Subject: Intimation about deliberate illegal acts and omissions done in DRDO.

Sir,                                                                                                                                                     Please find following informations about the intentional unlawful acts and omissions made in DRDO, MOD

  1. Shri Krishan Kumar and Shri J B Singh retired joint Directors of AFHQ Cadre of the o/o JS (T) & CAO, MOD have been appointed as consultants in the ADA, Bangalore (an autonomous body under the administrative control of DRDO, MOD.) soon after their retirement on superannuation for the regular official work of ADA Bangalore and they have been illegally posted in the very sensitive establishment of DRDO i.e. RAC, Delhi. these two (02) consultants are used illegally to attend the court cases at CAT Delhi & High Court of Delhi filed by regular employees of the DRDO like court case of retired Scientist ’G’ Shri Virender Kumar of DEAL Dehradun. These consultants even illegally screen the applications of direct recruitments of scientist in DRDO & in such screening no meticulous screening is carried out by these consultants resulting selection of ineligible & relatives of senior scientist of DRDO as a quid –pro-que. Moreover there is imminent danger of favoritism and leakage of confidential and sensitive documents/information of RAC Delhi.
  2. Shri S T Rajan & Shri R Natrajan retired joint Directors of AFHQ Cadre of the o/o JS (T) & CAO, MOD have been appointed as consultants in the program office of DRDO HQ New Delhi in the missiles program for carrying out routine works for which already their relievers in the form of regular employees have been posted in DRDO HQ. these retired GOVT. servants are also appointed against the vacancies of ADA Bangalore and posted in DRDO HQ New Delhi. they don’t belong to scientific or technical cadre. There is imminent danger of the leakage of the sensitive informations at their level.
  3. Shri V K Shrama retired joint Directors of AFHQ Cadre of the o/o JS (T) & CAO, MOD has been appointed as consultants in the o/o DOP, DRDO HQ New Delhi with the approval of the then defence minister of GOI by misrepresentation & distortion of the material facts particularly with regard to the actual need of hiring him as consultant. His services have been utilized for the assignments  for which he has not been appointed. There is imminent danger of leakage of the sensitive information.
  4. Dr. A K Singh, present DOP of DRDO HQ New Delhi has played an active role in illegal extension of the periods of consultancy and in new engagements of consultancies of the retired GOVT. servants which he carried out with deliberate misrepresentation and distortion of the material facts submitted to the various senior authorities of DRDO, MOD & to the defence minister.
  5. Shri A K Singh present DOP of DRDO HQ New Delhi did not take any initiative to suspend Shri G Malakondiah, the then CC R&D (HR of DRDO HQ) for his conviction in a contempt of court case of the high court of the judicature of Chennai on 24-sept-2014 although this conviction news came in almost all the important daily newspapers including Hindusthan times New Delhi edition. No convicted person can be retained in GOVT. service even for a single day if the news of his conviction comes to the notice of the concerned public authority through formal or informal channel. The stay granted to Shri Malakondiah on 26-09-2014 by the apex court was restricted to the implementation of the imprisonment and not his conviction. The convicted person was deliberately allowed an opportunity to influence the witnesses and to tamper, mend, amend, destroy, replace & concealment of the concerned documents against the public interest due to lake of devotion to duty and possession of doubtful integrity of the concerned officials of the DRDO HQ New Delhi.
  6. the number of retired officials of DRDO, AFHQ Cadre appointed as consultants, directly violating the rules of consultancy, for the regular work of DRDO has reached to the alarming point where regular employees are considering illegal interference of the consultants in their regular sphere of duties and are also feeling frustrated and de-motivated which is playing havoc on the output of the DRDO as an organization.

I hope that some appropriate concrete action would be taken against the concerned guilty officers of DRDO & all Deviations and distortions would be set right in the national interest.

Fake DEAL Awards – letter received by Website

Dear friends in every Labs/Establishments of DRDO, Directors are having absolute powers and they are using these powers not in the interest of organization or nor in the interest of lab officials. In maximum cases all facilities provided by DRDO like infrastructures, encouragements monetary benefits like, cash awards, phone facilities, participation in Seminars, Workshop or other trainings all are reserved for chamchas.

The following letter I have received from DEAL’s friends via post, which is an analytical explanation of DEAL director Sh R C Agarwal’s management capabilities, his love to chamchas and community, with great Sh R K Agarwal who joined hands to fulfillment of desire of outgoing director.

From today onward Sh R C Agarwal, Director, DEAL, Dehradun  will be busy for arrangement of fair well of his cluster DG, Sh S S Sundaram who is in his last tour to Dehradun, he called his all cluster directors like his (Lal) Sh Haribabu, Srivastava, Director LASTEC, Delhi, Taxi Bill expert Ms Manjula, Director, DARE, Bangalore, Director, DLRL etc.

