Great Example of DRDO for Supporting and Giving Scot-free Passage for Senior Corrupt Officials

CVC, MoD registered 9 cases against Dr. Arvind Kumar Saxena, Ex Director, DMSRDE, Kanpur and other scientists as per CVC the complaints has been sent to CVO, MOD for further action, to Director Vigilance, DRDO with reference No. 1323/2014/Vigilance 9, 3617/2014/Vigilance 9, 5022/2014/Vigilance 9, 13248/2014/ Vigilance 9, etc.

Recently a RTI reply recived on 27 June 2019 at 10:53 AM from CVO, MoD revealed that

(1)      As per records available in the file the following complaints were received 
(i)       Complaint(s) dated 26.12.2013, 17.12.2013, 15.01.2014, 24.12.2013 and 07.01.2014. The matter was examined in consultation with CVC and it had been decided with the approval of the competent authority to take the following action:-

           (A) Close the following complaints

           (i)      Regarding irregularities in procurement of laboratory micro  processor based high temperature furnace.

           (ii)     Irregularities in procurement of antivirus for computers and 

           (iii)    Irregularities in procurement of analytical weighing balance.

(B)       Issue recordable warning to 8 serving officers found involved in irregularities in procurement of high temperature reactor system and 18 serving officers found involved in procurement of chemicals. 

(C)       No action against officers who have retired from service. 

(2)       As contents of the replies/correspondence/file of the DRDO contain information relating to other officials/officers including third party information and disclosing the names of the officers dealing with the matter is barred under Section 8 (1) (g) and (j) of RTI Act, 2005. Moreover disclosure of the information would not serve any larger public interest. 

(3)       As regards complaint letters forwarded by CVC to D(Vig) and further forwarded to DRDO for action, in this connection, it is stated that these dates back to 2013 and 2014 and records of forwarding letters to DRDO of these period are not available.

Question is that the recordable warning to 8+18 scientist are nothing they are the puppets of Director and signed all wrong doings of boss for their promotion not for financial gain.

The Saxena the main culprit and conspirator of case have guts to deny the email exchange with vendor to discuss the requirement and finalize the specs before raising the file and made arrangement to split the order as per financial power and so many evidences are available because of evidences only the recordable warning was issued then how come kingpin escaped scot free.

Second is if reactor’s design is copy right of DMSRDE then what is meaning of M/s De Dietrich Process Systems India Pvt. Ltd, Mumbai mail which received by Dr A K Saxena via Mr Anish Gupta from M/s Manglam Traders with attached annexure

DRDO Chief is serious to handle sexual harassment cases

DRDO Chief Dr. Selvin Christopher dealing sexual harassment case in good spirit but the mindsets of senior officials not ready to co-op him for change of existing rotten handling process of DRDO. The getting justice in sexual harassment case is near to impossible in DRDO women scientist and employees.

There are number of example exists where DRDO management failed to deliver justice and always successes to buried the complaints.

The DRDO workforce of more than 30000 and nearly 20% women are working different level top to bottom, even in good positions like DG, Directors etc but harassment complaints are reaching to national women commission, national schedule cast commission etc is the clear evidence the failure of dealing these incidents by existing system of DRDO inspite of having good number of women official.

The reason is also very crystal clear the top existing women officials are not competent and got their position not on the basis of merit. That is the reason like so called famous scientist not able to give justice to victimized SRF.

In this darkness suddenly DRDO Chief Dr. Selvin Christopher sends direction to IRDE and ITM to deal these sexual harassment cases in seriously as per rule.

But unfortunately both the labs not taking it seriously the following enclose letter is showing the mindset of senior official of IRDE, who are openly violating the VISHAKHA guidelines of Honorable Supreme Court.

In following letter is clear example that how accused is trying to hostile the witness with putting through Director and the letter is trying to perusing through divisional head to witness.

The DRDO Hq directed to Director IRDE to take appropriate action against Admin Officer who gave false evidence in support of accused officer but till date Director IRDE not dare to take any action.

In ITM accused is enjoying his post/position after getting charge sheet. Here interesting fact of DRDO working that during the period three director handle the file, Mr M Kishor, Dr R S Pundir, as additional Charge and Sh Sanjay Tandon but no one able to shift the accuse from post of admin officer. As per rule everyone knows that what action is required after issuing such serious charge sheet.

The best part of Director’s order is the inquiry should be done as per DOPT F. No. 11013/2/2014-Estt (A-II1) Dated July 16th, 2015 but they forgot the following the rules or just giving privilege to accused to harass and manage the witness as he is holding all executive powers of ITM.

