Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of rules position to use army manpower deputed to DRDO for various assignments. It is observed that in DRDO scientists and services officers are using army jawans for their personal service, like cleaning private vehicles, using as driver in their personal cars in office hours and after office hours even in holidays. In VRDE, DRDO, Ahemadnagar Lt Col Praveen Kumar utilizing army manpower Sh Vaidya Mahesh in his personal service. The enclosed pictures are self explanatory.
Please find some pictures of Army jawans performing duty for private vehicles of Dr DP Singh Scientist, EMU, DRDO Dehradun engaged a private Scorpio in contract since few years. The vehicle is fully painted with Bharat Sarkar, Raksha Mantralay, EMU, DRDO etc.
Please provide the rules position for utilizing army jawans for personal works by services officers deputed to DRDO and DRDO scientists.
Whether it is allowed by Indian army (Yes/No)
Any disciplinary action can be initiate by competent authority if it is come under misutilization of army jawans or other ranks (Yes/No)
If yes then in case of services officers deputed in DRDO who will the competent authority.
If yes then in case of DRDO scientists who will the competent authority.

15 January 2015: Prime Minister Narendra Modi (was seen in a photo published by Press Information Bureau -PIB) received a cheque of Rs100 crore from Defence Minister Manohar Parrikar and Army Chief General Dalbir Singh towards Prime Minister’s Relief Fund on the 67th Army Day. Interestingly, the photograph when enlarged by us shows that it was a mock cheque handed over by the Army Chief. It has no amount mentioned. Instead, it says, “One day’s pay of all ranks of Indian Army”.
So what happened to the donation? Was the money donated? Was it collected from Army officers and soldiers and handed over to the PM Relief Fund?
20 March 2015: A reply received Right to Information (RTI) Act says the Army has yet to donate Rs100 crore toward the PM Relief Fund!
According to a PIB release on 15 January 2015, the Indian Army donated Rs100 crore and the amount was raised by officers and soldiers donating a day’s salary each. The cheque of Rs100 crore was handed over to PM Modi by General Dalbir Singh at the traditional ‘At Home’ at Army House on the 67th Army Day.
Dehradun-based Prabhu Dandriyal filed an RTI seeking details about the Rs100 crore donation given by the Army to PM Relief Fund. On 20 March 2015, he received a reply from the RTI Cell of the Army.
The reply sent by Lt Col Rajiv Guleria for Central Public Information Officer (CPIO) of Indian Army says, “It has been intimated by concerned agency that no amount on account of contributions from salary of any Army personnel has yet been donated to the Prime Minister Relief Fund. The matter is under consideration.”
Therefore, the question remains as to whether the PM Relief Fund received Rs100 crore donation by Army or no. There could be three possible scenarios. One, the donation was given, but someone may have forgotten to collect/deposit the actual cheque. Second, the PIO from Army not have received correct information and hence gave incorrect information. Three, the PIO may have given wrong or misleading information.
According to Shailesh Gandhi, former Central Information Commissioner and RTI activist, it is impossible for the PIO to provide misleading or wrong information. “However, the PIO may not have realised the impact of this information,” he said.

