DRDO’s bio-toilets raise a stink

BHUBANESWAR: The much-hyped bio-toilets invented by Defence Research and Development Organisation (DRDO) and installed in railway coaches, public places and colonies seem to have sparked of a controversy with some senior scientists raising voice against the functioning and technology which allegedly uses cow dung instead of imported bacteria.

Developed by Gwalior-based Defence Research and Development Establishment (DRDE) and Tezpur-based Defence Research Laboratory (DRL), both laboratories of DRDO, the bio-toilets, fondly known as ‘E-loo’, use anaerobic microbial bacteria to decompose and convert biological human excreta into usable water and gasses.
DRDO e looThough initially, the bio-toilets installed in high-altitude regions such as Siachen and Ladakh performed as expected for a certain period, now many of them are reportedly abandoned or unused for obvious reasons leading to objections from the armed forces.
While the DRDO said the anaerobic bacteria have been imported from Antarctica and can effectively function in extreme conditions and temperature ranging from -6 degree Celsius to 50 degree C, a group of DRDO scientists claimed that the imported bacteria cannot survive in high temperature.

“Since such type of anaerobic bacteria are abundantly available in cow dung, the cattle waste is now being used in bio-toilets while the research organisation is hoodwinking the people in the name of technology development by wasting crores. Like the bio-toilets, the normal septic toilets also have a perfect anaerobic environment with the only difference being addition of cow dung in the name of inoculum culture in the former,” they said.

According to senior DRDO scientist Dr Y Ashok Babu, who has lodged a complaint with the Central Vigilance Commissioner (CVC) seeking a probe into it, the imported bacteria worked perfectly well in the laboratory but did not work efficiently in the Siachen region, for which a solar panel heating system was added to accelerate digestion process.

“There is no requirement of specific bacteria in the normal temperature and local bacteria in the septic tank will do the same task more efficiently if cow dung is added to it. The technology is a farce which allows a handful of greedy business people to earn crores of rupees,” the complaint stated.

DRDE Director Dr Lokendra Singh, however, refuted the allegations. He said the cow dung is used only to multiply the bacteria brought from Antarctica, which can survive in Indian conditions. “Actually the cow dung used in the toilets is not the cattle waste but the bacteria which are transported through it. The toilets are working perfectly for which the Railways has given bulk orders,” he claimed.

The DRDO has so far made the transfer of technology (ToT) agreement with 56 companies which are producing bio-toilets at a cost ranging from Rs 15,000 to Rs 75 lakh depending on the volume of population using it and quality of materials.

Singh informed that while already 40,000 bio-toilets have been installed in railway coaches, additional 80,000 toilets are to be installed shortly. Besides, around 20,000 E-loos have been placed in colonies, urban areas and villages. The Indian Railways has planned to install 2.5 lakh toilets in all coaches by October 2, 2019

Sir,                                                                                                                                                               With reference to above cited complaint against Dr. Vijay Veer, Director, Defence Research Laboratory(DRL), Tezpur (Assam) under Defence Research & Development Organisation (DRDO), Min. of Defence, it is submitted that Dr. Vijay Veer is retiring at the end of this year and till date no action has been taken by CVC in this matter. The corrupt practices at DRL, Tezpur are continued without any fear by Dr. Vijay Veer as he is retiring this year and trying to materialize more & more procurement cases and other irregularities in DRL, Tezpur.

In this connection, one RTI Application submitted  dated 30 March 2015 to get status of the complaint to CPIO, CVC but till date no status of complaint received from CVC  against Dr. Vijay Veer, Director, DRL, Tezpur.

Kindly issue orders for speedy action on the said complaint and an early disposal of complaint prior to retirement of Dr. Vijay Veer, Director, DRL, Tezpur.

माननीय श्री प्रधानमंत्री जी यह एक बड़े खेद का विषय है कि इतने महत्वपूर्ण संगठन के शीर्ष अधिकारी श्री अविनाश चन्दर जी ने सारी नैतिकताओं को दर किनार करते हुए डीआरडीओ में अपनी जागीरदारी चला रखी है।

आपने दिल्ली में जो देख कर जनता को लालकिले से अपना अनुभव बताया कि सब विभागों में अपनी अपनी जागीरदारी चल रही है वह एक पूर्ण सत्य है।

श्री अविनाश चन्दर जी ने अभी कुछ समय पहले एक वैज्ञानिक ‘जी’ पद में बहुत ही मनमाने ढंग सब नियत मानको की अनदेखी कर रिटायर कमोडोर सरोज पटेल की नियुक्ति करी है।

श्री अविनाश चन्दर जी ने रिटायर कमोडोर सरोज पटेल की सिर्फ नियुक्ति ही नहीं करी बल्कि  डीआरडीओ के 507 वरिष्ठ वैज्ञानिक ‘जी’ की वरिष्ठता को दरकिनार करते हुए श्री पटेल को नियुक्ति के चार दिनों में डायरेक्टर के पद में भी बैठा कर वैज्ञानिको का मनोबल  गिरा दिया है।

पूरे देश ने कारगिल जंग के समय डीआरडीओ की असफलताओ को देखा था और सबको जनरल मालिक के शब्द याद है ” डीआरडीओ के वजह से सेना वेपन लोकेटर रडार नहीं प्राप्त हो पाया और जिसके कारण  सेना को अपने इतने जवान खोने पड़े”

आपसे आशा है की निम्न प्रेषित उक्त नियुक्ति की धांधली के पूर्ण विवरण को सी वी सी को जाँच के लिए आदेश देंगे जिससे डीआरडीओ के समर्पित वैज्ञानिको का मनोबल बढ़ सके और वे देश की विकास में भागीदारी में अपना पूर्ण योगदान कर सके।

Recruitment of Sh Saroj Kumar Patel, Scientist ‘G’ and Appointment on post of Director, Directorate of Quality, Reliability &Safety (DQRS), DRDO HQ Complaint against Sh Avinash Chander, DG, DRDO, SA to RM, Secretary, DRD

Sir,

Nepotism, favoritism, corruption and manipulations with vested interest in higher recruitment by misusing powers by HOD are very common practices now days in Government system by different means.

Based on the practices stated above, the Recruitment Scam-I occurred in DRDO in which several top Scientists including some ex-DGR&D, ex-CCR&D, ex-Directors and their daughters & relatives were involved. Several complaints were made to CVC & Defence Minister regarding Recruitment Scam-I and consequently CVC advices disciplinary action against Dr. Arun Kumar, Ex-DOP under major penalty vide OM No. 010/DEF/039/184877 dated 23.08.2012.(Copy enclosed-I).

Dr. Arun Kumar was suspended on the last day of his superannuation. Similarly some other Scientist Dr. S M Veerbhadrapa, Ex-Director, DTRL then HRD Charge Sheeted and Smt Chandra bano, Scientist ‘F’, DHRD was dismissed from service just 12 days before retirement. Since top ten officials of DRDO involved in Recruitment Scam-I were retired therefore on advice of Director (Vigilance) & CVO, Min. of Defence , then Defence Minister recommended CBI probe in Recruitment Scam-I of DRDO vide Dte (Vigilance), MOD note no.48-55 ante observations of JS & CVO at note 56 ante in November 2013. The news was published in media. Copy enclosed (II).