As per sources he like Tea……r so Dr S S Negi, Director, IRDE & future DG, ECS will be host and all other directors are coming in the name of cluster meeting and planning to give grand fair well party to great Sh S S Sundaram, only thing is left that Sh R C Agarwal after giving several CARS project to Deemed University Graphic Era not able to make Sundaram as Dr before his departure from DRDO. Request for assign scientific work to DR. A.K. SINGH, DIRECTOR, Dte of Personnel (DOP), DRDO HQ so that he could not influence the probe and temper the evidences and not able to protect DRDO’s corrupt officials and also not able to support corrupt DRDO Directors to harass the whistle blowers.

Honourable Sir,

It is requested to sake of DRDO image, productivity, to save money to curtailing in court cases, to protect honest scientists and whistle blowers please reshuffle immediately the DRDO scientists who are involved in non scientific assignments since 10 -15 years and main reason of DRDO’s current non productive image. These incompetent scientists are great example of exemplary carrier growth without doing science in DRDO.  Dr. A.K. Singh, Director, Dte of Personnel (DOP), DRDO HQ case is on the top, Dr R K Jain who is the boss of Scientists recruitment centre master mind of pushing all incompetent scientists on the top and country facing tremendous loss in respect of technology development, in respect of wastage in money and he was enjoyed his three consequent out staying promotion without doing science.

Sir, if you ask young real scientists, not incompetent ones, who come through LDCE will certainly going to pin point these two great scientists the main reason behind the downfall of DRDO.

The DRDO is great organisation in term of HR qualification enhancement. There are hundreds of examples where someone joined DRDO as peon/security guard or casual labour or Technician and within five to 10 years year span he become Technical Officer or in some cases scientists.

If you enquire DRDO regarding this kind of example of fake qualifications you will found thousands of degree diploma cases from unrecognised centre without doing study only managed. This is the major reason of DRDO’s corruption, nepotism and above all degradation of DRDO HR quality.

On 15th February 2015 DRDO, RAC conducted the limited departmental examination for scientist ‘B’ post for DRDO’s employees, you will find more than 90% cases candidates not having properly UGC or ACETE or DCE approved degrees. The certificates they enclosed are from recognised universities or institutes but the process of acquiring degrees are totally not recognised as per UGC norms.

And best part is that these two duos (Dr A K Singh & Dr. R K Jain) are the key persons to organise the game plan the application format was designed such a way that the degree acquiring process not able to revealed the ineligibility of candidate..

But interestingly till date they have not found single case only with the help of RTI four high profile cases were exposed resulted two scientists job was annulled and two are under process and Ex Defence Minister approved for CBI inquiry on 14th  October 2013 and also given approval for reconsider the DRDO recruitments through UPSC,

Sir, if government is serious about to revamp DRDO and make it productive worth organisation than first thing scarp RAC & CEPTAM immediately. These two bodies are engaged almost more than 25 scientists and number of technical manpower. Both establishments are den of corruption and nepotism. Because of these two establishments DRDO getting third grade manpower.

Main evidence of these establishments working screens the recruitments and promotions and court cases and RTIs which are sufficient to justify the above statement.

I have filed following complaints against Dr. A.K. Singh, Director, Dte of Personnel (DOP), DRDO HQ.

In this connection I got Letter No. DVS/02/2053/P/63 dated 12 Feb 2015 from Dte of Vigilance & Security, DRDO, Min. of Defence, DRDO Bhawan, Rajaji Marg, New Delhi for confirmation to my complaint dated 14 Nov 2014 to Hon’ble Defence Minister (mentioned at sr. no. 4 above). Copy enclosed as Annexure-1 and I sent the confirmation vide letter dated 20 Feb 2015. Copy enclosed as Annexure-2.

Sir, on 25 March 2014 the Supreme Court of India told N. Srinivasan to step down as BCCI president so that a fair investigation may be conducted. The court found it “nauseating” that he should hold on to the post despite various courts censuring him.

On 27th November,2014 the Supreme Court said that N Srinivasan’s conflict of interest was “obvious” as he also owned a team i.e. CSK in the IPL. The court also asked BCCI if it was open to have fresh polls for a new board without N Srinivasan.

Accordingly Mr. N.Srinivasan announced that he was stepping aside from the post of President of the BCCI until the probe was completed ostensibly.

In the light of the above facts stated above, I kindly request  that for fair probe on complaints against Dr. A.K. Singh, Director, DOP, and request assigned him some other scientific assignment as per his credentials  so that he could not influence the probe and temper the evidences. Because he always boast up that his father was great police officer and that’s why I have able to retain bungalow at 14-B, Mother Teresa Crescent, New Delhi-110011 along with ministers. He also protects corrupt DRDO officials and supports them in lodging false FIR against the whistle blowers.

