यह बहुत ही खेद का विषय है की जिन डीआरडीओ के वैज्ञानिकों की तुलना आपने 20 अगस्त 2014 को पुरस्कार वितरण करते हुए ऋषि मुनियो से की थी उनमे सबसे सीनियर डायरेक्टर जनरल, ऐरो, डॉ के तमिलमणि द्वारा सरकार के सारे नियमो का मजाक बनाते हुए प्रोजेक्ट की गाड़ी का न केवल दुर्प्रयोग कर रहे अपितु औरो को भी गाड़ियों के दुर्पयोग के लिए सहयोग कर रहे है।
डीआरडीओ के संस्थान ए डी इ, बैंगलोर में प्रोजेक्ट रुस्तम – 2 के अंतरगर्त एक संस्वीकृति संख्या DRDO/02/333/P/2/Vol-II-394/D/R&D दिनाक 23/02/2011 द्वारा 5 गाड़ियां रिमोट वीडियो टर्मिनल (आर वी टी) (टोयटा इन्नोवा समतुल्य) 77 लाख में खरीदने की स्वीकृति प्रदान की गयी। (सैंक्शन डिटेल संलग्न है)
एक इन्नोवा डायरेक्टर जनरल, ऐरो, डॉ के तमिलमणि द्वारा इस्तेमाल की जा रही है। गाड़ी में डीजी ऐरो का बोर्ड लगा है। ड्राइवर आर्मी का एक हवालदार नियुक्त है। गाड़ी को देख कर कोई नहीं कह सकता की गाड़ी का इस्तेमाल प्रोजेक्ट रुस्तम – 2 में रिमोट वीडियो टर्मिनल (आर वी टी) में हो रहा है। (चित्र संलग्न है )
डॉ के तमिलमणि द्वारा भारत सरकार के नियम विरुद्ध ट्रांसपोर्ट अलाउंस लाभ भी लिया जा रहा है। (जनवरी की सैलरी स्लिप संलग्न है)
डॉ के तमिलमणि को सरकार ने सेकंड सेवा विस्तार 62-64 वर्ष भी दिया है जोकि मई 2016 तक है। परन्तु केवल भगवान ही जानता है कि डॉ तमिलमणि द्वारा देश व् डीआरडीओ को क्या प्रदान किया है। क्योंकि देश की साइंटिफिक क्षेत्र में उनके योगदान का कोई चिन्ह नजर नहीं आता है केवल डीआरडीओ के स्वयं प्रयोजित पुरस्कार ही उनके खाते में हैं जिनकी कंही भी मान्यता नहीं है। डॉक्ट्रेट की उपाधि का भी अभी अभी प्रबंध किया।
रिमोट वीडियो टर्मिनल (आर वी टी) नाम से ली गयी दूसरी गाड़ी एडीइ निदेशक द्वारा तथा तीसरी गाड़ी प्रोजेक्ट डायरेक्टर रुस्तम -२ द्वारा और सूत्रों के अनुसार बाकि की दो गाड़ियों का कोई सुराग नहीं है।
इसी प्रकार से डीआरडीओ के पुणे स्थित संस्थान एच इ एम आर एल के निदेशक श्री विकास भट्टाचार्य द्वारा भी इसी प्रकार से एक इन्नोवा मोबाइल इन्ट्रूमेंट कैरियर नाम से खरीद कर अपने इस्तेमाल में ली जा रही है। टेंडर, फर्म्स, गाड़ी का लाल बत्ती लगा चित्र, सप्लाई आर्डर संख्या आदि संलग्न है।
इन उपरोक्त तथ्यों से यह लगता है कि रक्षा लेखा विभाग का जैसे डीआरडीओ के अधिकारीयों द्वारा अपहरण कर दिया है। क्या उन्हे वार्षिक ऑडिट में यह सब दिखाई नहीं देता या रक्षा लेखा अधिकारियो ने आँख बंद कर रखी है ?
आपसे अनुरोध है की आपकी लाल किले की प्रतिज्ञा “न खायंगे न खाने देंगे” का कुछ तो असर इन तथाकित डीआरडीओ के वैज्ञानिकों पर डालने की कृपा करे अन्यथा ये इस देश के करदाताओं से मिले बहुमूल्य पैसो को अपने मजे के लिए उड़ा देंगे।
आपसे यह भी अनुरोध है कि संलग्न शिकायती पत्र को सीवीसी व् सीविओ (रक्षा मंत्रालय) को तत्काल प्रभाव से जाँच करने के आदेश के साथ अग्रसारित करने का कष्ट करें।