Shri Avinash Chander then CCR&D(MSS) also played an important role in Recruitment Scam-I while being member of expert committee under Chairmanship of Prof. SK Salwan, he gave clean chit to his friend Dr. Arun Kumar , ex-DOP vide his report dated 08.06.2011.

This case is regarding illegal recruitment with motivated planned conspiracy of Shri Avinash Chander, DG, DRDO and SA to RM, Dr. A.K. Singh, DOP and Smt. Hina Gokhle, Director, DHRD and Dr. RK Jain, Director, RAC and Dr. DN Reddy, Chairman, RAC.

BRIEF FACTS OF THE COMPLAINT

  1. Shri Avinash Chander, DS was Director, ASL, Hyderabad from August 2005 to May 2011. He was appointed as CCR&D (MSS) in DRDO HQ and was holding position of no. 2 after Dr. V.K. Saraswat, then DGR&D and SA to RM. Shri Avinash Chander took over as DGR&D, DRDO and SA to RM wef 31 May 2013 after superannuation of Dr. V.K. Saraswat.
  2. Smt. Tessy Thomas was working in ASL since its foundation and she was subordinate to Shri Avinash Chander when he was Director, ASL, Hyderabad. Smt Tessy Thomas was promoted to Scientist ‘H’/Outstanding Scientist wef 18 October 2013. She was appointed as Director, ASL, Hyderabad wef 25 July 2014.
  3. As a matter of facts, the competent authority in DRDO for appointment of Directors of Lab/Estt and Directorates at DRDO HQ is Shri Avinash Chander DGR&D, DRDO and SA to RM.
  4. Shri Saroj Kumar Patel, husband of Smt Tessy Thomas, OS (now Director, ASL) was serving in Indian Navy as Commodore and retired from Indian Navy on 31 January 2013. To oblige Smt Tessy Thomas, Shri Avinash Chander, then CCR&D(MSS) misused his position and succeeded in creation of a vacancy of Scientist ‘G’ in DRDO HQ and applications for this vacancy of Scientist ‘G’ were sought vide RAC Advt No. 110/December 2012.   5. The Scientist ‘G’ in DRDO is having pay scale of Rs. 37,400-67,000/- & Grade Pay 10,000/-, which is equivalent to rank of Joint Secretary in Indian Administrative Services. Joint Secretary to the Government of India has pay scale in Pay Band – 4:Rs. 37400- 67000; and Grade Pay Rs. 10000.All promotions and appointments to this Joint Secretary rank and post are directly made by the Appointments Committee of the Cabinet (ACC).
  6. The requirement of said vacancy of Scientist ‘G’ was tailor made for Shri Saroj Kumar Patel as  evident from details of Advt. No. 110/December 2012.

  1. This malpractice for recruitment of Shri Saroj Kumar Patel was exposed by some senior Scientist ‘G’ of DRDO by writing complaint to Hon’ble Defence Minister in 2013 and therefore the plan of Shri Avinash Chander failed due to seriously  consideration of the matter by Dr. V.K. Saraswat, then DGR&D, DRDO and SA to RM.
  2. Shri Avinash Chander took over as DGR&D, DRDO and SA to RM on 31 May 2013 after superannuation of Dr. V.K. Saraswat. After acquiring full administrative & financial powers in DRDO, Shri Avinash Chander planned the recruitment of Shri Saroj Kumar Patel as Scientist ‘G’ in DRDO and therefore he planned a conspiracy of the illegal & motivated recruitment with help of his subordinates Dr. A.K. Singh, DOP, Smt. Hina Gokhle, Director, DHRD and Dr. DN Reddy, Chairman, RAC and Shri RK Jain, Director, RAC.
  3. Accordingly phase-II of the said conspiracy started by issue of Letter No. DOP/11/110059/QRSM/M/02 dated 14 August 2013 of Directorate of Personnel, DRDO, MOD, New Delhi on the Subject- Appointment of Director, QRS, DRDO HQ, New Delhi. Copy of the letter dated 14 August 2013 along with Proforma for Director, QRS, DRDO HQ, New Delhi is enclosed-IV.
  4. It was clearly mentioned in Para(1) of the letter that “Applications for the post of Director, Quality, Reliability & Safety(QRS) at DRDO HQrs, New Delhi are invited from SC ‘G’ promoted in the year 2013 having sufficient experience in the field of quality, reliability and safety. The Para 1 of letter is arbitrary, discriminatory, unethical and illegal in nature.
  5. No essential qualification, desirable qualification and years of experience were sought and mentioned in said DOP letter for the post of Director, QRS.
  6. Question arises why applications were invited only from the Scientist ‘G’ that were promoted in the year 2013 while in the seniority list of Scientist ‘G’ of DRDO as on 1st November 2013 there were 507 Scientist ‘G’ in total and out of which 114 were promoted in the year 2013 with effect from 01 July 2013? Copy of the seniority list of Scientist ‘G’ is enclosed-V. Why senior Scientist ‘G’ were not eligible for the post of the Director, QRS and under which rule DOP & DHRD decided that only junior most Scientist ‘G’ are eligible for the said post, while in appointments seniority plays an important role and senior most officers always  given priority.
  7. Mere reading of the letter dated 14 August 2013 issued from DOP establishes the conspiracy in recruitment. The letter was issued on 14 August 2013 and it was clearly mentioned in para (2) of the letter, reproduced as it is for ready reference “2. The applications should be duly forwarded/recommended by their respective Directors the enclosed profoma (Annexure-I) and must reach this office latest by 21st August 2013”. Hence only 6 days were provided to all Scientist ‘G’ of 52 Lab/Estt situated allover India right from Leh to Kochi and Vizag to Tezpur. The Para-2 is the clear violation of DOPT norms because period should be minimum 15 days.
  8. As a matter of fact 15 August was National holiday, 16th was Friday, 17-18 August (week end holiday), 19-21 August (three working days). Now three questions arises

(i)                 Why only 04 working days was provided to submit the applications for post of Director, QRS?

(ii)               What was the urgency to keep very short time for submitting applications?

(iii)             Whether it was possible in any circumstances that ink signed copy of the application duly recommended by respective Director be reach with in two-three days by speed post to New Delhi far from various Lab/Estt. Of DRDO.

  1. Answer to the questions raised in point(14) above is that applications were sought within DRDO simply to make formality and have a record that no Scientist ‘G’ applied for the said post or found eligible for the said post. It is matter of investigation by CVC from records that how many applications were received for post of Director, QRS, whether any list were prepared, whether any interview/interaction were organized, whether any committee scrutinized the proforma of Scientist ‘G’ and whether any Scientist ‘G’ was found suitable for the post of Director, QRS, DRDO Hqrs.
  2. In fact said post were preplanned for Shri Saroj Kumar Patel since the December 2012 therefore any Scientist ‘G’ out of 507 Scientist ‘G’ of DRDO was not selected for the post of Director, QRS, DRDO Hqrs and post remain vacant.
  3. Further to accommodate Shri Saroj Kumar Patel in DRDO an advertisement for post of Scientist ‘G’ were again issued by RAC, DRDO vide Advt. No. 112/October 2013 under direct recruitment scheme of DRDO under direction & guidance of Shri Avinash Chander with vested interest. Copy of the Advt No. 112/October 2013 is enclosed-VI.
  4. Shri Saroj Kumar Patel was recruited as Scientist ‘G’ in DRDO against the 01 vacancy of Scientist ‘G’ vide RAC Advt No. 112/October 2013 and joined DRDO at DRDO HQrs, DRDO Bhawan, New Delhi with effect from 27 March 2014 at seniority no. 486 among Scientist ‘G’ of DRDO.
  5. As a matter of fact Shri Saroj Kumar Patel joined DRDO as Scientist ‘G’ on 27 March 2014(Thursday) and appointed as Director, QRS, DRDO HQrs on 31 March 2014(Monday) so he worked only two days 27-28 March 2014 and jumped to post of Director only in service of 04 days. Shri Avinash Chander appointed Shri Patel as Director; QRS ignoring the 485 senior Scientist ‘G’ already available in DRDO and it establish favoritism & nepotism. It can only happened in DRDO.
  6. Now again four question arises

i.            Why Shri Patel was appointed as Director, QRS while he was recruited against vacancy of Scientist ‘G’ not for the post of Director, QRS by ignoring 485 senior Scientist ‘G’ in DRDO?

