DRDO Chief is serious to handle sexual harassment cases

DRDO Chief Dr. Selvin Christopher dealing sexual harassment case in good spirit but the mindsets of senior officials not ready to co-op him for change of existing rotten handling process of DRDO. The getting justice in sexual harassment case is near to impossible in DRDO women scientist and employees.

There are number of example exists where DRDO management failed to deliver justice and always successes to buried the complaints.

The DRDO workforce of more than 30000 and nearly 20% women are working different level top to bottom, even in good positions like DG, Directors etc but harassment complaints are reaching to national women commission, national schedule cast commission etc is the clear evidence the failure of dealing these incidents by existing system of DRDO inspite of having good number of women official.

The reason is also very crystal clear the top existing women officials are not competent and got their position not on the basis of merit. That is the reason like so called famous scientist not able to give justice to victimized SRF.

In this darkness suddenly DRDO Chief Dr. Selvin Christopher sends direction to IRDE and ITM to deal these sexual harassment cases in seriously as per rule.

But unfortunately both the labs not taking it seriously the following enclose letter is showing the mindset of senior official of IRDE, who are openly violating the VISHAKHA guidelines of Honorable Supreme Court.

In following letter is clear example that how accused is trying to hostile the witness with putting through Director and the letter is trying to perusing through divisional head to witness.

The DRDO Hq directed to Director IRDE to take appropriate action against Admin Officer who gave false evidence in support of accused officer but till date Director IRDE not dare to take any action.

In ITM accused is enjoying his post/position after getting charge sheet. Here interesting fact of DRDO working that during the period three director handle the file, Mr M Kishor, Dr R S Pundir, as additional Charge and Sh Sanjay Tandon but no one able to shift the accuse from post of admin officer. As per rule everyone knows that what action is required after issuing such serious charge sheet.

The best part of Director’s order is the inquiry should be done as per DOPT F. No. 11013/2/2014-Estt (A-II1) Dated July 16th, 2015 but they forgot the following the rules or just giving privilege to accused to harass and manage the witness as he is holding all executive powers of ITM.

Suspension

  1. A Government servant may also be placed under suspension before or after issue of a Charge Sheet where his continuance in office will prejudice the investigation, for example if there is an apprehension that he may tamper with witnesses or documents. Suspension may also be resorted to where continuance of the Government servant in office will be against wider public interest such as there is a public scandal and it is necessary to place the Government servant under suspension to demonstrate the policy of the Government to deal strictly with officers involved in such scandals. It may be desirable to resort to suspension in case of misdemeanor involving acts of moral turpitude.

Special provisions to deal with threats or intimidation

  1. Disciplinary Authority may also dispense with inquiry under Rule I 9(ii), and action may be taken without the inquiry when the Disciplinary Authority concludes that it is not reasonably practicable to hold such an inquiry. The circumstances leading to such a conclusion may exist either before the inquiry is commenced or may develop in the course of the inquiry. Such situation would be deemed to have arisen:

(i) where the Government servant, through or together with his associates terrorizes, threatens or intimidates witnesses who are likely to give evidence against him with fear of reprisal in order to prevent them from doing so; or

(I) where the Government servant himself or with or through others threatens, intimidates and terrorizes the Disciplinary Authority, Members of the Committee, the Presenting Officer or members of their family.

It is requested DRDO officials please go through the Vishakha Guidelines were a set of procedural guidelines for use in India in cases of sexual harassment. They were promulgated by the Indian Supreme Court in 1997 and were superseded in 2013 by The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

जागरण ब्यूरो, नई दिल्ली : रासायनिक हमले व हथियारों की जांच के लिए खरीदे गए विदेशी उपकरण सेना की फांस बन गए हैं। सारा पेंच उपकरणों की खरीद से पहले और बाद में कराए गए परीक्षणों के नतीजों को लेकर है। कंपनी और सेना मुख्यालय के बीच सौदे की परफार्मेस बैंक गारंटी को मामले के निपटारे तक बढ़ाने पर रजामंदी बन पाई है।

सूत्रों के मुताबिक उपकरणों की खरीद से पहले अंतरराष्ट्रीय प्रयोगशाला में हुए परीक्षणों को स्वीकार कर लिया गया था। हालांकि, बाद में सेना ने रक्षा अनुसंधान और विकास संगठन की प्रयोगशाला (डीआरडीओ) में भी इसकी जांच की। डीआरडीओ के नतीजे ही इस विवाद की जड़ हैं, क्योंकि इसके बाद ही सेना ने उपकरणों को तापमान और आद्र्रता के पैमानों पर निष्प्रभावी करार दिया।

उपकरण निर्माता फिनलैंड की कंपनी इनवायरॉनिक्स डीआरडीओ की प्रयोगशाला में हुए परीक्षण को चुनौती दे रही है। कंपनी अंतरराष्ट्रीय प्रयोगशाला में इसके परीक्षण को लेकर भी हीला-हवाली कर रही है। यह सवाल अहम है कि आखिर किन परीक्षणों के आधार पर उपकरणों की खरीद को हरी झंडी दी गई। साथ ही खरीद से पहले डीआरडीओ प्रयोगशाला में परीक्षण क्यों नहीं किए गए?

