Sir, I’m disappointed with the reply of CPIO Air HQ. I hereby submit first appeal under Section 19 of RTI Act, 2005.

  1. Facts leading to appeal:

An application under Section 6(1) of RTI Act 2005 dated 3 May 2019 was submitted to CPIO Air Hq sought information on IACCS project executed by costing approx 7900 Cr as new series posted in various media regarding scam in IACCS project. Being a senior citizen and tax payer I have request for some facts which are not in nature of any strategic information. It is hard to believe that CPIO not denial nor gave requested information judiciously, send reply without application of mind. Copy of RTI application is attached as Enclosure-1.

2. Particulars of Decision/Order of CPIO against which appeal:-

Request information in Para 3 is not provide by CPIO Air Hq and mentioned – not held with this Public Authority, the IACCS directorate in same building and as per RTI act CPIO has to transfer under section 6 (3) of the RTI Act 2005 to concern  CPIO of Air Hq  who is responsible for  IACCS Directorate.

Request information in Para 4 is not provide by CPIO Air Hq quoted that “not held with this Public Authority”, But CPIO has to transfer under section 6 (3) of the RTI Act 2005 to concern  CPIO of Air Hq  who is responsible for  IACCS Directorate

Request information in Para 7 the CPIO, Air Hq not even denied or mention that information is not available with him, just ignored. Here a big question arise that the vision of RTI Act 2005 is to restrict the corrupt practices prevailing in the system should be checked by citizen of India. The CPIO act clearly shows that he want protect these corrupt practices running in Air force, because  in Para  8 also CPIO even not mention any word just ignored the request of information.

The act of CPIO to ignore the request of Para 7 & 8 shows that CPIO, Air Hq does not believe the constitutional provision of India. The request of information from common citizen is nothing to CPIO, but CPIO want to save culprits..

3. Facts & Grounds leading to appeal:-

the information requested are purely related to corruption and for to take corrective measures to restrict prevailing corruption in defence sector which is very highly dangerous to our national security. Compromising with quality and quantity and encouraging the false documents in procurement and execution in such important project is not anyway appreciable by common country man.

Information not providing vide Para 7 & 8 itself prove that official sitting on seat are not thinking of our future Air Force officials who will going to work their duties in IAACS project centers, basically they are playing with the life of children may be some   present Air Force official’s sons or daughters who wishes to join Air Force like their father.

The CVO reports shows that Air force deputed in these palaces not allowed the senior vigilance officer to visit site and other way they allowed to any tom dick harry of L&T subletting contractor to roam around. Secondly in IACCS Directorate are co-operting BEL corrupt offices in big way.

4, Prayer /relief sought for:-

Information sought vides RTI Application dated 03.05. 2019 by appellant has been not provided properly it is incomplete information given by CPIO, Air Hq. Therefore, appellant kindly prays to FAA, Air Hq to allow this appeal and issue instructions/orders to CPIO, Air HQ  to provide the information sought as seek by appellant vide his RTI Application dated 03 05 2019. Hope FAA will prove that FAA  with “Nabha Sprsham Deeptam” not with corrupt officials who are busy with minting money and compromising with national security and also playing with life of our future Air Force aspirants.

NEW DELHI: The end of Section 66A, the controversial law that allowed arrests for offensive content online, marks a big victory for Shreya Singhal, the young law student who was among the first to challenge it in the Supreme Court.

“I am ecstatic. It was grossly offensive to our rights, our freedom of speech and expression and today the Supreme Court has upheld that,” Shreya told NDTV moments after the court scrapped the law, agreeing that it is unconstitutional and violates the rights of citizens.

“Nobody should have fear of putting up something because of the fear of going to prison. The court has upheld the rights of all citizens today,” she added.

Shreya comes from a family of lawyers; her mother is a Supreme Court lawyer and her grandmother was a judge.

She was 21 when she filed a petition in 2012, after two young women were arrested for posting comments critical of the total shutdown in Mumbai after the death of Bal Thackeray, the Shiv Sena chief.

