prevailing in government, public sector etc and these organizations using
public funds to protect themselves for exposing from citizen (Chowkidar) of
India. Then what is the mechanism do you have to protect these volunteer citizens
(Chowkidars) of India.
I
want to give you an example that since 20 years continue fighting with these
corrupt gangs of government servants who for their little greed compromise with
national security, and facing lot of time bogus FIRs and other short of
pressures and to save my life I have spend lot of money in traveling, hiring lawyers
etc.
Currently
you may aware that an Rs 7900 Cr IACCS Project of Air Force which is
implementing by BEL is exposed due to irregularities in awarding tenders and so
many different allegations by media with authentic documentary evidence. First

CVO investigated the ongoing 10 underground command centers IACCS Project of
Air Force and found lot of irregularities but entire top BEL management trying
to buried the issue and unforeseen reasons the recommendations (29th
March 2019) of BEL, CVO not processed till date. It seems that corrupt involved
top BEL officers trying to manage Ministry of Defence Production, because the
available documentary evidences are more than enough to prove the prevailing
corrupt practices of BEL officials.

Yatish Yadav Jul 11, 2019 12:31:00 IST First Post New Delhi: After Firstpost expose on glaring irregularities in the civil construction of Indian Air Force’s (IAF) highly sensitive Integrated Air Command and Control System (IACCS) project, a former manager of a defence public sector undertaking and a whistleblower has surfaced alleging corruption in the procurement of software for automated command and control system for air defence operations.
Bharat Electronics Limited (BEL), a defence public sector undertaking is implementing the Rs 7, 900 crore project, which was initiated during the UPA regime.
The former manager of BEL, Bhupesh Sharma in a letter to the Ministry of Defence and the Central Vigilance Commission (CVC) on 29 June 2019 has said that top management of the defence public sector undertaking, quietly buried the findings of a 2016 internal inquiry, which indicted six BEL officers for alleged corruption. Sharma alleged that despite a reminder from the Chief Vigilance Officer (CVO) of the company to the Chairman and Managing Director (CMD) of BEL in April 2018, no punitive action was taken against the accused officers.

Sharma, then part of the procurement committee, had blown the whistle over alleged manipulation in the procurement of Data Distribution Service (DDS) software to favour an American company. Sharma alleging victimisation said accused officers indicted by vigilance were rewarded by BEL while he was harassed for exposing deep-rooted corruption.
“Even after CVC intervention and reminders by CVO to CMD (Chairman and Managing Director) no action was taken against the erring officers. I was harassed and troubled to the extent that I was forced to resign. Instead of black listing the vendor M/S RTI USA, the order was finally placed on the vendor. The vigilance officer who did the enquiry in this case has also been given punishment posting to a remote unit of BEL. The message given by the top management was clear that anyone who speaks against corruption would be brutally suppressed and those who play along with the persons at the top having vested interests would be rewarded,” Sharma, who claims to have been decorated with innovation award, excellence awards and Raksha Mantri award for IACCS project , wrote to the CVC.
The documents also reveal that efforts were made by BEL officers to conceal the alleged irregularities by removing the files and purchase order. Even the investigators were denied full access to e-mails of concerned purchase department.
A detailed questionnaire sent to the Chief Vigilance Commissioner Sharad Kumar, Ministry of Defence and BEL CMD MV Gowtama remained unanswered.
Unravelling of software scam
Firstpost has reviewed the documents submitted to the Ministry of Defence and the CVC, which clearly shows that the procurement committee had engineered unwarranted specification in the procurement of DDS software to allegedly disqualify one of the two vendors in the race for the contract.
The two companies, M/S RTI, USA and M/S Prismtech, UK represented by M/S Mistral Solutions and M/S RTTS respectively were invited by the BEL for the procurement of DDS software. The vigilance report said procurement team had pre-decided to give the contract to M/S RTI USA and the entire process of real time demonstration to assess feasibility also known as Proof of Concept (PoC) was merely an eyewash.
Although UK Company had quoted value of the project in the range of about Rs 5 to 10 crore, the quote submitted by American company M/S RTI was about Rs 130 crore. However, since, the BEL had decided to grant the project to M/S RTI, USA through its Indian representative M/S Mistral Solutions, BEL officers inserted a particular specification which caught the eye of vigilance team investigating the case.
“Technical expert in his report has stated that there is a lack of clarity in the PoC evaluation process/criteria which leads to ambiguity and conspiracy. Also technical expert has confirmed that there are irregularities and inconsistencies in framing of specifications and conducting PoC. Scope of PoC for the DDS document does not specify any particular method of demonstrating the PoC and it generally highlights the features to be shown in the PoC. Hence the vendor can select any particular method and demonstrate the features. PoC evaluation criteria and the PoC test document is not uniform for all the vendors,” the vigilance report to the CVC said.
System Requirements Specification document signed with the customer by BEL indicates that there are no special specification requirements for the use and configuration of DDS and also the security of the data transferred using DDS. PoC scope does not highlight that the above security implementations should match and confirm to DDS OMG standards. Even though no vendor has a complete implementation of DDS X types still M/S RTI was shown complied during technical bidding regarding para 6.2 of technical specification,” the report further said.
