Files reveal links between Agusta, Embraer deals

ashish-embraer-story-edited-2The CBI has registered a preliminary enquiry (PE) against unknown Ministry of Defence officials to probe the Embraer aircraft deal scam, in less than 12 hours after this correspondent revealed on NewsX the minutes of four meetings held in December 2006 to finalise the aircraft for the AEW&C project.

This correspondent has revealed that the Defence Research and Development Organisation (DRDO) was not on board with the Indian Air Force under then Air Force chief S.P. Tyagi over the selection of Embraer aircraft.

PE is the very initial measure taken by the CBI to examine any case before lodging a First Information Report (FIR) against suspected persons.

The CBI told this correspondent that “CBI has registered a PE (preliminary enquiry) against unknown officials of the Ministry of Defence (GOI) and others. This on a reference from the said Ministry on allegations related to M/s. Embraer employing an agent to facilitate various contracts. These include the contract for AEW&C project wioth CABS/DRDO for procurement of 3 aircraft”.

This correspondent has accessed the key 10-page documents that form part of the “Embraer files” that are being investigated by the CBI and the Enforcement Directorate. The documents contain the minutes of the four meetings held in December 2006 to finalise the aircraft for the AEW&C project.

In the first of the four meetings, held at Air Headquarter, New Delhi on 5 December 2006, the documents suggest, then Programme Director (AEW&C) Dr S. Christopher (who is currently the DRDO chief) had proposed two alternative options with different configuration and endurance for the aircraft as a platform for this project. He also pointed out that better options will be available with the change of aircraft. But the Air Force under S.P. Tyagi overruled Christopher’s arguments and stated that the DRDO will work with Embraer, the world’s third largest aircraft manufacturer that is now under the scanner of the US and Brazilian authorities for alleged kickbacks.

The Embraer files accessed by this correspondent reveal that four meetings had taken place on 5,6, 8 and 19 December 2006 among the Air Force officers, DRDO officials and the scientific adviser to the then Defence Minister, A.K. Antony.

“Dr. Christopher brought out that better options will be available with change of aircraft. The Chairman (the then Deputy Chief of Air Staff) stated that we need to work with EMB-145 and develop a prototype with the configuration that CABS will formulate and send to IAF for consideration”, stated the minutes that are available with this correspondent.

The minutes further state: “The Programme Director, AEW&C stated that CABS has proposed two options with different configuration and endurance. DCAS asked him to submit a clear proposal of what can be achieved with a 24T aircraft.”

The Defence Ministry is also expected to seek information from Brazil and the US through Indian defence attachés deployed in Indian embassies in the two countries.

According to the Brazilian newspaper Folha de Sao Paulo, Embraer had allegedly engaged a UK-based defence middleman and paid him kickbacks in order to ink the deal with India. Media reports further alleged that Embraer officials had paid commissions to middlemen in order to finalise similar deals in Saudi Arabia. The US Justice Department has been scrutinising Embraer’s deal with India.

The newspaper report claimed that the Brazil based company came under the US scanner after the US Justice Department smelled a rat in 2010 following the former’s contract with the Dominican Republic.

In 2008, a $208 million deal with Embraer was signed by the Defence Research and Development Organization (DRDO) for three ERJ-145 aircraft to build indigenous Airborne Early Warning and Control Systems for the Indian Air Force. The three aircraft were to serve as an air-borne radar system known as airborne early-warning and control systems or AEWCS for the Indian Air Force.

Significantly, the Embraer deal reminds one of the AgustaWestland VVIP helicopter scam due to the many similarities. Both Embraer and Augusta deals were inked when S.P. Tyagi was the Air Force chief and A.K. Antony was the Defence Minister.

Both deals were cleared between 2008 and 2010 despite alternative options being available. In both deals, UK based middlemen and aircraft company officials are allegedly involved.

By seeing these views, the DRDO team gets charged to fight against corruption because they feel confident that a Defence Minister like Sh. Parrikar is there to stop all corrupt influences. Maybe some time is taken and some delays occur, but ultimately this corrupt gang of DRDO will soon get a big hit for their wrong doings.

