यह अधिनियम उस व्यक्ति पर लागू होता हैं जो अनुसूचित जाति, अनुसूचित जनजाति का सदस्य नहीं हैं और इस वर्ग के सदस्यों पर अत्याचार का अपराध करता है़। अधिनियम की धारा 3 (1) के अनुसार जो कोई भी यदि वह अनुसूचित जाति, अनुसूचित जनजाति का सदस्य नही हैं और इस वर्ग के सदस्यों पर निम्नलिखित अत्याचार का अपराध करता है तो कानून वह दण्डनीय अपराध माना जायेगा-

9. किसी लोक सेवक (सरकारी कर्मचारी/ अधिकारी) को कोई झूठा या तुच्छ सूचना अथवा जानकारी देना और उसके विरूद्ध अनुसूचित जाति, अनुसूचित जनजाति के किसी सदस्य को क्षति पहुंचाने या क्षुब्ध करने के लियें ऐसें लोक सेवक उसकी विधि पूर्ण शक्ति का प्रयोग करना।

दण्ड
ऊपर वर्णित अत्याचार के अपराधों के लियें दोषी व्यक्ति को छः माह से पाँच साल तक की सजा, अर्थदण्ड (फाइन) के साथ प्रावधान हैं।

Please provide certified copies of all concern note sheet of all the concern file of DRDO Hqrs generated in connection with representation of Sh Jagdish Kumar, TO – C, DEAL, Dehradun.

Height of Nepotism

Today 10^th January 2014 at 1200 Hrs Sh R C Agarwal, Director, DEAL rushed to IRDE to have meeting with Chairman ASCODAR to influence him and his team members.

He requested to Chairman, ASCODAR to sealed Sh R K Agarwal, Scientist’H’ as Sh R K Agarwal is his blue eyed boy.

The committee was influenced to use a word “Normalization” of APAR Marks.

The aim was to create an impression that the hatred shown by Sh R K Agarwal towards Schedule Cast community is shadowed by the word “Normalization”.

However, the intention of Sh R K Agarwal and Sh R C Agarwal and their hatred towards Schedule Cast community is not over sighted.

They have to assured and submit their apology to Sh Jagdish Kumar, T O ‘C’ and his spouse because last eight months they gone through mental agony. The way Sh R K Agarwal downgraded APAR marks without mentioning a single reason. Sh Jagdish Kumar, T O ‘C’ got clear signal that in early years during 2005 to 2007 when Sh R K Agarwal his recommended authority deprived him from promotion.

It is very common in DRDO because of absolute power of DRDO Directors and his trusted men (Chamchas) ignore all laid down rules of government of India.

However, honorable supreme court taken very serious view on the irresponsible senior officials who have tried to play with the provision of Indian Constitution.

It is requested to Honorable Raksha Mantri to look into the matter and give necessary directive to SA to RM.

Anarchy in DRDO Labs

The corrupt practices of DRDO Directors have made them blind to the extents that do not respect the chain of command. Do not respect their seniors who helped them to shoulder the responsibility.

Unnecessary infighting within labs has caused lack of motivation towards self reliance.

Directors, to satisfy their ego, searches some know buried facts against an individual’s officials who were the trusted men (Chamchas) of his predecessor.

Honorable Defence Minister is requested to make specific mention in his forth coming address to DRDO Directors Conclave “Directors of 52 Labs should concentrate their energy to delvers at least 52 Import Substitutes only” rather than indulge sundry ego problems, which resulted in form of increasing legal litigations.

Director, DRDE, Gwalior Sh M P Kaushik being put the lab knew that his predecessor in year 2010 permitted the inclusion of BE degree in service book record of Sh B P Shakya, STA’B’.

Since the Sh B P Shakya, STA’B belongs to Schedule Cast category and trusted man of Sh M P Kaushik’s predecessor overlooked the DO Part order 22 dated 10^th March 2010 and served charge sheet to Sh B P Shakya, STA’B.

It is requested to S A to RM Sh Avinash Chandra as competent authority please quashed the charge sheet dated 16^th October 2013 issued by Sh M P Kaushik and give directive to Sh M P Kaushik to concentrate his energy in DRDE & DRDE development work instead of wasting the precious time and energy in his cheap ego satisfaction.

Sir there is more 100 of similar cases known to me where individuals concealed their higher qualification while time of their joining. In DRDE you will find five cases in similar nature. Have DRDO ready to open all cases?