The vigilance report made it clear that specifications mentioned above as ‘para 6.2 technical specs’ were allegedly modified by the procurement committee of BEL to suit American firm. Sharma claims he had opposed such manipulation and turned whistleblower by exposing the wrongdoings in his emails to vigilance and top officials of the BEL.
“I became the whistleblower when ordering of software for the IACCS project was forcibly being ordered on the resultant single tender basis (by manipulating and making the other vendor technically non-complied). I tried my best to stop the ordering by talking to all my seniors in the unit and finally when I was not heard, I wrote to CVO and all the directors of the company including CMD about the corrupt practices being followed in the unit,” Sharma wrote to the CVC.
It is also evident from the vigilance report that the UK firm was deliberately denied security clearance for demonstration though its India representative M/S RTTS was allowed and subsequently disqualified.
“The team (BEL) misinformed M/S Prismtech regarding non-availability of security clearance on 11 May 2016, though a security clearance was taken by Senior Manager DGM (Development & Engineering division of Network Centric System 1) for the period of 9 May-11 May 2016. The contradicting statements of senior executives and D&E engineers in relation to security clearance for M/S Prismtech representative’s leads to suspect that D&E does not want to give the opportunity to M/S Prismtech to demonstrate the features,” the vigilance report said.
Questions have also been raised by the vigilance team over the formation of a technical committee and PoC committee for the procurement. The report observed although the procurement involves a lot of technical parameters related to software and high value of approximately Rs 130 crore, the procurement committee was made with two mechanical engineers, one finance and two electronic engineers. The report slammed BEL further asserting that there were no software professionals in the technical specification team and approval of a procurement team with non-technical members reveals a lax approach of the management as they played a dubious role.
“It appears that D&E engineers (Development & Engineering division) have played a pivotal role in finalizing specifications whereas others merely acted as spectators,” the vigilance report said.
The report has also raised doubt on the assessment process of technical specifications saying that evaluation of features is not the same for both M/S Prismtech and M/S RTI.
It said the PoC which were done by engineers from M/S Mistral Solutions, representative of RTI, USA, did not have relevant past experience to carry out PoC of DDS software and they could not answer anything technically or relevantly. The vigilance team during an interrogation of engineers from Development & Engineering division found that some engineers who were nominated as PoC members were not aware that they were part of an evaluation team.
Some were absent during the assessment, some engineers had relegated the job to their junior executives and no detailed review was done during the conduct of PoC and no senior executives have monitored the progress of PoC though it was such an important activity for the project. The test report of the American firm was also prepared in advance.
“From the test data report of M/S Mistral (representative of M/S RTI USA, it emerges that test data report was pre-prepared by suppliers and merely signed by BEL engineers. During examination of D&E engineers, it is observed that D&E-NCS has started working on evaluation versions of M/S RTI, USA since October 2015 through license agreements. During evaluation many issues came time to time and were resolved. This was probably the reason that PoC with M/S RTI, USA was merely a formality. The PoC conducted by M/S Mistral Solutions has been cleared despite number of irregularities/ inconsistencies,” the vigilance report said exposing the manipulation to favour a particular vendor.
The documents reveal that before the investigators could examine the documents related to alleged corruption, the files were removed by the concerned officers to erase the audit trail.
The vigilance report said, “Documents with respect to change of specifications which is intimated to M/S RTTS (India representative of M/S Prismtech, UK) was not found in the file, not informed to the investigator at any point and the same was concealed by purchase department. There was no documentary proof regarding the intimation of changed specifications to four cases to all the suppliers participated in the bidding. Currently, the purchase requisitions are also deleted in SAP (System Applications and Products) without assigning reasons and Unit Management has not given any reasons till now for the same.”
The vigilance report which was forwarded to the CVC on 24 November 2016, clearly opined that there are procedural violations in the subject case and there appear to be malafide intentions right from the beginning of coming out of consolidated requirements, generating the specifications for this software instead of PP drawings, arriving of PoC conditions, the manner in which PoC was conducted and M/S RTI, USA bid was accepted and M/S Prismtech bid was eliminated.
The vigilance recommended blacklisting of M/S RTI, USA, initiation of disciplinary action against officers involved and including the name of two senior officers in doubtful integrity list.
In defence procurements, the private companies are known to be hiring retired officials to exercise the influence. In this case too, vigilance raised apprehension about alleged manipulation as a former CMD of BEL was on board of Mistral Solutions. The vigilance had recommended a probe by the Central Bureau of Investigation (CBI), however, the matter was never referred to the premier investigative agency.
“It is learnt that M/S RTI’s malafide intention/ involvement with BEL D&E team cannot be underestimated as ex-CMD (BEL) Mr. Ashwini Kumar Datta is working in M/S Mistral Solutions which requires further investigation by the CBI,” the vigilance report said.
In its recommendation, the vigilance also said the finalisation of specifications and scope of PoC should be done by a competent technical committee and any vested interest/doubtful integrity executives should not be part of the panel.
Cover-up by BEL?
The alleged cover-up in the entire irregularities started after the project came under the scanner. The Rs 130 crore tender was scrapped and suddenly BEL realised that they have in house capability to provide that suspected security specifications that was inserted to allegedly favour a particular company.