Last few days Mr. Narang continue visiting ITM with a mobile and discussed the issue with ITM officials and showed his clarifications of property and asked whether ITM had complained officially or not. If they had not, then he asked for a letter mentioning some favors.

During the time of earlier Director, Mr. Narang visited ITM with a briefcase but returned without the briefcase and coincidentally the then Director and number two both were on long leave for few days and in between the construction was done in full swing.

Sub: Mushrooming illegal Hotels and Guest houses in Landour Cantt. Mussoorie

Honourable Chief Vigilance Commissioner,

I am writing this letter to complain about illegal high investment commercial activities going on in Landour Cantonment probably in collusion with officials, and members of cantonment board.

If Mussoorie is called “Queen of Hills” then Lanodur Cantt. Area can be called as “Crown of the Queen”. You may be aware that the green cover of these beautiful hills is being destroyed by indiscriminate urbanization, and commercial activity turning them into concrete jungles. Unfortunately, where Cantonment areas are supposed to be an example of clean and green with strict following of law and order, and integrity but we got an example of such cantonment in Landour which seems to be working other way and helping cronies occupy prime locations and indulging in indiscriminate, illegal commercial activities. The institute of Technology Management, DRDO is located in the Landour Cantt. And is the major stakeholder of the cantonment area. As Scientist of DRDO, and Officer In charge of Works (Estate) of Institute of Technology Management, I tried to do my best in my official capacity to highlight these activities in the vicinity of institute with Cantonment board authorities including GOC of Uttarakhand Subarea  on grounds of destruction of green cover of the hill, encroachment of  ITM roads, and high density moment of foreign tourist visiting these illegal hotels and guest houses posing severe inconvenience  and security threat to DRDO lab but I found things are much murkier than what I imagined. There is a sense of systematic and deep rooted corruption in Cantonment to allow multi billion investments by big players in hospitality industry with covert protection for flourishing their business.

Since I felt I have severe limitation to tackle at an official capacity, I should write to you at personal level to deal with the situation with suitable action. There are many high end hotels and guest houses running here illegally such as Rokeby Manor, Bothwell Bank, Tabour Cottage, Pine Tree Lodge, Lanodur Bakery (All owned by Mars Hospitality Group of Mr. Sanajay Narang), La Villa Batheny, Ivy Bank, Domas Inn, Devdar Woods,  Prospect Point. When ITM wrote to CEO cantonment about how you give these guest houses permission without any parking space due to which ITM roads are being blocked! In reply he said, we gave no permission to any such guesthouses to run. This shocking reply itself shows how such high end guest houses can run without covert support of Cantonment officials and members. Majority of these guesthouses are owned by Mr. Sanajay Narang, surprisingly all these within a span of 4-5 years. Mr. Sanajay Narang also constructed a big mansion (Dahlia Bank) behind ITM violating Works of Defence ACT. ITM in a court case with him with this regard (He filed a writ petition after losing the same case in Supreme court of India) in this case too Cantt. took good sweet time to comply with orders of SC so that he gets good time to file a writ petition. These high end hotels are made with investment worth 100s of crores (Especially hotels of Mr Narang) and cater to foreign tourists, high end guests including ministers, VIPS and judges. Its impossible to run 12 hotels without permission in a cantonment area, if integrity and sanctity of the Cantonment is intact. If Cantt. Not given any such permission than they are not even charging these properties to the tune of amount chargeable from commercial properties! Moreover, Cantonment board them self indulging in such activities, such as Building of Ivy Cafe, where they have initially taken sanction for double story car parking but the lower level space was constructed in such a way so that it becomes impossible for parking cars. This basement was later rented out for a cafe. In the same way, for another property the board has taken initial sanction for Cantt. Accommodation and guest house, but leased out to a private party to run guesthouse for civil tourist. The guy who has taken lease of this property had expanded to a big cafe but lack no space for a vehicle parking. This property made serious congestion of key road leading to ITM. It sounds fishy about how sanction for constructing something else has been changed to constructing a building for entirely for different purpose.