It is again requested please give directions to your all directors to stop harassing the Schedule Cast and weaker section of society.

In above it is also observed that the CAO, DRDE also not gave his co-operation and guidance to individual to get natural justice. As a senior administrative official and moral ground he should advice to Sh M P Kaushik not to take such vindictive approach.

Similar case of harassment of Schedule Cast category has been observed in DEAL, DRDO, Dehradun. Where sh R C Agarwal, Director, DEAL, instead of delivering the product casting 100 Cr (SDR) for which DRDO has extended his service twice (unprecedentedly ) has diverted his attention to torture Schedule Cast individual Sh Jagdish Kumar T O ‘C’, who has been thrice to Antarctica and best communication man of DEAl.

Sh R C Agarwal failed in every field of his technical contribution, feels that helping his own community by out of way, in promotion, protecting them in their action of harassing Schedule Cast and weaker section.

Sh R C Agarwal in his second extension in service as Director, DEAL, he was busy with

Sh R C Agarwal support Sh R K Agarwal for his false claim of his involvement in Project ‘NARAD’ and got success to supersede more than 50 odd DRDO senior scientist

Sh R C Agarwal accepted and recommended Sh R K Agarwal’s false claim ““his main contribution has been the development of NARAD, the first semi-static and transportable terminals developed in the country. These terminals were immediately deployed in SRI LANKA during operation PAWAN where they have played a vital Role.”

By this Sh R C Agarwal has abused his power and authority and has mislead with false information to honorable Raksha Mantri and selecting committee empower to select Sceitist ‘H’ equivalent to Lt general.

Sh R K Agarwal created hatred with SC community and Sh R C Agarwal seconded his misadventure. A committee constituted by DG, Sh SS Sundaram to look in to the matter, but unfortunately committee again plan to humiliate Sh Jagdish Kumar T O ‘C’, by sending a Fax dated 6^th January 2014 vide No.78700/TIS to ask him to prepare a power point presentation on work claimed in APAR against the norms of ASCODAR.

Honorable Raksha Mantri is requested to set up a inquiry so that Schedule Cast and weaker section of DRDO should not suffer.

Constitutional crises in DRDO

DRDO comes under the Ministry of Defence, Government of India and all central government rules are applicable.

However, beginning with 1980 (prior to this DRDO was running under defence secretary) when D G (R&D) post was created and approved by cabinet with status of secretary as independent charge of R&D, foundation were laid for an autonomous & central govt. body both.

Special status was given for program director of IGMDP with permission sign 10 cr papers while directors/lab heads limitation was 2.5 Lakhs.

In the name of science & technology development, recruitments were made to develop defence specific weapons/equipments/infrastructures. A separate recruitment and assessment centre (RAC) was created with consent of UPSC and with approval of government.

The absolute empowerment of secretary DRDO gave the individual to implement his decision and with passage of time the interest of nation was over shadowed. The secretary DRDO made the entire lab directors independent and unaccountable.

Today the scenario is no system exists in DRDO, every director following their own rules, whether it is case of procurements/ recruitments / assessments / maximum time busy with construction/renovations etc.

They don’t bother new born D.Gs, DOP, RTI cell and even Secretary, DRDO. Why? Because they know after few days, Dr Avinash Chandra will be working in contract basis. No one is listening his order as well as his advice. For example, Director, Dr CP Ramanarayanan, GTRE not honoring the order of Dr Avinash Chandra, the new DG Electronics Communication System Sh. S S Sundaram also supporting the acts and deed of Director, Dr CP Ramanarayanan, GTRE (because of regionalism). Transfer case of Mr Sachin GTRE to DEAL is a clear cut example of environment of DRDO; the words uttered by Dr. CP Ramanarayanan are resonating in the ears of all top DRDO Hqrs officials.

Dr Avinash Chandra told a scientist that your request is genuine but I am helpless. The scientist got transfer order one and half year back but the because of the dictatorship of Director, LRDE, Sh S Ravind the transfer is still pending and our Dr Avinash Chandra, SA, Dr G Malakondaiah, DS & CC R&D (HR & M), and DOP, Dr A K Singh all are helpless. Although Dr G Malakondaiah talked in front of the individual scientist with Sh S S Sundaram (conversation was in Telegu) but it did not turn positive.

Surprisingly, the aim and objective of Rama Rao committee was that the power is decentralized for fast decision on procurement issues, management issues. This would give boost for high productivity or pace in development program. It is looking like a total failure in the beginning itself.