K Tamilmani, DG (Aero), DRDO, Bangalore using Toyota Innova vehicle bearing No 14B 113597Y, it seems that vehicle procured under sanction of Project Rustom –II in the name of Remote Video Terminal Vehicle.
According the sanction letter No DRDO/02/333/P/2/Vol-II-394/D/R&D date 23/02/2011. The 5 no of Toyota Innova sanction for Rs 77 Lakhs in the name of Remote Video Terminal Vehicle was sanctioned as per file No DHRD/76682/ ADE(Proj)(Misc) /VEH/ C /P/01dated 27 June 2013
The letter no DHRD/76682/ADE/(Proj)(Misc)/VEH/P/01 date 27 Jun 2013 signed by Dr Hina A Gokhle, Director, HRD, DRDO Hqrs in its para 4 “This letter issue with special concurrence of Ministry of Finance/Deptt of Expenditure in exemption of the extent ban vide their ID Note No 18(2)/E.Coord)/2013(84982) dated 28/05/213)”. It is clear evidence that DRDO senior scientists try to fooling country system. They are taking extraordinary sanction of vehicle by showing its utility in project by putting name “Remote Video Terminal Vehicle”. The vehicle simply using by Dr.K Tamilmani, DG (Aero), as luxury staff car.
At the same time Dr.K Tamilmani, DG (Aero), DRDO, Bangalore availing the transport allowance of Rs 14490/- which attracts severe disciplinary action against under CCS (CCA) Rules 1965, False claims on the Government like T.A claims reimbursement claims, etc. False claims on the Government like T.A claims reimbursement claims, etc, Obtaining or attempting to obtain any valuable thing or pecuniary advantage without consideration or for a consideration which is not adequate. Three vehicles are using by Dr.K Tamilmani, DG (Aero), Director, ADE & Program Director Rustom – II, and rest not traceable.
K Tamilmani, DG (Aero), DRDO, Bangalore violated the Motor Vehicle Act by putting DG Name plate in front of Toyota Innova.
It is requested that please register case against Dr.K Tamilmani, DG (Aero), DRDO, Bangalore for maneuvering of Government funds under the provision of prevention of corruption act section 13(2), or any other applicable acts of GOI.

INVESTIGATION & INQUIRY OF COMPLAINTS OF CORRUPTION AGAINST DR. A.K. SAXENA, DIRECTOR, DMSRDE, KANPUR UNDER DRDO, MOD.
Sir,
I humbly submit your kind attention towards corruption in tunes of crores at Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur, an establishment under Defence Research & Development Organisation (DRDO), Ministry of Defence, Government of India.
Dr. Arvind Kumar Saxena, was appointed as Scientist ‘C’ on 28.04.1984 in DMSRDE, Kanpur and since then he is continuously posted at DMSRDE, Kanpur from past 30 years. He was never transferred from DMSRDE, Kanpur and since the date of his posting he is working at Kanpur. The roots of the Dr. Saxena while working at DMSRDE, Kanpur has become so deep that he was involved in various activities involving the financial and administrative irregularities that leads corruption in DMSRDE.
Dr. Arvind Kumar Saxena, Scientist ‘G’ was appointed as Director, DMSRDE, Kanpur wef 01 January 2011. In spite of the fact that he has been involved in various financial and administrative irregularities , Dr. Saxena was promoted to the rank of Scientist ‘H’ wef 02 August 2012 and since then he is holding the rank of Scientist ‘H’ and working as Director, DMSRDE.
The right from his appointment as Director, he was involved in various kinds of administrative and financial irregularities that lead corruption in tunes of crores. Several complaints were made against Dr. Arvind Kumar Saxena to then Defence Minister.
I am an RTI activist and social worker running a website corruptionindrdo.com to expose the corruption in DRDO. I also made as far as 12 complaints regarding corruption in procurements of various instruments, equipment and materials in DMSRDE by Dr. Arvind Kumar Saxena, Director, DMSRDE to Central Vigilance Commission, Hon’ble Defence Minister and DGR&D, DRDO. These complaints were filed by me during 29 Nov 2013 to 11 June 2014. Total cost of store items procured against which complaints were filed is about Rs. 7.5 crore. A complete list of complaints filed by me to CVC and Hon’ble Defence Minister is enclosed as Enclosure-1.
All the aforesaid complaints made by me have been endorsed by Central Vigilance Commission (CVC). CVC has taken cognizance of aforesaid complaints and registered on prima facia. These complaints have been forwarded to Chief Vigilance Office (CVO), Ministry of Defence for further enquiry/investigation of the aforesaid complaints. Under the provisions of RTI Act 2005 the CPIO, CVC vide letter no. CVC/RTI/13/1862/241925 dated 18.03.2014 informed to me that his complaints have been forwarded to CVO (MOD) for investigation. Letter enclosed as Enclosure-2.
Under RTI Act, CPIO, CVO MOD informed that all complaints have been forwarded to Director, Vigilance & Security, DRDO for further inquiry and asked the consolidated report from DRDO vide their letter dated 04 August 2014. Letter enclosed as Enclosure-3.
Meantime, a Fact Finding Inquiry Committee (FFIC) was constituted by Shri Avinash Chander, DG, DRDO to inquire the complaints against Dr. A.K. Saxena. The Fact Finding Inquiry Committee visited DMSRDE, Kanpur on 13th – 14th, March 2014 for inquiry on the complaints submitted against Dr. A.K. Saxena. The said committee submitted its report to Shri Avinash Chander but no action taken by DRDO against Dr. A.K. Saxena, Director.
Despite since long time all 12 complaints are still pending with Dte of Vigilance & Security (DVS), DRDO HQ, New Delhi and no action has been taken against Dr. A.K. Saxena.
Dr. A.K. Saxena, Director, DMSRDE is going to retire on 31 July 2015 and only five months remain for his superannuation. To give safe passage to safely retire to Dr. A.K. even after making corruption in tunes of croresis totally against the Government policy of “Zero Tolerance for Corruption”.
Therefore to take speedy action in the corruption cases of DMSRDE registered by CVC and forwarded to CVO(MOD) , I kindly request to take appropriate action in the matter and provide the status of complaints.In case the appropriate action on complaints has been taken then kindly provide copy of inquiry report.