These all activities in the Landour Cantt ruining sanctity and credibility of a cantonment and promoting rampant corruption and destroying green belt of the Crown of the Queen of the Hills (Mussoorie). I humbly request you to kindly order an enquiry on how these illegal hotels are running, who are behind it, involvement of Cantonment officials and presidents since last 6-7 years and save this serene hill from thugs and thieves. There is a serious fraud and corruption happening here, I wonder it may prove bigger than “Adarsh Housing Scam”.

Rustom-II UAV to be tested in Chitradurga

dh 11The first flight of India’s new combat-capable unmanned aerial vehicle (UAV) Rustom-II is scheduled to be held by the end of July in Chitradurga test flight range.

Scientists at the Aeronautical Development Establishment (ADE) would move to the test range later this week for the trial as an window between July 28 and August 2 would be kept open for the flight in the presence of Defence Minister Manohar Parrikar.

Once ready, the medium-altitude, long-endurance (Male) UAV is likely to be an asset for the military not only for its surveillance capability, but also for its ability to be used as an unmanned armed combat vehicle in the line of the US’s Predator that New Delhi is interested to buy.

“Rustom-II is a very big platform with a range of 250 km. However, for the first flight we will be flying it up to a distance of 50-100 km,” said a source associated with the UAV’s development.

Compared to Rustom-I that was test flown for the first time in November 2009, Rustom-II will be having Electronic Intelligence, Communication Intelligence, Medium and Long-Range Electro-optic Payloads and Synthetic Aperture Radar that will enable it to see through the clouds.

“Rustom-I is a primitive vehicle with minimal capabilities. Rustom-II, on the other hand, has several capabilities, including the ability to carry weapons,” G Satheesh Reddy, Scientific Adviser to Raksha Mantri, told DH.

Once fully ready, Rustom UAVs are meant to replace Israeli Heron unmanned aerial vehicles being used by the air force and the navy. The aircraft is named after former Indian Institute of Science professor Rustom Damania, who pioneered aviation research in India in the 1980s.

Addressing a seminar on UAV in Delhi last November, an ADE official stated that the three services initially projected a requirement of 76 of these platforms.

However, like many other defence research and development organisation (DRDO) projects, Rustom-II is also facing time overrun as the production schedule, first fixed for 2016, has now been pushed to 2017 with the possibility that it may get further delayed.

The biggest challenge faced by the scientists is the excess weight of the airframe. The airframe had a weight of about 2,400 kg by 2015 end, which ADE scientists would have to bring down to about 1,700 kg in the final version for accommodating every sensor package.

Hindustan Aeronautics Ltd and Bharat Electronics Ltd partners DRDO in the development of Rustom-II and has committed several hundred crores as financial support.

Respected sir,                                                                                                                                               With extreme humility & guided solely by the public interest to save the public exchequer from illegal enhanced payment of pensionary benefits to shri A K Maini, voluntarily retired scientist ‘H’ & director LASTEC, Delhi, DRDO, MOD (voluntarily retired on 09-06-2014), the following irregularities & illegalities deliberately incorporated in the pension claim of shri A K Maini submitted in may 2015 to the office of your goodself are brought to your kind notice for immediate action in the form of to hold on the admitting the claim of pension to shri A K Maini submitted by the office of Director, LASTEC, Metcalfe House, Civil Lines, Delhi pin-110054.