Suspension

  1. A Government servant may also be placed under suspension before or after issue of a Charge Sheet where his continuance in office will prejudice the investigation, for example if there is an apprehension that he may tamper with witnesses or documents. Suspension may also be resorted to where continuance of the Government servant in office will be against wider public interest such as there is a public scandal and it is necessary to place the Government servant under suspension to demonstrate the policy of the Government to deal strictly with officers involved in such scandals. It may be desirable to resort to suspension in case of misdemeanor involving acts of moral turpitude.

Special provisions to deal with threats or intimidation

  1. Disciplinary Authority may also dispense with inquiry under Rule I 9(ii), and action may be taken without the inquiry when the Disciplinary Authority concludes that it is not reasonably practicable to hold such an inquiry. The circumstances leading to such a conclusion may exist either before the inquiry is commenced or may develop in the course of the inquiry. Such situation would be deemed to have arisen:

(i) where the Government servant, through or together with his associates terrorizes, threatens or intimidates witnesses who are likely to give evidence against him with fear of reprisal in order to prevent them from doing so; or

(I) where the Government servant himself or with or through others threatens, intimidates and terrorizes the Disciplinary Authority, Members of the Committee, the Presenting Officer or members of their family.

It is requested DRDO officials please go through the Vishakha Guidelines were a set of procedural guidelines for use in India in cases of sexual harassment. They were promulgated by the Indian Supreme Court in 1997 and were superseded in 2013 by The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

Following facts regarding corruption and irregularities in construction of “Naturally Ventilated Green House With Multilayered Poly Carbonate Sheet” at DRL, Tezpur by Dr. RKR Singh, Technical Officer ‘C’ AND Dr. Vijay Veer, Director, Defence Research Laboratory, Tezpur is submitting for your investigation and appropriate action.

  1. Defence Research Laboratory (DRL), Tezpur (Assam) is an establishment under Defence Research & Development Organisation (DRDO), Ministry of Defence.
  2. Vijay Veer, Scientist ‘G’ is Director, DRL, Tezpur with effect from 01 March 2012 to till date and he is superannuating on 31 December 2015.
  3. RKR Singh, Technical Officer ‘C’ is posted at DRL, Tezpur since more than 20 years in DRL, Tezpur. He is Head of High Altitude Agriculture Division at DRL, Tezpur.
  4. A project with details submitted below was sanctioned by competent authority at DRDO HQ to DRL, Tezpur.DRL GH cvc table 1

Installation of two Green Houses at DRL, Dett. At Tawang

DRL, Tezpur has two detachments in Arunachal Pradesh. One is at Salari, 190 km from Tezpur and another at Tawang, 380 km away from DRL, Tezpur. DRL Dett., Tawang is situated at 10,000 Ft high from sea level. This area is very less of vegetation due to extreme cold climatic condition. Hence cultivation of vegetables in open environments is not possible.

DRL, Tezpur has installed one Green House at DRL, Dett., Tawang and another Green House in same location is under construction. In this Green House, varieties of vegetable nursery is being raised and are being supplied to those Green Houses installed in different army unit for making vegetables nursery is being raised and are being supplied to those green houses installed in different army unit for making vegetables seeding.

Gross irregularities and violation of Purchase Management 2006 took place in issuing of supply orders for construction and installation of Green Houses at DRL, Tezpur.

One case as case study is submitted herewith in which gross violation of purchase rules took place.DRL GH cvc table 4

(A)   Demand was initiated by Dr. RKR Singh, Technical Officer ‘C’ with following details:DRL GH cvc table 5

(B) Open Tender No. DRL/OT/13-14 was published in Newspapers and DRDO website with following details. DRL GH cvc table 7

(C) Based on the said open tender, supply order was issued with following details.DRL GH cvc table 8

 

(D)  Under Supply Order dated 26.12.2013, Job Completion Certificate was issued from DRL, Tezpur vide letter No. DRL/OT/HAR/11/13-14/S-73 dated with following details:DRL GH cvc table 9

(E)  Unique Power Systems is registered at Andhra Pradesh Commercial Tax Department with TIN – 37720549449 and date of registration 02-06-2014 under VAT and CST commodity MACHINERY, Works Contracts; ELECTRICAL TRANSFORMERS, SWITCH GEARS; MACHINERY SPARES, ALL KINDS OF CABLES; COPPER WIRE.

This vendor has its own website uniquepowersystems.in and Mr. Subbarao Ramisetty is proprietor of this firm. According to the information available on the website “Unique Power Systems” are a leading organization engaged in trading and supplying a variety of Electrical and Electronics Items. We have in store a technically superior range of Transmission Line, Substation, Insulator, Vacuum Circuit Breaker, Generator, Transformer, Speed Breakers, Flexible Cable and MCCB.

6. One Open Tender No. DRL/OT/14-15 was published in 2014 for 05 Green Houses with EMD Rs. 100,000. The demands were made in said open tender and case is under process.