Hon’ble Sir,
With regards, I would like to draw your kind attention towards letters under reference. The press release of PIB, MOD is regarding – Avinash Chander to Continue as DRDO Chief on Contract after Superannuation.
Following facts are conclusive form the above letters.
A contractual retired employee (employee on contract) is now DRDO Chief.
By which Order, The President is pleased to retire Dr. Avinash Chander, Secretary, Department of Defence Research & Development in the Ministry of Defence from Government Service with effect from 30.11.2014 (AN) on attaining the age of superannuation. Why the said Order was not disclosed by MOD?
The Order dated 31 May 2013 was issued by previous Government and this Government has issued orders for retirement of Shri Avinash Chander.
There is no fresh order issued by this Government regarding contract of Shri Avinash Chander as DRDO Chief.
Questions
Government is emphasizing on young Scientist in the DRDO on the other hand despite being several talented and experienced scientists available in DRDO, what is necessity and compulsions of a retired person as DRDO Chief.
How a person on contract will enjoy administrative and financial powers while DRDO is having 30000 employees and Rs. 15283 crore budget?
Will they have to report a contractual employee?
How an employee on contract be Head of Department and Head of Office in DRDO.
Would Ministry of Defence could not find any suitable scientist as DRDO Chief out of 7500 talented scientists in DRDO or from other organisations.
Why Government is not maintaining Transparency in the appointment on contract and powers being exercised by Shri Avinash Chander after superannuation. All RTI replies returned under section 24 of RTI Act 2005
Government has cancelled many appointments of previous Government but why not of Shri Avinash Chander while several complaints are pending before the Government against him.
Can a man of doubtful integrity be appointed on contract basis as DRDO Chief? The case of Dr Arun Kumar’s daughter’s recruitment where Sh Avinash Chander give clean chit and after CVC/CVO, MoD intervention the said recruitment was found illegal and cancelled.
Farzi EDK MoU in US propaganda till date nothing has been done, only Ms Reny enjoying the US trips, what India got from this MoU except spending crores of tax payers money and Sh Avinash Chander’s photo session with Ms Fay Crowe, her mother, her sister and her daughter.
Sir, on behalf of Government would you like to reply to the nation being a technocrat-cum-politician, how much it is justified to have DRDO Chief on contract basis for one and half year.
The scientific community and employees are very much surprised from this decision of Government and this will lead frustration among the scientific community of DRDO. In the interest of nation and the DRDO, I kindly request to you to remove the Shri Avinash Chander as DRDO Chief and setup High Level Committee to inquire all the complaints against Shri Avinash Chander pending before the Government (PMO & MOD)

The President is pleased to retire Dr. Avinash Chander, Secretary, Department of Defence Research & Development (DOB: 06.11.1950), in the Ministry of Defence from Government Service with effect from 30.11.2014 (AN) on attaining the age of superannuation.
The appointment of Dr. Avinash Chander beyond his date of retirement i.e. 30.11.2014 for 18 months would be on contract basis, with the same terms and conditions as he would be entitled to Secretary (DRD) before the date of retirement. His contractual term will end on 31 May 2016.

