Now, in the era of digitization of records DRDO not able save the face of its corrupt officials.
Honorable RM Parrikar shahib very well aware of DRDO corruption, since lot of scientists/ officials approached him and explained and denude the true picture of DRDO.
Sh Prakash Singh complained to CVC and CBI prevailing corruption in DRDO in 2011, CVC registered the case but took long time to expedite the case and DRDO encash the extenuation of CVC and terminated him from service. Media took stand and played their duty and then Honorable RM Antony reinstated Sh Praksh Singh.
This reinstation gave a big boost to Sh Prakash Singh in his mission to fight against corrupt officials of DRDO, here Sh Praksh Singh under estimated the powers of corrupt gang of DRDO.
Within two month of span Sh Prakash Singh received two transfer order first LASTEC to SPIC and then SPIC to DL, Jodhpur. Although transfer is not any punishment but the vindictive interest behind the act is more important, his transfer is not in public or organization benefit, it is only for ego satisfactions of corrupt gang of DRDO.
The main aim to send him far from Delhi is to restrain him to meet Honorable RM who understand the motives of corrupt gang of DRDO and passed order to identify them and initiated the action against them.
Sh Prakash Singh transfer is the litmus test of Sh Parrikar Shaihib existence whether he is able to protect victimization of honest and whistle blower or helpless in front of DRDO corrupt gang.
Yesterday Christopher gave open challenge to Sh Parrikar Shaihib by trying throw out Sh Prakash Singh from his office with the help of DRDO bouncers i.e. DSC Jawans & Private EMU contractual security. Prakash Singh obtained pass no 14876 2:30 dated 3rd June 2016 at 2:30 PM vide gate pass no 14876 to meet DOP,CCHR (R&D) and Secretary, DRDO.
Secretary, DRDO Dr S Christopher showed his discourtesy, intractability, rudeness by not to entertained Sh Prakash Singh and not listen his grievances, proved that government of India wasting public funds by assigned the secretary, DRDO post.

Website received inputs from various Labs/Establishments of DRDO and forwarding to you for necessary corrective measurement but unfortunately the bunch sitting in DRDO Hq playing old tactics that make a inquiry committee with yes men team, cooked slowly, a farzi inquiry report, and send MoD with lot of excuses if matter is related to corruption like the procurement was necessary in the strategic application so procedure laps overlooked.

If matter is related to service matter then it was presented like if we will not transfer this guy then country and organization will be in trouble. Actually, always you will found only cause, the ego of boss or fear of expose of corruption and nepotism. The fact is no one bothers for loss of public funds or harassment of family, in DRDO because money is flowing.

Sir, only one case, if you take seriously you will find chain of corrupt officials in DRDO. Like the case of DMSRDE corruption since last three years, MoD only served the show cause notice to 40 officials. Everyone knows the material facts, evidences are clear and sufficient but why they are not able to fix. Only reason is that they very well know that every lab/establishment working on same manner but they are fortunate and till date not exposed. Then how can they tie belt on their colleagues who are unfortunately exposed?

Sir please do something exemplary so DRDO corrupt officials stop following corrupt practices and honest will get their due credentials.

With utter dismay and disgust, I the dishonor of informing you that HUMANITY have been put to SHAME by the INFAMOUS Dr. A K Saxena, Director DMSRDE, who is fighting his last / lost battle of his corrupt practices due to my PIL before the Hon’ble Delhi High Court.

I am a committed INDIAN whose sole motto is to fight corruption, particularly in DRDO. It was because of my efforts that Dr. Arun Kumar (erstwhile Director of Personnel, DRDO); and Dr. A K Taygi (erstwhile Director RTI Cell, DRDO) have been charge sheeted and Dr. AK Mani (erstwhile Director LASTEC,Delhi) took VRS to avoid charge sheet because the fire case of COIL laser project was enough against him. I am sure SIR, that you would have been briefed about the submissions made by Mr. Anil Soni (counsel for MOD) before the Hon’ble Chief Justices of Delhi Court on 29-04-2015 in reference to my PIL (W.P.(C) 3610/2015) that as to why DRDO should not file an FIR against Dr. A K SAXENA with CBI for adopting corrupt practices to LOOT exchequers money for his personal benefit.

On 01-05-2015, an employee of DMSRDE, Mr. Raj Kumar, Technician-A entered the premises of DMSRDE at 1020 Hrs. He punched his attendance card and while signing the late register he collapsed at the gate itself. This INSENSITIVE Director of DMSRDE kept his body at the gate till 1300 hrs. The question is that when last month Dr. A K Saxena took his mother to PGI, Lucknow in DMSRDE ambulance and accompanied her in his staff car, why didn’t he show this basic courtesy to Mr. Raj Kumar. Director of a laboratory is supposed to be the guardian of his officers and staff. As per the laid down SOP he ought to have informed the police immediately and sent the body to a govt. hospital. Dr. A K SAXENA didn’t do either of the two and allowed the body to remain at the gate for three hours. The disgusting thing is that the body wasn’t even covered with a piece of cloth.