As Dr. A.K. Singh, Director (Personnel), DRDO HQ, New Delhi using his position to harass number of DRDO scientists like

Dr Gausal Azam Kahn, Sc ‘D’, DIPAS on the demand of his sister Dr Sahshi Bala Singh, Director, DIPAS He cooked false charge sheet against him who was joined DRDO direct Scientist D in DRDO NRI scheme,  

Sh N P Gupta, Sc ‘C’, DMSRDE a computer science background scientist thrown to Life Science Lab, DRL, Tezpur just because to protect corrupt Dr A K Saxena, Director, DMSRDE,

Sh D Muthuraja, Scientist E was shunted to ACME Nashik without work as he did complaint against the wrong deeds of Sh Guruprasad, Director, R&D Eng. of making Rath in R&D premises without any fear and wasted precious  poor tax payers money and DRDO manpower (two parliamentarian already raised question in zero hour on 18th December 2014)  

As per sources you might be received answer from Sh Guru Parsad , Director, R&D Eng., DRDO, Pune the bullock story   “making of Rath was not just devotional activity but also interesting technical task. Apart from saving bullock burden”

On last August DRDO award ceremony our Prime Minister mentioned to DRDO scientist please do something to reduce weight of our soldiers uniform like light weight shoes etc. That time our PM not aware of DRDO’s kind hearted scientists who already spent 5 corers Rs to saving bullock burden.

Dr A K Singh gave his all administrative supports to harass above scientists, Sir there are 100 of cases available their Dr A K Singh supporting Lab directors in ACR/APAR cases, promotions cases specially in minorities etc, Sir, It is requested please ask the total amount spend by DRDO in various court cases like CATs/District Courts/High courts and Supreme Court in Dr A K Singh tenure it is self explanatory of his administrative capability and degrading HR quality and image of DRDO.

Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of Dr M K Mandal, DG Life Science, DRDO’s official visit to DRL, Tezpur and Twang Arunachal Pradesh during October 2013 along with DR. Vijay Veer, Director, DRL and few officials of DRL. It was observed that the all expenditure towards Twang visit were managed by DRL guest house entertainment funds, for this one scientist drawn Rs 20000 for lodging and  food bills and simultaneously  all officials along with Dr M K Mandal also claimed in TA/DA as normal course.

  1. Provide the Temporary duty details of Dr M K Mandal, DG Life Science, DRDO visit of DRL, Tezpur in October 2013
  2. Provide the total amount claimed TA/DA with break up by Dr M K Mandal, DG Life Science against said visit to  DRL, Tezpur in October 2013
  3. Provide the number of officials from DRDL visited to Twang, Arunachal Pradesh
  4. Certified copy of bills submitted by Dr M K Mandal, DG Life Science against said Temporary duty to DRL, Tezpur and Twang Arunachal Pradesh.
  5. Certified copy of bills submitted by DR. Vijay Veer, Director, DRL against said Temporary duty to Twang Arunachal Pradesh.

Note: the requested information is not come under exemption of schedule  II of RTI Act 2005. Since, March 2014 end DRDO stopped to provide information under shadow of exemption. It is requested in above para-one of this request it is clear cut mentioned the corruption/ favoritism/ abuse of power, so before denial of information your point wise explanation is required that the matter not pertain under corruption.

Sir,

I have submitted eleven complaints to you regarding Corruption cases meted out by Dr. A.K. Saxena, Director, Defence Materials and Stores Research & Development Establishment (DMSRDE), Kanpur and several other Scientistsof this establishment working under Defence Research & Development Organisation (DRDO), Min. of Defence. Details of complaints along with involved Scientists are as follows:dmsrde rac

Based on my complaints to you a Fact Finding Committee was constituted by DGR&D and Scientific Advisor to Raksha Mantri to investigate my complaints and I have been informed by CPIO, DRDO regarding this. Copy of the letter No. RTI/01/2091/P/2014/0068 25 Feb 2014 from CPIO, DRDO is enclosed, Fact Finding Committee of DRDO yet to submit his report to DGR&D, DRDO.

The Fact Finding Committee under Chairmanship of Dr, S S Negi, Sc ‘H’, IRDE with as member Sh Manoj Bali, Sc ‘G’, Director, LIC, DRDO Hqrs and Sh Jagdeep, Sc ‘F’ Additional Director, DMM, DRDO Hqrs visited DMSRDE and inspected few files and interacted with scientists of DMSRDE. It is observed that the demeanor of  Fact Finding Committee was not appreciable, they treated the complainants unfairly because their mindset was prejudice and it is standard procedure in DRDO if someone want to give feedback about corrupt practice  of top officials they try to do their best for victimize such personnels. In this case the protest from complainants already present to DG, DRDO.

There are n numbers of examples, recently Sh Prakash Singh, SAO-II, LASTEC, who gave feedback of corrupt practices of Dr Anil Kumar Maini, Director, LASTEC and others,  the whole DRDO sit aside and they forcibly gave CRS to Sh Prakash Singh but grace of GOD you intervene the situation and save the service of honest person. Surprisingly, Dr Anil Kumar Maini is living DRDO from 31st May 2014 as he applied VRS and got sanctioned. His retirement was due on 31st Jan 2015, Big question what is the hurry, or he is maintain the LASTEC legacy, his predecessor was also took VRS.