Shreya says her family encouraged her. “I am also a law student so through my studies also I knew that you can approach the Supreme Court directly,” she said, aware that she has achieved, even before becoming a lawyer, what many veterans in the profession haven’t.

She spent three years studying astrophysics in the UK before returning to India to apply to law schools. Her attention was drawn to several high-profile arrests of people under Section 66A.

“It is being misused by BJP governments, Congress governments… all over the country. Even when the Congress was in power, it was being misused. Governments have their own political agenda; a law has to be for the people,” Shreya said.

The court today had strong words in support of that sentiment as it said, “Governments come and go. We can’t act on assurance that Section 66A will not be misused.”

With above referenced letters kindly provide me the following information requested under the purview of the Right to Information, RTI Act, 2005 in respect of complaints against Dr. Arvind Kumar Saxena, Director, DMSRDE, Kanpur

  1. I have submitted 12 complaints on allegations of corruption against Dr. AK Saxena, Director, DMSRDE. [List Enclosed]
  2. Two FFICs were constituted by Sri Avinash Chander, DG, DRDO to inquire the complaints against Dr. A.K. Saxena.
  3. The three member first Fact Finding Inquiry Committee (FFIC) constituted by Sri Avinash Chander was consisted of  Chairman as Sri S.S. Negi, Scientist ‘H’ , Sri Manoj Bali, Scientist ‘G’ and Sri Jagdeep, Scientist ‘F’. First Fact Finding Inquiry Committee visited DMSRDE, Kanpur on 13th – 14th, and March 2014 for inquiry on the complaints submitted by me against Dr. A.K. Saxena.
  4. Sri Avinash Chander again set up four membered second Fact Finding Inquiry Committee. The second FFIC was constituted under chairmanship of Dr. D.C. Pandey, Scientist ‘H’ and three members Sri Hari Babu Srivastava, Scientist ‘G’, Sri Jagdeep, Scientist ‘F’ and Sri R.S. Mehta, Joint Director. The said committee visited DMSRDE, Kanpur on 9-10 July 2014.
  5. It is also observed that few order cancelled for which complaint was submitted, it is perfect evidence that FFIC found some manipulations in procurements.

Two top DRDO scientists awarded jail term by Madras high court for contempt of court

CHENNAI: While the science community behind Mangalyaan’s success is still basking in glory, the Madras high court on Thursday awarded a three-week jail term to the nation’s two top scientists for contempt of court. The court also imposed a fine on them and directed the Centre to initiate stringent action against the duo.

V K Saraswat, scientific adviser to the minister of defence and director general of research & development, DRDO, and G Malakondaiah, director of Defence Metallurgical Research Laboratory (DMRL) in Hyderabad, have to surrender to police in a week and start their three-week jail stint. If they fail to do so, an arrest warrant shall be issued to get them under custody, ruled an irate division bench of the high court.

“The government is directed to take appropriate departmental action against them for the reckless negligence and wilful disobedience of the orders of this court,” said the bench of Justice S Rajeswaran and Justice P N Prakash on Thursday.

The two DRDO officers were found guilty of civil contempt under Section 12 of the Contempt of Courts Act, 1971. They were sentenced to a simple imprisonment for three weeks and directed to pay a fine of Rs 2,000 each.

“We are aware that they are occupying very high positions in the government, but ensconced in a pedestal, their vision became blurred when it came to the travails of an ordinary employee who was suddenly thrown out of employment, for no fault of his. Even during the course of the contempt proceedings, there was no tinge of remorse or an attempt to correct the mistake,” the court said.

On August 13, 1985, Joseph Raj was appointed clerk-cum-store keeper initially on an ad hoc basis in the Combat Vehicles Research and Development Establishment (CVRDE) under the ministry of defence. He acquired his B.Com and master of library and information science degrees later, and when a librarian post fell vacant in the school, he was selected on merits. CVRDE School, started at Avadi here in 1978, was sought to be closed in 2001 and staff members were issued termination notices.