Mr. Raj Kumar, Technician-A was basically being harassed by Dr. A K Saxena. Mr. Raj Kumar, Technician-A had made several verbal requests to Dr. A K Saxena for a transfer to a technical group that would have benefitted him in his promotion. The question is that why was Mr. Raj Kumar, Technician-A posted in a group which only does paper work. Dr. A K Saxena is a master of using posting and transfers as TERROR TOOL within the laboratory. Till now he has effected hundreds of transfers in his span as a Director and now he plans to transfer Head of Works for the THIRD Time.

Dr. A K Saxena visited the body of Mr. Raj Kumar after two hours and the important functionary of laboratory, Mr. R K Jain, Head Administration was missing from the laboratory. Incidentally Mr. R K Jain as Chairman of Vendor Registration Committee is INFAMOUS for registering Vegetable Vendors for supply of chemicals and costly equipments to DMSRDE at the direction of Dr. A K Saxena.

Officers and staff of DMSRDE, Kanpur are suffering at the hands of Dr. A K Saxena and today all of them were shattered by his DISGUSTING INHUMANITY. These days he only busy in making his PENSION Papers for a safe exit from DMSRDE. He doesn’t realize that like Dr. Arun Kumar (erstwhile Director of Personnel, DRDO) and Dr. AK Mani (erstwhile Director LASTEC,Delhi), he will also not get clearance from vigilance for their crimes.

It is therefore requested that CORRUPT and INHUMAN Director Dr. A K Saxena be removed with immediate effect and thus stop him from DESTRUCTION of EVIDENCE of his crimes.

Last year assessment list Dr. A K Singh name was added in third list for scientist G-H promotion. Since last more than 10 years he was engaged in only non scientific assignments.

Last year he was blessed by Sh Avinash Chander but now things are changed in DRDO.

As per sources in earlier all his assessment outside expert is always same person.

He has good proximity with Dr R K Jain, because both scratches each other back.

More than 80 % believes in Dr A K Singh capability of manipulation as per them he will get or manage promotion.

The ex SA specially given direction in Dr Gausal Khan case no intervention by DOP but DOP put his pet person Sh Rajiv Ranjan on the case.

if Dr A K Singh successes to get promotion then it means we have to fight with more strength to beat these kinds of corrupt officials.

Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of corrupt practices following by DRDO.

The applicants already filed hundreds of RTI s to DRDO with the aim of expose their corrupt practices earlier up to end of 2011 I have received 50% informations in the basis of those inputs, I have submitted some corruption complaints to CVC and other agencies partly the action were taken but from mid of 2013 I have only received 10% informations but no action taken on corruption exposures. Interestingly since end 2013 DRDO stopped giving any informations against RTI applications, whether it is related to corruption or human right. I tried to my best requested RTI with enclosed corruption evidences but to DRDO refuses to all RTI requests under section 24 (1). DRDO have no respect for constitutional provision of GOI.

The following information is requested with evidences which prima facie supported that Dr Tamilmani and other involved in corrupt practices. This information is requesting through PMO because we have faith on Sh Narendra Modi ji government and if, we will not get any response of this RTI than it is a confirmation that PMO is also in the grip of corrupt officers and Modi ji government has no meaning of RTI Act 2005.

Provide the information that Toyota Innova using by Dr K Tamilmani, DG AERO, Director, ADE and others are procured under Project Rustom II as Remote Video Terminal Vehicle as stated in Dr.Hina Gokhle, DHRD
Provide total Toyota Innova/Scorpios/Safaris in the financial 2012/13, 2013/14 & 2014/15 with nomenclature used, project names by DRDO.
Provide the numbers of Directors/establishment Heads/in-charges of various siblings of DRDO using red beacon on their vehicles.
Provide the total amount dispersed as transport allowance in financial year 2014/15 to Directors/establishment Heads/Program Directors/project Directors /in-charges of various siblings of DRDO

Corrupt officers block PM Modi’s transparency drive

Senior officials say that Prime Minister Narendra Modi has called for a review by the Cabinet Secretariat of the indiscriminate way in which documents have been classified as secret. The intention behind the exercise is “to ensure greater transparency in the functioning of government offices, in order to promote disclosure and probity”. Although as yet the Modi government has succeeded in bringing to justice only a small handful of corrupt officials during the UPA period, the rest of the tainted flock are nervous at a possible intensification of Prime Minister Modi’s quest for transparency and accountability. They are therefore working to ensure that the opaque governance system that is a relic of the British colonial era, continues into the foreseeable future. In particular, they are working to ensure through appropriate notings and interventions that the 2011-13 efforts by the Manmohan Singh government to water down the impact of the Right to Information Act get revived rather than rolled back.