इस सवालों पर सेना मुख्यालय की चुप्पी के बीच करोड़ों रुपये की खरीद अब बेकार हो गई है। भारत ने 2009 और 2010 में करोड़ों रुपये की लागत से जहरीले रसायनों का पता लगाने वाले उपकरण खरीदे थे।

Army has purchased instrument ICAD Chempro 100i (Qty: 999 No’s, Make: Environics) against contract nos B/28704/NBC-4C/ICAD/GS/WE-6 Dated 23 Jun 2009 and B/28704/NBC-4C/Option/ICAD/GS/WE-6 dated 26 Mar 2010 for approximately 100 Crore (INR). This instrument detects the chemical warfare agents and is of utmost importance for the defence services. Having cleared the payment after the delivery, it was found that all these instruments failed to perform as per the specification and have technical problems. It is evident from the letter enclosed that performance related issues were raised in Nov 2012 and since then no action has been taken. Few officials are trying to cover up the issue by changing the specification instead of taking 100 Crore back.

As per the information gathered from the sources, these instruments were first purchased by   M P Kaushik from DRDE Gwalior (A DRDO Laboratory and Nodal Agency in Chemical Warfare). Satisfactory working certificate were given to the company and payment was cleared. Later Army gave the contract. It seems that with the help of M P Kaushik few official of army has executed this act.

डीआरडीओ के श्री अविनाश चन्दर, वैज्ञानिक सलाहकार द्वारा अयोग्य, अक्षम व्यक्तियों की संस्तुति करना लगातार जारी है।  डी आर डी ई, ग्वालियर के निदेशक महोदय प्रोफ डा एम पी कौशिक जोकि इस 31 अक्टूबर 2014 को रिटायर हो रहे हैं वह अभी दिल्ली में श्री अविनाश चन्दर के चरण वंदना में लगे है कि किसी भी तरह उनको सेवा विस्तार दिला दे या फिर कोई चेयर, फेलोशिप, कॉन्ट्रैक्ट या कुछ भी दिला दो।

इस यंत्र की बड़ी इतनी संख्या में बड़ी हुई कीमतों में खरीददारी से किसको फायदा मिला और कहां कहां तक बटा यह तो सिर्फ डा एम पी कौशिक ही बता सकते है।

ऐसे लोगो की सेवा विस्तार के लिए संतुस्ती आना ही एक गंभीर बात है।  इस से संस्तुति करने वालो की मंशा व् नियत पर भी सवाल उठता है।

आपकी निरक्षण व् कार्यवाही के लिए कुछ तथ्य सलग्न है।

DRDO takes finance ministry for a ride again

HYDERABAD: Sixteen months after it was pulled up for sanctioning projects without the approval of the government, Hyderabad-based Defence Research and Development Organisation (DRDO) has done it again.

This time, the premier defence research establishment has amended the payscales of its employees on its own in violation of the rules and without the approval of the Union finance ministry.

Documents in possession of TOI show that DRDO amended or upgraded the grade pay of technical officer ‘A’ from Rs 4,600 to Rs 4,800. The violation that happened in 2006 came to the knowledge of the union finance ministry in April 2012, through a query raised under the Right to Information Act. A furious finance ministry then held that the order was irregular and sought an explanation from DRDO. The defence organization was also directed to withdraw the higher payscale already granted to its technical officers.

What followed was hilarious. In response to the reprimand from the Centre, DRDO reportedly sought retrospective permission for amending the grade payscales. At this, an even more furious finance ministry turned down the request in a strongly-worded letter saying that the “arrangement was irregular, contrary to the accepted recommendations of the 6th Central Pay Commission (CPC) and in violation of Allocation and Transaction of Business Rules since it had been undertaken suo motu without reference, much less concurrence.”

The finance ministry also rubbished the claims of DRDO that this was done to maintain ‘relative hierarchy of senior technical assistants (STA ‘C’) vis-a-vis technical officers ‘A’. DRDO was reminded that 6th CPC’s recommendations were aimed at de-layering the government and that ensuring the same ‘relative hierarchies’ as existed before the CPC awards defied the very purpose of rationalization/standardization of pay scales attempted by successive Pay Commissions. At the end, DRDO was once again asked to withdraw the orders.