In this case the Fact Finding Committee Chairman Dr, S S Negi, Sc ‘H’, IRDE is a pro management, yes man recently in Dehradun he set a unprecedented example as Chairman of ASCODAR committee. While handling a very sensitive issue of SC Community he tried to harass Sh Jagdish Kumar, TO ‘C’ by pressurizing him to give power point presentation to prove himself for 94 marks in APAR, which was not in the purview of ASCODAR. This act was done only in pressure of Sh R C Agarwal, Director, DEAL, Dehradun (Fax copy enclosed)

How can honest persons believe that Dr, S S Negi, Sc ‘H’, IRDE will give justice to his assignment of Chairmanship of Fact Finding Committee. Hope GOD will give him strength to come out from grip of corrupt gang of DRDO.

Besides this above mentioned my all complaints has been registered at CVC and Director (VIG.), Ministry of Defence is inquiring the complaints. In this connection I got letter No. CVC/RTI/13/1862/249925 dated 18th March 2014 from CVC.  “All complaints sent to CVO, MoD for further action.

Sir, this year in DRDO following delinquent Scientists of DMSRDE involved in Corruption got assessment call for promotion vide RAC, DRDO letter No. RAC/08/05/AB/M/2014 dated 12 March 2014.  Details are as follows:dmsrde rac2

Sir, DRDS Rules 1979 as amended are applicable for Recruitment & Promotion   in case of DRDS cadre (Scientists) and FCS is fully applicable in DRDO. As per DOPT OM No. AB-14017_37_2008-Estt-RR.pdf dated 10 September 2010 page 6 Para (ix)     and Page 9 Para(4) it is clearly stated that “Scientists/ Technical experts doing management/ administrative work in the Ministries should not be considered for up gradation under FCS, they should only be given benefit of up gradation under MACP”. Then how these corrupt officers got outstanding report and outstanding call despite being involved in Administrative/Management/Non-Scientific work. These officers got reward from Dr. AK Saxena, Director for indenting and clearing the cases of procurement that resulted Corruption in tunes of crores.

Sir, I therefore kindly request you to issue order to DGR&D, DRDO and Chairman, RAC to take appropriate action as per laid down direction of GOI for appearing in Assessment-2014 for DRDS till they got clearance from Vigilance (MOD) and Fact Finding Committee of DRDO.

Sh Avinash Chander in his reply to press question regarding engaging scientists in allied work justified but he forgot that VI Pay commission gave all incentives to scientists who are engaged in scientific work not for those who are working as clerk and wasting our country’s  poor tax payers money.

Unfortunately, DRDO top management encouraging scientists to work as managerial task, like HR, Admin, Stores, Security etc for long durations and scientists who are involved in such tasks are getting outstanding promotions without any scientific contributions. Dr A K Singh, DOP, Dr R K Jain, Director, RAC are exemplary examples to all DRDS scientists.  Result the real scientists either leaving the organization or dumped un-utilized or frustrated and every ugly acts are coming out from organisation.

Appropriate early action is requested, I would like to thanks you for recommendation of CBI investigation in DRDO recruitment scam for 10 top DRDO officials and also recommendation for alternate recruitment mechanism instead of RAC.

BRIEF FACTS OF THE COMPLAINT 

  1. Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
  1. Purchase Management 2006 is applicable for procurement of store items in DRDO. Gross irregularities and violation of Purchase Management 2006 was made in procurement of Analytical Weighing Balance in year 2012-2013 when the cases were indented by officers of Material Management Group under illegal orders of Head MMG & Dr. A. K. Saxena, Director, DMSRDE.
  1. Dr. A K Saxena Director is an incompetent, arrogant and corrupt administrator who has not only violated but also subverted all rules and regulations of purchase.  In earlier complaints pending with Central Vigilance Commissioner at New Delhi and now in the present case, it becomes amply clear that he is the not only the ‘CENTRE OF GRAVITY’ but also ‘PATRON-IN-CHIEF’ of corruption menace in DMSRDE.  Relevant rules and regulation of DRDO PURCHASE MANUAL-2006 for the execution of procurement are a mentioned below:
  • Para 4.6.2 of DRDO purchase manual 2006 Corrigendum 03 clearly  states: 4.6.2 For demands for stores above Rs 5 lakh, the level for initiation for putting up to SPC/DRDO HQrs/ various committees with delegated powers under various programmes and projects will be as under: (a) Above Rs 5 lakh to Rs 25 lakh: initiation by Scientist ‘C’/ TO ‘C’ and above, countersigned by project or group head. (b) Above Rs 25 lakh to Rs 50 lakh: initiation by Scientist ‘D’/ TO ‘D’ and above, countersigned by project or group head. (c) Above Rs 100 lakh and above: initiation by Scientist ‘E’ and above, countersigned by project or group head.
  • Para 5.1.1 of DRDO PURCHASE MANUAL 2006 clearly states that  following cautions shall be observed for purchasing stores:
  • Bulk purchases will normally fetch quantity discount. This should, however, not lead to over-stocking resulting in expiry of shelf life or redundancy due to obsolescence.
  • Purchase orders will not be split-up to avoid the necessity for obtaining sanction of the higher authorities.
  • Open tendering should be adopted to ensure fair competition, unless it is considered expedient to follow other modes of tendering due to urgency. Purchases will be made from the lowest acceptable tenderer. Adequate care would be exercised to ensure that delivery from the vendor is within the specified time schedule.
  • Para  7.6 Corrigendum 02 of DRDO PURCHASE MANUAL 2006 clearly states: LIMITED TENDERS: This mode of tendering may be chosen when estimated value of goods to be procured is up to Rs. 25 lakh (Rupees Twenty five lakh).  Purchase through Limited Tender Enquiry may also be adopted even where the estimated value of the procurement is more than Rs 25 lakh, in the following circumstances as per the delegated financial powers in vogue.