Acting on the overall directions of the Prime Minister, units of the Delhi police have uncovered several “corporate espionage rings” operating within key economic and other ministries. Senior officials in sync with PM Modi’s desire for clean and transparent government say that relevant agencies have since 2011 had knowledge of these networks, but that the corporate spies were allowed to continue unimpeded “because of protection from the highest political quarters”. Interestingly, some of these espionage networks ensured the flow (to selected media channels) of information stolen from ministry files, so as to generate negative (albeit factual) stories about rival groups and hostile individuals, including senior officials as well as ministers. Some of the rings “functioned also as the private detective agencies of friendly officials and politicians, securing for them dirt on their opponents, which could be leaked to friendly journalists or used for purposes of blackmail”.

For the media, accuracy and public interest trump the motivation of sources in revealing information, hence their case for publishing material stolen from government files by corporate espionage networks. Interestingly, police and other agencies have yet to question more than a third of the individuals known (from preliminary investigations) to have guided such spy rings, or who regularly accessed information gathered by them. However, an official said that these individuals have not been excused, but will be questioned later, after the huge volume of information secured during the raids gets processed by the police. Interestingly, an official privy to the documents said that “more than three-fourths of them should not have been classified as secret”. According to him, such documents ought to have been placed on the websites of the concerned ministries, and that to do so would have been in the public interest.

“Keeping information secret, which ought to have been in the public domain, ensures that bribes get paid to reveal such data, and also serves to protect corrupt officials”, a senior official warned, adding that “more than 90% of classified information is such as to serve the public interest better by disclosure rather than by secrecy”. A senior official said that specific measures to increase transparency have been suggested, which include:

(a) the placing of draft bills intended for introduction in Parliament on ministry websites, in order to generate the views of civil society on such prospective legislation;

(b) televising or live streaming of the discussions held by Parliamentary committees on important issues and the placing of minutes of proceedings in the public domain;

(c) placing on relevant official websites all decisions of the Union Cabinet as well as the notes relied upon in the taking of such decisions;

(d) making public the assets of officials, and making them fill out a declaration of assets each year for themselves and their family members, with penalties for non-disclosure. In particular, several officials claim that their offspring win scholarships to expensive international institutions of higher learning. Full details of how costs of stay and study abroad of dependents of decision-makers are being met would assist in accountability, officials unhappy at the non-disclosure of such information say;

(e) making public via ministry websites the file movements both within each ministry as well as between ministries, so as to keep a check on inefficiency or possible collateral motives;

(f) placing information given in public tenders on relevant websites, after technical and financial bids have been opened, so as to keep a check on possible scams based on “fixing” of criteria;

(g) strengthening the ambit of the Right to Information Act and set mandatory punishments for ignoring timelines for the handing over of information, as well as ensure that only those committed to transparency would be considered for the posts of Information Commissioners.

Senior officials say that except for a coterie of corrupt officials and their accessories, others in the government would welcome greater transparency. Owing to the widespread prevalence of graft in India, disclosure of information has much less of a downside than a continuation of the British colonial era fetish of official secrecy, one of the many features of colonial rule embraced in totality by Jawaharlal Nehru and his successors. These officials say that they are hopeful that Prime Minister Modi will succeed in his mission of ensuring transparent government. They would also like the Cabinet Secretariat to initiate workshops and courses on “open government” for officials at all levels, so as to rid them of the cult of secrecy and a mistrust in the good sense of the general public, both of which are holdovers from the British colonial era, but which still remain embedded within the governance system in India. “Prime Minister Modi can rely on the ‘honest majority’ of officials to ensure that he succeeds in his efforts at bringing the governance system in India on par with those in other major democracies, rather than resemble those of authoritarian states,” according to a senior official.

Dear Friends, I have received RTI reply from PMO, South block, New Delhi in respect of my online RTI request in respect of PMO website regarding Interact with Honorable Prime Minister of India. It is observed that when citizen of India submitted some feedback, suggestions to improve system or information regarding misuse of fund & power by authorities, PMO officials are taking these inputs as personal grievances of individuals rather than taking inputs in national interest. The PMO officials forwarding that information directly send to concern organizations without concealing the name of individuals, it may be affect the carrier of individual or authorities can target to harass the individual.

No doubt Modi ji intention is clean the corruption from government but Modi Ji failed to give an exemplary punishment to any officials for his act of corruption and the result was the failure in Delhi election.

Common man only believes in instant results and therefore people and intellectuals are sending n number corruption inputs but no action is reflected in day by day governance of Modi ji.

Another major massage received by these corrupt officers that new NDA government is also manageable by the decision of Dr V K Saraswat appointment in Niti Ayog, He is well known corrupt person in MoD, this on the basis of RTIreply from MoD that vigilance cases are pending against him, IB was not given clearance when he tried for post of PSA in UPA era. UPA honest Defence minister approved CBI inquiry against him, he also ordered special audit by CGDA and plenty of anonymous letter are lying with material facts with NSA/IB/Min of Defence but Modi ji not aware about this, only God knows

Many in the babudom are there simply to stop or at best delay the work for personal gains. Delhi of Congress rule has been resembling Delhi of Mogul era. So full of deceit, intrigue and palace politics with no concern for the people at large.Government is moving in the right direction by shifting the focus of activities to the states. Tomorrow you are going to chair DRDO DMC and it will be great experience for DRDO stalwart. After termination of contractual appoint of Sh Avinash Chander, DRDO top management was really shocked and disturbed, not for national interest but due to shaking of their equations which they build with passage of time.