ii.            What is the specialization of Shri Patel which is not available with 507 Scientist ‘G’ of DRDO, can the conspirators able to justify?

iii.            Why so much favoritism was given to Shri Patel for his recruitment as Scientist ‘G’ and appointment as Director, QRS since October 2012 to March 2014 by Shri Avinash Chander?

iv.            What special benefit DRDO get from Sh Patel’s tailor made appointment?

  1. Keeping in view of the facts mentioned above and the subordination of Smt Tessy Thomas with Shri Avinash Chander right from several years in ASL, Hyderabad, it is crystal clear gross violation of recruitment rules, ethics and procedures took place and the same were not followed in recruitment of Shri Patel as Scientist ‘G’ on 27 March 2014 and further his appointment as Director, QRS on 31 March 2014. This smacks planned conspiracy and criminal misconduct by Shri Avinash Chander, DGR&D, DRDO, Dr. A.K. Singh, Director of Personnel, DRDO Hqrs, Smt Hina Gokhle, Director, DHRD, Dr. RK Jain, Director, RAC and Dr. DN Reddy, Chairman, RAC.
  2. Therefore, it is kindly requested that appointment of Shri Saroj Kumar Patel, Scientist ‘G’ should be cancelled with immediate effect and inquiry be conducted under Prevention of Corruption Act 1988 and CCS (CCA) Rules 1965 against the senior officers of DRDO involved in planned conspiracy of recruitment and appointment of Shri Saroj Kumar Patel as Scientist ‘G’ in DRDO and appointment as Director, QRS, DRDO HQrs.

Subject: Corruption in purchasing of microwave calibration kits in DMSRDE.

Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.

DRDO’s Director Material Management distributed to all Labs & Establishments a manual named “DRDO Purchase Management -2006” which was duly approved by President of India and with the concurrence of Ministry of Defence (Fin/R&D) vide their ID No 752/IF (R&D) dated 20 March 2006.

Dr.T C Shami had a microwave network analyzer make – Agilent Technologies, Vector Network Analyzer (VNA). A network analyzer, like most electronic instruments requires periodic calibrationtypically this is performed once per year and is performed by the manufacturer or by a 3rd party in a calibration laboratory. When the instrument is calibrated, it will usually have a sticker fixed to the outside, stating the date it was calibrated and when the next calibration is due. A calibration certificate will be issued.

A number of verification kits are available to verify the network analyzer is performing to specification. These typically consist of transmission lines with an air dielectric and attenuators. It is observed that as a Head SMG, DMSRDE Dr.T C Shami, Scientist ‘F’, floated tenders in different mode for procuring microwave calibration kits since 2009 using different nomenclature. shami case table1

Throughout world any organization, govt. or private or technical educational institute if they required calibration their measurement equipment they approached nodal agencies for calibration or if they have budget then purchased single unit. In above case the DMSRDE, Kanpur purchasing so many calibration kits with using different nomenclature.

Dr.T C Shami raised demand almost every year for Agilent 7mm Precision calibration kit ( Model no. 58050C) from  Agilent Technologies but purchase not metalized for unforeseen reasons.

After that the   calibration kits     C band (3.95-5.85GHz) waveguide  & WR284 -S band(2.60-3.95 GHz) calibration kit  was purchased in limited tender from  M/S Surabhi International , 60/43, HAMRAJ COMMERCIAL CENTRE, NAYAGANJ, Kanpur – 208001. Military Tent, Yarn, fabric, vest & bulletproof jacket suppliers. The information available in public domain related to M/S Surabhi International is enclosed which is self explanatory.

Recently Dr.T C Shami raised demands vide No DMSRDE/ 14SMG044 for WR284 -S band(2.60-3.95 GHz) calibration ki t &  Tender floated on 05/03/2014 and due date is 9th May 2014.

  1.  Dr.T C Shami purchased microwave calibration kits since 2009 using different nomenclature and in process of procuring calibration,

i.            Question is this microwave calibration kits are consumable items?

ii.            Every year Agilent Technologies Vector Network Analyzer (VNA) need brand new calibration Kit?

iii.            Is same practice is following by other DRDO labs who are working in the field of microwave like, DEAL, DRDL, RCI,DLRL, LRDE, CARE, CABs, ADE and so on.

iv.            Is DMSRDE extending this calibration facility to all other organization like HAL, IIT etc as revenue generation under resource management scheme?

v.            Or Dr.T C Shami is calibrating Vector Network Analyzer (VNA) by every time shield pack new calibration kit in the manner of use & throw. (typically this is performed once per year)

vi.            Or money is flowing in DMSRDE, Kanpur

2.  As per microwave expert this kind of regular procurement shows that the regular procurement of shear wastage of precious foreign currency. 

3.  Procurements of such delicate microwave precision calibration kits should be from Agilent Technologies, Rohde & Schwarz, Maury Microwave Corporation etc or its authorized dealers not from fabric & tent suppliers again raised big question.

4.  Dr T C Shami purchased C band (3.95-5.85GHz)waveguide  & WR284 -S band(2.60-3.95 GHz) calibration kit  in limited tender from  M/S Surabhi International Pvt. Ltd 60/43, HAMRAJ COMMERCIAL CENTRE, NAYAGANJ, Kanpur – 208001. Who deals with Military Tent, Yarn, fabric, vest & bulletproof jacket suppliers. The information available in public domain related to M/S Surabhi is enclosed which is self explanatory.

5.   M/S Surabhi International is registered at DMSRDE with Registration No.  DMS/26/27. This firm is registered in category Chemicals & Polymers.

6.   M/S Surabhi International have two more support family firms M/s Pee Cee Textile Stores and M/s Mishra Trading Company.

7.   M/S Surabhi International has also supplied a very specialized microwave component Double Ridge Microwave 18-40 GHz Horn Antenna with Carrying & Shipping Case vide Demand No.: DMSRDE/11SMG125, Dated: 07 Sep 2010 costing Rs 4,25,000.00. The modus oprendi was same limited tender.

 9.   In search of corruption in DRDO, it is observed that DRDO is helping our traders in very big way to educate them high technology fundas, the Pan wala where scientist use to purchase pan become supplier of high-tech components, the IB report revealed the rice exporter friend of Dr A S Bains, Ex Director, DEAL, DRDO, Dehradun become high-tech 35 GHz satellite terminal component suppliers, in Hyderabad the wedding mundapam owner become missile components suppliers. The same practices being are followed by DMSRDE, Kanpur, the chemical suppliers/ fabrics suppliers suddenly became microwave components supplier.