However, Sharma said, the BEL management did not take any disciplinary action against accused officers, did not include two senior officers in doubtful integrity list and did not blacklist the American firm. In fact, Sharma alleged, a bogus re-tendering process was initiated on the single-vendor basis and this time the DDS software contract without suspected specification was awarded to same firm Mistral Solutions, India representative of RTI, USA at less than Rs 10 crore. The BEL GM, NCS Joydeep Majumdar in a letter to the CVO confirmed the contract to Mistral Solutions while claiming they have saved more than Rs 110 crore.
“Earlier security features were included in the RFQ for DDS software. M/S Mistral Solutions qualified technically. Mistral quoted Rs. 120 Crores, however, the technical committee after study found out that the security solution was available with CRL Bangalore (Central Research Laboratory) and no need to buy from Mistral. A proof of concept was carried out and it was found working with the proposed DDS. Thus, the committee decided to go for the same DDS from Mistral which was purchased earlier for CMS in NCS, SBU which was without security features and hence was valued very low. Also, since the NCS engineers are conversant with this DDS it will obviate learning the new DDS, if chosen otherwise. A fresh Single Tender Enquiry was floated and the expected order price is less than Rs.10 Crore,” GM Majumdar wrote to the CVO on 9 February 2017.
This new found solution to douse the scandal was clearly an afterthought, reveals the documents sent to defence ministry and the CVC. The vigilance report clearly stated that Request For Proposal (RFP) even before the procurement process began, was finalised in coordination with the CRL. Nowhere, documents mentioned CRL team’s observation that they have in-house capability of security solution and therefore there was no need to purchase it from a private vendor at such a high price.
Even after RFP, the two members of CRL were part of the evaluation process and nowhere during the assessment process, the members acknowledged having in-house capability for the security solution that could save taxpayers money. In fact, further investigation revealed that UK’s company India representative M/S RTTS had held meeting at CRL Bangalore but the issue of having this in house security specification capability was not raised.
“A meeting with the vendor M/S RTTS at CRL Bangalore was conducted and the vendor has informed during discussion that PoC had ambiguous requirements not in line with PoC document, hostile environment during conduct of PoC by some of the PoC team members, required infrastructure which has to be provided by BEL was not provided,” the investigation report said.
Sharma claimed, the BEL officials brought up the issue of CRL having security solution only after procurement came under the vigilance scanner to conceal the alleged irregularities.
Subsequently, the CVC, not pleased with soft action of merely issuing warning letters to accused officers, wrote to BEL CMD MV Gowtama on 5 July 2017 for taking appropriate action.
“The Commission has observed that the tender was scrapped but the violations are serious in nature. The officers concerned have been let off with very lenient action. The Commission has desired that the CMD, Bharat Electronics Limited may review it sou-moto, if provision exists,” Ajay Kanoujia, Director, CVC wrote to Gowtama.
Later on 17 July 2017, Manager Vigilance in a note decided to send a reminder to the CMD observing that action against accused officers were indulgent.
“In the subject case, CVC’s observation were in line with Corporate Vigilance’s observations that a lenient view has been taken by the disciplinary authority without analyzing corporate vigilance letter/report, to close the case with minor penalty actions for the reasons not mentioned in the corporate vigilance report. In this regard, in line with CVC recommendations, it is proposed to send a letter to CMD to initiate appropriate major disciplinary proceeding action on attempts done by delinquent officers,” the note said.
Further, file noting suggests that another reminder for action in the case was sent to the CMD on 9 April 2018. It is also learnt that similar irregularities were unearthed in the procurement of database (DB) and Operating System which were later rectified after an internal probe flagged the wrongdoings.
Similarly, in civil construction, the issue of a single vendor for design consultant and procurement from the related parties have come under the vigilance scanner. Instead of taking action against the accused officers named in the vigilance report, the defence public sector undertaking has suspended members of the investigation team, who exposed the corruption.
“The same modus operandi has been followed with the vigilance team which brought out the corruption in selection of the design consultant and civil infrastructure ordering. The report of the vigilance enquiry has been downplayed and every member who was part of the vigilance enquiry has been charge sheeted, suspended or given punishment postings,” Sharma wrote to the CVC.

As you aware there are several questions raised by honorable members of Parliament regarding corrupt practice complaints against DRDO Directors and senior scientist but unfortunately DRDO “pull the wool over MoD eyes” in the name of constitution Fact Finding Committees for such complaints. The fact is the committees chairman and members are always their yes man/chamchas. The reports generated after consuming months and months and as per designed by DG and his loyal coterie. CVO, MoD only busy with correspondences for several years in each case.
Sir, you just call a sample case from CVO, MoD on your table, will expose the modus operendi of these great manipulator scientists of DRDO. Whether case of R&D E, Ex Director Dr Guruprasad, Ex Director DMSRDE, Dr A K Saxena, Dr A K Tyagi, Scietist ‘G’, Ex C C &D, Dr Selvamurty and so many case are pending in the desk of CVO, MoD waiting for fake reports of FFIC’s and clarifications of show cause notices replies of DRDO.