  1. No formal hometown declaration document has been submitted by shri A K Maini during his entire service in DRDO w e f 1978 to 09-06-2014.
  2. No entry of hometown declaration existed in the 2nd page of the service book of Maini for complete 20 years i.e. w e f 1978 to 1998.
  3. An entry declaring hometown at the address of Delhi was made by Maini in his own handwriting in 1999.
  4. An additional entry of changed hometown address at Jammu was again inserted later on by Maini in his own handwriting in different inks in his service book without mentioning the date of such insertion.
  5. No D.O. PART-II was published for the changed place of the hometown i.e. of Jammu.
  6. No correspondence exists in any official document of LASTEC, Delhi for obtaining permission of the competent authority for change of hometown of
  7. Both the entries of hometown in the service book of Maini were made by  Maini himself in two (02) different inks at two different times and he miserably failed to submit cogent reasons for the same in response to the comments sought from him officially.
  8. Maini availed many times Hometown LTCs to Jammu i.e. at the changed place of Hometown inserted in his service book by himself without approval of the competent authority.
  9. This conduct of Maini was officially brought to the notice of DRDO HQ New Delhi & DRDO HQ referred the matter to the LAO (R&D),  Sharma, at METCALFE House Civil Lines Delhi who gave 02 (two) conflicting advices as follows i.e. the advice – (01) to recover the entire amount of hometown LTCs availed by  Maini during his entire service in DRDO with penal interest, the advice (02) to let go the pension papers of  Maini without any recovery.
  10. Illegal special pay @ Rs 4,000 has been paid to Maini during his service as scientist ‘G’ in DRDO, MOD violating the extant rules in this regard.
  11. The illegally sanctioned & drawn special pay @ Rs 4,000 by Maini was illegally taken into account for fixation of pay when he was promoted to the post of scientist ‘H’ in DRDO on 01-07-2010.
  12. He has been illegally overpaid @ Rs 4,000 & allowances thereof during the entire period w e f 01-07-2010 to till his voluntary retirement on 09-06-2014.
  13. Accordingly he has been sanctioned more pension then his legitimate entitlement by the Director, LASTEC, Delhi due to wrong fixation of his basic pay as on 01-07-2010.
  14. Pension papers of Maini has been submitted to the ofiice of your goodself without effecting the recovery of the Hometown LTCs amount reimbursed to Maini & without withholding any amount from the entitlement of retirement gratuity to

No formal or informal action has been taken against Maini either at the level of the O/O Director, LASTEC, Delhi or at the level of DRDO HQ New Dehi for the particular conduct of Maini with regard to 02 (two) different entries of Hometown declaration made by him in his own service book in his own handwriting in two different inks changing the Hometown without any authority.
  16. Maini has been lobbying in PCDA (p), Allahabad in last week to any how get issued PPO in his favour hurriedly without letting to know about the irregularities & illegalities deliberately incorporated in the pension claim submitted by O/O Director, LASTEC, Metcalfe House, Civil Lines, Delhi pin-110054 to the O/O PCDA (P) Allahabad.
  17. The pension papers have been submitted on the date when officer in charge of the pension cell of the O/O Director, LASTEC, Metcalfe House, Civil Lines, Delhi pin-110054 was present by affixing the earlier date (i.e. the date on which the officer-in-charge of the pension cell was on leave) then the actual date of signing the forwarding letter by some other officer.
  18. Maini submitted false annual immovable property returns every year in his entire service stating in writing that “He & members of his family did not have any immovable property”.
  19. Maini have been residing at Mayur Vihar,Phase- I Delhi,house belonging either to him or to the members of his family and he has been drawing HRA during his more than 36 years of service in the O/O Director, LASTEC, Metcalfe House, Civil Lines, Delhi pin-110054 still he falsely submitted nil immovable property returns.
  20. This fact mentioned in point no 18 above was brought to the notice of the DRDO HQ by the whistle blower of the corruption and misconducts done by Maini but no action has been taken as yet by the DRDO HQ New Delhi in that regard.
  21. A proposal of vigilance clearance was submitted by the office of Director of vigilance & security, DRDO HQ,New Delhi to the O/O Director vigilance (MOD) disregarding the material facts mentioned in point no 18 & 19 above which led to issuance of wrong vigilance clearance to Maini by the office of Director ( vigilance) MOD under the O/O CVO of MOD.
  22. K D Nayak, DG (MED & CoS) holding the additional charge of DG (ECS) illegally pressurized & issued show cause notices to Director, LASTEC, Delhi & to Dy. Director (Admin) LASTEC for not turning the blind eye to the irregularities & illegalities pertaining to the pension claim of his Friend Maini and for not submitting the pension claims of Maini immediately to the O/O pcda (P) Allahabad irrespective of any irregularity & illegality. I, therefore, request your good self to kindly act swiftly &with utmost due diligence keeping in view the above mentioned material facts to protect the public interest. You are also requested to call for the concerned original pension fileof the LASTEC Delhi including the original note sheets containing the comments of the officer-in-charge of the pension cell of the O/O Director, LASTEC, Metcalfe House, Civil Lines, Delhi pin-110054 which will spill all the beans.

