AURANGABAD: A city-based associate professor has sent a fresh complaint to the defence ministry alleging discrimination during a recruitment process by Defence Institute of Advanced Technology (DIAT) in Pune.
In support of his claim, the associate professor has attached a bunch of “self-contradictory” documents from the DIAT received under the RTI Act. The DIAT – a deemed university funded by the defence ministry – had published an advertisement on April 25, 2015, inviting applications for the post of assistant professor in the technology management. It received as many as 18 applications.
In an RTI reply, the DIAT clearly stated that the scrutiny committee shortlisted nine applicants – all holding a postgraduate degree in management. Subsequently, the shortlisted candidates were called for an interview on September 12, 2015. The interview was attended by all the shortlisted candidates, following which one was provisionally selected and his name was published on DIAT’s website on the same night.
Unconvinced with the selection, the Aurangabad-based associate professor, Dr Nitin Untwal, challenged the decision of the selection committee and sent a letter to the DIAT, claiming that the appointment was in violation of the University Grant Commission norms. Untwal holds an MBA, MCom, PhD and has cleared UGC SET.
Taking cognisance of Untwal’s letter, the National Commission for Scheduled Castes (NCSC) has initiated a probe into the recruitment as the seat was reserved for an OBC candidate. Untwal has also lodged a series of complaints with the Prime Minister’s Office (PMO). The PMO, in its reply, cited a Supreme Court judgment in the case between one P Sushila and UGC for carrying out the recruitment process.
According to Untwal’s complaint, out of the 18 applicants, nine were disqualified on the grounds that they did not have a PG or a master’s degree in management. He added that eventually a candidate with an M-Tech degree was not only shortlisted, but selected.
Moreover, an RTI query with the National Institute of Technology in Calicut revealed that M-Tech under mechanical engineering (industrial engineering and management) is not equivalent to postgraduation in management.
In a fresh complaint, Untwal cited that a letter sent by the DIAT to the UGC – a copy which has been obtained under RTI on September 28, 2015 – the DIAT stated that the essential qualification for the post were as per para 4.4.5 of the UGC regulation 2010, which is a post graduate degree in management declared equivalent by AICTE/AIU.
In its RTI reply, the DIAT on May 23, 2016 stated that the essential qualification for the position were as per para 4.4.6.1 of the UGC regulation 2010, which says that “the essential qualification for the post is a postgraduate degree in engineering and technology”.
When contacted, DIAT officials refused to comment. But in a reply to a query posed via email, DIAT’s joint registrar (administration) T V Ananthasubramanian said, “I am directed to forward the following as our response: Dr Untwal was a candidate for the position of assistant professor for technology management. He was not found suitable by the duly constituted Selection committee and hence, not selected. His various queries to DIAT and various other agencies and authorities, including the Hon’ble Raksha Mantri/Chancellor, DIAT have been replied. The DIAT has nothing more to add to the answers given earlier.”

It is observed that DRDO has a 30000 strong scientific and technical force and but unfortunately output is not corresponding with manpower strength, it is exceptionally very low in compare to any other organizations or corporate.
Reports are showing so many reasons and excuses for achievements in development of technology like inadequate allotment of budget, unavailability of latest components and systems from developed countries, not given free hand for procurement, not giving free hand for recruitments of manpower etc.
One of the real reasons is incompetency in lower level to higher level of DRDO organization.
If you see the level and quality of qualification of DRDO, a 30000 strong scientific and technical force you will see a very unbelievable scenario.
The real qualified manpower who are having a certificate/diplomas/degrees/post doctoral research/ having good number of published papers in national and international journals/ having name patents but under pressure put their bosses name or bosses blue eyed names without contribution/researchers are doing PhD’s under them, all these kind officials fail to get proper growth in DRDO. Such Skilled officials, if their family commitment allows, then the first thing they do is quit DRDO. Otherwise they accept the current scenario as their destiny.