It was so sudden that they don’t have time to rebuilt equations; as a result day by day all dirt of DRDO coming out and DRDO management is in chaos.

DRDO management wrongly handled the case of Sh D Muthuraja, DRDO only titillated the ego of Dr. Guruprasad and agreed to throw scientist to ACME without work, result is matter with High court, Mumbai and not only countryman but whole laughed on this Silver chariot adventure. Till date no corrective measures are taken by DRDO, because money is flowing in DRDO.
The case of promotion of Sc H and appointment as Director ASL of Ms Tessy Thomas and her husband Cmdr S K Patel’s tailor made appointment and then within few days giving him post of Director is one of suicidal attempts to derail the scientific tempo and created frustrations, result the Dr R K Gupta blow the trumpet.
Dr Gausal Azam Khan, Sc D, (NRI quota) is victim of Dr Shashi Bala’s ego, he approached minority commission, now fighting case in CAT, Delhi and Tis Hazari, forgot all science, offshoot is Dr Mujamdar was transferred 3^rd March 2015 and lot of other conspiracies are knitting around DIPAS which will be surfaced in few days.
Dr A K Saxena, Director, DMSRDE, Kanpur don of lab did all manipulations in procurements, the evidences are sufficient, lay man can certify his acts & deeds but DRDO’s two fact finding committee have dare to make even small dent. In spite he kicked off two scientists from his kingdom with the help of harfunmoula Dr A K Singh, DOP who can go up to any extent because he believes that he is the resident of mother Teresa crescent road with ministers and MP’s.
Tomorrow Dr K Tamilmani, DG (Aero) going to sit in your next being senior most DG. He is one of the big manipulator please find enclose two pay slips where he is drawing Transport allowances and same time using official vehicles which are procured by fooling the government procedure. In the name of project Rustom-II, Remote Video Terminal Vehicles DRDO got concurrence from Ministry of Finance and cheated the whole nation.
Sir, God is given you chance to create history, please fix these corrupt official of DRDO who are daily cheating the nations and wasting the foreign exchange and as well as poor tax payer money. Sir, only few incompetent scientists are spoiling the DRDO, most are in extensions, some you can easily identify as they sitting in non scientific assignment for last 10 to 15 years but same time they got all outstanding promotions without doing science. The big examples of violation of FCS are Dr R K Jain, Director, RAC & Dr A K Singh, DOP rest you can see from the list of approx 7560 scientist

Sir, every day I am receiving lot of evidences of corrupt practices from all DRDO establishments and request you to kindly depute some agency who can analyze the data/ evidences, so we can contribute to Honorable Prime Minister Modi ji’s mission of Swatch Bharat, corruption free India.

Sir,

Please find enclosed Corruption Complaints Status against Dr A K Saxena, Director, DMSRDE, DRDO, Kanpur & other officials working with him (Complaints during period from 29/11/2013 to 15/01/2014).
All complaints sent to CVC with documentary evidences till date no action was taken by DRDO hqrs because Ex Secretary, DRD, SA to RM, DG, DRDO Sh Avinash Chander patronized Dr A K Saxena, Director, DMSRDE.
DRDO hqrs constituted two fact finding committees to investigate the complaints. First fact finding committee under chairmanship of Dr S S Negi, Sc ‘H’ only grope the complaints and smell only the hands of Sh Navin Prakash Gupta, Sc ‘C’ and Sh R P Bhatt, Sc ‘F’. Rest real findings buried under the Sh Avinash chander’s table because that time Dr S S Negi was in the race of IRDE Lab directorship.
Based on his unconstitutional (because the fact finding committee jurisdiction is only find the facts and handover those facts to competent authority not to give any suggestions) suggestions DRDO hqrs transferred both scientists from DMSRDE, Kanpur and gave hurdle free play ground to Dr A K Saxena’s team to collect as much run (Gandhi) from the unrequited, low specifications items/ machineries etc from unqualified vendors. (Dr A K Singh, DOP submitted an affidavit in Allahabad court that on the basis of first fact finding committee’s suggestions DRDO transferred Sh Navin Prakash Gupta, Sc ‘C’ to DRL, Tezpur)
The copy emails are a security threat waning in the concern of defence preparedness as these emails exposes that vendors are know the all future plans of DRDO R&D that what they are planning to develop and what are their aim & objects. But unfortunately our responsible post holders are ignoring such activities of their beloved ones.
Second fact finding committee under chairmanship of Dr D.C. Pande, Sc’H’ , LRDE, Bangalore visited DMSRDE and grilled Dr A K Saxena’s team but delayed the report waited up to result of Distinguished Scientist. Unfortunately Dr D.C. Pande not able to achieved goal, submitted report. In the mean time Sh Avinash Chander hold his position very strongly and showed his lousy power by making Ms Tessy Thomas as Director, ASL and her husband Cmdr S K Patel director QRS with violation of all rules regulation, with this success he kicked the second fact finding report proudly in to dustbin.
It is requested that it is high time top show DRDO’s corrupt scientists that you are paid for science and development not for making fun ride with vendors. ( like Director, GTRE, Mohan Rao who caught by Karnataka police in massage parlor with Israeli company rep) The technology is so powerful that now 250 crores eyes are watching corrupt official’s each and every move.
The following table will show you clear picture of handling corruption complaints related to DRDO. The massage is to all corrupt officials is that nothing will happen to anyone so enjoy life with corrupt practices.

