Hello,

Kindly provide me with the following information requested under the purview of the Right to Information (RTI) Act, 2005.

In reference to Golden jubilee celebrated by Defence Research Laboratory (DRL), Tezpur in 2012.

  1. How much amount was sanctioned by DRDO Hqrs, is it Rs 2.75 Lakhs or more? if more, than total sanctioned amount.
  2. Was any Golden jubilee function was organized by DRL, if yes then date of function and name of the chief guest of the function.
  3. Was any Golden jubilee memento or gift was distributed to the all DRL employees? if yes, then please provide quantity in numbers.
  4. Director, DRL, Tezpur opened an account in the name of TEZCON-12 in IDBI, Tezpur Branch A/C no 1158104000003261. Please provide the total amount collected by various vendors, the list of vendors, the last date of money deposited by vendor.
  5. The above account is still in operative yes/ No; if yes then please provide account statement till date. Remember it is public fund and any citizen of India has right to know about it.

In reference of Estate Management Unit, DRL, Tezpur

  1. All quarters of P-3 Block allotted to DRL employees Yes/No
  2. Any quarter of P-3 Block is allotted to any individual who is not a Government servant. Yes/No
  3. All service personals of working in DRDL availing the accommodations, Yes/No
  4. All service personals who are availing the accommodations are also claiming HRA, Yes/No

Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of recovery of HRA. The letter no DOP/03/31000/M/05 dated 17th August 2011of DOP, DRDO Hqrs address to directors of all labs/establishment

Reference :   (i)         The letter no DOP/03/31000/M/05 dated 17th August 2011of DOP,

DRDO   Hqrs address to directors of all labs/establishment

(ii)        File No CIC/LS/A12011/000412 DRDO reply for availing DRDO guest

house facilities by DRDO officials.

  1. Please provide the name of DRDO officials who claimed HRA while staying in Government accommodations.
  2. Total amount recovered from DRDO officials  in  2011-12,  2012-13
  3.  As per DRDO reply in CIC – “Dr. Prahiada, CC R&D (Ae & SI) & DS, DRDO HQrs availed DRDO guest house facility in Delhi during 26 Mar 2010 to 20 Mar 2011”. Please provide the dated and total amount recovered from then Dr. Prahiada, CC R&D.
  4. Please provide the residential address of  Dr. Prahiada, CC R&D (Ae & SI) & DS, DRDO HQrs  from his date of joining in DRDO Hqrs to 25 March 2010.
  5. As per DRDO reply in CIC – “Sh. S Ravi, Additional Director, DRDO HQrs availed DRDO guest house facility in Delhi during 10 Jul 2009 to 10 Sep 2010” Please provide the dated and total amount recovered from Sh. S Ravi.
  6. Copy of any disciplinary action taken against those DRDO officials who violated the CCS rules of HRA in above subject matter.

Note: – above required information is directly related to corruption and not come under schedule – II. Because the recovery from DRDO officials proved that the some senior DRDO officials were indulged in corrupt practices.

DRDO Outstanding Scientist

Kindly provide me with the following information requested under the purview of the Right To Information (RTI) Act, 2005 in respect of Sh. R K Agarwal, Scientist ‘H’, (Out Standing Scientist ) Defence Electronics Application Lab, DRDO, Dehradun

As per SRO- 36 dated 9t May 2011 ( FileNo. DHRDn6205IDRDSlRRlClP/10/1022/D(R&D))

Para 2

“(iv) The Peer Committee as specified in Schedule ID shall assess suitability for appointment of Scientist ‘H’, Outstanding Scientist in Defence Research and Development Service”.

In DRDO Newsletter September 2012 page No -14. In which the details of Outstanding Scientists of the DRDO. Sh, R K Agarwal, Outstanding Scientist, DEAL   “ his main contribution has been the development of NARAD, the first semi-static and transportable terminals developed in the country. These terminals were immediately deployed in SRI LANKA during operation PAWAN where they have played a vital Role.”

Sh. R K Agarwal claimed false that he worked and contributed in “Project NARAD”, which was the only real-time successful project and was appreciated by user (IPKF).