Instead of all this all new DG are too busy to manage big chunks of funds and showing off the power of their new kingdom.

DRDO labs directors, mostly known as distinguished or outstanding scientists but it is astonishing fact that most them are not known in India because they have never published any outstanding paper, not have any patents, if PhD then from deemed universities where they are suppose to feed project funds. Like their big guru Dr W Selvamurthy Ex C C R&D, who is PhD in Yoga and involved in feeding funds to various deemed universities or private institutions. (Famous SASTRA case everyone knows). Rest are following their footsteps like Sh S S Sundaram, new born DG, Sh RC Agarwal, Director, DEAL (2^nd extension age 63+ yrs), Sh R K Agarwal another outstanding scientist now start pursuing PhD from Graphic Era, also new born Deemed University at Dehardun because they fed funds in the name of projects and their agents ex DRDO employees are managing the show.

A constitutional crisis was the appointment of RAC Chairman. Dr PS Goel was appointed for period 3^rd December 2008 – 2^nd December 2011. As per rule search committee for next RAC chairman was supposed to be constituted in June 2011. However, minutes (DOP/05/50219/M/01 7^th Dec 2011 disclose that first meeting of newly constituted committee was scheduled for 19 December 2011, it is astonishing fact that DRDO writes its own constitution and shows disrespect to Honorable Raksha Mantri.

Negligence of then SA to RM, not to initiate search committee in time was a planned action. He wanted to push all his close aides to appropriate place/post, who were handling sub contracts signed with foreign firms with different areas and were responsible omission/commission dues. The period of Dec 2011 to June 2012 was the crucial period of assessment/recommendations/selections/promotions. To cash this opportunity Dr V K Saraswat as chairman RAC recommended those who were not competent for the post of ‘H’. Had there been an independent RAC Chairman, he would kept the national interest in forefront. The example of the case of Sh R K Agarwal, Scientist ‘H’ at DEAL, DRDO, Dehradun, who prepared citation for promotion with a false claim (Copy of his claim) attached and got promoted with the blessing of Sh R C Agarwal, Director, DEAL (2^nd extension without any achievement) and Dr V K Saraswat.

The letter no 12/7/2012 EO(SM-II) dated 19^th March 2012 of DOPT revealed that appointment of

as RAC chairman was approved by Appointment Committee of Cabinet (ACC). The question is why it was waited up to June 19^th, 2012; time was buying to adjust all incompetent senior officials by Dr V K Saraswat.

It is requested to Sh A K Antony, honorable Raksha Mantri order for investigation of assessment year 2012 scientist ‘H’.

Sh. R K Agarwal, Scientist ‘H’, (Out Standing Scientist ) Defence Electronics Application Lab, DRDO, Dehradun was promoted wef 1^st July 2012.

In DRDO Newsletter September 2012 page No -14. In which the details of Outstanding Scientists of the DRDO.Sh, R K Agarwal, Outstanding Scientist, DEAL “his main contribution has been the development of NARAD, the first semi-static and transportable terminals developed in the country. These terminals were immediately deployed in SRI LANKA during operation PAWAN where they have played a vital Role.”

Sh. R K Agarwal claimed false that he worked and contributed in “Project NARAD”, which was the only real-time successful project and was appreciated by user (IPKF).

Sh. R K Agarwal claimed the aforementioned for his promotion to outstanding scientist and it was published in DRDO’s News Letter September 2012 page No -14 (Copy enclosed)

Departmental Part Order for manpower for Project NARAD reference are DO Part-I No.232/AD dated 18/11/1988 and DO Part-I No.238/AD, No.239/AD dated 24/11/1988. There was clear cut mention in the order that Sh. R K Agarwal was not part and parcel of Project NARAD.

The appreciation letter No 35795/Aks/per date 20th April 1990 by Major A K Singh, 57 Mtn Div. Signal Regiment to ShSurendra Pal, Dy. Director, Project NARAD clearly reveals the names of DEAL’s scientists who participated and contributed their best in the real operation scenario. There is no name of Sh. R.K Agarwal in the appreciation letter.