Last but not least is DRDO HR is in worst situation number of CAT/court cases increasing day by day, vindictive transfers according to ego of Lab Directors, manipulations in APAR, encouragement of incompetents, no fair assessments, grievance redressal  system is extremely failed, officials & families are waiting for replies more than years.

Did Indian Army Really Contribute Rs 100 Crore To PM Relief Fund For Kashmir Floods?

New Delhi, May 15 (Only Kashmir): Four months after Army chief Gen Dalbir Singh Suhag handed over an Rs 100-crore cheque to Prime Minister’s Relief Fund for the flood victims of Jammu and Kashmir, the Army has denied information of any such donation.
Army General Suhag had presented the Rs 100-crore cheque, which was claimed to be raised by the soldiers and officers of 1.18 million strong army after donating their day’s salary, to Prime Minister Narendra Modi during the Army Day reception on January 15.
However, an RTI reply from Army headquarters, has confirmed that “no such amount on account of contributions from salary of any Army personnel has yet been donated to the PM’s Relief Fund.”
Three days after the reception day function, it was reported about the army soldiers and officers, fuming over being not asked in advance by the higher officials before deducting their salaries and presenting the collected amount to the relief fund.
Apparently, media reports like these prompted Dehradun-based activist Prabhu Dandriyal to file an RTI on March 20, seeking what happened to the Rs 100 crore cheque donated to the PM’s Relief Fund by army.

Denying any such contribution for the flood-affected people of Jammu and Kashmir, the RTI reply from Public Information Officer, Lt. Col. Rajiv Guleria on Tuesday, May 12, has added that the matter is undInterestingly, press releases with photographs of Suhag handing over the cheque of raised amount to Modi in the presence of Defence Minister Manohar Parrikar, continue to be hosted on the websites of Prime Minister and Press Information Bureau.

Filing his RTI petition now to the Prime Minister’s Office, Dandriyal has sought to know how the Rs 100 crore cheque was utilized.

“When by March 20, no amount of contribution was taken from the salaries, then how did the army chief submit the fund of Rs 100 crore to PM relief fund. This is why I have sought clarification from the PMO by filing another RTI,” Dandriyal said.

The RTI revelation has come in the backdrop of severe financial crises ailing Jammu and Kashmir. Reeling from the post-floods devastation, the summer capital city of Srinagar has witnessed protests, almost on daily basis, from daily wagers and government employees demanding pending salaries and arrears.

After the September 2014 floods, the J&K state government had forwarded a Rs 44,000 crore rehabilitation proposal to the central government, which has not been entertained by the centre till now.

I have submitted following complaints against Dr. A.K. Singh, Director (Personnel), DOP, DRDO HQ, DRDO, Min. of Defence, New Delhi to Hon’ble Prime Minister as well as to your office. Details of the complaints are given belowAK Singh remider letter table

As a matter of fact, Dr. A.K. Singh, Scientist ‘G’ is posted in New Delhi since his joining at INMAS, New Delhi since 1988. He is posted at New Delhi continuously since past 27 years and never been transferred out from Delhi.

Being posted as Director (Personnel) at DRDO HQ, Dr. A.K. Singh is misusing his official position to influence the inquiry of complaints filed against him. You may surprise that till date no action has been taken against Dr. A.K. Singh by Ministry of Defence despite my all complaints submitted to PMO were forwarded to MOD by PMO for necessary action.