“The President is pleased to retire Dr Avinash Chander, Secretary, Department of Defence Research & Development (DOB: 06.11.1950), in the Ministry of Defence from Government Service with effect from 30.11.2014 (AN) on attaining the age of superannuation,” an official statement said on Friday.
It said “the appointment of Chander beyond his date of retirement, November 30, for 18 months would be on contract basis, with the same terms and conditions as he would be entitled to Secretary (DRD) before the date of retirement.”
His contractual term will end on May 31, 2016. Asked if this was the first time a DRDO chief will go on contract, sources said there had been instances when chiefs have been given “extraordinary” extensions.
The DRDO chief also holds the post of Scientific Adviser to the Defence Minister and the Secretary of Department of Defence Research and Development.
Chander joined DRDO in 1972 after completing graduation in Electrical Engineering from Indian Institute of Technology (IIT), Delhi.
He obtained MS in Spatial Information Technology from Jawharlal Nehru Technological University (JNTU), Hyderabad. Chander is the chief architect of Agni series of ballistic missile systems.
Development of Agni range of missiles under a highly-restrictive international control regimes was possible only out of his technology forecast, perspective planning and relentless efforts, DRDO officials said.

बायो डायजेस्टर तकनिकी का कई बार डी आर डी ओ ने विभिन्न स्थानो में लोकार्पण करके देश के बहुमूल्य पैसो का जम कर दुरूपयोग किया।

India’s DRDO develops eco-friendly toilets

India’s Defence Research and Development Organisation (DRDO) dedicated to enhancing self reliance in defence systems, has demonstrated exemplary versatility by developing eco-friendly bio-toilets for soldiers for human waste management in high altitude regions.
The low temperature at high altitude halts and delays the natural biodegradation of human waste and leads to its accumulation which is an environment hazard.
The painstaking research spanning a decade involved study of the science of bio digestion. It began in 1998 and was carried out by a team of DRDO scientists who camped for 16 months in harsh weather conditions in Antarctica and identified psychrophilic bacteria that can withstand both summer and winter temperature. The bacteria were then brought back to the laboratories where they were cultured and their kinetics studied.
After DRDO installed 200 units of bio digesters in high altitude areas such as Siachen and Ladakh for its jawans and word spread about the advantages of bio toilets, the Planning Commission evinced interest in the technology developed by DRDO. The technology has been adapted successfully for use in all terrains.
Dr W. Selvamurthy, DRDO’s distinguished scientist and Chief Controller of Research and Development, said, “The Lakhsadweep Islands were facing water borne diseases and had approached the Planning
Commission for a solution. What began as a solution for jawans turned out to be a gift to society. The bio toilets are a blessing in rural India where only 30 per cent of population has private toilets.”
Not just this, big brother America is taking interest in the bio-toilets. Coming month, Dr Selwamurthy alongwith Dr Lokendra Singh, Scientist G and Director, Life Sciences, Defence Research and Development Establishment, Gwalior, will be travelling to Seattle in the United States to make a presentation to the Bill Gates Foundation as Bill Gates is reviewing the technology of bio toilets.
The presentation alongwith the exhibition of the innovation will be made at the invitation of the Bill Gates Foundation which is holding a global competition for best global solution for human waste management.
Dr Selwamurthy is confident that this will become a global technology. “ It is a unique IP (Intellectual Property. We have patented this technology not only at the national level but also at the international level.”
Better known as bio digesters, the toilets were conceptualised as DRDO’s solution for decomposition of biological waste generated by soldiers deployed in high altitude areas.While 12,000 units in Lakshadweep islands are using DRDO developed technology , the railways which have faced severe criticism for stinking platforms and unsightly human waste littered tracks , are also using these toilets.
As of date, eight trains are running with 436 bio toilets based on DRDO technology in 191 coaches.” As part of the green intitatives promised in the Railway Budget for 2012-’13, the Ministry of Railways will provide 2500 bio toilets in its coaches. By 2016-17, the new railway coaches will completely switch over to bio toilets.
]The Minister for Rural Development, Mr Jairam Ramesh, has given a go ahead for installation of bio toilets in 1000 village communities (gram panchayats) with a budget of Rs 400 crore. At the launch venue located only 15 kilometre from the Wheeler island where Agni V was successfully test fired early this year, the Minister for Rural Development promised that under the recently launched Nirmal Bharat Abhiyan (Clean India Campaign) , his ministry will ensure that all gram panchayats are covered in the next 10 years.
As of now, India has 2,40,000 gram panchayats.”
The DRDO distinguished scientist said, “ To begin with, we have installed six twin bio digester toilets in Odisha in eastern India. The Ministry of Rural Development will identify these 1000 villages communities and ensure that every village home gets a bio toilet.”
Dr Selwamurthy is satisfied that DRDO is discharging its corporate social responsibility. “ Our technology has a spin off. It is now going to States. The Minister for Urban Development has recommended that new housing societies being developed in Uttar Pradesh, Gujarat and Maharashtra, instal bio toilets.”
DRDO’s versatility has earned it praise from the Union Minister for Rural Development, Mr Jairam Ramesh. While launching the eco toilet project based on DRDO’s bio digester technology in Dhamra in Odisha’s
Bhadrak district last month, the minister said that bio toilets can do to rural sanitation what Agni has done to India’s external defence. He said that the DRDO developed technology for bio toilets can bring a significant change in the quality of life of people, mainly in rural areas and help them lead a healthy life.”
Dr Selvamurthy agrees that the bio digesters will prevent the dehumanising practice of manual scavenging and meet its objective of discouraging open defecation and improving sanitation conditions. Open defecation is a huge problem in India and Sikkim is the only State that boasts of zero defecation in the open. Sixty per cent people in the world who have to go outside for toilets are from India.
The senior scientist, who has been part of the DRDO’s growth story for almost four decades, said that one toilet would cost Rs 15,000 but the cost would be borne by the Ministry of Rural Development. “Looking at the cost benefit analysis, it is not very expensive. It will prevent deaths that are caused by water borne diseases. A large number of children die due to water borne diseases. The durability of the whole system is 25 years. We have given it to 45 Indian companies for capacity building. We are willing to give it to other countries also. Industry will implement it under the Quality Assurance of DRDO. We are only monitoring it.”