Hon’ble Sir,
Human Resource is an asset of an organisation and proper utilisation and deployment of its HR/Manpower is challenging job for an organisation especially on DRDO which holding very significant responsibility for the nation. In the past several years DRDO cannot meet its target well within time and seeking extensions in PDC again & again in several major projects of national significance. This drawback of DRDO has been noticed by Hon’ble Ex-PM Dr. Manmohan Singh, Ex- Defence Minister Shri A.K. Antony, CAG, CGDA, Parliamentary Standing Committee on Defence (15th Lok Sabha). This has been also noticed and criticised by you in DRDO Award Function on 20th August 2014 by saying “Chalta Hai wala attitude nahin chalega“.
Poor HR planning and deployment of scientists in various Lab/Estt of DRDO is major reason for not delivering the products and timely completion of project. Almost each and every lab/Estt all sundry work (Admin/Stores/Security/MTO/Library/works/ conservancy etc) are managed by qualified scientist and technical officials (more than 15% of total strength of DRDO) Simultaneously they are drawing all perks which is provided towards incentive in the name of scientific encouragement and also enjoying flexible complementary scheme on promotions which is also strictly for those who dedicatedly involve in scientific and technical assignments.
HR of DRDO comes under CCR&D (HR) which consisted of DOP, DHRD, RAC, CEPTAM, DESIDOC, ITM, MILIT, DIAT, DPI and RTI Cell. Presently Dr. G. Malakondiah, Distinguished Scientist is holding the charge of CCR&D (HR) and he was convicted by Madras High Court for imprisonment of three weeks in case of contempt of court this the highest example of ignorance of constitutions provision.
One such example of poor HR planning of DRDO is of Dr. A.K. Singh, Director, Directorate of Personnel, DRDO HQ, New Delhi. Dr. A.K.Singh, Scientist ‘G’ is great Nuclear Medicine scientist of India with five patents granted, fourteen patents filed, one copy right and more than fifty publications in international & national journals.Bio-Data of Dr. A.K. Singh is annexed.
As a matter of fact, despite having so many scientific contributions in area of Nuclear Medicines which is primarily used for treatment of cancer, brain tumours and complex diseases.
Dr. A.K. Singh was basically recruited for projects of DRDO in its New Delhi based unique laboratory working in Nuclear Medicine, Institute of Nuclear Medicine and Allied Sciences (INMAS). He worked in INMAS till the year 2004 but all of sudden he was transferred in DRDO HQ and assigned non-technical clerical assignments like Staff Officer to CCR&D.
Since the year 2004, the great Nuclear Medicine scientist is working non-scientific work like Director, CEPTAM, Director, DHRD and presently DOP. The work assigned to Dr. A.K. Singh is of administrative nature for which DRDO is having it’s another HR cadre known as administrative cadre and from this cadre manpower should be appointed in DOP.
Being a bonafide life science scientist, Dr. A.K. Singh, DOP not having any expertise in field of HR, therefore, he made several wrong decisions due to which DRDO faces lot of embarrassment and bad fame in media, it also affected various officials of DRDO who are facing several court cases in various courts all over India, even 15th October 2014 he received notice from CAT Delhi for his misadventure towards a senior scientist who belong to minority. This created lot of expenditure in term of fees to lawyers, TA/DA to attend court cases and cause of derailing scientific research tempo of DRDO.
Government of India is paying more than Rupees twenty lakhs to Dr. A.K. Singh, DOP for his non-productive and non-scientific work that can be carried out by any of the officer of Joint Director/Additional Director of DRDO from the admin cadre. DRDO wasting poor tax payers money.
Dr. A.K. Sigh is great Nuclear Medicine Scientist which is rare in DRDO. The discipline of Dr. A.K. Singh is from Life Sciences so proper utilization of his potential to posted him in Laboratory/ Establishment of DRDO under Life Sciences Cluster so he can contribute more in the national interest.
There are nine (09) Lab/Estt under Life Sciences Cluster of DRDO spread over all India. These are DEBEL, DIPAS, DIPR, INMAS, DRL, DIBER, DFRL, DIHAR & DRDE. Life sciences scientists are 120+ out of 7500 total DRDO scientist’s strength so proper utilization of these 9 labs can only possible when all life science scientists dedicatedly posted in Life Sciences Cluster of DRDO not in HR related Corporate Directorate. Dr A K Singh qualified life science scientist but he convert his field into technical services in the official records while as per his biodata he is fit for life sciences activities.
Sir you know the maxim “wrong shoe in right leg- “. Similar is the case of Dr. A.K. Singh who has been wrongly posted in HR assignments of DRDO while he is great Nuclear Medicine scientist with international fame scientific contributions in Nuclear Medicine. He is very much required in Lab/Estt of DRDO that are working in specialization of Dr. A.K. Singh like Defence Research Laboratory, Tezpur, Defence Research & Development Establishment, Gwalior, DEBEL, Bangalore and INMAS, New Delhi. Since Dr. A.K. Singh had already worked in INMAS, New Delhi for more than 16 years and his experience was bitter at INMAS thereby he was expelled from projects and scientific assignments at INMAS, New Delhi. Therefore the ,most suitable work places for getting output from his scientific knowledge and experience is DRL, Tezpur, DRDE, Gwalior and DEBEL, Bangalore.
Keeping in view of the facts stated above, to save public revenue and streamline HR of DRDO, it is very much required that scientists of the DRDO having educational qualification and experiences in life sciences should be posted in Lab/Estt under Life Sciences Cluster of DRDO.
Therefore I kindly and earnestly request you to start “operation clean- Swachta Abhiyan” in DRDO by transferring Dr. A.K. Singh, DOP from DRDO HQ to any of the Life Sciences Cluster Lab/Estt like DRL, Tezpur, DRDE, Gwalior or DEBEL, Bangalore so that poor & dirty HR of DRDO may be rich & clean.
DRDO RTI Cell is acting as a blind body. Since RTI Act, 2005’s implementation, DRDO felt its power and put all efforts to get rid off but success was partial, Schedule – II exemption did not include the corruption and Human rights allegations and subsequently CIC also gave guidelines that, day to day administration and management matters are also not exempted.
This CIC supports give honest officials and citizen an immense power to fight against neck deep corruption/nepotism/favoritism prevailing in DRDO.
Cases started to expose the corrupt practice of senior DRDO officials in various matters like recruitment/promotions/procurements, etc and action started against corrupt officials by Defence Minister, CVO, CVC, etc
The DRDO management now come under desperation and looking after to fix those who are trying to expose the corrupt senior officers, few terminated/dismissed, few transferred, few deprived with promotions, a message was passed among the DRDO officials/employees, that if any one seeks RTI, he should be ready to face consequences and it is established that facts that DRDO management extensively used unwritten policy not give promotions or due credits to those who are involved in RTI acts practices.
It is a clear cut message to the nation that DRDO top management is a dishonest corrupt and not working in the interest of the nation because it is not committed towards the constitution of India.
On 8th March 2014, Dr. R B Sharma, CPIO, DRDO Hqrs acted as a super boss and sent a letter to all Labs/ Establishments of DRDO to not give any information under RTI Act, 2005.
On 28thMay, 2005 a meeting was held under DRDO transparency officer Dr. Sudershan Kumar, DS and CC R&D (PC & SI). In that he told to all DRDO’s CPIO not to supply any information under RTI Act-2005. It can be verified by records of DRDO’s RTI cell that no information was passed after this decision to any RTI applicant.
That all RTI applicants receiving reply in the same format which was supplied by DRDO RTI Cell and First appellate authority reply was also given by DRDO in same format.
Surprisingly the following case of Dr. R G Taware, Ex- Technical Officer ‘B’ was to show the blind act of DRDO’s RTI cell.
Dr. R G Taware, Ex- Technical Officer ‘B’ was illegally dismissed by DRDO management with conspiracy. The conspiracy was proved by single point DRDO used then RRM, Sh Palam Raju for suspension and after dismissal and material fact is that RRM, Sh Palam Raju nor has the power for such approval, because as per Ministry of Defence orders of power delegation by Defence Minster shows he has never delegated such powers to RRM, Sh. Palam Raju specially for DRDO.
Dr. R G Taware, Ex- Technical Officer ‘B’ suspension /dismissal orders one of major allegation was “The tone and tenor of letter of Dr. R G Taware dated 26 Aug 2009”
Dr. R G Taware send an RTI request to CPIO, HEMRL, Pune, information sought that DRDO scientists developed a machine which can measure “The tone and tenor of any letter”, he asked whether scientist got any award and promotions for this great innovation.
The Blind DRDO RTI cell replied in a standard format “ You hereby inform that DRDO is placed in second schedule of RTI Act and exempted from disclosure of Information under Section 24 (1) exceptpertaining to the allegation of corruption and human right violations”( copy enclosed)
Further after getting above reply from BLIND DRDO RTI Cell, Dr. R G Taware sent first appeal to FAA, DRDO to check their IQ.
Interestingly the height of blindness of DRDO RTI cell or to hell with RTI same standard reply send by FAA on the issue that “You hereby inform that DRDO is placed in second schedule of RTI Act and exempted from disclosure of Information under Section 24 (1) exceptpertaining to the allegation of corruption and human right violations” (copy enclosed)