No action against corrupt officers by competent authority lead frustration in mind of complainant and this forces the complainant to approach to Hon’ble Court by means of PIL to request to Court for action against Corrupt officer(s).

Recently, I was compelled to file one PIL on Corruption cases at DMSRDE, Kanpur against one Dr. A. K. Saxena, while in that case  MOD was helpless because DRDO CVO and DRDO Hqrs did not taken any action against Dr. A.K. Saxena, Director, DMSRDE, Kanpur. The two fact finding committees constituted for only for eye wash.

Sir, you will appreciate that our judiciary is overloaded from court cases and whistle blowers and anti-corruption/RTI activists should not be forced to approach again and again to Hon’ble Court for filing PIL for proper action on complaints.

It is  requested kindly,  transfer Dr. A.K. Singh, Director (DOP) urgently from DRDO HQ to any other Lab from Life Sciences Cluster and order the High Level Inquiry to investigate my complaints against Dr. A.K. Singh as stated above in speedy and time bound manner.

LCA will not be able to penetrate enemy lines

LCA DH 8 may 2015The indigenous Tejas light combat aircraft (LCA) will experience a major handicap in defeating the enemy due to non-availability and poor performance of three electronic warfare instruments, developed by Indian agencies.

During the trial, the all-important counter measure dispensing system that protects the aircraft against radar and heat-seeking missiles, could not do its job properly, leaving the jet with poor defence. The system was developed by , Hyderabad-based Bharat Dynamics Limited.

It was not the only faltering system on-board the LCA. The self protection jammer that blocks the enemy radar was too big to be fitted into the Mark-I version of the LCA and the radar warning receiver, which alerts the pilots on hostile enemy signals, perform poorly. Both were developed by Bangaluru-based Defence Avionics Research Establishment.

“LCA Mark-I remains deficient in full electronic warfare capabilities as specified in the Air Staff Requirement (ASR),” the Comptroller and Auditor General (CAG) says in a review report that was tabled in Parliament on Friday.

The aircraft, which achieved initial operational clearances on December 2013, has as many as 53 shortfalls from the specifications drawn in the ASR.

Some of the shortcomings like increased weight, reduced internal fuel capacity, pilot protection from the front and reduced speed are to be addressed in the Mark-II version that was taken up by the Aeronautical Development Agency in 2009 and scheduled for completion in 2018.

Even after 30 years, the LCA could get only the initial operational clearance (IOC) in December 2013. The full operational clearance (FOC) is now targeted in December, 2015.

The cost is also rising all these years. What began as a Rs 560 crore programme in 1983 has now gone up by almost twenty times. The financial package for LCA now stands at Rs 8294 crore.

The auditor also criticised the Defence Ministry for awarding two commercial contracts to Hindustan Aeronautics Limited (HAL) in 2006 and 2010 for delivering 20 fighter planes in each contract in the IOC and FOC configurations respectively to the IAF.

Both were termed premature because in 2006 LCA design was nowhere near finalisation, whereas in 2010 HAL was yet to supply any aircraft to the force as per the previous contract. Even now, the IAF is not in a position to operationalise the LCA squadron in the absence of a trainer aircraft. Moreover, HAL’s production capacity – four aircraft per year – is only half of what the government wants.

Hi-tech chariot: Role of DRDO lab under lens, govt tells Parl

A probe is on into allegations that a Pune-based DRDO lab had donated to a temple a ‘hi-tech chariot’ made by its scientists, Defence Minister Manohar Parrikar informed Parliament today.

Responding to a question in Lok Sabha whether Pune-based DRDO lab, Research and Development Establishment (Engineers) had developed a hi-tech battery-operated chariot and subsequently donated it, the minister said in a written reply that the matter is “under inquiry”.

“Further action would be taken thereafter,” he added.

News reports had it that the lab had developed the chariot for a temple and donated it under its corporate social responsibility.

The battery-operated chariot can reportedly run for about 12 hours and the battery can be fully charged in six hours.