Corruption and adoption of corrupt practices in routine office activities is inherent property of DMSRDE, Kanpur. Even after dozens of complaints on corruption to CVC and its slow motion action on these complaints, Hon’ble High Court Delhi Order in PIL WP(C) No. 3610/2015 dated 17 Dec 2015 and Show Cause Notices to more than 30 Scientists and officers of DMSRDE, Kanpur and approval of Charge Sheet under Major Penalty to Ex- Director Dr. Arvind Kumar Saxena there is no fear in some daring Scientists of DMSRDE and once again Corruption started in DMSRDE, Kanpur.
The recent case is of Complaint dated 21 October 2016 by Shri K.K. Sharmaagainst Dr. Rajesh Kumar Tiwari, Scientist ‘F’. As usual on receiving of complaint DRDO HQ constituted Fact Finding Committee (FCC) – Chairman Shri R.K. Sharma, Scientist ‘G’ , DPA, DRDO HQ.
The case relates to complaint dated 21 October 2016 sent by Shri K.K. Sharma, DMSRDE, Kanpur to Hon’ble RakshaMantri alleging corruption in procurement of material by using fake addresses of firms by Dr. R.K. Tiwari, Scientist ‘F’, DMSRDE, Kanpur in development of Bullet Proof Jacket (BPJ) GSQR 1318.
A File No. DVS/02/2039/P/22 was initiated in the matter and a revised report in accordance with Note No. 19 dated 09 March 2017 was seek by Director General (NS &M) and letter was sent to Dr. N. Eswara Prasad, Director, DMSRDE on 21.03.2017 from Office of DG(NS&M). He was asked to submit the revised report by 23 June 2017 vide DG(NS&M) letter No. DVS/02/2039/P/22 dated 19 June 2017.
As a matter of fact Dr. Rajesh Kumar Tiwari, Scientist ‘F’ was Head of Composite Material Division and Project Head of Body Armour : Bullet Proof Jacket (BPJ) -GSQR 1318. He was removed from Head, Composite Division and Shri A.S. Parihar , Scientist ‘E’ was made Project Head & Head of Composite Division by Director, DMSRDE under huge pressure of DRDO HQ. It is relevant to mention here that Show Cause notice has been issued to Shri A. S. Parihar , Scientist ‘E’ in Corruption matter of Dr. A.K. Saxena complaints and his promotion was also withheld by DRDO HQ for several months.
Dr. Rajesh Kumar Tiwari, Scientist ‘F’ is still posted at DMSRDE, Kanpur and no action has been taken against him. He is having blessings of Dr. N. Eswara Prasad, Director, DMSRDE and enjoying at DMSRDE, Kanpur. DRDO HQ is trying to wash out the matter by its FCC business ( means submit fake FCC report and protect the corrupt) and adopting delay tactics in this complaint.
Sir, your Government is having policy of “zero tolerance” on corruption then why not any disciplinary action has been initiated since last 09 months of filing the complaint? I kindly request you to take urgent action in the matter and issue orders to immediate transfer/posting of Dr. Rajesh Kumar Tiwari, Scientist ‘F’ out of DMSRDE as he is affecting the inquiry and influencing the case due to his contacts at DMSRDE. It is relevant to mention here that Dr. Rajesh Kumar Tiwari, Scientist ‘F’ is posted at DMSRDE since the year 1990.

It is also observed the manufacturer always quote higher than pet firm, If any manufacturer has to do business with DRDO then should smell or identify these families/relatives or pet firms and routed his business through these firm only.

Sir, It is requested that give the clear cut directions to PCDA (R&D) to rotate JCDA officials because all procurement manipulation only possible with the help of these IDSA officials. In some places they are occupying these creamy posts more than 10 years and enjoying all legal and illegal facilities from DRDO.
Hope you will analyze the following letter and take appropriate measures to stop these families/relatives or pet firms business in DRDO, which directly affecting the progress of DRDO projects because with these families/relatives or pet firms labs accepting lower quality items.

Some of DRDO scientists/officials are so expertise in corruption that they can squeeze money even from the scrap also.
Last year October 2014, SASE, DRDO tried to cleared his scrap material at J&K more than 100 tons.
The Firm M/s Jai Mata Trader, Chandigarh was awarded contract to lift the Iron scrap etc vide order no No MPG/Sale Order/2014-15/8212/01/Dis dated 17th July 2014.
The above order was given to lift 55000 Kgs @ Rs 23.92/Kg but as per SASE store records the vendor only lifted 37020 Kgs due to unavailability of trucks and labuors.
As per sources the six trucks loaded from scrap site out of six trucks, Five (5) trucks were caught and detained by J&K Police in Ramban Police station for the charge of overloading etc, the FIR was registered all formalities were done and case is pending in the court, J&K
M/s Jai Mata Trader, Chandigarh lifted 37020 Kgs and paid only Rs 907122.00 to SASE, DRDO Six trucks loaded (over loaded).
It means each truck lifted 6170 Kg scarp only then how can these trucks were detained by J&K police for overloading charges.

SUBJECT: Corruption in Procurement of Universal Testing Machine (UTM) at DMSRDE,DRDO, Kanpur by Dr. Arvind Kumar Saxena, Director.