The officials who have the manipulated certificates/diplomas/degrees/post doctoral research in private deemed universities where they are instrumental to in siphoning the DRDO funds in the name of CARS, Grants-in-Aid. Grants-in-Aid Scheme: Research sponsored in academic institutions under the extramural research (ER) etc / having good number of published papers but as a second, third fourth author, patents in their name but forcefully entered their names etc. These kinds of DRDO officials are at the top of DRDO each and every where.
Sir, unfortunately this is the real harsh situation of DRDO, since we are feeling that you are in the process of revamping DRDO, so this is the real time to look and check even verified from out sourcing like the corporate world is adopted before giving responsibility to someone because you are giving a free hand to spend 10000 cr taxpayers money, the educational professional background of each and every DRDO officials.
Any qualification enhancement from DIAT, Amity, JNTU, Shoolini University and other private deemed universities are mostly by manipulations. DIAT governed by DRDO, rest all private deemed universities from last 15 years enjoying lot of funds from DRDO in the name of CARS, Grants-in-Aid. Grants-in-Aid Scheme: Research sponsored in academic institutions under the extramural research (ER) etc and freely distributing all kind of qualification M Tech, MBA’s, lot unrecognized subject P h D’s and private university self designed degrees/diplomas.
When you will see the data of these DRDO officials you will automatically realize the reason of failure of DRDO.
Sir, above subject’s court decision attracted me to write this letter that I have collected so many evidences of forge qualification evidences of DRDO officials, and as per DOP, DRDO, Dr A K Singh’s letter it is clearly established such acquired qualification were not even verified and encouragement money was also distributed to hundreds of DRDO officials.
Sir, it is requested in the national interest through study is required from outside agency GOI can decide before allotting funds for projects whether the DRDO officials qualified and capable and they are having background knowledge of proposed projects, till date country is witnessing DRDO’s technology demonstration drama which they are able to display with the fully support from outside firms Indian or international.
If you want the evidences which I have collected in last 10 years, I am ready to provide.

Respected Sir,
Very humbly, I submit as under:
- I, Dr. Rohidas Gopinath Taware was working as a Group ‘A’ Gazetted officer with designation Technical Officer ‘B’ in High Energy Materials Research Laboratory (HEMRL), Pune- 411021, DRDO, Ministry of Defence. My educational qualification is M.Sc., Ph.D., MBA, PGDEE (Post Graduate Diploma in Ecology and Environment). I have completed 27 years’ of satisfactory service in HEMRL. My entire service record is spotlessly clean.
I hail from a much respected family. My father was a Freedom Fighter and a brave soldier of Azad Hind Sena.
- I had submitted timely my grievances to Dr. A Subhananda Rao, Director, HEMRL, Pune regarding my harassment. But no cognizance was taken by him.
I made earnest ‘Appeal for Justice’ on 09.01.2008 to the Director of Personnel (DoP), DRDO, Ministry of Defence, New Delhi regarding my grievances along with supporting documents. I had written a letter on 04.05.2009 to DoP regarding my ‘Harassment by Ostracism’ in HEMRL, Pune. The DoP, too, did not take any cognizance of my grievances and harassment.
- Instead of considering the gravity of my grievances and harassment by ostracism, Dr. Arun Kumar, the Director of Personnel, all of a sudden, suspended me on 08.2009 by fax order. So, I lodged my protest on 26.08.2009 against the illegal suspension order issued by the DoP.
- There is a big conspiracy in DoP office of DRDO from my suspension to dismissal from the service. The Director, HEMRL gave false information to DoP that I was involved in “High-Handed Anti- Departmental Activities”, “the Laboratory has come to a stand still vulnerable position”, “the working of the Laboratory is badly dislocated” and “all officers are in demoralized state”.
The DoP office without any preliminary Inquiry proceeded against me and arranged for my suspension and further dismissal. Thus, the Director HEMRL and DoP joined hands against me and were bent upon to see that I was dismissed from service on 30.12.2010 for the reasons best known to them. The suspension to dismissal charges are not related to each other. Further, penalty of dismissal is horribly disproportionate to the charges leveled against me.