And now, DRDO in an attempt to cover up its administrative blunder has distressed its more than 1,100 such technical officers across its 52 laboratories of which almost 124 promotees have already retired. In December 2013, DRDO not only downgraded these officers of DRDO research and technical cadre, but also asked these officials to appear for special review and assessment and interview schedule in addition to the recovery of money so paid to them.

Meanwhile, the aggrieved officials maintain that it took them five years residential period and rigorous assessment tests to earn technical officers promotions from Rs 4,600 to Rs 4, 800 grade. The DRTC Officers Association has reportedly urged defence minister AK Antony to bring the erring officers to book. These officials have been asked to return money to the tune of Rs 1000 to Rs 5,000 earned monthly all these years as a result of this increased grade pay.

This is the second instance where DRDO has been found indulging in arbitrary functioning. About 16 months ago, a clandestine audit conducted by the Comptroller General of Defence Audit (CGDA) on the instructions of defence minister Antony, found major anomalies in DRDO’s arbitrary functioning. The defence organization was found guilty of sanctioning projects without government approval, etc.

When asked about the developments, DRDO director general Avinash Chander said “while following the orders, the defence organization is trying to find a solution to the problem and issues raised by the technical officers’ issue.” Dr G Malakondaiah, chief controller R&D (HR) at DRDO, while refusing to comment upon the orders in the past, said attempts are on to find a way out of the situation stemming out of the technical officers’ payscale issue.

PMO, NSA shielding CAG-indicted NTRO – The Pioneer

While the Prime Minister’s Office and the National Security Advisor are trying to hush up the wrongdoings by powerful technical intelligence agency, NTRO, by not tabling the CAG report in Parliament, the CAG response to an RTI query confirms blatant violations in purchase and recruitments in the sensitive organisation.

The CAG submitted its report to the President in mid-February 2011. As per tradition, this should have been tabled in Parliament in the next session. But the Government has not mustered the courage to table it even after more than a year.

The Government may attract breach of privilege notices from parliamentarians as it is going to submit the report to the Supreme Court on March 19. All the CAG reports are first placed in Parliament, which makes it public.

This will be the first time the Government will bypass Parliament and submit a CAG report to the Supreme Court. The SC had ordered for production of the controversial CAG report in a sealed cover on a petition filed by former joint secretary of National Technical Research Organisation VK Mittal.

“We have noticed lack of transparency and non-compliance of rules and procedures in procurement of systems/stores/equipment and deficient procurement management resulting in cases of excess payment/wasteful expenditure/loss to exchequer,” said the CAG’s office in the RTI reply sought by whistleblower VK Mittal.

“We have noticed cases of appointment of ineligible candidates and lack of transparency in recruitment of regular employees also in NTRO…. We have noticed lack of transparency in appointment of contractual employees… We have noticed instances of misuse of official position,” added CAG’s office.

CAG decision to audit on NTRO affairs in December 2009 was vehemently objected by then National Security Advisor MK Naryanan and later overruled by Prime Minister Manmohan Singh. NTRO, which was formed after the Kargil war, works under NSA who reports to the Prime Minister.

The CAG submitted its performance audit on the NTRO, the first such audit report on an intelligence organisation in mid-February 2011. The report, according to sources, exposed the style of functioning and rampant corruption in secret service organisation, nepotism and siphoning money in the name of national security. The findings of the CAG were pointing directly towards the “arbitrary decisions” of then NSA and higher officials in the PMO, said sources.

Among the major findings, the blatant violation of UAV (Unmanned Aerial Vehicle) purchases by manipulating the decisions of Cabinet Committee on Security (CCS). The CAG report, a copy of which is also with National Security Advisor Shiv Shankar Menon over the past one year, has indicted former NTRO Chairman KVSS Prasad Rao and its Advisor MS Vijayaraghavan for misdeeds in several purchases.

The CAG’s Special Audit on Performance and Finance of NTRO has revealed that the agency, in a bid to favour the Israeli vendors, never informed the CCS on adding extra cost of Rs 150 crore. The CCS sanctioned Rs 300 crore for purchase and NTRO manipulated the accounting procedures and hiked the purchase amount to Rs 450 crore.

More over CAG found that the entire such purchase to favour the Israeli vendor lead to inferior quality and the entire UAVs are still non-operational.

The CAG in its report on the functioning of NTRO found that as many as 143 posts in the sensitive organisation were filled not according the procedures and observed severe nepotism in such postings. The CAG decided to audit when Mittal, who quit from the organisation and complained on illegalities.

After Government hushed up the CAG report by not tabling before Parliament, he approached Supreme Court through noted lawyer Prashant Bhushan. In a recent hearing, Justices HL Dattu and CK Prasad directed Solicitor General Rohinton Nariman to submit the controversial CAG report on March 19 in a sealed cover. Several legal experts point out that non-tabling of CAG report before Parliament and presenting it in a sealed cover before court may invite breach of privilege by Parliamentarians.
