Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of Sri Saroj Kumar Patel, Scientist G who has been appointed as Director, Directorate Quality, Reliability & Safety (QRS) with effect from 31 March 2014 vide order No. DOP/05/53269/DQR&S/M/02 dated 31 March 2014. His wife Smt. Tessy Thomas is Director, Advanced System Laboratory, Hyderabad (ASL) and permanently residing at Hyderabad since past several years.

  1. Temporary duty total number of days of Sri Saroj Kumar Patel, Scientist G since his posting at DRDO HQ in New Delhi to Hyderabad upto 31 August 2014.
  2. The local address of Sri Saroj Kumar Patel, Scientist G.
  3. Whether Sri Saroj Kumar Patel, Scientist G is occupying Government accommodation/DRDO Guest House in New Delhi.(Yes/No)
  4. If yes then provide the HRA details paid to him with effect from his posting at DRDO HQ till date.

Note : It is observed that it is common practice of DRDO officials specially who are posted in DRDO Hqrs using Government accommodations /guest houses for long durations and simultaneously claimed HRA. The Letter of Ex DOP, Dr Arun Kumar in this respect enclosed herewith.

The abuse/misuse of power for personal gain is corruption. The information sought in this RTI Application pertains to allegations of corruption and as such not exempted u/s 24(1) of the RTI Act as per CIC decisions.

DRDO advertised RAC Advt No. 110, December 2012 for the post of Scientist ‘G’ specially to accommodate CMDR S K Patel Husband of Ms Tessy Thomas but unfortunately due to lot of  resistance from DRDO senior scientists Sh Avinash Chander could not succeeded to obliged ? as he was not the big boss that time and Dr V K Sarswat turned down the case and thus RAC Advt No. 110 for Scientist ‘G’ mere wasted.

DRDO advertised RAC Advt No. 112/ October 2013 for the post of Scientist ‘G, this time  Sh Avinash Chander was boss and ignoring 485 available scientists G, CMDR(Retd.) S K Patel husband of Ms Tessy Thomas was selected and he joined DRDO as Scientist ‘G’ on 27 March 2014. He was appointed as Director in Directorate of QRS(DQRS) on 31 March 2014″ at DQ, DQRS as Director. The all eligible and more experienced DRDO scientists who are grown with DRDO Missile program now blowing the trumpet – Mera Kya, Mujhe Kya

 4. Brief facts leading to appeal:

(a)       An application under Section 6 of RTI Act 2005 was submitted online to Shri Rajesh Nagpal, Under Secretary & CPIO on 01 August 2014.  Copy of the RTI application dated 01 August 2014 is enclosed

(b)       CPIO ACC Cell, Cabinet Secretariat denied/refused for information sought vide his decision letter F. No. CABST/R/2014/60302-RTI dated 29 August 2014.

(c)       CPIO denied for information under the provisions of Section 24 of RTI Act 2005.

(d)       Cabinet Secretariat, Rashtrapati Bhavan, New Delhi has not been placed in Second Schedule of RTI Act 2005 by Government of India.

(e)       Appellant is deeply aggrieved by this decision of CPIO, ACC Cell and this leads to appellant to file first appeal u/s 19(1) of RTI Act 2005.

  1. Reasons/Grounds for First Appeal and Prayer/Relief:-

(a)     Information sought was related to Business & Charter of Appointment Committee of Cabinet, Cabinet Secretariat, Government of India. The information sought was regarding appointment of Secretary, Deptt. of Defence R&D(DRD), MOD by Appointment Committee of Cabinet, GOI.

(b)     Cabinet Secretariat, Rashtrapati Bhavan, New Delhi has not been placed in Second Schedule of RTI Act 2005 by Government of India.

(c)     The information sought or any part of it was not at all concerned with details of DRDO projects and therefore Section 24 does not apply on the information sought.

(d)     The custodian of information sought is ACC Cell, hence denial of information is illegal under RTI Act 2005.

(e)     The information was denied to conceal the facts related to irregularities & illegality in contractual appointment of Shri Avinash Chander, CC (R&D) as Secretary, DRD, MOD by ACC.

(f)      Under the provisions of Section 7 subsection(8) [Disposal of Request], reproduced for your ready reference:

Where a request has been rejected under sub-section (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall communicate to the person making the request,—

(i) the reasons for such rejection;

(ii) the period within which an appeal against such rejection may be preferred;   and

(iii) the particulars of the appellate authority.

The CPIO should provide the period within which an appeal against such rejection may be preferred and particulars of the appellate authority but such information was not provided in his letter dated 29 August 2014. Thereby CPIO fails to perform his duties properly and violated the provisions of Section 7(8)(ii) &(iii) so that appellant could not file first appeal.