Since then, Joseph Raj won several rounds of litigations in the administrative tribunal, the high court and then in the Supreme Court as well. As he was not reinstated or given job in another unit, he then filed the present contempt of court proceedings, pointing out that the authorities had misled even the apex court.

Narrating the travails of Joseph Raj in detail and convinced that the two officers had done everything to deny him employment for more than a decade, the judges directed the Centre to give a job to Joseph Raj according to the 2004 judgment that favoured him.

It also rapped the two top DRDO officers quoting the Supreme Court’s words: “Non-acceptance of a mistake is not a heroic deed. On the contrary, it reflects flawed devotion to obstinacy. The pink of perfection really blossoms in acceptance.”

The project headed by Roy, a scientist at DRDO’s explosives lab in Pune, led to the creation of Explosive Detection Kit (EDK), which makes it easy to detect all kinds of explosive, especially those used by terrorists.
The kit was launched in Washington on Friday for production and sale in the US and other countries in the region, by Crowe and Company, a South Carolina firm.
It is currently undergoing tests by US military and other security agencies but may soon be headed for use by coalition forces in Afghanistan through a non-profit.

“It feels great,” said Roy after the launch with her boss SN Asthana, a man of few words, standing by her side.
Roy got the project “around 1997” with a brief to develop something to stop terrorists. But it was not a priority, not like DRDO’s more glamorous Agni, Arjun and the LCA projects.

(Patent Application: 0123/Del/2005 A, Filling date: 19-01-2005 Publication date: 10-11-2006) 30 number of Ships have been fitted with this Device.   1. Provide the present status of this patent application no 0123/Del/2005 filed by DRDO.

Note: the requested information is not come under exemption of schedule –II of RTI Act 2005. Since, March 2014 end DRDO stopped to provide information under shadow of exemption. Section 177 in IPC Furnishing false information. Whoever, being legally bound to furnish information on any subject to any public servant, as such, furnishes, as true, information on the subject which he knows or has reason to believe to be false, shall be punished with simple imprisonment for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both. So  before denial of information your point wise explanation is required that the matter not pertain under corruption.

Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of audit of service books of DRDO officials. It is observed that several DRDO officials were acquired Diploma, Degree after joining DRDO from various deemed universities  via distance education mode etc  and most of the cases the courses are not recognised by APEX body like  AICTE,DEC etc  in RTI replies DRDO also accepted this facts.   It is also observed that the individuals who received such diploma/ degrees were also received lump sum incentive grants for acquiring higher qualification as per DOPT OM No. 1/2/89-Estt Pay-I dated 9.4.99 but their respective acquired qualifications were not duly verified by DRDO

DRDO Having Blind RTI Cell

DRDO RTI Cell is acting as a blind body. Since RTI Act, 2005’s implementation, DRDO felt its power  and put all efforts to  get rid off but success was partial, Schedule – II exemption did not include the corruption and Human rights allegations and subsequently CIC also gave guidelines that, day to day administration and management matters are also not exempted.

This CIC supports give honest officials and citizen an immense power to fight against neck deep corruption/nepotism/favoritism prevailing in DRDO.

Cases started to expose the corrupt practice of senior DRDO officials in various matters like recruitment/promotions/procurements, etc and action started against corrupt officials by Defence Minister, CVO, CVC, etc

The DRDO management now come under desperation and looking after to fix those who are trying to expose the corrupt senior officers, few terminated/dismissed, few transferred, few deprived with promotions, a message was passed among the DRDO officials/employees, that if any one seeks RTI, he should be ready to face consequences and it is established that facts that DRDO management extensively used unwritten policy not give promotions or due credits to those who are involved in RTI acts practices.

It is a clear cut message to the nation that DRDO top management is a dishonest corrupt and  not working in the interest of the nation because it is not committed towards the constitution of India.