10.   Last but not least it is unethical and unauthorized suppliers are supplying the items at exorbitant prices and some time used and refurbished items are also supplied, it happens because of close proximity with indenters and director of lab. 

11.   It is requested CVC please do physical verification of above calibration kits  in DMSRDE premises with serial numbers verified from manufacture, because today all big multinational companies maintaining the data base. Anyone can verify with serial number, who was the first buyer of the item, is it brand new or refurbish etc.

12.    In the case of these calibration kits Agilent Technologies main supplier company and the Maury Microwave Corporation is the manufacture.

13.    In view of the above mentioned facts and evidences it is earnestly requested that an order for through investigation of all procurement done by  Dr T C Shami after assuming charge as Head, SMG DMSRDE, DRDO, Kanpur to stop further corruption and wastage of poor tax payers money.

SUBJECT : Purchasing of Laboratory Microprocessor Based Programmable High Temperature Furnace at Exorbitant Price

Sir,

  1. Sh.Rakesh Kumar Gupta, Scientist ‘C’ raised a demand of Laboratory Microprocessor Based Programmable High Temperature Furnace vide Demand No. DMSRDE/13552009 dated 30 August 2012.
  2. SPC date 13th September 2012
  3. DRDO Hqrs approval 1st October 2012
  4.  Tender Date 1st October 2012 (see the efficiency)
  5.  Limited tender enquiries will be issued to vendors registered with R&D Labs/Estts, DGS&D, NSIC, other Government departments and to the firms of national repute who will be registered before their bid is considered as per Para 3.2.2.  Such tenders may also be invited from the Government designated agencies. While inviting limited tender enquiries, due care will be observed in selecting vendors, especially in the case of traders who are not the actual manufacturers/authorized agent, to ensure better after sale service. (Rule 7.6.1 PM 2006)
  6.  Seven firms were mentioned in demand to which tender enquiries were sent. Out of these Modern Scientific Centre, Kanpur, Dhankar Enterprises, Kanpur,  Manglam Traders, Kanpur, Scientific Aid and Omega Furnace Industries, Banglore were registered in July 2013 at DMSRDE.
  7.  In this case two firms Dev Industrial Enterprises, Mumbai and Inschem, Lucknow are non-registered firms.
  8. As per PM 2006 Rule 7.6.1 “Limited tender enquiries will be issued to vendors registered with R&D Labs/Estts, DGS&D, NSIC, other Government departments and to the firms of national repute who will be registered before their bid is considered as per Para 3.2.2.  Such tenders may also be invited from the Government designated agencies. While inviting limited tender enquiries, due care will be observed in selecting vendors, especially in the case of traders who are not the actual manufacturers/authorized agent, to ensure better after sale service”.
  9. Dhankar Enterprises is not registered for Scientific Equipment/Instruments at Commercial Tax Department, Uttar Pradesh then how tender inquiry was sent to Dhankar Enterprises. Copy of registration enclosed.

  12. Supply was made on 27 Sept 2013 while in demand the delivery period was 3 months from date of supply order but SO was placed on 26 Feb 2013 that is delivery was made after 7 months (27 Sept 2013 – 26 Feb 2013 = 7 Months)
  13. No VAT /Tax was claimed in SO as basic cost of item was 1681500.00 only.
  14. Actual cost of item is Rs. 560000 + VAT 5.5% (560000*5.5% = 30800) . Thus total cost is 590800. But SO was placed for  Rs. 1681500.00. Hence item was purchased at very high price and commission of Rs. 1681500 – 590800 = 1090700.00 was made by Dr. AK Saxena, Director, DMSRDE, Kanpur. A thorough investigation is needed to explore the relation between Dr A K Saxena, Director, DMSRDE and M/s Manglam Traders, Kanpur. It may be reveal crores of crores rupees scam in DMSRDE and RCI, DRDO.

LTC Scam in DRDO Labs

SUBJECT: LTC Scam in DRDO Labs

The scientists from DRDO are involved in LTC scam

According to DoPT guidelines issued time to time, DRDO officials can avail LTC80 scheme for self and their wards.

Taking the privilege some of the scientists / officials have found out the method to temper normal e-tickets of Air India to LTC80 tickets.

This way the government is paying more and Air India is getting less, the balance amount goes to the pocket of individuals.

Sh G S Malik, Director, DTRL, DRDO received written complaints on 31st December 2013 and 1st January 2014 of this racket which was run by a scientist of DRTL, DRDO, Ministry of Defence.

An inquiry committee was setup and the finding reveals that LTC claim was settled with doctored / tempered Air India E- tickets.

Sh G S Malik, Director, DTRL, DRDO reported immediately  this matter to Director Vigilance, DRDO Hqrs vide letter No DTRL/Dir/Vig_LTC/2014 dated 3rd January 2014 along with evidences. Copy enclosed for ready reference.

The interesting facts is that top DRDO official a CC R&D instructed to Director, Vigilance & Security to rafa/dafa/ buried this case.

DRDO lab loosed their credentials, the morals, the values, ethics and highly place officials of DRDO has gone down to such an extent that the youngsters of DRDO are at the loss.

Honourable Defence Minister has taken strong action against some top officials, who played with constitutional authorities based on the recommendation of CVC & CVO, MoD.

This LTC scam is not only pertain to DRTL but if examined thoroughly more than 100 cases from  will found from Delhi based DRDO Labs.

For your ready reference the sample e- ticket which was booked by one Sc’D’, DTRL using his credit card for Sh Sanjeev Kumar, Sc ‘D’, LASTEC, DRDO. It clearly indicates that scam is not limited to DTRL.

It is requested that the competent authority may please be directed for through investigation in DTRL, LASTEC, DIPAS, INMAS, CEPTAM, SAG, ISSA, SSPL, DIPR, CFEES etc. and CC R&D should not be allowed to jeopardize the investigation.

Recent News on LTC scam in various News papers.

The CBI filed an FIR against him. Nine MPs have been accused of inflating travel bills to claim expenses they never paid.

CBI is still probing if officials of Shipping Corporation of India, Air India and Ordinance Factory Board (OFB), Jabalpur committed fraud. The agency had registered a preliminary enquiry into the matter in August.

CBI has alleged that senior and mid-level officers in government organisations colluded with private tour operators to take personal trips with families to far-off destinations and then claim the amount spent as official visits.