DRDO RTI cell doing propaganda that Honorable High Court declared DRDO 100% exempted organization from RTI Act-2005 and started giving denial to each and every RTI request without seeing the merit and facts that the request pertain to corruption. And best part of this now they are stop writing “except information pertaining to the allegations of corruption and human rights violations”
In this judgment is nothing new every one clearly knows DRDO was an exempted organization under Section 24 of the Right to Information Act, 2005. In other words, the Act would apply to DRDO only to the extent of information pertaining to allegations of corruption and human rights violations.
In DR. NEELAM BHALLA case DR. NEELAM BHALLA prayer to honorable court that information supplied by then CPIO, DRDO Sh Bundella was incorrect and inaccurate and court says
“4. It is a matter of fact that Shri Bundela had provided inaccurate and incorrect information to the appellant but Shri Bundela’s contention that he had transmitted information as received by him from CPIO of RAC cannot be disregarded. It is important to bear in mind that Shri Bundela was not the holder of information. The holder of information was CPIO, RAC. Whatever information was W.P.(C) No. 83/2014 Page 1 of 4 forwarded to Shri Bundela by CPIO, RAC, he transmitted the same to the appellant.
6. Even so, before parting with this matter, I would like to caution Shri Bundela to exercise due diligence in responding to the RTI application in future.”