The DRDO in their RTI reply No.DEAL/RTI/0003/2013 dated 08/04/2013 clearly mentioned that No such document/information is available, means there is nothing available which proves that Sh R K Agarwal was part and parcel of Project ‘NARAD’. It is clear evidence that Sh RC Aggarwal supported Sh R K Agarwal’s false claim for promotion to outstanding scientist because of the only reason of nepotism and castism. (Copy enclosed)

RTI request sent to DoPT and DoPT furnished partly information which is also mark as confidential, but after result it was a open document.(Copy Enclosed)
DoPT transferred my RTI request to Ministry of Defence for rest information vide their letter no F.No/29/38/2013-EOSM-II Dated 15^th July 2013.

Subsequently RTI Cell, DRDO transferred to CPIO,RAC, DRDO vide RTI/01/2091/P/2013/0178 dated 10^th July 2013
Subsequently CPIO,RAC, DRDO informed me vide letter no RAC/03/RTI/95/2013 Dated 1^st August 2013 that my application sent back to RTI Cell, DRDO for further action. (Copy enclosed)
Unexpectedly I have received 6^th September 2013 a letter from CPIO,DEAL, Dehardun stated that they received a letter from CPIO,RAC, DRDO on 20^th August 2013 (no letter no reference) stated that the information (Biodata) of Sh R K Agarwal marked as confidential, hence it cannot be disclosed (copy enclosed)
As Sh R K Agarwal worked in DEAL in various projects and “only those project are classified as secret/confidential which have been sanction under staff project (ARMY/Air force/Navy/ Services Branch, the rest of the project sanctioned to DRDO comes under R&D Projects.

Sh R K Agarwal himself quote in DRDO News Letter (September 2012) that he was associated with Project “NARAD” his claim was totally false and supported by Sh R C Agarwal, Director, DEAL for his promotion to Scientist ‘H’ and this act come under corruption. (“Whoever does anything with the intention of causing wrongful gain to one person or wrongful loss to another is said to do that thing dishonesty”)

Corruption – Giving or obtaining advantage through means which are illegitimate, immoral, and/or inconsistent with one’s duty or the rights of others. Corruption often results from patronage)

viii. DRDO is protecting Sh R K Agarwal for his false claim and to stop this corrupt practice in DRDO, it is very well require exposing false claims especially in R&D atmosphere because these practices demoralize young scientists. As CPIO, DEAL already committed in one RTI reply no information and document evidence is available in DEAL regarding Sh R K Agarwal’s claim.

6. Prayer /relief sought for:-

Information sought vide RTI Application dated 28^th May 2013 by appellant has been denied on false and invalid reasons by CPIO, DEAL,Dehradun. Therefore, appellant kindly prays to FAA, DRDO to allow this appeal and issue instructions/orders to CPIO,DEAL, Dehradun to provide the information sought as seek by appellant vide his RTI Application dated 28^th May 2013 (Copy Enclosed)

7. Grounds for prayer/relief sought for:-

1. CIC decisions on notified organisations under Schedule II of RTI Act 2005 like DRDO

(i) CIC in its various decisions consistently held that Establishment Matters relating to the organization notified u/s 24 of the RTI Act come within the purview of the Act and information in this regard thereto are not exempted from disclosure.

(ii) CIC in its various decisions clarified that the exemption u/s 24(1) for DRDO (notified organisation under Schedule II) is only for Scientific/Technical/Strategic/national security information and not for the information of General nature/Estt. Matters/ Routine Correspondence/ all other information for which exemptions u/s 24(1) are not allowed.

(iii) These decisions of CIC are binding on all notified organisation under Schedule II, as these decisions of CIC has not been challenged till date in any court.

“(iv) The Peer Committee as specified in Schedule ID shall assess suitability for appointment of Scientist ‘H’, Outstanding Scientist in Defence Research and Development Service”.

In DRDO Newsletter September 2012 page No -14. In which the details of Outstanding Scientists of the DRDO. Sh, R K Agarwal, Outstanding Scientist, DEAL “ his main contribution has been the development of NARAD, the first semi-static and transportable terminals developed in the country. These terminals were immediately deployed in SRI LANKA during operation PAWAN where they have played a vital Role.”

Sh. R K Agarwal claimed false that he worked and contributed in “Project NARAD”, which was the only real-time successful project and was appreciated by user (IPKF).

Sh. R K Agarwal claimed the aforementioned for his promotion to outstanding scientist and it was published in DRDO’s News Letter September 2012 page No -14 (Copy enclosed)

The appreciation letter No 35795/Aks/per date 20th April 1990 by Major A K Singh, 57 Mtn Div. Signal Regiment to Sh Surendra Pal, Dy. Director, Project NARAD clearly reveals the names of DEAL’s scientists who participated and contributed their best in the real operation scenario. There is no name of Sh. R.K Agarwal in the appreciation letter.