(a)  When the sources of supply are definitely known and are limited.

(b)  When it is not in the public interest to call for open tenders due to reasons of security or when superior authorities have issued specific instructions in this regard.

(c)  When Government policies designate specific agencies.

(d)  When open tender system adopted during previous one year has established sufficient and assured sources of supply at competitive rates.

(e)  When the requirement of stores is urgent and the desired delivery schedule cannot be met if open tenders are invited, the indenting officer must place on record, the nature of the urgency and why the demand could not be anticipated earlier. Urgency of such cases will be specifically monitored till the placement of order.

(f)   EPC approval issued by DMM in all cases shall include the names of the vendors to whom the Tender enquiries must necessarily be sent in addition to others.

  • Para 7.6.3 of DRDO purchase manual 2006 clearly  states:The limited tender enquiries will be floated to all registered firms with a minimum of seven such firms for the concerned item(s). In a case where the number of registered firms is less than seven, these enquiries will be issued to all known firms dealing with the stores and efforts made in this regard will be recorded on the file”. Corrigendum 03 clearly  states: “Add: at the end of the para 7.6.3Vendor selection for the purpose of Limited Tender enquiries must be done with utmost diligence so as to give fair opportunity to all known vendors who are willing and eligible for consideration. The enlistment and delisting of registered vendors should be based on clearly laid down criteria and the existing provision for buildup followed rigorously  by periodically referring to vendors registered with R&D Labs/ Estt., DGS&D, NSIC, other Government  Departments and to the firms of national repute who will be registered before their bid is considered.”
  • Para 7.13.3 of DRDO purchase manual 2006 clearly  states: Scrapping of tenders will be resorted to in the following cases with the approval of the Director:
    • Change in basic specifications governing supplies after opening of tenders.
    • Non-receipt of offers as per specifications laid down.
    • Sudden downward market trend.
    • Prices quoted being very high/unreasonable.
    • Large/manifold variation in tendered prices.
    • Para 3.2 of DRDO purchase manual 2006 clearly  states: REGISTRATION OF VENDORS: The vendors will be registered by Labs/Estts for different categories of stores, e.g., raw materials, chemicals, machine tools, instruments, electronics and electrical items, timber, fabrication jobs and other general stores etc. The credentials of firms seeking registration will be verified to ascertain their credibility with regard to financial standing i.e. annual accounts, capacity, reliability, bonafides (income-tax returns sales tax No. etc.) and past performance, etc. For this purpose, specialists from the respective fields will be included in the Vendor Registration Committee while examining the applications of vendors seeking registration. The registration committee will be appointed for one financial year. The constitution of the vendor registration committee will be as follows:

1. Scientist- F Chairman

2. Scientist- D/E Member

3. Head MMG or Rep Member Secy.

The Chairman can co-opt specialist members if considered necessary.

4.    Mr. Aneesh  Kumar Singh, Scientist ‘C’,  Mr. Amit Sarriya,  Head Material Management Group, Mr. R.K. Jain, Scientist ‘E’ Chairman Vendor Registration Committee Dr. D. N. Tripathi, Scientist ‘F’ Chairman TEC, and Dr. T. C. Shami, Scientist ‘F’, Chairman SPC(above Rs 10 lakh) for    possibly under heavy pressure entered into a criminal conspiracy with Dr. A K Saxena, Director  & CFA of splitting requirement of the same items to fabricate store demands violating  DRDO purchase manual 2006, details of which are mentioned below:

5.    PROCUREMENT IRREGULARITIES OF Analytical Weighing Balance

Central Procurement of Analytical Weighing Balances worth total estimated cost Rs. 52.8 lakh on limited tender basis by splitting requirement into

