DRDO hikes salary, ignores FinMin order

The Defence Research and Development Organisation (DRDO), increased on its own the pay scale of its officials, thus overlooking the objections by the Ministry of Finance (Department of Expenditure) and Audit authorities, who had turned down the request for the increase. In spite of being asked to stop this, the DRDO ignored the Finance Ministry order and continued to pay the hikes salary, thus causing an annual liability of Rs 9.6 crore.

According to a note dated 10 September 2012 and signed by an under secretary of the Department of Expenditure, Ministry of Finance, upgrading the grade pay of Technical Officers (A) from Rs 4,600 to Rs 4,800, was “irregular, contrary to the accepted recommendation of the Central Pay Commission and in violation of the allocation and transaction of business rules and was undertaken suo moto without reference, much less concurrence, of the Ministry of Finance”. An audit conducted by the defence audit branch (DGADS) for 2011-2012 passed strictures against the DRDO authorities for this action. The audit report said that DRDO officials, during the audit, agreed to recover the amount that was paid to its employees.

“The grant of Grade pay Rs 4,800 did not have the approval of the Ministry of Finance. Department of Expenditure had treated it as ‘irregular’ and asked to withdraw it. During discussion, at the insistence of audit, the DRDO authorities agreed to recover the overpaid amount of Rs 24 cr,” remarked DGADS. Some DRDO officers said that scientists who do not have the required expertise have been entrusted with managing the administration of DRDO.

Tatra case: Rishi’s money trail leads CBI to UK

New Delhi: The CBI is looking into the payments made by defence PSU BEML to Tatra Sipox UK for the supply of all terrain trucks and plans to send judicial request to the United Kingdom seeking details of its financial transactions and ownerships.
The agency suspects that payments from BEML were actually going to a tax haven, CBI sources said, adding that they are probing into it but added that the investigations are in preliminary stage.
The sources said at present they are likely to send Letters Rogatory to the UK seeking information on financial transactions of Tatra Sipox UK in which Vectra Chairman Ravinder Rishi has been a Director, owning substantial shares.
The agency will also demand details of Tatra Sipox UK’s association with Czech-republic based Tatra a.s, they said.
Rishi has refuted allegations of any wrong doing and is said to be co-operating with the agency during his questioning sessions during last week, the sources said.
The CBI is now focusing on the role of officials of Defence Ministry, BEML and army and may question them in connection with the case soon, they said.
The sources said it was in 1997 that Tatra Sipox UK signed the truck supply deal with BEML which was in alleged violation of defence procurement rules which say that procurement should be done directly from original equipment manufacturer only.
The CBI has alleged that since Tatra Sipox UK was not the original manufacturer of these all terrain trucks, the rule that defence procurements should be made from original
manufacturer was violated.
Meanwhile, Czech Republic-based Tatra a.s. had said in a statement that it supplies for India various truck components (“CKDs”) that make up approximately 30 to 35 per cent of a complete vehicle.
“The remaining components are made or supplied by other manufacturers or by BEML, an Indian government controlled company that also assembles the Tatra branded vehicles and then sells and delivers them to customers within India under license agreement for Tatra a.s,” it had said in a statement.
It had also stated that neither Ravi Rishi nor his investment company Vectra Limited, control or have controlled — directly or indirectly — Tatra a.s. “The British company Vectra Limited is a minority stakeholder in Tatra holdings and in principle holds one of
the four votes.
“Nonetheless, Tatra will request from Mr Rishi and Vectra Limited an explanation of the information about any initiated investigation of him and Vectra Ltd by Indian Central Bureau of Investigation (CBI) as it relates to sales of products branded with the ‘Tatra’ name,” it had said in a statement.

The reply of my RTI related to SFCian issue was denied by DRDO Hqrs under the shelter of Schedule- II of RTI Act 2005.

As per section 19 of RTI Act 2005 I have appealed to DRDO Hqrs appellate authority and as you very well know that he is deaf & dumb for humanity issues and only act fast on personal issues  in which he has some personal interest. So reply is known but we will take this issue up to supreme authorities.

7. Brief facts of the case: 

The official address of SF Complex is “SF COMPLEX, AIRPORT TERMINAL BUILDING, JAGDALPUR-494001”. SFC Employees are given appointment letters with above address as reporting place. But, all are forced to report at the above address as well as at its work centre located at Girola village, Bakawand block, Bastar district. This location is completely out of 40 Kms away from municipality (Jagdalpur) of the official address.

As per rule they should report at the place of posting as per the appointment letter. But it is not so. Is it (forcing to report at other place) not violation of an employee’s right to report at the posting place? The management says that reporting place is at Girola and same time management says Airport terminal building, Jagdalpur. It is clear cut case of harassment of employees of SF Complex.

