Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of procurement of PCs from M/s Tata Power by CAIR, DRDO, Bangalore. To favor M/S Tata Power demands raised against the laid down rule of PM-2006 approved purchased manual of DRDO, The procurement was done in PAC. It is not understood how universal available Personal Computer can become PAC item. In the name of secrecy exemptions are being obtained for publishing in Central Public Procurement Portal (CPP).

The recommendation of the TPC was approved by Director and the statement of case was prepared for obtaining sanction for approval of purchase from competetent authority i.e SA to RM as in case of single tender the FINANCIAL competence of Director of Lab is restricted to Rs 1 Lakh. The statement of case put up DRDO under the signature of Dr.AS Bains and Dr.KD Nayak dt 7th Oct 1997 sate that the requirement of………

The deal for the purchase was approved by the then SA to RM Dr.APJ Abul Kalam. However the only bone of connection is fact that when the supplier asked for change of nomenclature and replacing the word down convertor with integrated circuit, Dr AS Bains, director of the lab had approved of the TPC recommendation and have not referred this matter of change of nomenclature to SA to RM as the deal was approved by him.

The care procured Rs 40-50 thousand PC in nearly 5.5 Lakhs with following demands.

The above case is the example of corrupt practice followed by DRDO in the name of secrecy government India can verify from the expert of DOE.

DMSRDE – Second Fact Finding Inquiry Committee 9th & 10th July 2014

It seems DRDO take U –turn in DMSRDE corruption cases. Shri AvinashChander , DGR&D and SA to RM constituted second four members  FFIC under Chairmanship of Dr. D C Pande, Outstanding Scientist, LRDE, Bangalore  and members Shri Haribabu Srivastva, Director, LASTEC, New Delhi, Shri R S Mehta, Joint Director, Dte of Vigilance& Security, DRDO Hqrs, Shri Jagdeep, Scientist ‘F’,Dte of Materials Management DRDO Hqrs  reached at Kanpur on 9th July early morning 5:00 AM at DMSRDE, Guest House, Kanpur by Rewa Express.

In deference to three members first FFIC which was led by Dr. S S Negi, Outstanding Scientist,this second FFIC did not entertained Dr. A K Saxena, Director, DMSRDE, Kanpur. Dr.Saxena  was sent for two days leave and remained in  his government residence just adjacent to Transit Hostel’s DRTC Room where whole FFI was  conducted for two days by FFIC.

The first FFIC Committee did their inquiry under supervision of Dr. A K Saxena in DMSRDE Office in the room just opposite to Dr. Saxena office so that he can monitor activities of first FFIC. Chairman & members of first FFIC tried their best to discourage complainants and in month of March 2014  all scientists were under pressure due to their APAR and coming assessment and not opened or uttered any single word against Dr. A K Saxena in front of   first  FFI Committee. The first FFI Committee overlooked the gravity of complaints to Defence Minister rather they were busy in digging the past history of complainants. They were basically misleded and managed by Dr. A K Saxena.

The letter No DOP/DS/008/M/01 dated 28 May 2014 of DOP Dr. A K Singh prepared on basis of first FFI Committee Report already exposed the nexus between Dr. A K Saxena and first FFI Committee because the without any constitution rights and ignoring the terms and condition of FFI Committee they simply recommended the transfers of both complainants with baseless and illogical reasons. It should be asked to Dr. S  S Negi, Outstanding Scientist that if on allegations of habitual  drinking one senior Scientist  may be transferred then what about the drinkers of whole DRDO right from top at DRDO HQ and bottom at 52 Establishment/Labs of DRDO. Why they have not been transferred even they are heavy habitual drinker. In fact first FFIC was  hijacked by  Dr. A K Saxena.