IRREGULATIES AND VIOLATION OF PM 2006 IN CONSTRUCTION & INSTALLATION OF GREEN HOUSES AT DRL, TEZPUR

  • Very junior officer of rank Technical Officer ‘C’ was appointed as Project leader with only one member (STA) in the project which is major project activity of DRL, Tezpur. In past project of Green House more than Five Officer/staff were involved with senior most scientists as Project Head. Keeping only officials in such a big project smacks something wrong at end of Director/CFA.
  • RKR Singh, TO ‘C’ was not authorized to indent case of Rs. 50 L while other several senior scientists were available at DRL, Tezpur. This violates section 4.6.2 and 4.6.3 of PM 2006. Demands costing Rs 50 lakh and above: Initiation by Scientist E and above countersigned by project or group head.
  • The demand was initiated as well as countersigned by Dr. RKR Singh, TO ‘C’ and approved by Dr. Vijay Veer, Director. This violated the various sections of PM 2006.
  • Item cost was inclusive of taxes while as per PM 2006 all taxes should be separately calculated and added in basic cost of the item. Material cost, construction and installation cost should be mentioned separately.
  • In demand unit price was mentioned as Rs. 9,92,331.00 but how the indenter arrived at his cost. How he done cost estimation or he submitted any quotation in record for this cost. The figure of unit cost as mentioned by indenter is unrealistic and fabricated.
  • Board of Officers was not constituted for inspection of constructed Green Houses and handing over to users Amy Units. Issue Voucher should be issued to each Green House separately. Job completion report should be endorsed by Board of Officers.
  • Splitting of cases to keep demand cost with in financial powers of Director as in project of Rs. 4.18 crore small-small cases costing just below Rs. 50 L are initiated. Two open tenders no. DRL/OT/13-14 and DRL/OT/14-15 each costing Rs. 50 L was published within same project by splitting of the cases. One tender should be published to avoid splitting of cases and get better prices and consolidated demand should be raised for whole project as PDC was only 36 months. Hence PM 2006 was grossly violated by Dr. Vijay veer, Director/CFA.
  • As per PM 2006 the Supply Order should be signed for and on behalf of ‘President of India’ in DRDO.MM.16 but this section of PM 2006 was grossly violated by Dr. Vijay Veer, Director/CFA. The supply orders issued by DRL, Tezpur are not in format DRDO.MM.16 and these SO are not signed for and on behalf of India, which is very serious matter as per PM 2006.
  • Cost Estimation not made properly figure of unit price is unrealistic.
  • TEC Report was ignored and parameters effecting installation of Green House like soil testing, wind speed, altitude etc not considered by Director and TPC done without clearance of TEC Report.
  • Gross violation of Purchase Rules, Supply Order not in proper format signed on behalf of Director, DRL, Tezpur, TO ‘C’ is not authorized to indent case up to Rs. 50 L. No sales tax, service tax or VAT charged and prices were inclusive of all taxes. Service tax Registration Number.

7.    The departmental action under CCS(CCA) Rules 1965 and PC Act 1988 may kindly be initiated against Vijay Veer, Director, DRL, Tezpur for said misconduct and misuse of power.

In light of above  facts and evidences it is  requested to CVC to setup a high level inquiry to inspect the procurement process and violation of PM 2006 at DRL, Tezpur by Dr. RKR Singh, TO’C’ and Dr. Vijay Veer , Director in construction and installation of all these Green Houses.

Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of corrupt practices following by DRDO.

The applicants already filed hundreds of RTI s to DRDO with the aim of expose their corrupt practices earlier up to end of 2011 I have received 50% informations in the basis of those inputs, I have submitted some corruption complaints to CVC and other agencies partly the action were taken but from mid of 2013 I have only received 10%  informations but no action taken on corruption exposures. Interestingly since end 2013 DRDO stopped giving any informations against RTI applications, whether it is related to corruption or human right. I tried to my best requested RTI with enclosed corruption evidences but to DRDO refuses to all RTI requests under section 24 (1). DRDO have no respect for constitutional provision of GOI.

The following information is requested with evidences which prima facie supported that Dr Tamilmani and other involved in corrupt practices. This information is requesting through PMO because we have faith on Sh Narendra Modi ji government and if, we will not get any response of this RTI than it is a confirmation that PMO is also in the grip of corrupt officers and Modi ji government has no meaning of RTI Act 2005.

  1. Provide the information that Toyota Innova using by Dr K Tamilmani, DG AERO, Director, ADE and others are procured under Project Rustom II as Remote Video Terminal Vehicle as stated in Dr.Hina Gokhle, DHRD
  2. Provide total Toyota Innova/Scorpios/Safaris in the financial 2012/13, 2013/14 & 2014/15 with nomenclature used, project names by DRDO.