Sir,
DRDO corruption is challenge for your new government; continue constructions without utilizing the existing infrastructure and unnecessary procurement of systems/equipments without justification of needs are the common mechanisms of DRDO officials for minting money.
DRDO Directors are above the all constitution provisions like Dr. A.K. Saxena, Director, DMSRDE, DRDO, Kanpur still continue the corrupt practices on last leg of his service, despite several complaints (12 complaints) at CVC and Defence Minister, DG, DRDO etc.
DG, DRDO made two fact finding committees and it seems that those committees were managed by Dr. A.K. Saxena.
CAG make observation about corrupt practices at DMSRDE in its Report No. 24 (2011-2012)
Dr. A.K. Saxena several highly costly equipment and instruments have been purchased and some are under procurement process having no utility in any project and scientific activity in DMSRDE. Method of Repeat Order is being mis-utilised for getting fatty commission from vendors of his choice.
Further regarding these irregularities at DMSRDE, Kanpur, The Comptroller & Accounts General (CAG) in its report No. 24 of 2011-12 (Defence Services) Chapter 6-DRDO Para 6.2 – Procurement/receipt of equipment after the closure or at the fag end of a project mentioned that “Defence Materials and Stores Research & Development Establishment (DMSRDE) procured equipment worth 1.52 crore after technical completion of the project or at the fag end of a project. The project was completed with the facilities available in DMSRDE and other Labs implying that the procurement was avoidable”.
Corruption is criminal offence under Prevention of Corruption Act 1988, Indian Penal Code and CCS (Conducts) Rules 1964. On issues of Corruption the anti-corruption establishments like CVC, CBI, CVO & Ministries should be more serious as Corruption is crime against Government not against any individual. Corruption is the abuse of entrusted power for private gain. It is like rust that weakens the foundation of the Government System. Corruption is a termite to society and present in every system.
The Hon’ble Supreme Court said in its judgment dated 02 January 2013. Quoted here from judgment passed by a bench of justices B S Chauhan and F M Ibrahim Kalifulla in Civil Appeal Nos. 8814-8815 of 2012 the court said “Corruption in a civilised society is a disease like cancer, which if not detected in time, is sure to spread its malignancy among the polity of the country, leading to disastrous consequences,”.
Government is having policy of “Zero Tolerance for Corruption” as stated in DO letter No. 11017/04/2010-AIS-III dated March 3, 2010 which clearly states in para (3) that “The issue of corruption needs to be addressed fairly and squarely. The Government’s policy of zero tolerance for corruption must be implemented fully and effectively. Preventive vigilance should be strengthened. Transparency must be introduced in decision making and in all our systems. Stringent action must be taken against officers found guilty. Disciplinary proceedings must be expedited“.
Corruption is authority plus monopoly minus transparency. Despite my 12 complaints on corruption costing about 7.5 crores , no action has been taken against Dr. Arvind Kumar Saxena, Director, DMSRDE, Kanpur by CVC, CVO MOD and Director, Vigilance & Security (CVO), DRDO HQ and Ministry of Defence.
This attitude of anti-corruption agencies towards Dr. Arvind Kumar Saxena encourages him upto the extent that he again started corrupt practices in procurement at DMSRDE, Kanpur.
It is very relevant to mention here that based on my compliant to CVC on the subject “Complaint to CVC – DMSRDE FUME HOOD Procurement Case” dated 22 Jan 2014 costing Rs 45,76,005.00 the supply order was cancelled by Dr. Arvind Kumar Saxena and till date Fume Hoods were not purchased in DMSRDE as there was no requirement of the said item. Fume Hoods were procured from China and these Fume Hoods are still lying at Airport, New Delhi. Based on my complaint in said case the public money of Rs. 46 Lacs was saved as Dr. Arvind Kumar Saxena , Director, DMSRDE was procuring the said item on 300% high prices and getting about Rs 25 Lac as commission. The Million Dollar Question is that if there was no corruption in procurement of fume Hood then why the said Supply Order was cancelled?
On the same line a case was again indented on orders of Dr. Arvind Kumar Saxena in DMSRDE, Kanpur for procurement of UTM with following details.
UTM purchase details
The same instrument was again procured by Dr. Arvind Kumar Saxena who being Competent Financial Authority (CFA) gave sanction the procurement through Rubber & Adhesive Division in the year 2014 under Repeat Order. The supply order (Repeat Order) was placed to Pal Enterprises in Jan-Feb 2015 for the same item Precision UTM for Ceramic Composite (Tech. Spec. Attached) as stated above .
The following irregularities, violation of the Purchase Management 2006 (Purchase Manual of DRDO (PM 2006), criminal conspiracy and corruption establish in procurement of two UTM in DMSRDE, Kanpur on following grounds.
The item supplied by Pal Enterprises was of INSTRON make which is OEM of the said UTM purchased at DMSRDE. INSTRON (an ITW company) is a Massachusetts based manufacturer of test equipment designed to evaluate the mechanical properties of materials and components, such as Universal Testing Machines (UTM). INSTRON is having its subsidiary in India known as INSTRON INDIA PVT. LTD., 3-C, P.M. TOWER, 37, GREAMS ROAD, Chennai, Tamil Nadu, India.