Your early needful action in this matter required. The all honest DRDO officials are waiting the decision so they can feel the difference of new fare governance.

SUBJECT: Request for the sanction of fund from Prime Minister’s relief fund for filing PIL

Honorable Sir,

The foul smell coming out of DRDO in particular the misuse of government funds and misinterpretation of government rules have been sent to successive government since 2001.

So far barring a few dent the fundamental change expected by countryman have not been observed, may the reason known to successive Defence Ministers.

There was growing hope of countries scientific fraternity and as well as common man of India that Honorable Prime Minister Shri Narendra Modi ji will take appropriate action against the corrupt officials of DRDO. When several cases of extensions were put up for approval it was denied. The culprits were furious and looking for safe exit, however, when the contractual appointment of Sh Avinash Chander, DG, DRDO, SA to RM, Secretary, DRD was continued, the message delighted the corrupt officials, operating within the four walls of DRDO.

DRDO can spend government fund for manufacturing Silver Rath of Rs 2.5 Crores without having any approval from competent authority. The existence of Controller Defence Accounts is also not visible. And above all our government is keep mum on this unethical, irresponsible act of DRDO bosses.

Sir, an enclosed PIL is almost ready for submission to honorable court and we seek financial assistance for national interest from Prime Minister’s relief fund as court expenditure for the sake timely action to save premier defence organisation of the country.