- The charges leveled against me for my dismissal like ‘tone and tenor of letter’ are trifling, false and fictitious.
- I wish to point out legal points regarding my suspension to dismissal which show that how the Principles of Natural Justice were blatantly violated.
- Two separate Memoranda, two separate Disciplinary Inquiries.
- Second Inquiry initiated for alleged misconduct during my suspension period when I was not on duty.
- Two separate Penalties simultaneously, First Minor & Second Major.
- Second penalty was awarded without cancelling first penalty.
- No revocation of suspension when first minor penalty was awarded.
- Second penalty of Dismissal awarded while under suspension.
- Both the penalties horribly disproportionate to the charges.
- All the orders from suspension to dismissal illegal. Approval from Rajya Raksha Mantri (RRM) taken instead of Raksha Mantri. Signatory to the orders not authorized under Art.77(2) of the Constitution.
- After dismissal order, I have done a lot of correspondence with the Competent Authority of DRDO for my illegal suspension, illegal punishments including my dismissal and for the settlement of Government dues i.e. rightful amount. But no cognizance was taken by them. This is also the intentionally harassment of me and my family.
- I had submitted ‘Appeal for Justice’ to the Competent Authority of the DRDO for my grievances and harassment. But instead of taking any cognizance, suitable action or giving any justice for the same, they have horribly punished me.
It means, ‘Asking for Justice is a Crime’ in DRDO! The Competent Authority of DRDO unnecessarily constrained me to file a various suits in the Hon’ble Courts for the Justice. After the dismissal order, I am jobless. I am highly qualified with 27 years well experienced officer from DRDO but disqualified for any service in the society because of my additional qualification is ‘Dismissal’ which was illegally and unauthorized awarded by the Competent Authority of DRDO. Hence, in all respect, this is very serious harassment and punishment for me.
- Sir, I have mentioned all the above irregularities and illegalities, involved in my suspension to dismissal, for your perusal please. I pray and request you to look in to the case and give me justice.

11 Bangalore terror suspects remanded in police custody
THE HINDU – BANGALORE, August 31, 2012
The 11 persons arrested by the Bangalore police on Wednesday on the charge of plotting terror strikes in Karnataka, were remanded in police custody for 14 days by a judicial magistrate here on Thursday. Defence Research and Development Organisation, where suspect Aijaz Ahmed Mirza was employed as a junior research fellow, issued a release on Friday, saying Mirza “was not involved in any sensitive work and, as such, no sensitive/classified information has been compromised.”
“Disciplinary action as per Government of India rules is being taken [against Aijaz],” it said adding Mirza’s antecedents were verified before he was taken in.
Even as the police remained tight-lipped, heads of various Muslim organisations, at a press conference, expressed concern at the developments. Students Islamic Organisation (SIO) State president Ashfaq Ahmed said journalist Muthi-ur-Rahman Siddiqui was a listed member of the SIO and the Jamaat-e-Islami.
Jamaat leader Moulana Wahiduddin Khan said, “If those arrested are found guilty, they should be punished by all means.” But he called for more transparency on the part of the police. “Why is it that terrorists from a certain community are always arrested when elections are near,” he asked.
At another press conference, Muthi-ur-Rahman’s brother Ata-ur-Rahman said: “My heart says my brother is innocent.” Meanwhile, the Central Crime Branch of Bangalore police arrested Ubed-ul-Rahman, an MBA student, in Hyderabad.

In a report from Bangalore published in the issue of August 31, headlined “Journalist among 11 arrested for ‘plotting terror in Karnataka’,” the description of some journalists who were purportedly targeted by the alleged plotters as ones “known for their virulent anti-minority columns” was unfair and unwarranted, and escaped gatekeeping mechanisms that are in place to keep such editorialising comments out of the news columns of this newspaper. That description, as well as the loose and imprecise reference to the “divergent ideologies” of two terrorist organisations are regretted and may be deemed as withdrawn. — The Editor