Tender inquiry under Limited Tendering was not given to INSTRON India despite it was representative/Subsidiary of OEM in India.
M/s Pal Enterprises, New Delhi was registered in DMSRDE on 30 July 2013 in category of Glassware & Hardware under 20 Lac capacities. Case was initiated on 13 August 2013 and this vendor was given tender inquiry on 04 September 2013 for Scientific Instrument costing Rs. 48,37,500.00 despite this vendor not supplied in category of Scientific Instruments and even not supplied any single item in DMSRDE.
R.K. Jain, Scientist E’ was appointed as Chairman, Committee for Registration of Vendors in DMSRDE vide DO No. 10/AD dated 17.01.2013 with gross violation of PM 2006 as Chairman should be of rank Scientist ‘F’ or above.He registered Pal Enterprises on 30 July 2013 in capacity of 20 L under category Glassware and Hardware with registration number DMSRDE 013/02C/42 – 20L.
The case of Precision UTM for Ceramic Composite was indented by Dr. Suresh Kumar, Scientist ‘E’ with demand No. DMSRDE/14ACD013 dated 13 Aug 2013 and demand cost was 45 Lakh .
The case was processed under Limited Tender, although the cost of item was Rs. 45 Lakh and as per Purchase Management 2006 of DRDO, the case should be processed under open tender/Global Tender.
The tender enquiry was send to Pal Enterprises and its dummy firms despite Pal Enterprises were registered in category Glassware and Hardware under capacity of 20Lakh.
In Dec 2013-Jan 2014, for procurement of another case of Tensile Tester (UTM) from FFIT Division, Global Tender was published in News Papers for demand No. DMSRDE/TEX053 with estimated cost Rs. 49 Lac. Copy of advertisement for procurement under Global Tender is enclosed.
It clearly establish conspiracy that to procure the UTM under Limited Tender was corruption and placing the Repeat Order establish splitting of the cases as there was demand of two UTM then these should be purchased in single case but since Director Financial powers is limited upto 50 Lac and total of 02 UTM were about 97 Lac which was beyond the Director Financial Limit so bring the case within Director limit the case was spitted in two parts. One UTM was procured through Limited Tender while other through Repeat Order by pet vendor of Dr. A.K. Saxena, M/s Pal Enterprises, New Delhi.

CLAUSE 7.29(b) REPEAT ORDERS of PM 2006- “The repeat order is not placed to split the requirement to avoid sanction of the next higher CFA” was grossly violated as the purpose to place Repeat Order was to split the demands of two UTMs in two cases.
The Financial Powers of Directors are sanctioned vide letter No. No. DRDO/DBFA/F A/83226/M/OI /2031 /D(R&D) dated 30 July 2010. Accordingly on page 5 of the letter it has been clearly mentioned that extent of financial powers delegated to Lab Director without concurrence of Finance is upto(i) Rs.50 Lakhs in each case Labs/Estts. On Open, Global or Limited Tender basis. (ii) Upto Rs 20 Lakhs in each case concurrence of on PAC basis. (iii) Up to Rs.2 Lakh in each case on Single Tender basis. Copy of the page (5) of the letter dated 3o July 2010 is enclosed.
CENTRAL ANALYTICAL FACILTY DIVISION is exiting in DMSRDE where all costly scientific instruments and equipment are placed in centralised place to be used for the scientists of DMSRDE. Then why two UTMs costing about Rs. 97 Lakhs were purchased at DMSRDE.
This supply order has been issued on behalf of President of India, it clearly means that the Dr. A.K. Saxena, Director, DMSRDE, Kanpur was involved in criminal misconduct and breach of trust against Government.

श्री अविनाश चन्दर जी ने रिटायर कमोडोर सरोज पटेल की सिर्फ नियुक्ति ही नहीं करी बल्कि डीआरडीओ के 507 वरिष्ठ वैज्ञानिक ‘जी’ की वरिष्ठता को दरकिनार करते हुए श्री पटेल को नियुक्ति के चार दिनों में डायरेक्टर के पद में भी बैठा कर वैज्ञानिको का मनोबल गिरा दिया है।
पूरे देश ने कारगिल जंग के समय डीआरडीओ की असफलताओ को देखा था और सबको जनरल मालिक के शब्द याद है ” डीआरडीओ के वजह से सेना वेपन लोकेटर रडार नहीं प्राप्त हो पाया और जिसके कारण सेना को अपने इतने जवान खोने पड़े”

Sir,
Nepotism, favoritism, corruption and manipulations with vested interest in higher recruitment by misusing powers by HOD are very common practices now days in Government system by different means.
Based on the practices stated above, the Recruitment Scam-I occurred in DRDO in which several top Scientists including some ex-DGR&D, ex-CCR&D, ex-Directors and their daughters & relatives were involved. Several complaints were made to CVC & Defence Minister regarding Recruitment Scam-I and consequently CVC advices disciplinary action against Dr. Arun Kumar, Ex-DOP under major penalty vide OM No. 010/DEF/039/184877 dated 23.08.2012.(Copy enclosed-I).