The two days grilling of involved scientists of DMSRDE by second  FFI Committee members especially by Shri Mehta, Vigilance, DRDO Hqrs shows some hope that the committee will help to Shri Avinash Chander , DGR&D and SA to RM and DRDO Hqrs to take one step forward towards eradicate prevailing corruption in DRDO like Dr A K Tyagi, Sc ‘G’ waiting to face CVC disciplinary proceeding against him as he also involved in corrupt practices in procurement at DIAT, Pune.

Some scientists of DMSRDE given in writing about the facts of these procurements and shows their helplessness.

Second FFI Committee also got advantage that the DRRDS result was declared and scientists who supported Dr. A K Saxena’s corrupt practices under pressure opened up and exposed the modus of oprendi adopted by Dr. A K Saxena.  FFI Committee also got inputs about nexus between M/s Manglam Trades, Kanpur (Mr.Anish Gupta/Mr. Manish Gupta) and Dr. A K Saxena in various procurement cases.

1.       Reactor case is open case that the procurement was done in coalition  with M/s Manglam Trades because all mails are the perfect evidences of corruption and DRDO Hqrs already aware that CBI, Lucknow have already got all evidences and approached MOD. Payment of Reactor case has not been made till so far even after 18 months the Reactor was installed in January 2013 at DMSRDE.

2.       The case of procurement of Laboratory Microprocessor Based Programmable High Temp.Furnace supplied by M/s   Omega Furnace Industries, Bangalore. In this case illegal Second TPC was done for recommending to make payment  to M/s Manglam Traders, Kanpur.( It can happen only in DRDO)

3.       Fume Hood Chamber procurement case is open example of looting in DRDO.

Common man are waiting to see the impact of new Prime Minister Shri Narendra Modi ji’s Government on  DRDO, as Shri Avinash Chander Ji especially mentioned in his address in last JCM that “now new government has come and the accountability is also increased”.

It is coincidence that both FFIC having chairman from Uttarakhand and Uttarakhandies are famous for their honesty and devotion in service. We hope that like Dr. S SNegi, the Chairman of second FFIC Dr. D C Pande will not be hijacked by corrupt nexus of DRDO and he will do justice with DMSRDE people.

Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of  procurement of Thermal Imaging Camera (3-5 micro meter) vide SO No. DMSRDE/12AT0053/SMG/CMS-II dated OCTOBER’ 07, 2011 by DMSRDE, Kanpur.  The item purchased from M/s FLIR SYSTEMS, 19 bd BIDAULT-77 183, CROISSY- BEAUBOURG, FRANCE order value was Euro -1,32,943.00 ( Rs  84,65,810.00). It is observed that the item received by indenter Dr. ABBAS SAYED M, Scientist F was not as per supply order. A committee was constituted and as per committee few discrepancies was found but items were received and payment was done. Item was supplied with much low cost instead of ordered item example

i.           L10476 – DOUBLE FIELD OF VIEW LENS 50/250 MM MWIR LENS ordered item cost – 36,534.00 Euro (approx Rs 2326119.00) October 2011 euro rate Rs 63.66 

ii.         L1116 Double FOV lens, 50/250 mm, F/2.3 Received item cost US Dollar  5,278.00 (Rs approx 257196.00) October 2011 dollar rate Rs 48.72

  1. Provide the date of TPC and the name, address of M/s FLIR SYSTEMS rep attended the TPC.
  2. Name and designation of all TPC members who participated in proceeding of above supply order.
  3. Certified copy of invoice of Flair Systems, France, Invoice No. 9200282074 dated 27 June 2012
  4. Certified copy of report submitted by committee who scrutinize the above supply order.
  5. Certified copy of inspection note submitted by indenter Dr. ABBAS SAYED M, Scientist F against above supply order.

Note: Matter is directly related to corruption and not exempted under Section 24 (1) as point i & ii clearly confirm the manipulation in said procurement order.