The Defence Research and Development Organisation (DRDO) in a first of its kind attempt, will launch, not missiles, but bio-toilets for use by civilians. Scheduled to be dedicated to the nation on Sunday at Dhamra, 64 km from Bhadrak district, the bio-toilets project was conceived by the Ministry of Defence in collaboration with Ministry of Rural Development.
With the objective of reducing open defecation and increasing sanitation, the project has been based on DRDO’s Bio-Digester technology developed by Defence Research and Development Establishment (DRDE), Gwalior, and Defence Research Laboratory (DRL), Tezpur, two constituent laboratories under DRDO.
The technology was used to decompose biological waste generated by soldiers deployed in high-altitude regions such as Siachen and Ladakh. It degrades and converts the human waste into usable water and gasses in an eco-friendly manner. The generated gas can be utilised for energy/cooking and water for irrigation purposes. The process involves the bacteria which feeds upon the fecal matter inside the tank, through anaerobic process which finally degrades the matter and releases methane gas that can be used for cooking, along with the treated water. Highlighting the technical aspects and features of bio-digester technology, Dr W Selvamurthy, Chief Controller (R&D Life Science & International Cooperation) stated, “The bio digester technology is an innovative and cost effective solution for a mega problem of water pollution and health hazard due to open defecation.
The effluent coming out of the bio digesters is odourless and harmless and could be used for gardening and irrigation as well. Minister of State (I/C) Statistics and Programme Implementation and Minister of State for Chemicals and Fertilizers Srikant Jena and Minister of Rural Development and Drinking Water and Sanitation, Government of India, Jairam Ramesh are expected to be present at the inauguration.
The research body held a meeting with the RD Minister introducing him to the new technology and desired it be adopted in the Total Sanitation Campaign (TSC) that funds construction of toilets in rural households. Earlier, DRDO and FICCI had entered into a MoU for DRDO-FICCI Accelerated Technology Assessment & Commercialisation (ATAC) programme.
The DRDO-FICCI ATAC programme is a unique initiative of DRDO and FICCI that aims for commercialisation of cutting edge technologies developed by various DRDO labs for civilian applications. The RD Ministry will be implementing bio- toilets in its sanitation campaign providing privacy to rural folks apart from dealing with waste management. CTRAN Consulting, a BASIX group company dealing with sustainability solutions, has provided techno-managerial coordination for this project.
Bio-digester would cost Rs 15,000 (approx) and plans are afoot to launch it in thousands of gram panchayats.

Pujya Swami Chidanand Saraswatiji, founder of Ganga Action Parivar, spoke on how it is everyone’s right to live with dignity, and thus current practices related to sewage management, such as manual scavenging, must be eliminated. Pujya Swamiji detailed how lack of toilets in villages, girls’ schools and elsewhere is a true curse on society, as it creates innumerable difficulties in so many lives. Women in villages must wait until it is dark to go to relieve themselves, causing many stomach and bowel issues and diseases. To protect their dignity, they must stand up every time a person or a vehicle passes by, and to avoid this women often walk out into dark areas and jungles to go to the bathroom – a very dangerous practice.
Pujya Swamiji also spoke about how building toilets is necessary for maintaining Gangaji’s purity and cleanliness, and that by building eco-friendly toilets within the Ganga Basin will not only help keep the environment clean, but will help our culture shine everywhere.