Sh. R K Agarwal claimed the aforementioned for his promotion to outstanding scientist and it was published in DRDO’s News Letter September 2012 page No -14 (Copy enclosed)

Departmental Part Order for manpower for Project NARAD reference are DO Part-I No.232/AD dated 18/11/1988 and DO Part-I No.238/AD, No.239/AD dated 24/11/1988. There was clear cut mention in the order that Sh. R K Agarwal was not part and parcel of Project NARAD.

The appreciation letter No 35795/Aks/per date 20th April 1990 by Major A K Singh, 57 Mtn Div. Signal Regiment to Sh Surendra Pal, Dy. Director, Project NARAD clearly reveals the names of DEAL’s scientists who participated and contributed their best  in the real operation scenario. There is no name of Sh. R.K Agarwal in the appreciation letter.

The DRDO in their RTI reply No.DEAL/RTI/0003/2013 dated 08/04/2013 clearly mentioned that No such document/information is available, means there is nothing available which proves that Sh R K Agarwal was part and parcel of Project ‘NARAD’. It is clear evidence that Sh RC Aggarwal supported Sh R K Agarwal’s false claim for promotion to outstanding scientist because of the only reason of nepotism and castism. (Copy enclosed)

Kindly provide the following informations under the purview of the Right To Information (RTI) Act, 2005

  1. The certified copy of  Sh R K Agarwal’s credentials submitted to then Peer Committee by DRDO for consideration for promotion of Scientist ‘H’ (Outstanding Scientist).

Honorable Sir,

As you already very well aware that DRDO is in neck deep nepotism and corruption and we all welcome your latest decisions like suspension of Dr. Arun Kumar, not giving nod for further extension to Dr. V. K. Sarswat, order for special audit to CGDA, etc.

Sir, your commitment for honesty and stride for eradication of corruption and nepotism specially in defence sector, we salute your honest efforts and we are trying to contribute some authentic information related to nepotism and corruptions prevailing in DRDO from time to time to strengthen your  mission.

In this series I would like to submit some documentary evidences of nepotism of Sh. R. C. Aggarwal, Director, DEAL, DRDO.

  1. Sh. R. C. Aggarwal after taking charge as Director, DEAL put all scientists/staff of his community in important positions. You can verify with Departmental Part orders.
  2. He supported Sh. R K Agarwal for his false claim of work in “Project NARAD”, which was the only real-time successful project and was appreciated by user (IPKF).
  3. Sh. R K Agarwal claimed the aforementioned for his promotion to outstanding scientist and it was published in DRDO’s News Letter September 2012 page No -14 (Copy enclosed)

  7. Sh R.K.Agarwal already created an embarrassing situation for you due to his personal bias towards Schedule Cast when he deliberately cut the APAR numbers of a Technical Officer ‘C’. The victim has already represented this to Director, DEAL on 11th April 2013. But the best part is that DEAL management threatened and focused all their lethal weapons to fix him. And soon you will get this matter from SC/ST committee.

Sir, this nepotism and corruption is in the peak and this is also a right time for you to select a dynamic personality who can first tackle this neck deep nepotism and corruption of DRDO.

Sir, you are giving answering regarding exodus of DRDO scientists to our honorable parliamentarian since last 7-8 years and quoting that the senior scientists E, F, G are not quitting. But you are not aware that by seeing this honoring of incompetent scientists due to nepotism the junior scientists imagine their future and quit for better future.

Second major point is the senior scientists who were/are super seeded by these incompetent scientists are suffering from, blood pressure, heart problems and depressions. Ask health report of senior scientists.

Sir, can we expect any miracle research from these bunch of halfhearted and blood pressure, heart problems and depressions patients? Not at all.

Sir, you can find some scientist ‘G’ age of 38/40/42 etc. but they achieved this due nepotism if it is not true than how many get international recognition of their research work.

Once again it is requested to see this personally in the interest of DRDO as well as in the interest of nation.

The agenda of the meeting was how to stop Prabhu Dandriyal’s RTI requests. It was not a general RTI issue meeting because the officials who were called to the meeting were directly involved in tackling the issues which I had raised through RTIs.