SUBJECT : Purchasing of Laboratory Microprocessor Based Programmable High Temperature Furnace at Exorbitant Price

Sir,

  1. Sh.Rakesh Kumar Gupta, Scientist ‘C’ raised a demand of Laboratory Microprocessor Based Programmable High Temperature Furnace vide Demand No. DMSRDE/13552009 dated 30 August 2012.
  2. SPC date 13th September 2012
  3. DRDO Hqrs approval 1st October 2012
  4.  Tender Date 1st October 2012 (see the efficiency)
  5.  Limited tender enquiries will be issued to vendors registered with R&D Labs/Estts, DGS&D, NSIC, other Government departments and to the firms of national repute who will be registered before their bid is considered as per Para 3.2.2.  Such tenders may also be invited from the Government designated agencies. While inviting limited tender enquiries, due care will be observed in selecting vendors, especially in the case of traders who are not the actual manufacturers/authorized agent, to ensure better after sale service. (Rule 7.6.1 PM 2006)
  6.  Seven firms were mentioned in demand to which tender enquiries were sent. Out of these Modern Scientific Centre, Kanpur, Dhankar Enterprises, Kanpur,  Manglam Traders, Kanpur, Scientific Aid and Omega Furnace Industries, Banglore were registered in July 2013 at DMSRDE.
  7.  In this case two firms Dev Industrial Enterprises, Mumbai and Inschem, Lucknow are non-registered firms.
  8. As per PM 2006 Rule 7.6.1 “Limited tender enquiries will be issued to vendors registered with R&D Labs/Estts, DGS&D, NSIC, other Government departments and to the firms of national repute who will be registered before their bid is considered as per Para 3.2.2.  Such tenders may also be invited from the Government designated agencies. While inviting limited tender enquiries, due care will be observed in selecting vendors, especially in the case of traders who are not the actual manufacturers/authorized agent, to ensure better after sale service”.
  9. Dhankar Enterprises is not registered for Scientific Equipment/Instruments at Commercial Tax Department, Uttar Pradesh then how tender inquiry was sent to Dhankar Enterprises. Copy of registration enclosed.
  10. TEC was done on 6th December 2012
  11. TPC was done on 16th Jan 2013
  12. Supply was made on 27 Sept 2013 while in demand the delivery period was 3 months from date of supply order but SO was placed on 26 Feb 2013 that is delivery was made after 7 months (27 Sept 2013 – 26 Feb 2013 = 7 Months)
  13. No VAT /Tax was claimed in SO as basic cost of item was 1681500.00 only.
  14. Actual cost of item is Rs. 560000 + VAT 5.5% (560000*5.5% = 30800) . Thus total cost is 590800. But SO was placed for  Rs. 1681500.00. Hence item was purchased at very high price and commission of Rs. 1681500 – 590800 = 1090700.00 was made by Dr. AK Saxena, Director, DMSRDE, Kanpur. (Omega Furnace Industries, Banglore’s quotation for same specification furnace is enclosed for ready reference)
  15. Stores Received on 27th September 2013 vide RIN No 14LP0149
  16. M/s Manglam Traders come in front and a review TPC was done,  under Chairmanship of  Dr. Sarfaraz Alam, Sc’G’
  17. Para two of review TPC                                                                                                 “Now, the firm M/s  Omega Furnace Industries, Bangalore has intimated that billing and supply of stores will be done by their local dealer M/s Manglam Traders, Kanpur, vide letter of even no dated September 24, 2013”
  18. Para three of review TPC                                                                                              “The finance rep told that the stores have been supplied by M/s Manglam Traders, Kanpur. Hence, the payment may be made to M/s Manglam Traders, Kanpur”      Para four of review TPC

In view of above details, it is clear Violation of Purchase Management 2006 Rule 7.15(a) Constitution of TPC/NC,  it is requested that registered the complaint against Dr A K Saxena, Director, DMSRDE and his blind followers who are mishandling the government funds for their own vested interest. A thorough investigation is needed to explore the relation between Dr A K Saxena, Director, DMSRDE and M/s Manglam Traders, Kanpur. It may be reveal crores of crores rupees scam in DMSRDE and RCI, DRDO.