DRDO unveils eco-friendly complex based on bio-digester tech – The Economic Times

NEW DELHI: DRDO is achieving many successes on technology front and is being recognised for the facilities it has developed for the welfare of people, Avinash Chander, Scientific Adviser to Defence Minister, said today.
Chander, who is also Defence, R&D, Secretary, appreciated the efforts of DRDO while inaugurating Anusandhan Vihar, a self-contained residential complex at DRDO Estate
The 5.4-acre eco-friendly complex consists of 56 Type V & 56 Type IV accommodations sports and children park facilities, a DRDO statement said, adding that the highlight of the complex is that it is first ever residential complex based on DRDO-developed bio-digester technology for sewage treatment.
“The entire water is recycled for various purposes including treated flush water for arboriculture, soft water for bathing and washing purposes each of 2-lakh litre capacity and treated water of 80000-ltr per day capacity for drinking and cooking purposes,” it said.
As per a study carried out by Defence Terrain Research Laboratory, the ecological balance of the area is maintained because the complex has adequate amount of greenery, it said.
DRDO said it has signed MoUs with various states, Union Territories, FICCI and Ganga Action Plan for installation of more than 18000 bio toilets across the country based on the bio-digester technology.
Over 10000 bio-digesters are being installed in various types of passenger coaches of the Indian Railways.

Led by Pujya Swami Chidanand Saraswatiji, the Founder of Ganga Action Parivar and President of Parmarth Niketan Ashram, Rishikesh, Vivek performed puja, yagna and a ceremonial “bhoomi puja” blessing for bricks to be used in the eco-friendly, bio-digester toilet complexes. The first toilet complex built by the partnership of Ganga Action Parivar, DRDO and FICCI was inaugurated at Parmarth Niketan Ashram, Rishikesh by the hands of the Honourable Governor of Uttarakhand; the second toilet complex was inaugurated at Parmarth Niketan Ashram, Rishikesh, by the hands of revered saints of all the world’s religions at a huge “Environmental Protection for World Peace” event held on November 3, 2012 in honor of Pujya Swami Chidanandji’s 60th birthday. Now, further complexes are being built throughout Uttarakhand, and plans are underway for construction in Uttar Pradesh as well, including here in Allahabad. The 2 toilet complexes sponsored by Vivek will be located here in Allahabad and in the sacred teerth of Badrinath.
Last night, on February 25th, at the Ganga Action Parivar Camp, Pujya Swami Chidanandji showed a film which had been made on the need for toilets. The lack of proper toilet facilities is not only a major factor contributing to pollution in Ganga, Yamuna and all rivers, but also is a source of violence, fear and illness in girls and women. Embarrassed to go to the toilet in the daytime, they suffer innumerable ailments from holding until the dark of night. Then, in the dark of night, they fall prey to wild animals and violent men. Hence, the toilet program initiated by Pujya Swamiji is an answer to problems faced by Mother Ganga, Mother Yamuna and all the young and old girls and women living on their banks.
Said Pujya Swami Chidanandji: “Every time we drive and I see women and girls having to jump up in the middle of answering nature’s calls due to shame of passing cars, it hurts my heart and I feel that we are inflicting great physical and emotional violence against our “Matri Shakti” by not providing them with safe, available places to go to the toilet. Also, lack of toilets is one of the main reasons for young girls dropping out of school, so we are committed to building toilets in schools so our young girls can continue their studies. Our temples purify our minds and thoughts, but a toilet is necessary for the body. Just as temples are crucial for spiritual health, so are toilets crucial for physical health. That is why, after decades of building temples, I am now focused on building toilets.”
Said Vivek Oberoi: “I am so glad to be part of such an important initiative which not only helps keep Mother Ganga clean but which also is seva for all of our mothers and sisters — of every age — who don’t have access to toilets and must brave the jungle and rapists in the dark of night. Giving our women the dignity they deserve is our duty.”
Members of Ganga Action Parivar explained that currently, much of India’s sewage is disposed of within water bodies such as the Ganga. The Ganga is deluged with nearly 2 billion liters of human waste a day, while being the sole source of drinking water to a population approximating that of the United States, Canada and Russia combined. The resulting public health crisis has taken a tremendous toll. According to the World Bank, 21% of communicable diseases in India are related to unsafe water. Of these diseases, diarrhea alone is responsible for over 1,600 deaths each day.
The DRDO-Developed Biodigester uses no chemicals and requires no electricity, nor moving parts. Rather, the biodigester tanks provide an oxygen-free environment within which harmless bacteria dissolve all sewage. What’s left is clear, 99% pathogen-free water, which is rich in agricultural nourishments, and odor-free methane gas which can then be utilized as a fabulous source of energy. Cars have been developed which can reach a top speed of over 180 kph which are fueled for an entire year from the biogas produced from the sewage of just 70 homes. A consortium of Japanese auto makers reports that this fuel can potentially cut carbon emissions by 75%.