Sir,

My RTI application to CPIO, DoPT dated 27^th May 2013 was transferred to Shri Rajiv Singh, CPIO, & Under Secretary, MoD, South Block vide letter no AB14017/4/2013-Estt (RR)(03074/RTIC/13) dated 28/6/2013. The CPIO, MoD transferred my RTI request to CPIO, DRDO vide letter no Mof D ID No 21(3)2013(1083)/D(RTI) dated 5/7/2013.

Subsequently I have received information of my RTI request point 2 from DoPT vide their letter no F.No.29/38/2013-EO(SM-II) dated 15^th July 2013.

The CPIO, DRDO Hq transferred my RTI request vide letter No. RTI/01/2091/P/2013/0178 dated 18^th July 2013 to your office for information of point 1 of my RTI request.

As per my previous experiences regarding RTI requests all DRDO establishments 99% replied with their fix quote –

“DRDO is an organisation which is placed in Second Schedule of RTI Act 2005 and is therefore, exempted from disclosures of information under Section 24(1) except information pertaining to the allegations of corruption and human rights violations.”

Therefore, it is requested that the information is pertaining to the allegations of corruption. Sh R K Agarwal’s promotion case is totally based on corruption & nepotism.

I would like to submit some evidences of nepotism of Sh. R. C. Aggarwal, Director, DEAL, DRDO.

Sh. R. C. Aggarwal after taking charge as Director, DEAL put all scientists/staff of his community in important positions. You can verify with Departmental Part orders.
He supported Sh. R K Agarwal for his false claim of work in “Project NARAD”, which was the only real-time successful project and was appreciated by user (IPKF).

Departmental Part Order for manpower for Project NARAD reference are DO Part-I No.232/AD dated 18/11/1988 and DO Part-I No.238/AD, No.239/AD dated 24/11/1988. There was clear cut mention in the order that Sh. R K Agarwal was not part and parcel of Project NARAD.

As you already very well aware that DRDO is in neck deep nepotism and corruption and we all welcome your latest decisions like suspension of Dr. Arun Kumar, not giving nod for further extension to Dr. V. K. Sarswat, order for special audit to CGDA, etc.

Sir, your commitment for honesty and stride for eradication of corruption and nepotism specially in defence sector, we salute your honest efforts and we are trying to contribute some authentic information related to nepotism and corruptions prevailing in DRDO from time to time to strengthen your mission.

In this series I would like to submit some documentary evidences of nepotism of Sh. R. C. Aggarwal, Director, DEAL, DRDO.

Sh R.K.Agarwal already created an embarrassing situation for you due to his personal bias towards Schedule Cast when he deliberately cut the APAR numbers of a Technical Officer ‘C’. The victim has already represented this to Director, DEAL on 11^th April 2013. But the best part is that DEAL management threatened and focused all their lethal weapons to fix him. And soon you will get this matter from SC/ST committee.

Sir, this nepotism and corruption is in the peak and this is also a right time for you to select a dynamic personality who can first tackle this neck deep nepotism and corruption of DRDO.

Sir, you are giving answering regarding exodus of DRDO scientists to our honorable parliamentarian since last 7-8 years and quoting that the senior scientists E, F, G are not quitting. But you are not aware that by seeing this honoring of incompetent scientists due to nepotism the junior scientists imagine their future and quit for better future.

Second major point is the senior scientists who were/are super seeded by these incompetent scientists are suffering from, blood pressure, heart problems and depressions. Ask health report of senior scientists.

Sir, can we expect any miracle research from these bunch of halfhearted and blood pressure, heart problems and depressions patients? Not at all.

Sir, you can find some scientist ‘G’ age of 38/40/42 etc. but they achieved this due nepotism if it is not true than how many get international recognition of their research work.

Once again it is requested to see this personally in the interest of DRDO as well as in the interest of nation.

Number of technical papers published as first author on design aspects of SATCOM systems by Sh R K Agarwal in various publications? Provide the name of Journals /year/page no of publications and issues/ volume numbers.
On “Throughput Acceleration Satellite Adaptation Unit (SAU)” and the role and contribution of Sh R K Agarwal in its patent filing. –