  5. The temporary duty reports of out station officials who attended the above mentioned meeting. Mainly Mr.YV Ratna Prasad, DMS, DRDL, Hyderabad and Sh K K Mishra, Joint Director, DEAL, DRDO. After completion of any temporary duty DRDO officials always submits the TD reports to his parent department stated what the purpose of visit was and what the outcome of visit was, etc.

DRDO is already aware that this matter is related to exposing corruption prevailing in the organization. Dr. Arun Kumar, then DOP, DRDO already suspended on 30th November 2012 by MOD due to his involvement in corrupt activities in the organization. It is requested that you please furnish the above information in prescribed period of RTI Act because this matter is directly related to corruption the evidences are enclosed herewith for your ready reference. DRDO transit facilities/Guest house for a month or more from their date of reporting and also have claimed/claiming HRA for the said period are required to refund the amount of HRA wrongly claimed forthwith by 15 Sep 2011 through MRO under intimation to the undersigned.
4. This has the approval of the competent authority.

5. The contents of this letter may please be communicated to all concerned.” He wishes to know as to why no recoveries have been effected so far.

6. To this, Shri Mishra would respond that recoveries have been made from all of the scientists.

7. In my opinion, this does not mitigate the irregularity committed in claiming HRA by the above named scientists. Even so, it is to be noted that recoveries have been made from all concerned. If so, the appellant may be informed accordingly in 03 weeks.

It seems that the irregularity are carried out by the officers / scientists appointment / service extension / re- employment through the contract basis in DRDO. As per the DOPT letter no. dt.9th Dec.2002 regarding the grant of extension / re-employment to central govt. servants beyond the age of superannuation – issue of instructions regarding.-“ Re-employment : No proposal for employing a govt. servant beyond the age of superannuation of 60 years shall be considered. It is also clarified that no person can be appointed / re-appointed to central govt. service after the age of superannuation of 60 years through contract.” This is a case of the corruption so that the main object to take this information is to provide as an evidence before High Power Investigating Officer/ Commissions / High Courts in the interest of law and justice. . I hereby enclosed all related documents for your consideration and decision.

8. Brief facts of the case:-

I submitted my RTI application before the CPIO, DRDO, New Delhi on dt.01-11-2011. Cause for put up this application was the allegation of the corruption / misuse of the office during the Re-employment of the scientist. CPIO reply is not satisfactory and not as per the law because the RTI is related with the allegation of the corruption and not exempted under section 24(1) of the RTI Act-2005.

However in this Supreme Court civil Appeal no – 6454,clearly mentioned that- “37. The right to information is a cherished right. Information and right to information are intended to be formidable tools in the hands of responsible citizens to fight corruption and to bring in transparency and accountability.The provisions of RTI Act should be enforced strictly and all efforts should be made to bring to light the necessary information under clause (b) of section 4(1) of the Act which relates to securing transparency and accountability in the working of public authorities and in discouraging corruption.”

I was not satisfied with the reply of CPIO,DRDO HQ, New Delhi, after that I submitted an appeal before FAA to take the information but the FAA of DRDO dismissed the appeal and failed to provide the information with the ref. of second schedule of the RTI Act & section 24(1) of the RTI Act-2005

9. Reasons/grounds for this appeal:-

That this information is directly related with the corruption and misuse of the office and not come under section 24(1) of the RTI Act because the high no of scientists are working and take the financial and other benefits after the violation of the-
(i)- DOPT rules as DOPT letter no. dt.9th Dec.2002 regarding the grant of extension / re-employment to central govt. servants beyond the age of superannuation – issue of instructions regarding.-“ Re-employment : No proposal for employing a govt. servant beyond the age of superannuation of 60 years shall be considered. It is also clarified that no person can be appointed / re-appointed to central govt. service after the age of superannuation of 60 years through contract.”
(ii)- Defence Research Development (DRDO)Service Rules no-9-“Probation- Persons appointed to the grade of scientist ‘B’ of the service either by direct recruitment or by promotion or by re-employment before the age of superannuation ,shall be on probation for a period of 2 years. Persons appointed to any other grade of the service viz. scientist ’C’. scientist ’D’ .scientist ’E’, scientist ’F’ and scientist ‘G’ .either by direct recruitment or by re-employment before the age of superannuation ,shall be placed on probation for a period of one year; Provided that the Director General may extend or curtail the period of probation in accordance with the instruction issued by the central govt. from time to time; Provided further that in case where it is proposed to extend the period of probation, the Director General shall give notice in writing of his intention to do so, to the officer with in twelve weeks after expiry of the initial or extended period of probation”

In an unprecedented disciplinary action, four of the biggest names in the space community, including former chairman of the Indian Space Research Organisation (ISRO) G Madhavan Nair, have been barred from occupying any government position — current or in future — for their role in the Antrix-Devas deal, in which a private company was accused to have been wrongfully allotted S-band frequencies for radio waves.