1). My 75 years old mother staying with my family. She needs constant medical care. Hence my
presence is required at Chennai.
2). I have 27 years Son & 23 years Daughter at Chennai, to fix suitable alliance, as a father my presence is very essential.
It is palpable from the perusal of impugned letter dated 06.07.2009 that request made by applicant was turned down without assigning any cogent reason. Mrs.U.Dutta, learned counsel for applicant strongly relied on the decision of this Bench rendered in the case of Sanjay Garg vs. Union of India in O.A. No.175 of 2009 dated 04..02.2010. Relevant portion of said judgment is reproduced below:-
We have heard the rival submissions. It is stipulated in the office memorandum dated 14.12.1983 that officers on completion of the fixed tenure of service in the State or Union Territories of North East Region may be considered for posting to a station of their choice as far as possible. May is an auxiliary verb qualifying the meaning of another verb by expressing ability, competency, liberty, permission, possibility, probability or contingency. Regardless of the instrument however, whether Constitution, statute, deed contract or whatever, Courts not infrequently construe may as shall or must to the end that justice may not be the slave of grammar. However, as a general rule, the word may will not be treated as a word of command unless there is something in context or subject matter of act to indicate that it was used in such sense. It appears that to attract competent officers to serve in the North East Region the provision for choice transfer was made. Right to give a choice was bestowed on the employees. Once a right is created it cannot be disturbed without any legal justification. Jurisprudentially, speaking right is an interest, protected under the law. The justification which is given by the respondents qua, the non consideration of choice is correct in the context of normal transfer rules but when it is stipulated that officer on completion of fixed tenure of service at North East
Region may be considered for posting to a station of their choice, it is incumbent on the authorities concerned to accommodate the officer at the place of his choice as far as possible. However, for some reasons, if such posting is not possible, opportunity of being heard, must be provided and detailed order should be passed stating the reasons as to why the concerned officer could not be accommodated at the place of his choice.
Transfer can uproot a family, cause irreparable loss to an employee and drive him into desperation. It disrupts education of his children and leads to numerous other complication and problems and cause hardship and demoralization. It therefore follows that policy of transfer should be reasonable and fair and should apply to everybody equally. It cannot be gain said that transfer is an exigency of service and may be ordered for administrative reason and the employer is the best judge in this regard. In a Welfare State to maintain the rule of law attempt should be made to ensure fairness and equality of treatment, arbitrariness should be avoided at all cost. The proposition that who will be posted where is within the discretion of the authorities in control of the matter, is not absolute. It is subject to the limits of law. By serving in the North East Region applicant gained right of consideration for posting to a station of his choice. This fact was not correctly appreciated by the respondents.
The obligation which emanated out of the assurance given to the employee for coming to North East Region was not properly discharged. The issue was not examined in the right perspective. The rule of audi alteram partem (no one should be condemned unheard) was not followed. Taking into consideration the entire conspectus of the case, we direct the respondents to accommodate the applicant at the place of his choice within four months from the date of this order. Meanwhile applicant be not disturbed from the place of his present posting.
I find that facts of the present case are squarely covered by the ratio of the aforesaid ruling. In the present case also I find that obligation which emanated out of the assurance given to the employee for coming to North East Region was not properly discharged. The issue was not examined in right perspective. The rule of audi alteram parterm (no one should be condemned unheard) was not followed. Respondents did not assign any reason in rejecting the request for choice posting. Having regard to the facts, I direct the respondents to accommodate the applicant on the place of his choice within a period of four months from the date of receipt of order. Meanwhile, applicant be not disturbed from his present place of posting.
In the result, O.A. stands disposed of accordingly. No costs.