The Petitioner is totally devoted to promote transparency and accountability and ensure to contain corruption in post-retirement appointment on contract of Shri Avinash Chander posted on contract as Director General R&D, DRDO, Scientific Advisor to Raksha Mantri and Secretary , Department of Defence R&D for 18 weeks with effect from 01 December 2014 to 31 May 2016.
That under the provisions of Government of India(Allocation of Business) Rules 1961 , Allocation of Business – The business of the Government of India shall be transacted in the Ministries, Departments, Secretariats and Offices specified in the First Schedule to these rules and the distribution of subjects among the departments shall be as specified in the Second Schedule to these Rules.
That Department of Defence Research and Development (Raksha Anusandhan aur Vikas Vibhag) is under Ministry of Defence in First Schedule of AOB Rules 1961 and under the provisions of The Second Schedule (Rule 3) of AOB Rules 1961, the Distribution of Subjects Among The Departments for the Department of Defence Research and Development is annexed as Annexure-A1 to this PIL.
That under the provisions of Rule 2(i) of CCS(CCA) Rules 1965 the Head of Department is defined as “head of the department” for the purpose of exercising the powers as appointing, disciplinary, appellate or reviewing authority, means the authority declared to be the head of the department under the Fundamental and Supplementary Rules or the Civil Service Regulations, as the case may be.
That under the provisions of Rule 2(j) of CCS(CCA) Rules 1965 the Head of Office is defined as “head of the office” for the purpose of exercising the powers as appointing, disciplinary, appellate or reviewing authority, means the authority declared to be the head of the office under the General Financial Rules.
That Defence Research & Development Organisation (DRDO) is an organisation under Department of Defence R&D, Ministry of Defence. Head of Department and Head of Office in DRDO is Secretary , Department of Defence R&D who is also holding posts of Director General Research & Development and Scientific Advisor to Raksha Mantri simultaneously.
That Defence Research & Development Organisation (DRDO) is having vision ” Make India prosperous by establishing world class science and technology base and provide our Defence Services decisive edge by equipping them with internationally competitive systems and solutions ” and Mission ” Design, develop and lead to production state-of-the-art sensors, weapon systems, platforms and allied equipment for our Defence Services , Provide technological solutions to the Services to optimise combat effectiveness and to promote well-being of the troops and Provide technological solutions to the Services to optimise combat effectiveness and to promote well-being of the troops”.
That DRDO is having budget of Rs. 15283 crore for the FY 2014-2015 in Union Budget 2014 and this is fund is controlled by Secretary, Department of Defence R&D, DGR&D and SA to RM.
That DRDO is having 52 establishments and approx. 30000 employees including 7500 Scientists. The Head of DRDO is holding three post simultaneously DGR&D, SA to RM and Secretary, DRD. He is having control over 30000 employees, 52 establishments and Rs. 15283 crore of public money.
That DRDO is having seven technology based domain cluster with seven Director General(DG) and more than 20 Corporate Directorate headed by more than 8 Chief Controller Research & Development(CCR&D) . Most of the DG and CCR&D are on extension in service beyond 60 years. The copy of the Organisation Chart of DRDO is annexed as Annexure- A2 to this PIL.
That statutory Recruitment & Promotion Rules for DRDO Scientists under Defence Research & Development Service (DRDS) cadre of DRDO are called as Defence Research & Development Service Rules 1979 (DRDS Rules 1979). All recruitment and promotions of scientist are made under these Rules. There is no provision of appointment on contract in recruitment methods under DRDS Rules 1979.
That Establishment Officer’s Division (EO Division) , DOPT, Ministry of Personnel, Public Grievances & Pensions, Government of India processes all proposals for senior appointments in the Government of India that require approval of the Appointments Committee of the Cabinet under the Government of India Transactions of Business Rules, 1961. These include Board level appointments in Public Sector Undertakings and appointments to the posts at the level of Joint Secretary. In addition, all appointments by promotion that require ACC approval are processed through the E.O. Division. For this purpose, the Establishment Officer functions as the Secretary to the Appointments Committee of the Cabinet.
That Appointments Committee of the Cabinet(ACC) approves appointments to several top posts under the Government of India. The committee is composed of the Prime Minister of India (who is the Chairman), the Minister of Home Affairs and the Minister in-charge of the concerned Ministry. The Establishment Officer’s Division (EO Division) processes all proposals for senior appointments in the Government of India that require approval of the Appointments Committee of the Cabinet under the Government of India Transactions of Business Rules, 1961. The Appointments Committee of the Cabinet, reconstituted in June 2014. Now Prime Minister and Home Minister to constitute Appointments Committee on Cabinet and will no longer have ‘minister in-charge of the concerned ministry’ as member.
That Shri Ajit Kumar Seth, IAS (DOB: 24 Nov 1951) appointed as Cabinet Secretary, Government of India by Appointment Committee of Cabinet(ACC) for two years with effect from 14.06.2011 to 13.06.2013. His tenure was further extended for one year with effect from 14.06.2013 to 13.06.2014. His tenure was again extended for 06 months with effect from 14.06.2014 to 13.12.2014. His tenure has been again extended for six month beyond 13 Dec 2014 by ACC.