One example: one of the scientists, named Shri Kushal Sahoo, was killed in an accident near Bakawand last year while returning from the Girola site to Jagdalpur in Bolero vehicle. Bakawand police station filed FIR and accident report (can refer the same with the police station). When settling the case the DRDO HQs asked the official movement order to consider it as death while performing duty. As the movement order was not issued actually for him and few more travelling in the same vehicle they were also injured, management of SF Complex made a statement of case stating that “Kusahl Sahoo is travelling for the purpose of meeting at Airport Terminal Building, Jagdalpur office”.

If the travelling from Jagdalpur to Girola and back is official and as per the rule and the rule position should be clear for all for management, employees and the general public. After this accident all the staff of SF Complex Jagdalpur took a decision and reported at posting place only. This happened for two days and later management has interfered and threatened to them for report at Girola and told them if they will not report at Girola, will get termination letter.  Employees were forced to report at Girola. It is a violation of Human Right? Reporting at posting place is not correct? Then why appointment letters were given like that?  DRDO has to duty to provide them proper necessary papers as per rule position of Central Government.

The requested information is not come under 8(1) (a) and 24 (1) of the RTI Act at all because the information asked not in the nature of secrecy like The copy of fitness certificates of those vehicles which carries the employees daily to Girola plant site from SF Complex from competent authority. This the major concern of family and friends of employees of SF complex for their safety and well beings. For mere few thousand Rupees from contractors as bribe the Top DRDO officials playing with the life of SF Complex Employees.

The required information is fall under corruption and as well as violation human right and therefore in any means it is not come under schedule –II exemption of RTI Act 2005.

6. Particulars of Decision of CPIO:

7. Brief facts of the case: 
Why did they call it sensitive? I never asked the project details, I only asked for the procurement details and they can’t be sensitive, because they are procured from an open market with tender.
Dr A.S Bains, then Director, DEAL, DRDO, Dehradun, when appointed in DRDO at DRDL, Hyderabad, who did the police verification? The Shah Times News Report (Copy enclosed) says that he might be relation with “Babar Khalsa” terrorist outfit, who was active in Punjab insurgency and had Hqrs in England.
The money minted by Dr. A. S. Bains with few of his close associates by establishing these fake firms might be used for supporting terrorist outfits. At that time Dr. A. S. Bains was the Director, DEAL; orders were placed with these firms for the supply of items in quantity with enormously high prices and siphoned the precious foreign currency.
DRDO Hqrs since the expose of this case has come under pressure and has declared the purchase made, as sensitive. The officers who were Scientist ‘C/D’ during that period, were given out of turn promotions as reward to conceal the facts. Sh. R.P. Dixit, Sc’G’ and holding presently the charge of CFA in DEAL, Sh.S.C Jain Sc’G’  due to retirement has been given two years extension. Dr. K.D.Nayak Sc ‘H’, CC R&D and Sushil Verma, Sc’F’ were involved and were the master designer of these procurement from fake firms and as well as concealing the facts.
Dr. V.K.Atre, then SA to RM has a very close association with Dr.AS Bains, in fact Dr.Atre made him member of Sh. Arun Singh committee on defence expenditure, when I brought the facts of Dr.AS Bains to then NSA, Sh Brijesh Mishra personally. Dr.AS Bains was removed by each and every committee and was confined to DEAL only until he retired.
The appellate authority of DRDO, Dr. Prahlada is committed to protect Dr. A
S Bains and go to any extent to conceal the facts.
Only an independent agency is therefore required to investigate the total no of procurements cases / supplies under place with these fake firms and identify those culprits who still protecting the criminals.
During US sanction the uses of Custom Duty Exemption Certificates by these firms is required to be investigated, because to see the proximity with Dr.AS Bains the CDE’s might be used for benefiting terrorist outfits of Punjab.
i)      Both firms did business only with DEAL, Dehradun and belongs to one person  Lt.Col Deepak Badhwar, Resident of 37/7, Vijay Colony, Dehradun ( IB revealed and IB report is enclosed)
ii)     He is a good friend of Dr. A. S. Bains’s (then Director DEAL, Dehradun) ( News paper revealed copy enclosed)
iii)    Dr. A. S. Bains  (then Director DEAL, Dehradun) is a mysterious personality and might  be link with terrorist  as per news paper report (Paper cutting enclosed)
iv)   As per Tender Procurement Committee the supplied were state of art components/devices and were in the critical list of post US sanctions.   
v)    So question is whether both firms used CDE or not because they cannot import these items from US due to sanction.
vi)   It is the larger possibilities that with bonding with Dr. A. S. Bains the CDE might be used for support to terrorist outfit.
 Dr. A. S. Bains (then Director DEAL, Dehradun) aim was to damage the organization’s financial deals and help his friends, who were parting the hefty commission/omission. Example – a purchase of Digital display Synthesizer (DDFS) which was required for Composite Net Radio (CNR a prestigious project of DEAL), he directed project in-charge to put his friend’s company’s name (M/S Wave Components & Systems, 1409 W, Woodcrest, Fullerton CA 92833, USA) in the quotation enquiry. The best part of that the firm’s rep supplied the item in person (in the shape of scrape which is still lying with CNR project) at DEAL’s gate well before the quotation’s opening date and with item there were no papers enclosed that the items were imported from US. The plea was given by firm’s rep that his luggage was stolen at airport.  It can be verified with DEAL’s gate records. The matter was exposed by me, the file was closed but he had to give money to his friend, so again a new file was raised as per direction in proprietary base case with new nomenclature as DDES instead of DDFS, order were placed to US, LC opened, money was drawn but the item were not send from US. As expected that he had already delivered back at DEAL’s gate. After two years RBI asked for FE settlement, and then DEAL asked the firm to send anything against the said supply. But because of the Pokhran Blast, US sanction was imposed and company was not able to supply, but again they adopted DRDO’s Scientist gimmicked and arranged locally, a bogus airway bill no and with empty box they deposited via their Delhi based firm by courier. They forget that they established a relation between a firm and later on in other quotation they used this firm as their competitive.