On 8th March 2014, Dr. R B Sharma, CPIO, DRDO Hqrs acted as a super boss and sent a letter to all Labs/ Establishments of DRDO to not give any information under RTI Act, 2005.

On 28th May, 2005 a meeting was held under DRDO transparency officer Dr. Sudershan Kumar, DS and CC R&D (PC & SI). In that he told to all DRDO’s CPIO not to supply any information under RTI Act-2005. It can be verified by records of DRDO’s RTI cell that no information was passed after this decision to any RTI applicant.

 That all RTI applicants receiving reply in the same format which was supplied by DRDO RTI Cell and First appellate authority reply was also given by DRDO in same format.

Surprisingly the following case of Dr. R G Taware, Ex- Technical Officer ‘B’ was to show the blind act of DRDO’s RTI cell.

Dr. R G Taware, Ex- Technical Officer ‘B’ was illegally dismissed by DRDO management with conspiracy. The conspiracy was proved by single point DRDO used then RRM, Sh Palam Raju for suspension and after dismissal and material fact is that RRM, Sh Palam Raju nor has the power for such approval, because as per Ministry of Defence orders of power delegation by Defence Minster shows he has never delegated such powers to RRM, Sh. Palam Raju specially for DRDO.

Dr. R G Taware, Ex- Technical Officer ‘B’ suspension /dismissal orders one of major allegation was “The tone and tenor of letter of Dr. R G Taware dated 26 Aug 2009”

Dr. R G Taware send an RTI request to CPIO, HEMRL, Pune, information sought that DRDO scientists developed a machine which can measure “The tone and tenor of any letter”, he asked whether scientist got any award and promotions for this great innovation.

The Blind DRDO RTI cell replied in a standard format “ You hereby inform that DRDO is placed in second schedule of RTI Act and exempted from disclosure of Information under Section 24 (1) exceptpertaining to the allegation of corruption and human right violations”( copy enclosed)

 Further after getting above reply from BLIND DRDO RTI Cell, Dr. R G Taware sent first appeal to FAA, DRDO to check their IQ.

Interestingly the height of blindness of DRDO RTI cell or to hell with RTI same standard reply send by FAA on the issue that “You hereby inform that DRDO is placed in second schedule of RTI Act and exempted from disclosure of Information under Section 24 (1) exceptpertaining to the allegation of corruption and human right violations”  (copy enclosed)

Great DRDO RTI cell proved their scientific capability in this RTI application replies – can the common Indian believe these DRDO scientists caliber for defence preparedness ??????????????

Kindly provide me with the following information requested under the purview of the Right to Information (RTI) Act, 2005 in respect of sanction a project of Rs 288.oo Lakhs to Prof V R Reddy, CR Rao Advanced Institute of Mathematics, Statistics and Computer Science,(AIMSCS) Hyderabad (a Society) for Project titled NIMO Radar- Spatial Diversity, Spatial Resolution and Transmitter Waveform in Target Detection, Resolution and Identification. The projection sanction by Dr V K Saraswat, Ex-DG, DRDO

  1. Total money released to AIMSCS Society, Hyderabad by DRDO
  2. Present status of project it is delivered (Yes or No)
  3. If not than DRDO has initiated to recover funds from  AIMSCS Society, Hyderabad (Yes or No)
  4. Copy of financial expenditure details submitted by AIMSCS Society, Hyderabad

Note : Matter is directly related to corruption and not exempted under Section 24 (1), as  Dr V K Saraswat, Ex-DG, DRDO happened to be the president of AIMSCS Society governing body. Hence, without prejudice to the correctness of the decision relating to this Grant-in-Aid, it was against the canons of financial propriety for SA to RM to have sanctioned grants to a society headed by him. Release of advance payment to the society even for salary in respect of non-existent manpower blocks government funds and provides an opportunity to private society to earn interest income. DRDO was hired a consultant and the consultant is also planning to hire consultant. CGDA special audit also raised serious objection on this matter.