That Shri Bhanu Pratap Sharma, IAS was appointed as Establishment Officer & Additional Secretary, DOPT, Ministry of Personnel, Public Grievances & Pensions by Appointment Committee of Cabinet(ACC) on 23.11.2011 and by order dated 03.11.2014 of ACC , he has been appointed as Special Secretary and Establishment Officer, DOPT.
All the extensions in service beyond age of 60 years are made through DOPT, DPRC, Screening Committee headed by Cabinet Secretary and ACC headed by Hon’ble Prime Minister. ACC is constituted of three members- Hon’ble Prime Minister, Hon’ble Home Minister and Hon’ble Minister of concerned Ministry.
That Shri Avinash Chander (DOB: 06.11.1950) joined DRDO in August 1972. He was appointed as Chief Controller Research & Development (Missiles & Strategic Systems) on 11 May 2011 and that time he was holding rank Distinguished Scientist in 75,500-80,000/- (HAG+ Scale) with effect from 14.06.2006. His date of retirement was 30 November 2010 but Government gave extension in service to him for two years beyond 60 years and up to 62 years from 01 December 2010 to 30 November 2012. Government gave further extension of two years beyond 62 years and up to 64 years age from 01 Dec 2012 to 30 November 2014.
That procedure to Grant of extension/re-employment to Central Government servants beyond the age of superannuation covered by DOPT OM 26012/6/2002-Estt. (A) dated 09 December 2002 , DOPT OM No. 26012/8/2011-Estt. (A) dated 16 May 2011 and DOPT OM No. 22/35/2011-E0 (SM.I1) dated 24 September 2014. Copies of the DOPT OMs dated 09 December 2002 and dated 16 May 2011 is annexed as Annexure-A3 , Annexure-A4 and Annexure A5 to this PIL.
That the for consideration of cases of extensions in service beyond age of 60 years for scientists in DRDO are covered by Office Memorandum of DOPT issued time to time. These OMs are OM No. 26012/15/2010-Estt(A-IV) dated 4th May 2011, OM No. 26012/7/2013/Estt.(A-IV) dated 26th June 2013 and OM No. 26012/7/2013-Estt(A-IV) dated 26th September 2014. All the proposals for extension in service are processed through DPRC constituted by these OMs of DOPT. Copies of OMs dated 4th May 2011, 26th June 2013 and 26th September 2014 are annexed as Annexure-A6 , Anexure-A7 and Annexure-A8 to this PIL.
That the Screening Committee headed by Cabinet Secretary for considering the proposals for extensions beyond 62 years and up to 64 years of age is constituted by DOPT OM No. 26012/15/2010-Estt/A-IV dated 4th May 2011 and DOPT OM No. 26012/12/2013-Estt.(A) 13th June 2013. Copies of DOPT OMs dated 4th May 2011 and 13th June 2013 are annexed as Annexure-A9 and Anexure-A10.
That under the provisions of DOPT OMs at Annexure-A3, Anexure-A4 and Anexure-A5 and FR 56(d) for extension beyond 62 year and up to 64 year age two conditions should be fulfilled-(i) the Scientist should have international stature (ii) such extension should not block promotion opportunities of others in the Department.
That Bio-Data of Shri Avinash Chander, DS & CCR&D (MSS) is annexed as Annexure-A11 to this PIL. Bio-data of Sri Avinash Chander, DS & CCR&D(MSS) shows that he was not having International Stature in field of Science & Technology. Therefore DPRC headed by DGR&D, SA to RM and Secretary, DRD and Screening Committee headed by Cabinet Secretary illegally recommended the name of Shri Avinash Chander for extension from 62 to 64 year age in gross violation of FR 56(d) and DOPT OMs. The ACC approved the extension of Shri Avinash Chander based on recommendations of DPRC and Screening Committee and did not applied their mind to see the rule position and documents on record in file. Besides these DPRC, Screening Committee and ACC violated provisions of the FR 56(d) and second condition as Shri Avinash Chander was Distinguished Scientist from 14.06.2006 and his second extension blocked the promotion opportunity of other senior Scientists having rank of Outstanding Scientists as vacancy of Distinguished Scientist in DRDO is very limited 08-10 during the 2010-2012. Fundamental Rules are statutory rules and extension in violation of Fundamental Rules 56(d) was unconstitutional.
That in any circumstances DRDO Scientists cannot get extension beyond 64 year age under the provisions of FR 56(d) and DOPT OMs on grant of extension in service.
That Appointment Committee of Cabinet(ACC) headed by Prime Minister as Chairman, Home Minister and Defence Minister as members approved the regular appointment and appointment on contract after retirement of Shri Avinash Chander as Secretary, Department of Defence Research & Development-cum-Director General, Defence Research and Development Organisation and Scientific Adviser to Raksha Mantri for a period of three years from the date of assumption of charge or until further orders, whichever is earlier by order 31 May 2013. Copy of the order I2/9/2013-EO (SM.I) , Secretariat of the Appointment Committee of Cabinet, DOPT dated 31 May 2013 is annexed as Annexure-A12 of this PIL.
That according the appointment letter dated 31 May 2013 of Shri Avinash Chander as Secretary DRD -cum- DGR&D and Scientific Advisor to Raksha Mantri , ACC approved that “The appointment of Shri Avinash Chander beyond his date of retirement i.e. 30.11.2014 would be on contract basis with the same terms and conditions as he would be entitled to Secretary (DRD) before the date of retirement”.
That , the list of Scientists of DRDO considered for the post of Secretary (DRD) by ACC in May 2013 is enclosed as Annexure -A13 to this PIL.
That Shri Avinash Chander retired on 30th November 2014. In this connection Press Release was issued by PIB, MOD on 28th November 2014 at 18:48 IST. Copy of Press Release of PIB , MOD dated 28 November 2014 is annexed as Annexure-A14 to this PIL. According to press release of PIB “The appointment of Dr. Avinash Chander beyond his date of retirement i.e. 30.11.2014 for 18 months would be on contract basis, with the same terms and conditions as he would be entitled to Secretary (DRD) before the date of retirement. His contractual term will end on 31 May 2016”.