ii)             The above firms received crores of rupees order from DEAL. The origin and existence of this firm is also mysterious.
iii)            The firms deals with only DEAL, Dehradun
iv)           The firms have no dealership of any manufactures
v)            The firm does not have a single leaflet/brochure’s/any professional existing document which proves that they are very well in the business later on due course of CBI inquiry they generated few but they found bogus.
vi)           The firm supplied MMIC components/Li batteries, quartze crystal etc. It shows big variation in business field
vii)          The firm always asked for splitting the order because to avoid FERA and other agencies who normally not bother for small transactions.
viii)         The asked for change the nomenclature of the items so it can help to fool, financial member, custom authorities and US commerce department.
ix)           Not a single fruitful output was generated by DEAL by using items supplied by said firm. If one can go for physical verification will find the only scarp, in case of 35 GHz Down Converter the CBI, Dehradun was found that out of 150 nos half were not working, some odd 20+ were pasted without use or any output and some they said were given to Project Trishul (i.e 18 GHz project not 35 GHz) and rest to CERI, Pilani. It is a complete eyewash.
x)            What was the DEAL’s  gain, all scientists who helped in procurement got outstanding reports and got promotions the main example Dr.KD Nayak presently holding post  of CC R&D and Mr. Sushil Kumar Verma presently Sc ‘F’ and recently posted to DRDO Hqrs with Dr KD Nayak, so they can again create a new gimmick.
After Pokhran Blast all pending orders of M/S Wave Components & Systems,  1409 W, Woodcrest, Fullerton  CA 92833, USA  were converted in RE and diverted to garment and rice exporter firms belongs to Dr. Bains landlord Lt Col Deepak Badhwar.

He is a regular visitor to US, and good friend of Dr. A.S.Bains, Director, DEAL, DRDO, Dehradun ( As IB report revealed the facts) and also related with Mr. Moti Kapur of 4804- Astreria, Torrance, CA – 90503, this address they used for another firm M/s S.K. Components for quotations game.
Just to compete the coram for quotation formalities they included two more firms name which do not exist in US.( I have collected sufficient evidences in respect which can be produce to government investigation agencies)

Dr. AS Bains also violated the govt. rules by asking quotation from US based firms during US sanctions for just route the money of poor tax payers of India.  Anyone can imagine the quotations are coming from US and TPC reflecting in the minutes these companies are well known firms in their field based on the DEAL’s procurement records.
Sir, have any finance rep ever asked about the credential of any firms or verify with any other lab or source, I can understand the pressure on other TPC members because they are from DRDO and always worried for their carriers.
Under the forging details there is no room to allow the culprits to go scot free. Anyone asks details from various investigation agencies who have worked in this respect and are perplexed. Please contact Major Chetri, then in-charge, MI, Dehradun, Mr. Bist, then SP, CBI, Dehradun, IB, Dehradun, Director, CAG, Dehradun.
This is a tip of iceberg if you people allow me to work with financial agencies for uprooting the corruption in DRDO; I can produce tons of information and info related to their modus of operandi.
8. Reasons/grounds for this appeal:
   i)
It is clear cut case of corruption and national security interest.
ii) A holistic approach of expose the weak procurement process of DRDO as a façade.