By this O.A., applicant makes a prayer to direct the respondent to consider his choice posting in any of the stations of his choices, namely Coimbatore, Chennai, Mysore or Gwalior.
Mrs. U.Dutta, learned counsel appearing on behalf of the applicant submitted that applicant has joined as Scientist B for the post Parasitology (Microbiology) in Defence Research Laboratory, Tezpur on 07.01.2004. He was promoted to the grade of Scientist C from 01.07.2007 and further to the grade of Scientist D on 01.07.2014 and he has been continuing at Tezpur as such.
According to the learned counsel, applicant is a permanent resident of village Chathirappatti, Thanjvur district of11/15/2014 Untitled Page http://judis.nic.in/judis_cat/CaseNo_Cat_Result.aspx 2/3 Tamilnadu and he has completed his fixed tenure of 3 (three) years in the N.E. Region way back in 2007 and on completion of his fixed tenure of posting at N.E. Region, he is entitled to any of his choice place of posting. To buttress her argument, learned counsel has drawn our attention to Clause (i) of the O.M. dated 14.12.1983 which reads as under:-
(i) Tenure of posting/deputation:
There will be a fixed tenure of posting of 3 years at a time for officers with service of 10 years or less and of 2 years at a time for officers with more than 10 years of service. Periods of leave, training, etc. in excess of 15 days per year will be excluded in counting the tenure period of 2/3 years. Officers, on completion of the fixed tenure of service mentioned above, may be considered for posting to a station of their choice as far as possible. The period of deputation of the Central Government employees to the States/Union Territories of the North Eastern Region will generally be for 3 years which can be extended in exceptional cases in exigencies of public service as well as when the employee concerned is prepared to stay longer. The admissible deputation allowance will also continue to be paid during the period of deputation so extended.
According to the learned counsel, aforesaid beneficial provision was subsequently extended by the O.M.s dated 01.12.1988 and 22.07.1998.
According to the learned counsel, applicant’s mother who is a widow is staying alone in his native village and has been suffering from various heart related problems since several years and there is no one to look after her. Applicant being the eldest son in his family has not been unable to look after her in her need as applicant is posted far off place. That apart, according to the learned counsel during his stay at Tezpur, applicant, his wife and son had developed certain ailments due to extreme weather and climate do not suited them.
According to the learned counsel, due to the aforesaid compelling reasons applicant submitted various representations before the respondents i.e., on 07.04.2008, 12.06.2008, 02.05.2011, 12.09.2012, 13.05.2013, 02.07.2013, 11.07.2013, 23.07.2013 and 24.07.2014 seeking posting in any of the choice places, namely Gwalior, Coimbatore, Chennai or Mysore upon completion of his fixed tenure in N.E.Region, but the respondents have not considered any of his representations till date.
Learned counsel further submitted that as many as five Scientists, namely Dr. Mehbuba Begum, Shri Y V S Rao, Dr.Jubilee Purkayastha, Dr. Anurag Pandey and Dr. Gaurav Agnihotri, who have jointed at DRL, Tezpur much later than the applicant, have been transferred out to their choices out of N E Region, but in an arbitrary and unreasonable manner the respondents, the respondents have not yet transferred the applicant to any of his choice places despite completion of his tenure at N.E. Region.
We have heard the learned counsel for the applicant, perused the pleadings and material placed before us.
Clause (i) of the OM dated 14th December 1983 prescribes that there will be a fixed tenure of posting of 3 years at a time for officers with service of 10 years or less and of 2 years at a time11/15/2014 Untitled Page http://judis.nic.in/judis_cat/CaseNo_Cat_Result.aspx 3/3 for officers with more than 10 years of service. It was further prescribed therein that – officers, on completion of the fixed tenure of service mentioned above, may be considered for posting to a station of their choice as far as possible. The said OM confers a right upon the applicant to be considered for being posted at his place of posting as far as possible. Applicant has completed his tenure of three years in 2007 at DLR, Tezpur. Upon completion of his fixed tenure in N.E.Region, applicant has opted for 4 choice places of posing, namely, Gwalior, Coimbatore, Chennai or Mysore in his representations, the respondents ought to have considered his request, inasmuch as applicant has been continuing at DLR, Tezpur for more than 7 years even after the completion of his tenure.
In the case of Union of India vs. Dr. Umesh Kr. Mishra WA No. (SH) 17/2012, Honble Gauhati High Court has held that Fairness requires that if a policy has been laid down, the same may be deviated from only if there is any reason to do so. If no reason is forthcoming, the exercise of power of transfer in violation of a laid down policy may be held to be arbitrary. This Tribunal in its decisions rendered in the cases of S K Garg v. UOI & Ors (OA.179/2009 and R.Periasamy v. UOI & Ors (OA.49/2010) held that it was incumbent on the authorities to accommodate the officer at the place of his choice after completion of his fixed tenure and if such posting is not possible opportunity of being heard must be provided and detailed order should be passed stating the reasons as to why the concerned officer could not be accommodated at his place of choice.
Therefore, the respondents ought to have considered the case of the applicant for his posting at any of his 4 choices after completion of his tenure at N. E. Region and in the event of their inability to accommodate him at any of his places of choice; reasoned order ought to have been passed after affording him a reasonable opportunity of being heard. Such steps having not taken, it is a fit case to direct the respondents to consider the case of the applicant for his posting in any of his 4 choices.
For the reasons, narrated above, we direct the respondents to consider his transfer to any of his choice places, namely, Gwalior, Coimbatore, Chennai or Mysore subject to the availability of vacancy in the light of the aforesaid OMs as well as the observation made hereinabove, as expeditiously as possible, but not later than a period of four months from the date of the receipt of this order.
O.A. stands disposed of accordingly at the admission stage. No order as to costs.