  • 02 demands raised by Mr. Aneesh Kumar Singh, Scientist C of Material Management Group along with Mr. Amit Sarriya Head MMG, on same date 20th Feb 2013 with exactly same list of pet vendors of Dr. A. K. Saxena, Director , DMSRDE.
  • the 02 demands were cleared by the SPC (Store Procurement Committee) dealing cases above Rs. 10.0 lakh, headed by  Dr.  T C Shami, Scientist ‘F’,  as Chairman of SPC 2012,
  • Technical evaluation of Techno Commercial Bid  in case of Analytical Weighing Balance was done by a TEC comprising of  Dr. D. N. Tripathi, Scientist ‘F’ Chairman TEC, Mr. A. K. Dixit Scientist ‘E’ (Expert Member),  Mr. Aneesh Kumar Singh, Scientist C(User Member) and Mr. A. K. Mishra Technical Officer ‘C’(Member Secretary). Queries were asked from Vendors vide letter dated 19 June 2013 Kawach Instruments & Chem Tex Noida & Abhigyan Traders, Kanpur was  technically disqualified in TEC report for case at Sl. No.01.
  • Respective   supply orders placed during Sep 2013 to Oct 2013.
  • Point to be noted that
    • requirement of “Analytical Weighing Balance” received from various user divisions in response to MMG ION (Annexure-I) was  deliberately split into two demands below Rs. 50.0 Lakh to keep it within the lab director CFA power so as to avoid DRDO HQrs  concurrence. These demands were cleared in same SPC meeting held on 07-Mar-2013 and limited tender enquiries were issued on same date 03-Apr-2013 to exactly similar vendors as shown in Table-I below.
    • Only 06 pet vendors are given tender enquiry whereas  as per para 7.6.3 DRDO purchase manual 2006 the limited tender enquiries will be floated to all registered firms with a minimum of seven such firms for the concerned item(s). Further vendors should be selected in accordance to Para 7.6.3-Corrigendum 03 to DRDO purchase manual 2006.
    • Further vendors selection  for the two demands  at Sl.No.01& 02 is improper as:
      • M/s Nav Jyoti Scientific Sales Corporation Lucknow (Reg. No. DMSRDE_013/01C/19_10L for Chemicals, Instruments) and M/s Kawach Instruments & Chem Tex Noida (Reg. No. DMSRDE_012/03C/073_10L for Chemicals, Instruments, Textiles,) were registered in 2013  for supply orders limited up to Rs 10.lakh then how these vendors were selected for tender inquiry for cases costing above  Rs. 10 Lakh
      • M/s Abhigyan Traders, Kanpur (Reg. No. DMSRDE_07/03C/044 for Chemicals) and M/s National Industrial Corporation (NIC) Kanpur (Reg. No. DMSRDE_11/03C/61 for Chemicals) are registered in DMSRDE only for Chemicals supply then how they were selected for tender inquiry for Scientific Equipment.
      • Demand for such specialized equipment is raised by Material Management Group centrally based on requirements submitted  by user divisions under pressure of Dr. A K Saxena, the Director,  in response to the ION issued by Material Management Group(Annexure-I)  despite no demand was raised from user divisions.
      • there is no requirement for this store in such a huge quantity in DMSRDE as it may be  sufficient to provided such costly and specialized equipment in Central Analytical Facility which is equipped with various special purpose sophisticated costly equipment. This is an attempt to create redundant facilities leading to underutilization of the equipment and this can be treated as wastage of poor tax payers money.

 6.    Point to be noted that

Dr. A. K. Saxena, the Director, has got registered more than fifty of his pet vendors in year 2013 through formulation of an illegal Vendor Registration committee with his pet man Mr. R.K. Jain Scientist ‘E’ as Chairman despite the fact that there are more competent and honest Scientist’s ‘F’ available in DMSRDE who are not only underutilized but not even acknowledged.. This  is a clear cut violation of para3.2 of DRDO purchase manual 2006 by Dr AK Saxena, for placement of the supply  order on limited tender to known vendors clearly exhibit his vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms.

Point to be noted

  • For Analytical weighing balance at Sl.no.01
    • As per Para 4.6.2 DRDO purchase manual 2006 Corrigendum 03 Scientist ‘C’ can raise demand up to Rs.  25.0 lakh.
    • This limited tender above Rs 25 lakh violates Para 7.6 DRDO purchase manual 2006 Corrigendum 02.
    • Placement of supply order worth Rs. 30.92 (costing  close to  estimated cost Rs 33.6 lakh) on limited tender basis  to known local/pet vendor M/s Nav Jyoti Scientific Sales Corporation Lucknow, clearly exhibit vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms
  • For Analytical weighing balance at Sl.no.02
    • The Demand for Dual Range High Precision Semi Micro Balance with Density Determination Kit is exorbitantly estimated at the rate of Rs 6.4 Lakh (i.e. Total cost for 03 No. Rs 19.2 Lakh ) as:
  • Similar Semi Micro Dual Range High Precision Analytical Balance with Density Determination Kit was procured by a user division vide demand dated in 08-Aug-11 and supply order dated 19-Dec-2011 at the rate of Rs 1.6 lakh from M/s P.D. Scientific Industries, Kanpur.
  • For a demand estimated Rs.19.2 lakh the supply order costing Rs 9.7 lakh at the rate Rs 3.3 lakh only was placed to lowest bidder M/s Kawach Instruments & Chem Tex Noida.
  • Point to be noted that M/s Kawach Instruments & Chem Tex Noida could not be technically disqualified in this case by the TEC otherwise this supply order also might be costing close to estimated cost Rs 19 lakh as in first case above.  It appears that the first case is exorbitantly estimated too.
    • Item nomenclature is slight changed by changing the location of “Semi Microat Sl. No. 02 & 03 with a view to create a differentiation.  
    • M/s P.D. Scientific Industries Kanpur was not considered for the said tender enquiry otherwise prices might have lowered further in order of case at Sl. No. 03.
    • Scrapping of tenders should be considered in case of sudden downward market trend or Large/manifold variation in tendered prices as per DRDO purchase manual 2006 Para 7.13.3 .