Dr. Arun Kumar was suspended on the last day of his superannuation. Similarly some other Scientist Dr. S M Veerbhadrapa, Ex-Director, DTRL then HRD Charge Sheeted and Smt Chandra bano, Scientist ‘F’, DHRD was dismissed from service just 12 days before retirement. Since top ten officials of DRDO involved in Recruitment Scam-I were retired therefore on advice of Director (Vigilance) & CVO, Min. of Defence , then Defence Minister recommended CBI probe in Recruitment Scam-I of DRDO vide Dte (Vigilance), MOD note no.48-55 ante observations of JS & CVO at note 56 ante in November 2013. The news was published in media. Copy enclosed (II).
Shri Avinash Chander then CCR&D(MSS) also played an important role in Recruitment Scam-I while being member of expert committee under Chairmanship of Prof. SK Salwan, he gave clean chit to his friend Dr. Arun Kumar , ex-DOP vide his report dated 08.06.2011.
This case is regarding illegal recruitment with motivated planned conspiracy of Shri Avinash Chander, DG, DRDO and SA to RM, Dr. A.K. Singh, DOP and Smt. Hina Gokhle, Director, DHRD and Dr. RK Jain, Director, RAC and Dr. DN Reddy, Chairman, RAC.
BRIEF FACTS OF THE COMPLAINT
Shri Avinash Chander, DS was Director, ASL, Hyderabad from August 2005 to May 2011. He was appointed as CCR&D (MSS) in DRDO HQ and was holding position of no. 2 after Dr. V.K. Saraswat, then DGR&D and SA to RM. Shri Avinash Chander took over as DGR&D, DRDO and SA to RM wef 31 May 2013 after superannuation of Dr. V.K. Saraswat.
Smt. Tessy Thomas was working in ASL since its foundation and she was subordinate to Shri Avinash Chander when he was Director, ASL, Hyderabad. Smt Tessy Thomas was promoted to Scientist ‘H’/Outstanding Scientist wef 18 October 2013. She was appointed as Director, ASL, Hyderabad wef 25 July 2014.
As a matter of facts, the competent authority in DRDO for appointment of Directors of Lab/Estt and Directorates at DRDO HQ is Shri Avinash Chander DGR&D, DRDO and SA to RM.
Shri Saroj Kumar Patel, husband of Smt Tessy Thomas, OS (now Director, ASL) was serving in Indian Navy as Commodore and retired from Indian Navy on 31 January 2013. To oblige Smt Tessy Thomas, Shri Avinash Chander, then CCR&D(MSS) misused his position and succeeded in creation of a vacancy of Scientist ‘G’ in DRDO HQ and applications for this vacancy of Scientist ‘G’ were sought vide RAC Advt No. 110/December 2012. The Scientist ‘G’ in DRDO is having pay scale of Rs. 37,400-67,000/- & Grade Pay 10,000/-, which is equivalent to rank of Joint Secretary in Indian Administrative Services. Joint Secretary to the Government of India has pay scale in Pay Band – 4:Rs. 37400- 67000; and Grade Pay Rs. 10000.All promotions and appointments to this Joint Secretary rank and post are directly made by the Appointments Committee of the Cabinet (ACC).
The requirement of said vacancy of Scientist ‘G’ was tailor made for Shri Saroj Kumar Patel as evident from details of Advt. No. 110/December 2012.

This malpractice for recruitment of Shri Saroj Kumar Patel was exposed by some senior Scientist ‘G’ of DRDO by writing complaint to Hon’ble Defence Minister in 2013 and therefore the plan of Shri Avinash Chander failed due to seriously consideration of the matter by Dr. V.K. Saraswat, then DGR&D, DRDO and SA to RM.
Shri Avinash Chander took over as DGR&D, DRDO and SA to RM on 31 May 2013 after superannuation of Dr. V.K. Saraswat. After acquiring full administrative & financial powers in DRDO, Shri Avinash Chander planned the recruitment of Shri Saroj Kumar Patel as Scientist ‘G’ in DRDO and therefore he planned a conspiracy of the illegal & motivated recruitment with help of his subordinates Dr. A.K. Singh, DOP, Smt. Hina Gokhle, Director, DHRD and Dr. DN Reddy, Chairman, RAC and Shri RK Jain, Director, RAC.
Accordingly phase-II of the said conspiracy started by issue of Letter No. DOP/11/110059/QRSM/M/02 dated 14 August 2013 of Directorate of Personnel, DRDO, MOD, New Delhi on the Subject- Appointment of Director, QRS, DRDO HQ, New Delhi. Copy of the letter dated 14 August 2013 along with Proforma for Director, QRS, DRDO HQ, New Delhi is enclosed-IV.
It was clearly mentioned in Para(1) of the letter that “Applications for the post of Director, Quality, Reliability & Safety(QRS) at DRDO HQrs, New Delhi are invited from SC ‘G’ promoted in the year 2013 having sufficient experience in the field of quality, reliability and safety. The Para 1 of letter is arbitrary, discriminatory, unethical and illegal in nature.
No essential qualification, desirable qualification and years of experience were sought and mentioned in said DOP letter for the post of Director, QRS.