Having heard learned counsel for the petitioner, this Court is of the view that once the CIC has held that DRDO is an exempted organisation under Section 24 of RTI Act and the information sought does not pertain to corruption and/or human rights violation, it was not open to the CIC to carve out any further exemption.
But in whole judgment there is nothing new and not giving extra immunizing to DRDO from RTI act, if there is any extra facilitation in judgment than DRDO should quote specifically that.

The matters pertaining to recruitment/appointments and day to day administrative nature information, where it is also found that DRDO top officials did lot of irregularities. Therefore honorable defence minister approved CBI intervention against 10 top DRDO officials including 2 ex- DRDO chiefs one Dr V K Saraswat and other one Sh M Natrajan for their ugly acts.
It was establish facts till date all senior officials of DRDO who were fixed by CVC and CVO, MOD were exposed with the help of RTI’s only.
So DRDO officials are afraid of RTI’s if they are honest then why they worries from RTI’s . The Ex CPIO, DRDO Dr A K Tyagi who is facing charge sheet in corruption case was the big manipulator and protector of corrupt officials.
I request to DRDO RTI cell you people are serving to our nation; please not to protect culprit’s corrupt officers, your younger generation will ask you what did you contributed for justice. Now in the age of IT revolution era kid can explore what are the score of my grandpa, because these documents are alive forever.

You informed that “it is stated that the cases for grant of RTI Cell, DRDO Hqrs Incentive are received from respective Labs/Estt in which it is certified that the higher qualifications and the institute are approved by the competent authority. On receipt of such confirmation, the cases are submitted to Ministry of Defence who process each and every cases and issue sanction for grant of Lump Sum Incentives after getting concurrence of the Integrated Finance. However, in case of any doubt regarding verification/ reorganization, the same is thoroughly examined before issuing the sanction. It is also stated here that the lump sum incentive is only one time to promote higher qualification among employees.”

Note : Matter is directly related to corruption and not exempted under Section 24 (1), as you can verify this with letter of Director of Personal vide letter No DOP/01/03500/Lump sum/M01 dated March 2014 to all Director Lab/Estt/ Dte in Hq dated 11 March 2014 in Para – 1, line- 9 states that “Of late it has been notice that in most of the cases are taken up acquiring higher qualification, recognition of various courses and universities/ institutes by Competent Authority is not verified/ authenticated by Labs prior to sanction of permission. This non verification in the some cases results in award of degrees/ diplomas by Universities / Institutes not recognized by the competent recognizing authorities. Grant of incentives for such higher qualification becomes against the Rules”