A Bhaskarnarayana, former scientific secretary in ISRO; K R Sridharmurthi, former managing director of Antrix which is the marketing arm of ISRO; and K N Shankara, former director in ISRO’s satellite centre, are the others who have been penalised, according to an order issued by the Department of Space on January 13, 2012.

Nair, during whose tenure the contract was signed, is the recipient of the Padma Vibhushan. He is the chairman of the board of governors of IIT Patna.

The order, a copy of which is with The Indian Express, is signed by Sandhya Venugopal Sharma, director, Department of Space. While it does not specify the allegations against these scientists, the order says that the decision comes after the government “carefully considered” the report of the high-powered review committee set up on February 10, 2011 and that of another team set up on May 31, 2011.

The order, sent to all Secretaries of the Government of India and Chief Secretaries of state governments and Union Territories, says that these “former Officers of the Department of Space shall be excluded from re-employment, committee roles or any other important role under the government”.

Further, the order states that “these former officers shall be divested of any current assignment/consultancy with the government with immediate effect”. Ministries and departments concerned have been asked to communicate necessary action taken towards the same to the Department of Space.

The deal involved a contract that Antrix Corporation — whose mandate is to market technologies developed by ISRO — had signed with Bangalore-based Devas Multimedia in 2005. The multi-million dollar deal gave Devas bulk lease — 90 per cent — of transponders on two yet-to-be-launched satellites for supporting a range of satellite-based applications for mobile devices through S-band frequencies. For this, the company was given access to 70 MHz of the 150 MHz spectrum that ISRO owns in the S-band.

The Cabinet approved the building of these two satellites — GSAT-6 for Rs 269 crore and GSAT-6A for Rs 147 crore — in 2009. The cost of the launch of satellites was to be Rs 350 crore. Interestingly, the Cabinet was not informed that these two satellites were meant to be used by Devas, a fact admitted by ISRO.

“Ideally, that should have been explicitly mentioned but it was not done,” ISRO chief K Radhakrishnan had told reporters last year when the matter had broken out.

Following allegations that the contract was awarded to the company without competitive bidding, ISRO had set up a committee to review the contract in November 2009, soon after Radhakrishnan had taken over as ISRO chairman from Madhavan Nair.

On the recommendations of that committee, the deal had been scrapped. Devas has gone to court against that decision and the matter is pending in court.

While deciding to scrap the deal, ISRO was also guided by the fact that strategic and societal needs of the S-band spectrum had changed radically from 2005 when the contract was signed, and therefore, it was not imprudent to hand over such a large band of spectrum to a private company.

Former head of NASSCOM Kiran Karnik, who had served as an independent member on Devas Board, had, however, strongly defended the contract. In a letter to the Prime Minister, he had lamented the fact that the government had not done enough either to defend the agreement or the reputation of ISRO.

“In terms of processes, as far as I know, this agreement went meticulously through every step… If cabinet approval was not sought for the deal, the question is whether it was at all required and whether past transponder deals with private parties has gone through any such specific Cabinet approvals,” Karnik had asked.

After the controversy broke out, Karnik resigned from the Devas Board. He had told The Indian Express that he did not have the time or the energy to spend on offering explanations, particularly to the media.

Sir, ISRO is one of the most prestigious organisations in the country. A chance to head such an organisation is an extraordinary achievement for any Scientist. It is shocking and Paradoxical that Mr. Madhavan Nair who was one of the most respected individuals in the country should have indulged in such a shameful and deceitful act. The action taken is probably too small a punishment for the heinous crime he has committed. One can only hope and pray that ISRO would never again face the ignominy of such individuals heading it