Question arises why applications were invited only from the Scientist ‘G’ that were promoted in the year 2013 while in the seniority list of Scientist ‘G’ of DRDO as on 1st November 2013 there were 507 Scientist ‘G’ in total and out of which 114 were promoted in the year 2013 with effect from 01 July 2013? Copy of the seniority list of Scientist ‘G’ is enclosed-V. Why senior Scientist ‘G’ were not eligible for the post of the Director, QRS and under which rule DOP & DHRD decided that only junior most Scientist ‘G’ are eligible for the said post, while in appointments seniority plays an important role and senior most officers always given priority.
Mere reading of the letter dated 14 August 2013 issued from DOP establishes the conspiracy in recruitment. The letter was issued on 14 August 2013 and it was clearly mentioned in para (2) of the letter, reproduced as it is for ready reference “2. The applications should be duly forwarded/recommended by their respective Directors the enclosed profoma (Annexure-I) and must reach this office latest by 21st August 2013”. Hence only 6 days were provided to all Scientist ‘G’ of 52 Lab/Estt situated allover India right from Leh to Kochi and Vizag to Tezpur. The Para-2 is the clear violation of DOPT norms because period should be minimum 15 days.
As a matter of fact 15 August was National holiday, 16th was Friday, 17-18 August (week end holiday), 19-21 August (three working days). Now three questions arises
(i) Why only 04 working days was provided to submit the applications for post of Director, QRS?
(ii) What was the urgency to keep very short time for submitting applications?
(iii) Whether it was possible in any circumstances that ink signed copy of the application duly recommended by respective Director be reach with in two-three days by speed post to New Delhi far from various Lab/Estt. Of DRDO.
Answer to the questions raised in point(14) above is that applications were sought within DRDO simply to make formality and have a record that no Scientist ‘G’ applied for the said post or found eligible for the said post. It is matter of investigation by CVC from records that how many applications were received for post of Director, QRS, whether any list were prepared, whether any interview/interaction were organized, whether any committee scrutinized the proforma of Scientist ‘G’ and whether any Scientist ‘G’ was found suitable for the post of Director, QRS, DRDO Hqrs.
In fact said post were preplanned for Shri Saroj Kumar Patel since the December 2012 therefore any Scientist ‘G’ out of 507 Scientist ‘G’ of DRDO was not selected for the post of Director, QRS, DRDO Hqrs and post remain vacant.
Further to accommodate Shri Saroj Kumar Patel in DRDO an advertisement for post of Scientist ‘G’ were again issued by RAC, DRDO vide Advt. No. 112/October 2013 under direct recruitment scheme of DRDO under direction & guidance of Shri Avinash Chander with vested interest. Copy of the Advt No. 112/October 2013 is enclosed-VI.
Shri Saroj Kumar Patel was recruited as Scientist ‘G’ in DRDO against the 01 vacancy of Scientist ‘G’ vide RAC Advt No. 112/October 2013 and joined DRDO at DRDO HQrs, DRDO Bhawan, New Delhi with effect from 27 March 2014 at seniority no. 486 among Scientist ‘G’ of DRDO.
As a matter of fact Shri Saroj Kumar Patel joined DRDO as Scientist ‘G’ on 27 March 2014(Thursday) and appointed as Director, QRS, DRDO HQrs on 31 March 2014(Monday) so he worked only two days 27-28 March 2014 and jumped to post of Director only in service of 04 days. Shri Avinash Chander appointed Shri Patel as Director; QRS ignoring the 485 senior Scientist ‘G’ already available in DRDO and it establish favoritism & nepotism. It can only happened in DRDO.
Now again four question arises
i. Why Shri Patel was appointed as Director, QRS while he was recruited against vacancy of Scientist ‘G’ not for the post of Director, QRS by ignoring 485 senior Scientist ‘G’ in DRDO?
ii. What is the specialization of Shri Patel which is not available with 507 Scientist ‘G’ of DRDO, can the conspirators able to justify?
iii. Why so much favoritism was given to Shri Patel for his recruitment as Scientist ‘G’ and appointment as Director, QRS since October 2012 to March 2014 by Shri Avinash Chander?
iv. What special benefit DRDO get from Sh Patel’s tailor made appointment?
Keeping in view of the facts mentioned above and the subordination of Smt Tessy Thomas with Shri Avinash Chander right from several years in ASL, Hyderabad, it is crystal clear gross violation of recruitment rules, ethics and procedures took place and the same were not followed in recruitment of Shri Patel as Scientist ‘G’ on 27 March 2014 and further his appointment as Director, QRS on 31 March 2014. This smacks planned conspiracy and criminal misconduct by Shri Avinash Chander, DGR&D, DRDO, Dr. A.K. Singh, Director of Personnel, DRDO Hqrs, Smt Hina Gokhle, Director, DHRD, Dr. RK Jain, Director, RAC and Dr. DN Reddy, Chairman, RAC.
Therefore, it is kindly requested that appointment of Shri Saroj Kumar Patel, Scientist ‘G’ should be cancelled with immediate effect and inquiry be conducted under Prevention of Corruption Act 1988 and CCS (CCA) Rules 1965 against the senior officers of DRDO involved in planned conspiracy of recruitment and appointment of Shri Saroj Kumar Patel as Scientist ‘G’ in DRDO and appointment as Director, QRS, DRDO HQrs.