  1. Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
  2. DRDO’s Director Material Management distributed to all Labs & Establishments a manual named “DRDO Purchase Management -2006” which was duly approved by President of India and with the concurrence of Ministry of Defence (Fin/R&D) vide their ID No 752/IF (R&D) dated 20 March 2006.
  3. “DRDO Purchase Management -2006”  page no 12,  para 4.5.2 stated     Directors of Labs/Estts will observe adequate caution while working out detailed specifications of an intended procurement that these are not tailor made to suit a particular brand of product. Broad coverage of the functional performance and environmental parameters will be spelled out in the specifications to allow competition. For this purpose a computer-based data bank of similar products, along with broad specifications will be maintained and updated frequently so as to facilitate fair competition in purchases.
  4. The following case of procurement of Fume Hoods is totally violated procurement rules laid down by DRDO.
    • Tailor made specification was made and brand name as well as model number mentioned in tender inquiry.
    • Make cannot be mentioned in demand only item can be purchased whichever is having lowest prise. So he can purchase a branded item of particular firm unless it is propitiatory item. Bio base is Chinese Company so how they decided to purchase that brand when several manufactures and brands of Fume Hood were available in the Market
    • Item was purchased by Estate & Works Division, This division cannot indent & purchase Fume hood as this division is only for maintenance of Buildings & Govt accommodation.
    • Purchased qty 14 because the total price comes under fifty lakh which was within the limit of Director’s purchase power. Purchase Rules was violated as case was so designed that cost remain below 50 Lakhs (the Financial Power of Director)
    • Purchased exorbitant price because the same item is available in open market @ 1350 $ and dollar rate of date of supply order (19 November 2013) was Rs 62.26.
    • Open Market cost of  Fume Hood Chamber (Make- Biobase, Shandong Model- FH-1200 C) $1350 X 62.26 ( Dollar Rate on 19 Nov 2013 ) = Rs 84051.00
    • Fume Hood Chamber (Make- Biobase, Shandong Model- FH-1200 C) was purchased @ 290540.00 and Quantity 14 was purchased total amount Rs. 45,76,005.00. (With Tax)
    •  Actual cost of 14 no of Fume Hood Chamber (Make- Biobase, Shandong Model- FH-1200 C) Rs 84051.00 X 14 = Rs. 1176714.00
    •  Purchased exorbitant price by DMSRDE – Rs 290540.00 x 14 = Rs 4067560.00
    •  Total loss of poor tax payers Rs 4067560.00 – Rs. 1176714 = Rs 2890846.00

BRIEF FACTS OF THE COMPLAINT 

  1. Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
  1. Purchase Management 2006 is applicable for procurement of store items in DRDO. Gross irregularities and violation of Purchase Management 2006 was made in procurement of Analytical Weighing Balance in year 2012-2013 when the cases were indented by officers of Material Management Group under illegal orders of Head MMG & Dr. A. K. Saxena, Director, DMSRDE.
  1. Dr. A K Saxena Director is an incompetent, arrogant and corrupt administrator who has not only violated but also subverted all rules and regulations of purchase.  In earlier complaints pending with Central Vigilance Commissioner at New Delhi and now in the present case, it becomes amply clear that he is the not only the ‘CENTRE OF GRAVITY’ but also ‘PATRON-IN-CHIEF’ of corruption menace in DMSRDE.  Relevant rules and regulation of DRDO PURCHASE MANUAL-2006 for the execution of procurement are a mentioned below:
  • Para 4.6.2 of DRDO purchase manual 2006 Corrigendum 03 clearly  states: 4.6.2 For demands for stores above Rs 5 lakh, the level for initiation for putting up to SPC/DRDO HQrs/ various committees with delegated powers under various programmes and projects will be as under: (a) Above Rs 5 lakh to Rs 25 lakh: initiation by Scientist ‘C’/ TO ‘C’ and above, countersigned by project or group head. (b) Above Rs 25 lakh to Rs 50 lakh: initiation by Scientist ‘D’/ TO ‘D’ and above, countersigned by project or group head. (c) Above Rs 100 lakh and above: initiation by Scientist ‘E’ and above, countersigned by project or group head.
  • Para 5.1.1 of DRDO PURCHASE MANUAL 2006 clearly states that  following cautions shall be observed for purchasing stores:
  • Bulk purchases will normally fetch quantity discount. This should, however, not lead to over-stocking resulting in expiry of shelf life or redundancy due to obsolescence.
  • Purchase orders will not be split-up to avoid the necessity for obtaining sanction of the higher authorities.
  • Open tendering should be adopted to ensure fair competition, unless it is considered expedient to follow other modes of tendering due to urgency. Purchases will be made from the lowest acceptable tenderer. Adequate care would be exercised to ensure that delivery from the vendor is within the specified time schedule.
  • Para  7.6 Corrigendum 02 of DRDO PURCHASE MANUAL 2006 clearly states: LIMITED TENDERS: This mode of tendering may be chosen when estimated value of goods to be procured is up to Rs. 25 lakh (Rupees Twenty five lakh).  Purchase through Limited Tender Enquiry may also be adopted even where the estimated value of the procurement is more than Rs 25 lakh, in the following circumstances as per the delegated financial powers in vogue.

(a)  When the sources of supply are definitely known and are limited.

(b)  When it is not in the public interest to call for open tenders due to reasons of security or when superior authorities have issued specific instructions in this regard.

(c)  When Government policies designate specific agencies.

(d)  When open tender system adopted during previous one year has established sufficient and assured sources of supply at competitive rates.

(e)  When the requirement of stores is urgent and the desired delivery schedule cannot be met if open tenders are invited, the indenting officer must place on record, the nature of the urgency and why the demand could not be anticipated earlier. Urgency of such cases will be specifically monitored till the placement of order.

(f)   EPC approval issued by DMM in all cases shall include the names of the vendors to whom the Tender enquiries must necessarily be sent in addition to others.

  • Para 7.6.3 of DRDO purchase manual 2006 clearly  states:The limited tender enquiries will be floated to all registered firms with a minimum of seven such firms for the concerned item(s). In a case where the number of registered firms is less than seven, these enquiries will be issued to all known firms dealing with the stores and efforts made in this regard will be recorded on the file”. Corrigendum 03 clearly  states: “Add: at the end of the para 7.6.3Vendor selection for the purpose of Limited Tender enquiries must be done with utmost diligence so as to give fair opportunity to all known vendors who are willing and eligible for consideration. The enlistment and delisting of registered vendors should be based on clearly laid down criteria and the existing provision for buildup followed rigorously  by periodically referring to vendors registered with R&D Labs/ Estt., DGS&D, NSIC, other Government  Departments and to the firms of national repute who will be registered before their bid is considered.”
  • Para 7.13.3 of DRDO purchase manual 2006 clearly  states: Scrapping of tenders will be resorted to in the following cases with the approval of the Director:
    • Change in basic specifications governing supplies after opening of tenders.
    • Non-receipt of offers as per specifications laid down.
    • Sudden downward market trend.
    • Prices quoted being very high/unreasonable.
    • Large/manifold variation in tendered prices.
    • Para 3.2 of DRDO purchase manual 2006 clearly  states: REGISTRATION OF VENDORS: The vendors will be registered by Labs/Estts for different categories of stores, e.g., raw materials, chemicals, machine tools, instruments, electronics and electrical items, timber, fabrication jobs and other general stores etc. The credentials of firms seeking registration will be verified to ascertain their credibility with regard to financial standing i.e. annual accounts, capacity, reliability, bonafides (income-tax returns sales tax No. etc.) and past performance, etc. For this purpose, specialists from the respective fields will be included in the Vendor Registration Committee while examining the applications of vendors seeking registration. The registration committee will be appointed for one financial year. The constitution of the vendor registration committee will be as follows:

1. Scientist- F Chairman

2. Scientist- D/E Member

3. Head MMG or Rep Member Secy.

The Chairman can co-opt specialist members if considered necessary.