9.      Despite all above placement of the supply  order on limited tender to known vendors clearly exhibit vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms

10.       From the facts stated above, it is amply crystal clear that prima facie material regarding ‘ABUSE OF AUTHORITY’, ‘DICTATORIAL TRAITS ’, ‘PATRONIZATION OF CORRUPTION’ as regards to arrogant and corrupt Dr. Arvind Kumar  Saxena, Director DMSRDE exists.

That he has created a robust cobweb of corruption system’ killed proven departments / institutions in DMSRDE to hold system to ransom. This is evident from the fact that sequentially right from the indenter, head of the Division, whole Stores Purchase Committee including its CHAIRMAN and lastly HEAD MMG have fallen under tremendous pressure into criminal conspiracy to cheat DRDO and exchequer’s money.

In pursuance of the said criminal conspiracy,  Dr. A. K. Saxena, Director, present Head MMG, and Mr. A. K. Singh, Technical Staff Officer of Director, DMSRDE are tampering with evidence / documents that shall be prejudice to fair trial, investigation, trial or any inquiry.

11.      In view of the above mentioned facts and evidences it is earnestly requested that an order for through investigation of all procurement done by Dr.  A. K. Saxena after assuming charge as Director, DMSRDE, DRDO, Kanpur to stop further corruption and wastage of poor tax payers money.

BRIEF FACTS OF THE COMPLAINT

  1. Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
  2. Purchase Management 2006 is applicable for procurement of store items in DRDO. Gross irregularities and violation of Purchase Management 2006 was made in procurement of Dyneema Fabric in year 2011-2013 when the cases were indented by officers of Composite Materials Divisions  under illegal orders of Head, LED & Composite Division, Head MMG & Dr. A. K. Saxena, Director, DMSRDE.
  3. Dr. A K Saxena Director is an incompetent, arrogant and corrupt administrator who has violated all the rules and regulations of purchase.  In earlier complaints pending with Central Vigilance Commissioner at New Delhi and now in the present case, it becomes amply clear that he is the ‘CENTRE OF GRAVITY’ of corruption menace in DMSRDE.  Para 5.1.1 of DRDO PURCHASE MANUAL 2006 clearly states that  following cautions shall be observed for purchasing stores:
  • Bulk purchases will normally fetch quantity discount. This should, however, not lead to over-stocking resulting in expiry of shelf life or redundancy due to obsolescence.
  • Purchase orders will not be split-up to avoid the necessity for obtaining sanction of the higher authorities.
  • Open tendering should be adopted to ensure fair competition, unless it is considered expedient to follow other modes of tendering due to urgency. Purchases will be made from the lowest acceptable tenderer. Adequate care would be exercised to ensure that delivery from the vendor is within the specified time schedule.

Triphati, Head Rubber and Adhesive Division, Mr. Amit Sariaya, Head MMG (2011-2012), Mr. Shielendra Kumar Accordingly Head MMG (2013), Mr. AK, Scientist ‘D’ and Mr. Arun Kumar Singh, Scientist ‘D’ possibly under heavy pressure entered into a criminal conspiracy with Dr. A K Saxena, Director  & CFA of splitting demands of the same items, details of which are mentioned below:
  2. PROCUREMENT IRREGULARITIES OF DYNEEMA

Dyneema worth total estimated cost of Rs. 1.05 Crore was procured on limited tender basis by splitting requirement

  • 11 demands below Rs.10 lakh (to avoid TPC) were raised during 16 months period (from May 2011 to Sep 2012) which were cleared by the SPC (Store Procurement Committee) dealing cases below Rs. 10.0 lakh, headed by  Dr.  Ashok Ranjan, Joint Director and Mr. Darshan Lal, Joint Director,  as Chairman of SPC 2011 and SPC 2012, Respective   supply orders placed during Aug 2011 to  Aug 2012.
  • One demand raised by Mr. A. S. Parihar and Dr. D.N. Tripathi, Joint Director in Apr 2013 for which supply order is placed on Manglam Traders in July 2013 worth Rs 7.06 Lakh. One demand raised by Mr. Arun Kumar Singh and Dr R. K. Tiwari, Joint Director, in Feb 2013 for which supply order is  placed on SMPP Pvt. Ltd. in Nov 2013 worth Rs 25.8 Lakh.
  • Point to be noted that there is no requirement for this store in such a huge quantity as there is no running project work on Bullet Proof Jacket with DMSRDE.
  • Details are as show in table-1