That DOPT issued two OMs No. AB.14017/34/2008-Estt. (RR) (Pt.) dated 17th June, 2013 and AB.14017/34/2008-Estt. (RR) (Pt.) dated 16th June, 2014 regarding need for contract appointment in the Ministry/Department. These two OMs of DOPT clarified that till date Government has not finalised the policy/rules for appointment on contract in SAG/HAG scale. Copy of OMs dated 17th June, 2013 and 16th June, 2014 is annexed as Annexure-A15 to this PIL.
That in reply to Unstarred Question NO-2871 put by Sri E.M. Sudarsana Natchiappan, MP in Rajya Sabha on 06.09.2012 on Appointment of Secretaries on contract basis, it was informed by Hon’ble Shri V. Narayanasamy, Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office that “there is no policy formulation for appointing the Secretaries in Union Ministries and Departments on contract”. Copy of the reply dated 06.09.2012 is annexed as Annexure-A16 to this PIL.
The Department of Personnel and Training (DoPT), in its reply to Lok Sabha MP Asaduddin Owaisi, has stated that “Government servants are allowed to continue in service after 60 years in rare and exceptional cases.” It is relevant to mention here that the news was published on 28 May 2012 in Hindustan Times stating “Contractual appointment post-retirement not in rules” based on reply given by DOPT, Ministry of Personnel in 15^th Lok Sabha. Copy of the News published in Hindustan Times dated 28 May 2012 is annexed as Annexure-A17.
That several complaints against Shri Avinash Chander are pending before PMO and MOD and according to rules without vigilance clearance any retired Government employee cannot be appointed on contract as Secretary cum DGR&D and Scientific Advisor to Raksha Mantri and Head of the DRDO.
That Shri Navin Prakash Gupta resident of Kanpur filed complaint to Hon’ble Prime Minister, PMO regarding “Cancellation of illegal appointment of Sri Avinash Chander, Director General Research & Development, Scientific Advisor to Raksha Mantri and Secretary, Department of Defence R&D by Appointment Committee of Cabinet , Govt. of India” dated 06 August 2014. Copy of the complaint is annexed as Annexure-A18 to this PIL. The said complainant has been disposed of by Group of Secretaries headed by Cabinet Secretary on 12.11.2014 and it was informed by CPIO, Cabinet Secretariat vide his letter dated 26 November 2014. Copy of the letter dated 26 November 2014 is annexed as Annexure-A19 to this PIL. The complainant has not been informed about outcome/decision of Government on the complaint.
That Shri Navin Prakash Gupta resident of Kanpur filed complaint to Hon’ble Prime Minister, PMO regarding “Doubtful Integrity, Criminal Misconduct, Breach of Trust & Nepotism by Shri Avinash Chander, Secretary, Department of Defence R&D Ministry of Defence, Government of India” dated 13 November 2014. Copy of the complaint dated 13 November 2014 is annexed as Annexure-A20 to this PIL. The complaint is still pending before the PMO.
That the petitioner has filed complaint against Shri Avinash Chander to PMO on the subject “Shri Avinash Chander, SA to RM, DG DRDO, Secretary (DRD) patronizing organized corruption in procurement by Dr. A. K. Saxena, Director, DMSRDE, DRDO, Kanpur” dated 13 September 2014. Copy of the complaint dated 13 September 2014 is annexed as Annexure-A21 to this PIL
That the petitioner has filed complaint against Shri Avinash Chander to PMO on the subject ” Example of Shri Avinash Chander’s feudalism in DRDO” dated 14 September 2014. Copy of the complaint dated 14 September 2014 is annexed as Annexure-A22 to this PIL.
That the petitioner has filed complaint against Shri Avinash Chander to Central Vigilance Commissioner(CVC) on the subject “Recruitment of Shri Saroj Kumar Patel, Scientist ‘G’ and Appointment on post of Director, Directorate of Quality, Reliability &Safety (DQRS), DRDO HQ Complaint against Shri Avinash Chander, DG, DRDO, SA to RM, Secretary, DRD” dated 14 September 2014. Copy of the complaint dated 14 September 2014 is annexed as Annexure-A23 to this PIL.
That petitioner has filed complaint against Shri Avinash Chander to Hon’ble Defence Minister on the subject “Shri Avinash Chander is not interested to take any action on DMSRDE corruption cases” dated 01 November 2014. Copy of the complaint dated 01 November 2014 is annexed as Annexure-A24 to this PIL.
That petitioner has filed complaint against Shri Avinash Chander to PMO on the subject “Request for cancellation Post Retirement Contractual Appointment of Shri Avinash Chander as DG, DRDO to save the premier organization from the clutches of corrupt and incompetents officials” dated 26 November 2014. Copy of the complaint dated 26 November 2014 is annexed as Annexure-A25 to this PIL.
That Government is having view that the extensions in service beyond age of retirement should not be granted to scientists in DRDO as well as other S&T Organisation/Departments. This view of Government has come in media. Specially an article published in issue of 13 October 2014 of India Today. Copy of the article “DRDO has become ageing body with top scientists on extension” is annexed as Annexure-A26 to this PIL.
That despite being so many complaints pending against Shri Avinash Chander, the Government continued his appointment on contract as Secretary, Department of Defence Research & Development-cum-Director General, Defence Research and Development Organisation and Scientific Adviser to Raksha Mantri and he is working on this post on contract with full administrative and financial powers.
That in view of the facts and circumstances stated above, it is expedient in the interest of justice that this Hon’ble Court may be pleased to direct the Respondent no. 1 & 2 to ensure the cancellation of appointment on contract of on contract as Secretary, Department of Defence Research & Development-cum-Director General, Defence Research and Development Organisation and Scientific Adviser to Raksha Mantri and issue order to keep away from post of Secretary, DRD cum DGR&D and SA to RM during the pendency of the present Writ Petition (PIL).
That the Petitioner has no other efficacious alternative remedy except to approach this Hon’ble Court under Article 226 of the Constitution of India.
That the Petitioner is filing the instant (PIL) writ petition inter-alia on the following among other grounds:-