4.    Mr. Aneesh  Kumar Singh, Scientist ‘C’,  Mr. Amit Sarriya,  Head Material Management Group, Mr. R.K. Jain, Scientist ‘E’ Chairman Vendor Registration Committee Dr. D. N. Tripathi, Scientist ‘F’ Chairman TEC, and Dr. T. C. Shami, Scientist ‘F’, Chairman SPC(above Rs 10 lakh) for    possibly under heavy pressure entered into a criminal conspiracy with Dr. A K Saxena, Director  & CFA of splitting requirement of the same items to fabricate store demands violating  DRDO purchase manual 2006, details of which are mentioned below:

  • the 02 demands were cleared by the SPC (Store Procurement Committee) dealing cases above Rs. 10.0 lakh, headed by  Dr.  T C Shami, Scientist ‘F’,  as Chairman of SPC 2012,
  • Technical evaluation of Techno Commercial Bid  in case of Analytical Weighing Balance was done by a TEC comprising of  Dr. D. N. Tripathi, Scientist ‘F’ Chairman TEC, Mr. A. K. Dixit Scientist ‘E’ (Expert Member),  Mr. Aneesh Kumar Singh, Scientist C(User Member) and Mr. A. K. Mishra Technical Officer ‘C’(Member Secretary). Queries were asked from Vendors vide letter dated 19 June 2013 Kawach Instruments & Chem Tex Noida & Abhigyan Traders, Kanpur was  technically disqualified in TEC report for case at Sl. No.01.

  • Point to be noted that
    • requirement of “Analytical Weighing Balance” received from various user divisions in response to MMG ION (Annexure-I) was  deliberately split into two demands below Rs. 50.0 Lakh to keep it within the lab director CFA power so as to avoid DRDO HQrs  concurrence. These demands were cleared in same SPC meeting held on 07-Mar-2013 and limited tender enquiries were issued on same date 03-Apr-2013 to exactly similar vendors as shown in Table-I below.
    • Only 06 pet vendors are given tender enquiry whereas  as per para 7.6.3 DRDO purchase manual 2006 the limited tender enquiries will be floated to all registered firms with a minimum of seven such firms for the concerned item(s). Further vendors should be selected in accordance to Para 7.6.3-Corrigendum 03 to DRDO purchase manual 2006.
    • Further vendors selection  for the two demands  at Sl.No.01& 02 is improper as:
      • M/s Nav Jyoti Scientific Sales Corporation Lucknow (Reg. No. DMSRDE_013/01C/19_10L for Chemicals, Instruments) and M/s Kawach Instruments & Chem Tex Noida (Reg. No. DMSRDE_012/03C/073_10L for Chemicals, Instruments, Textiles,) were registered in 2013  for supply orders limited up to Rs 10.lakh then how these vendors were selected for tender inquiry for cases costing above  Rs. 10 Lakh
      • M/s Abhigyan Traders, Kanpur (Reg. No. DMSRDE_07/03C/044 for Chemicals) and M/s National Industrial Corporation (NIC) Kanpur (Reg. No. DMSRDE_11/03C/61 for Chemicals) are registered in DMSRDE only for Chemicals supply then how they were selected for tender inquiry for Scientific Equipment.
      • Demand for such specialized equipment is raised by Material Management Group centrally based on requirements submitted  by user divisions under pressure of Dr. A K Saxena, the Director,  in response to the ION issued by Material Management Group(Annexure-I)  despite no demand was raised from user divisions.
      • there is no requirement for this store in such a huge quantity in DMSRDE as it may be  sufficient to provided such costly and specialized equipment in Central Analytical Facility which is equipped with various special purpose sophisticated costly equipment. This is an attempt to create redundant facilities leading to underutilization of the equipment and this can be treated as wastage of poor tax payers money.

 6.    Point to be noted that

Dr. A. K. Saxena, the Director, has got registered more than fifty of his pet vendors in year 2013 through formulation of an illegal Vendor Registration committee with his pet man Mr. R.K. Jain Scientist ‘E’ as Chairman despite the fact that there are more competent and honest Scientist’s ‘F’ available in DMSRDE who are not only underutilized but not even acknowledged.. This  is a clear cut violation of para3.2 of DRDO purchase manual 2006 by Dr AK Saxena, for placement of the supply  order on limited tender to known vendors clearly exhibit his vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms.

Point to be noted

  • For Analytical weighing balance at Sl.no.01
    • As per Para 4.6.2 DRDO purchase manual 2006 Corrigendum 03 Scientist ‘C’ can raise demand up to Rs.  25.0 lakh.
    • This limited tender above Rs 25 lakh violates Para 7.6 DRDO purchase manual 2006 Corrigendum 02.
    • Placement of supply order worth Rs. 30.92 (costing  close to  estimated cost Rs 33.6 lakh) on limited tender basis  to known local/pet vendor M/s Nav Jyoti Scientific Sales Corporation Lucknow, clearly exhibit vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms
  • For Analytical weighing balance at Sl.no.02
    • The Demand for Dual Range High Precision Semi Micro Balance with Density Determination Kit is exorbitantly estimated at the rate of Rs 6.4 Lakh (i.e. Total cost for 03 No. Rs 19.2 Lakh ) as:
  • Similar Semi Micro Dual Range High Precision Analytical Balance with Density Determination Kit was procured by a user division vide demand dated in 08-Aug-11 and supply order dated 19-Dec-2011 at the rate of Rs 1.6 lakh from M/s P.D. Scientific Industries, Kanpur.
  • For a demand estimated Rs.19.2 lakh the supply order costing Rs 9.7 lakh at the rate Rs 3.3 lakh only was placed to lowest bidder M/s Kawach Instruments & Chem Tex Noida.
  • Point to be noted that M/s Kawach Instruments & Chem Tex Noida could not be technically disqualified in this case by the TEC otherwise this supply order also might be costing close to estimated cost Rs 19 lakh as in first case above.  It appears that the first case is exorbitantly estimated too.
    • Item nomenclature is slight changed by changing the location of “Semi Microat Sl. No. 02 & 03 with a view to create a differentiation.  
    • M/s P.D. Scientific Industries Kanpur was not considered for the said tender enquiry otherwise prices might have lowered further in order of case at Sl. No. 03.
    • Scrapping of tenders should be considered in case of sudden downward market trend or Large/manifold variation in tendered prices as per DRDO purchase manual 2006 Para 7.13.3 .

9.      Despite all above placement of the supply  order on limited tender to known vendors clearly exhibit vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms

10.       From the facts stated above, it is amply crystal clear that prima facie material regarding ‘ABUSE OF AUTHORITY’, ‘DICTATORIAL TRAITS ’, ‘PATRONIZATION OF CORRUPTION’ as regards to arrogant and corrupt Dr. Arvind Kumar  Saxena, Director DMSRDE exists.

That he has created a robust cobweb of corruption system’ killed proven departments / institutions in DMSRDE to hold system to ransom. This is evident from the fact that sequentially right from the indenter, head of the Division, whole Stores Purchase Committee including its CHAIRMAN and lastly HEAD MMG have fallen under tremendous pressure into criminal conspiracy to cheat DRDO and exchequer’s money.

In pursuance of the said criminal conspiracy,  Dr. A. K. Saxena, Director, present Head MMG, and Mr. A. K. Singh, Technical Staff Officer of Director, DMSRDE are tampering with evidence / documents that shall be prejudice to fair trial, investigation, trial or any inquiry.

11.      In view of the above mentioned facts and evidences it is earnestly requested that an order for through investigation of all procurement done by Dr.  A. K. Saxena after assuming charge as Director, DMSRDE, DRDO, Kanpur to stop further corruption and wastage of poor tax payers money.