  • Points to be noted that
    • The requirement split into demands below Rs. 10.0 Lakh to avoid TPC and open tender which would have fetched better quality at discounted prices.
    • Further 02 Supply Orders worth Rs 13.5 Lakhs were placed on a pet vendor Mangalam Traders, Kanpur. 02 Supply Orders worth Rs 12.5 Lakhs were placed on a pet vendor Shahi Traders, Kanpur 01 Supply Orders worth Rs 7 Lakhs were placed on a pet vendor Pee Cee Textile Stores Kanpur.
    •  06 supply orders worth Rs 58.5 Lakhs were placed on a pet vendor S M Pulp Packaging Pvt Ltd, a  manufacturer of molded pulp products, protective packaging, presentation packaging and Industrial packaging which turned to an Armour manufacturer over a period of two years  by adding  the armor division through buildup of technical knowhow in the strategic field while working with scientists of DMSRDE Kanpur on development of Bulletproof Jacket.(pls refer website http://smgroupindia.com/pulp-molded-packaging.htm).  SMPP Pvt Ltd was not registered vendor at DMSRDE from 01.01.2011 to July 2013, when the vendor supplied the Dyneema in DMSRDE.. It is interesting to see that BPJ developed by DMSRDE Kanpur is still waiting for a customer where as S M Pulp Packaging Pvt Ltd are established supplier for the same as they claim in the website that there BPJ is certified by HP White USA and TBRL Chandigarh a nodal agency of DRDO for ballistic testing.
    • Further 02 Supply Orders worth Rs 13.5 Lakhs were placed on a pet vendor Mangalam Traders, Kanpur. 02 Supply Orders worth Rs 12.5 Lakhs were placed on a pet vendor Shahi Traders, Kanpur 01 Supply Orders worth Rs 7 Lakhs were placed on a pet vendor Pee Cee Textile Stores Kanpur
    • Placement of these orders on limited tender to non-registered, known/ local vendors clearly exhibit vested interest through manipulation  in prices, quality etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms
  • Further interesting statistics out of above is as under
    • 04 demands worth Rs. 25.5 Lakhs were raised on 15th Sep 2011 by Mr. Amit Kumar, posted in Composite Material Division, and Dr. R. K. Tiwari, Joint Director, through Light Engineering Division (LED) with a deliberate attempt to bypass Group Director of Composite Material Division, an honest person Dr. D. K. Setua for the reason that splitting of demand is not permissible as per the guide lines of DRDO’s Purchase Manual 2006.It is important to note that Mr. AK, Scientist ‘D’ is not a part of Light Engineering Division (LED). He is posted in Composite Material Division. How he can indent the cases of LED?
    • Further these demands were cleared in SPC meeting held on 28th Sep 2011 and their tender enquiry was issued on same date 03rd Oct 2011 and very magically all   the 04 No. Supply orders worth Rs. 28.5 Lakhs were fetched by the same firm M/s SMPP Pvt. Ltd. on same date  11th Nov 2011.
    • Placement of these orders on limited tender to M/s SMPP Pvt. Ltd.  clearly exhibit vested interest through manipulation in prices, quality, quantity etc so as to fetch financial benefits hence indicates financial corruption/ corrupt practices of giving business/ benefits to own firms. SMPP Pvt Ltd was not registered vendor of DMSRDE during 2011-2013.
  • In a nutshell point is that out of  Rs 1.05 crore only 02 supply order worth Rs. 16 lakhs were placed on OEM M/s DSM Dyneema BV.  Dyneema is a proprietary item of OEM M/s DSM Dyneema BV and procurement from OEM might have saved around 35% of the cost paid in form of custom duty, local dealer profit and other overheads which comes to Rs 25 to 30 lakhs of loss of poor tax payer’s money.

6.  From the facts stated above, it is amply crystal clear that prima facie material regarding Abuse of Authority by arrogant and corrupt administrator Dr. A. K. Saxena, Director DMSRDE exists.

  • That he has created a robust cobweb of corruption system and that he entered into criminal conspiracy with Chairman’s of two successive SPC committee, Head Composite Division, Head Light Engineering, Head Finance Division  with an intention to cheat DRDO and exchequer’s money.
  • In pursuance of the said criminal conspiracy,  Dr. A K Saxena, Director, present Head MMG,  and Mr. A K Singh, Technical Staff Officer of Director DMSRDE are tampering with evidence / documents that shall be prejudice to fair trial, investigation, trial or any inquiry.

7.    In view of the above mentioned facts and evidences it is earnestly requested that an order for through investigation of all procurement done by Dr. Arvind Kumar  Saxena after assuming charge as Director, DMSRDE, DRDO, Kanpur to stop further corruption and wastage of poor tax payers money.
