J&K HC orders FIR against teacher who fails to write essay on cow

SRINAGAR: The J&K High Court made a teacher write an essay on cow and solve a class IV maths problem in an open court and ordered slapping a case against him when he failed, inviting strong observations from the judge who wanted “soulless” authorities to close down education “tuck shops”.

The direction came yesterday when Justice Muzaffar Hussain Attar was hearing a petition challenging appointment of Mohammad Imran Khan as Rehbar-e-Taleem (education guide) teacher in a school in south Kashmir.

The petitioner had alleged that Khan’s certificates — issued by Board of Higher Secondary Education Delhi and Global Open University, Nagaland were not recognised. The marksheet issued to the respondent by the Board of Higher Secondary Education Delhi showed he had secured 74 per cent, 73 per cent and 66 per cent in Urdu, English and Maths respectively.

The court asked a senior counsel to give a simple line for translation from English to Urdu and vice-versa but the teacher failed.

The teacher was then asked to write an essay on ‘cow’ in Urdu, but he failed. Khan sought permission to write the essay outside the court room, which was granted but he failed again.

Khan, who claimed he had better hold on Mathematics, was then asked to solve a maths problem for 4th graders.

As he failed yet again, a visually perturbed Justice Attar said,”In this situation, what would be the fate of the state has to be only visualised. The school going children ….would pass out as blockheads.”

“The authorities, responsible to ensure that the stream of academics and education is not polluted in the state of J&K, however, in view of the facts, which have surfaced in this case, have acted as soulless bodies with ray-less eyes, as they have criminally condoned and over-looked the Himalayan blunders committed in procuring the academic degrees,” the court observed.

Defence deals stuck due to lobbying, Parrikar says

PANAJI: Defence minister Manohar Parrikar on Wednesday said most defence deals are stuck because of lobbying, vested interests, and kickbacks that happened during the last 10 years of Congress rule at the Centre. He said his priority is to clear the controversy and speed up acquisition in a transparent manner.

“My target is to clear all weapons purchase deals one by one on a priority basis, beginning next week,” said the country’s new defence minister, adding that he will also strengthen the army’s fighting capability, logistics, and infrastructure. He further said he will strengthen the armed forces with pre-emptive measures that discourage cross-border firing on the line of control.

He said India need not worry about Pakistan or China or any other country as the country’s defences are strong.
Speaking to party workers on his maiden visit to Goa after being sworn into the Union Cabinet, he said that after being extensively briefed over the last two days, he has realized that India has no need to worry about any other country.

Parrikar, who is on a five day visit to Goa, told media persons that everybody knows what happened in the Agusta Westland VVIP chopper deal and there was a question mark raised on the acquisition of fighter aircraft for the Indian Air Force (IAF). He refused to elaborate on the fighter aircraft deal.

“Most (defence) acquisitions made have some controversy. I don’t want to go into the details, but my job is to clear the controversy,” he said, adding that the more you go in for tightening on corruption, the more you raise the question, and the deals get more complex, and one should adopt a transparent method where no questions are raised.

Asked to react on incursions in Arunachal Pradesh by the Chinese military, Parrikar said this type of incursion and crossing the imaginary line of control happens many times in many sectors, but it is taken care of on the same day or within a couple of days. “Except on one or two occasions, there has been no serious incident.” He added the ministry will take steps to avoid such incidents in the future.

He said he will look at the country being able to produce indigenous weapons based on Prime Minister Narendra Modi’s ‘make in India’ concept. He also said that revamping of the DRDO is on the cards, but “as of now I have not taken any decision. Right now, I want them to perform”. He further said the ministry will concentrate on improving training capacity, and filling up vacancies of officers in the army.

Parrikar was given a rousing welcome at the Dabolim airport by Goa chief minister Laxmikant Parsekar and the state cabinet.

Air Force audit says pact for LCA parts unauthorised

The Aeronautical Development Establishment (ADE), one of the agencies working on light combat aircraft — Tejas had struck an agreement with BAE Systems Overseas Inc for supply of 15 ship sets of integrated flight control systems line replacement units costing US$3,06,00,000, without the approval of competent authority, states the audit of the Office of the Director of Air Force Audit.

BAE Systems Overseas Inc was to have delivered the units by March 2009. “Under the contract, ADE received 14 shipments. The consignment containing the 15th set consisting of actuators (total 15 numbers) valuing US$21,27,215 (Rs 10.63 crore) in one case weighing 206-kg was sent via shipper number 54151 dated December 17, 2008 by British Airways. However, the consignment was not received by ADE,” the report, completed in 2010 reveals.

Bringing this to the notice of Defence Minister A K Antony, Javed Abbas Technical Officer ‘B’, retired, in a letter said there are several other irregularities going on at ADE, a lab under Defence Research and Development Organisation (DRDO), regarding appointments, promotions and transfers.

The audit report, annexed in to the letter, further states: “as per documents provided by BAE Systems, USA, the consignment was received by British Airways and the aircraft left the John F Kennedy International Airport (New York) for Heathrow Airport, London on December 12, 2008 by flight number BA 114.”

While 40 per cent of the value of these products had already been paid to BAE, payment for balance, amounting to 60 per cent of value was effected in October 2009, well after the deadline for delivering of the units was passed, and, the consignment had not reached ADE.

The auditors point out that as per para 7.2 of Purchase Management procedure, 2006, stores costing Rs 2.5 crore might be insured against loss or damage in transit and that insurance cover will invariably be obtained from the insurance agency before dispatching the consignment by the supplier.

“However, the consignment was not insured by DRDO in contravention of the regulation. On reasons for non-insurance, the ADE stated that the clearing agent Air Consolidation Agent — Balmer & Lawrie & Co did not advise the establishment to do so,” the report adds. Observing that the excuse is not tenable, the audit said, onus of deciding on whether the consignment should be insured or not rests with ADE and not the clearing agent.

“Thus, by not insuring the consignment by ADE, as provided in the regulation, the State had to bear loss of Rs 10.63 crore,” the report concluded.

DRDO sources said the consignment, eventually never reached the organisation, and it was lost in transit!