BRIEF FACTS OF THE COMPLAINT

  1. Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
  2. Purchase Management 2006 is applicable for procurement of store items in DRDO. Gross irregularities and violation of Purchase Management 2006 was made in procurement of Dyneema Fabric in year 2011-2013 when the cases were indented by officers of Composite Materials Divisions  under illegal orders of Head, LED & Composite Division, Head MMG & Dr. A. K. Saxena, Director, DMSRDE.
  3. Dr. A K Saxena Director is an incompetent, arrogant and corrupt administrator who has violated all the rules and regulations of purchase.  In earlier complaints pending with Central Vigilance Commissioner at New Delhi and now in the present case, it becomes amply clear that he is the ‘CENTRE OF GRAVITY’ of corruption menace in DMSRDE.  Para 5.1.1 of DRDO PURCHASE MANUAL 2006 clearly states that  following cautions shall be observed for purchasing stores:
  • Bulk purchases will normally fetch quantity discount. This should, however, not lead to over-stocking resulting in expiry of shelf life or redundancy due to obsolescence.
  • Purchase orders will not be split-up to avoid the necessity for obtaining sanction of the higher authorities.
  • Open tendering should be adopted to ensure fair competition, unless it is considered expedient to follow other modes of tendering due to urgency. Purchases will be made from the lowest acceptable tenderer. Adequate care would be exercised to ensure that delivery from the vendor is within the specified time schedule.
  1. Mr. R. K Tiwari,  Head Composite Division and also Head Light Engineering Division, Dr. D N. Triphati, Head Rubber and Adhesive Division, Mr. Amit Sariaya, Head MMG (2011-2012), Mr. Shielendra Kumar Accordingly Head MMG (2013), Mr. AK, Scientist ‘D’ and Mr. Arun Kumar Singh, Scientist ‘D’ possibly under heavy pressure entered into a criminal conspiracy with Dr. A K Saxena, Director  & CFA of splitting demands of the same items, details of which are mentioned below:
  2. PROCUREMENT IRREGULARITIES OF DYNEEMA

Dyneema worth total estimated cost of Rs. 1.05 Crore was procured on limited tender basis by splitting requirement

  • 11 demands below Rs.10 lakh (to avoid TPC) were raised during 16 months period (from May 2011 to Sep 2012) which were cleared by the SPC (Store Procurement Committee) dealing cases below Rs. 10.0 lakh, headed by  Dr.  Ashok Ranjan, Joint Director and Mr. Darshan Lal, Joint Director,  as Chairman of SPC 2011 and SPC 2012, Respective   supply orders placed during Aug 2011 to  Aug 2012.
  • One demand raised by Mr. A. S. Parihar and Dr. D.N. Tripathi, Joint Director in Apr 2013 for which supply order is placed on Manglam Traders in July 2013 worth Rs 7.06 Lakh. One demand raised by Mr. Arun Kumar Singh and Dr R. K. Tiwari, Joint Director, in Feb 2013 for which supply order is  placed on SMPP Pvt. Ltd. in Nov 2013 worth Rs 25.8 Lakh.
  • Point to be noted that there is no requirement for this store in such a huge quantity as there is no running project work on Bullet Proof Jacket with DMSRDE.
  • Details are as show in table-1

    • The requirement split into demands below Rs. 10.0 Lakh to avoid TPC and open tender which would have fetched better quality at discounted prices.
    • Further 02 Supply Orders worth Rs 13.5 Lakhs were placed on a pet vendor Mangalam Traders, Kanpur. 02 Supply Orders worth Rs 12.5 Lakhs were placed on a pet vendor Shahi Traders, Kanpur 01 Supply Orders worth Rs 7 Lakhs were placed on a pet vendor Pee Cee Textile Stores Kanpur.
    •  06 supply orders worth Rs 58.5 Lakhs were placed on a pet vendor S M Pulp Packaging Pvt Ltd, a  manufacturer of molded pulp products, protective packaging, presentation packaging and Industrial packaging which turned to an Armour manufacturer over a period of two years  by adding  the armor division through buildup of technical knowhow in the strategic field while working with scientists of DMSRDE Kanpur on development of Bulletproof Jacket.(pls refer website http://smgroupindia.com/pulp-molded-packaging.htm).  SMPP Pvt Ltd was not registered vendor at DMSRDE from 01.01.2011 to July 2013, when the vendor supplied the Dyneema in DMSRDE.. It is interesting to see that BPJ developed by DMSRDE Kanpur is still waiting for a customer where as S M Pulp Packaging Pvt Ltd are established supplier for the same as they claim in the website that there BPJ is certified by HP White USA and TBRL Chandigarh a nodal agency of DRDO for ballistic testing.
    • Further 02 Supply Orders worth Rs 13.5 Lakhs were placed on a pet vendor Mangalam Traders, Kanpur. 02 Supply Orders worth Rs 12.5 Lakhs were placed on a pet vendor Shahi Traders, Kanpur 01 Supply Orders worth Rs 7 Lakhs were placed on a pet vendor Pee Cee Textile Stores Kanpur
    • Placement of these orders on limited tender to non-registered, known/ local vendors clearly exhibit vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms
  • Further interesting statistics out of above is as under
    • 04 demands worth Rs. 25.5 Lakhs were raised on 15th Sep 2011 by Mr. Amit Kumar, posted in Composite Material Division, and Dr. R. K. Tiwari, Joint Director, through Light Engineering Division (LED) with a deliberate attempt to bypass Group Director of Composite Material Division, an honest person Dr. D. K. Setua for the reason that splitting of demand is not permissible as per the guide lines of DRDO’s Purchase Manual 2006.It is important to note that Mr. AK, Scientist ‘D’ is not a part of Light Engineering Division (LED). He is posted in Composite Material Division. How he can indent the cases of LED?
    • Further these demands were cleared in SPC meeting held on 28th Sep 2011 and their tender enquiry was issued on same date 03rd Oct 2011 and very magically all   the 04 No. Supply orders worth Rs. 28.5 Lakhs were fetched by the same firm M/s SMPP Pvt. Ltd. on same date  11th Nov 2011.
    • Placement of these orders on limited tender to M/s SMPP Pvt. Ltd.  clearly exhibit vested interest through manipulation in prices, quality, quantity etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms. SMPP Pvt Ltd was not registered vendor of DMSRDE during 2011-2013.
  • In a nutshell point is that out of  Rs 1.05 crore only 02 supply order worth Rs. 16 lakhs were placed on OEM M/s DSM Dyneema BV.  Dyneema is a proprietary item of OEM M/s DSM Dyneema BV and procurement from OEM might have saved around 35% of the cost paid in form of custom duty, local dealer profit and other overheads which comes to Rs 25 to 30 lakhs of loss of poor tax payer’s money.

6.  From the facts stated above, it is amply crystal clear that prima facie material regarding Abuse of Authority by arrogant and corrupt administrator Dr. A. K. Saxena, Director DMSRDE exists.

  • That he has created a robust cobweb of corruption system and that he entered into criminal conspiracy with Chairman’s of two successive SPC committee, Head Composite Division, Head Light Engineering, Head Finance Division  with an intention to cheat DRDO and exchequer’s money.
  • In pursuance of the said criminal conspiracy,  Dr. A K Saxena, Director, present Head MMG,  and Mr. A K Singh, Technical Staff Officer of Director DMSRDE are tampering with evidence / documents that shall be prejudice to fair trial, investigation, trial or any inquiry.

7.    In view of the above mentioned facts and evidences it is earnestly requested that an order for through investigation of all procurement done by Dr. Arvind Kumar  Saxena after assuming charge as Director, DMSRDE, DRDO, Kanpur to stop further corruption and wastage of poor tax payers money.

BRIEF FACTS OF THE COMPLAINT

  1. Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
  2. Purchase Management 2006 is applicable for procurement of store items in DRDO.  Gross irregularities and violation of Purchase Management 2006 was made in procurement of Chemicals in year 2012 when the cases were indented by officers of MMG under threat illegal orders of Head ‘Materials Management Group’ (MMG)& Dr. A K Saxena Director DMSRDE
  3.  Dr. A K Saxena Director is an incompetent, arrogant and corrupt administrator who has violated all the rules and regulations of purchase. In the year 2012 while chairing ‘Head of Divisions’ (HOD) meeting, he directed that all HOD’s shall ensure that all demands of chemicals what-so-ever should be immediately forwarded to Head MMG. Head MMG shall consolidate all the requirements and one order shall be placed to get maximum discount from the suppliers
  4. Accordingly Head MMG circulated a memo requesting for the details of chemicals as per the enclosed format. Now here is where criminal conspiracy starts and instead of placing one consolidated demand, Head MMG & Dr. A K Saxena, Director  & CFA split the orders of various chemicals to the tune of Rs. 2.2 Crores.
  5. Procurement of CHEMICALS

Chemicals worth total estimated cost of Rs.2,19,19,074/-were procured centrally by a single division i.e. Material Management Group on limited tender basis splitting total demand against requirements received from various divisions of lab

  • into 30 cases below Rs.10 lakh(to avoid TPC) during 10 months period(from 12 Oct 2011 to 31 July 2012)
  • these demands were cleared by the same SPC (Store Procurement Committee)  Chairman Darshan Lal Joint Director, and
  • issuing more than 40 supply orders during Apr 2012 to  Dec 2012
  • Point to be noted that only in Month of Oct 2011   22 Demands worth total estimated cost of Rs. 15333034.00 were raised out of which 16 Demands worth total estimated cost of Rs 11471067.00 were cleared in one SPC meeting held on 16th Nov 2011 by SPC (Store Procurement Committee) dealing cases costing less than Rs 10 lakh headedby Chairman Darshan Lal Joint Director. Further it has bypassed the expert higher level SPC (Store Procurement Committee) dealing cases costing more than Rs 10 lakh headed by an honest officer Chairman Dr. DK Setua, Addl. Director having expertise with chemical background who might have not permitted splitting of cases in this manner.
  1. These 30 No. Cases for which at least details up to supply order date(which confirms that supply order is prepared) are mentioned in following tables

  • For Sl. 01-03 total estimated cost  is Rs. 2832300.00 and total value of 08 Supply orders is Rs. 2635059.00
  • Point to be noted that
    • These Demand are raised on Limited Tender basis by same indenter officer, on same date 31-Jul-12 ,
    • SPC conducted on 22nd Aug 2012,
    • CFA approval accorded on 05-Sep-12, Tender Enquiry issued on the same date 05-Sep-12, and
    • 08 No Supply orders worth Rs. 2635059.00 are placed on same date 4-Dec-2012.
    • Demands of chemicals vide DMSRDE/13MMG042 & DMSRDE/13MMG041 at Sl.No. 01 and 02 reflect same chemical “Ethylene Di Chloride AR Make: Rankem/SD fine /Qualigens /SRL Each Pack of 2.5 ltr”
    • The requirement of chemicals was split into demands below Rs. 10.0 Lakh to avoid TPC and open tender.
    • DRDO Chemical Rate Contract exists w.e.f. 17th Sep 2012 and placement of these supply orders under the RC would have fetched better quality at discounted prices.
    • Placement of these orders on limited tender to known local vendors ignoring DRDO Chemical RC  clearly exhibit vested interest through manipulation  in prices, quality, pack size etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms.chem table1

  • For Sl. 04-08 total estimated cost  is Rs. 3422198.00
    • These Demand are raised on Limited Tender basis in December 2011 from 02nd to 31st Dec2011,
    • These Demand are cleared in 05 SPC meetings  conducted over a period of 45 days from  21st Dec 2011 to 02nd Feb 2012
    • CFA approval accorded and Tender Enquiry issued over a period of 45 days from  26th Dec 2011 to 14th Feb 2012, and
    • Supply orders prepared over a month period from 17th Apr 2012 to 22nd May 2012.
  • Point to be noted that
  • The requirement of chemicals was split into demands below Rs. 10.0 Lakh to avoid TPC and open tender which would have fetched better quality at discounted prices. Further it has bypassed the expert higher level SPC (Store Procurement Committee) dealing cases costing more than Rs 10 lakh.

Placement of these orders on limited tender to known local vendors clearly exhibit vested interest through manipulation  in prices, quality, pack size etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms.chem table2

    • These Demand are cleared in one  SPC meeting  conducted on   16th Nov 2011
    • CFA approval accorded and Tender Enquiry issued over a period of 15 days from  8th Dec 2011 to 21st Dec 2011, and
    • Supply orders prepared over six months period from  14th Jan 2012 to 22nd Jun 2012 (i.e. there appears no urgency).
  • Point to be noted that
  • The requirement of chemicals was split into demands below Rs. 10.0 Lakh to avoid TPC and open tender which would have fetched better quality at discounted prices. Further it has bypassed the expert higher level SPC (Store Procurement Committee) dealing cases costing more than Rs. 10 lakh headed by an honest officer Chairman Dr. DK Setua. Addl. Director having expertise with chemical background who might have not permitted splitting of cases in this manner.

    • Out of these Demand most are cleared in one SPC meeting conducted on   16th Nov 2011 and only four demands were cleared in SPC meetings held on 8th Dec 2011 (01),  06th Jan 2012 (02 ) and 02nd Feb 2012 (01).
    • CFA approval accorded and Tender Enquiry issued over a period of 45 days from  29th Nov 2011 to 14th Feb 2012, and
    • Supply orders prepared over two and half months periodfrom  18th May 2012 to 30th  July2012.
  • Point to be noted that
    • The requirement of chemicals was split into demands below Rs. 10.0 Lakh to avoid TPC and open tender which would have fetched better quality at discounted prices. Further it has bypassed the expert higher level SPC (Store Procurement Committee) dealing cases costing more than Rs 10 lakh headed by an honest officer Chairman Dr. DK Setua, Addl.     • Placement of these orders on limited tender to known local vendors clearly exhibit vested interest through manipulation  in prices, quality, pack size etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms.chem table4

From the facts stated above, it is amply crystal clear that prima facie material regarding Abuse of Authority by arrogant and corrupt administrator Dr. A K Saxena, Director DMSRDE exists.

    • That he entered into criminal conspiracy with Mr. Darshan Lal, Joint Director, Chairman SPC and Head MMG with an intention to cheat DRDO and exchequer’s money.
    • In pursuance of the said criminal conspiracy,  Dr. A K Saxena, Director and Mr. A K Singh, Technical Staff Officer of Director DMSRDE are tampering with evidence / documents that shall be prejudice to fair trial, investigation, trial or any inquiry.

In view of the above mentioned facts and evidences it is earnestly requested that an order for through investigation of all procurement done by Dr A K Saxena after assuming charge as Director, DMSRDE, DRDO, Kanpur to stop further corruption and wastage of poor tax payers money.