(g)     As a matter of fact, an another application under RTI Act 2005 was filed on 29th January 2014 to CPIO, DOPT by appellant regarding contractual appointment of Shri Avinash Chander as Secretary, DRD, MOD. (Annexure FA3)

(h)     The same application under RTI Act 2005(Annexure FA3) was transferred by DOPT vide letter No. 39/3/2014-EO(SM-I) dated 16-04-2014 to CPIO, ACC Cabinet Secretariat. The information sought in the said application under RTI Act forwarded by DOPT to ACC, Cabinet Secretariat was provided to the appellant by Shri K.A. Avinash, US & Link CPIO, ACC vide letter No. F 12015/277/2014 dated 19 May 2014.(Annexure FA4)

(i)       It is very surprising that same nature of information was provided by one CPIO of ACC, Cabinet Secretariat vide letter dated 19 May 2014 but now the same nature of information was denied by another CPIO, ACC on false & illegal grounds.

(j)       The information sought is neither related to DRDO nor DRDO is custodian of the information sought, information sought is not at all related to charter & activities of DRDO, ACC is sole custodian of the information sought and information sought is pertaining to activities, charter & business of ACC under Allocation of Business Rules 1961.

(k)     The denial of information by misusing section 24 of RTI Act 2005 by CPIO, ACC is motivated to protect the interest of particular officer and to conceal irregularities committed by ACC in appointment of Shri Avinash Chander as Secretary, DRD, MOD.

(l)       CPIO denied information on illegal grounds with malafide intentions to harass the appellant.

  1. Prayer /relief sought for:-

Appellant sought information vide his application dated 01 August 2014 under RTI Act to CPIO, ACC, Cabinet Secretariat and the information sought was denied by CPIO, ACC. Therefore, it is kindly prayed to FAA, ACC, Cabinet Secretariat that the orders may kindly be issued to CPIO, ACC, Cabinet Secretariat to provide the information sought by appellant in RTI Application dated 01 August 2014 based on the grounds/reasons mentioned above in Para(5).

As per patent search it is found that the patent application deemed to be withdrawn u/s 11B (4) Copy enclosed. As per DRDO website PATENT, Infra Red Signature Suppression (IRSS) Device, For Fitment at Exhaust of Diesel Engine of Ship to Evade Attack by Infra Red Seeker Missiles. (Patent Application: 0123/Del/2005 A, Filling date: 19-01-2005 Publication date: 10-11-2006) 30 number of Ships have been fitted with this Device. As per patent application six names are there as inventor and second name VEPAKOMMA BHUJANGA RAO. Copy enclose

  1. Provide the present status of this patent application no 0123/Del/2005 filed by DRDO.
  2. If patent approved by apex body of government of India than copy of patent approval or reference of approval.
  3. If patent application withdrawn then copy of approval from competent authority to information on DRDO website regarding patent claim.
  4. Provide the date of withdrawn patent application and reasons of withdrawn.

Note: the requested information is not come under exemption of schedule –II of RTI Act 2005. Since, March 2014 end DRDO stopped to provide information under shadow of exemption. Section 177 in IPC Furnishing false information. Whoever, being legally bound to furnish information on any subject to any public servant, as such, furnishes, as true, information on the subject which he knows or has reason to believe to be false, shall be punished with simple imprisonment for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both. So  before denial of information your point wise explanation is required that the matter not pertain under corruption.

DRDO Having Blind RTI Cell

DRDO RTI Cell is acting as a blind body. Since RTI Act, 2005’s implementation, DRDO felt its power  and put all efforts to  get rid off but success was partial, Schedule – II exemption did not include the corruption and Human rights allegations and subsequently CIC also gave guidelines that, day to day administration and management matters are also not exempted.

This CIC supports give honest officials and citizen an immense power to fight against neck deep corruption/nepotism/favoritism prevailing in DRDO.

Cases started to expose the corrupt practice of senior DRDO officials in various matters like recruitment/promotions/procurements, etc and action started against corrupt officials by Defence Minister, CVO, CVC, etc

The DRDO management now come under desperation and looking after to fix those who are trying to expose the corrupt senior officers, few terminated/dismissed, few transferred, few deprived with promotions, a message was passed among the DRDO officials/employees, that if any one seeks RTI, he should be ready to face consequences and it is established that facts that DRDO management extensively used unwritten policy not give promotions or due credits to those who are involved in RTI acts practices.

It is a clear cut message to the nation that DRDO top management is a dishonest corrupt and  not working in the interest of the nation because it is not committed towards the constitution of India.

On 8th March 2014, Dr. R B Sharma, CPIO, DRDO Hqrs acted as a super boss and sent a letter to all Labs/ Establishments of DRDO to not give any information under RTI Act, 2005.

On 28th May, 2005 a meeting was held under DRDO transparency officer Dr. Sudershan Kumar, DS and CC R&D (PC & SI). In that he told to all DRDO’s CPIO not to supply any information under RTI Act-2005. It can be verified by records of DRDO’s RTI cell that no information was passed after this decision to any RTI applicant.

 That all RTI applicants receiving reply in the same format which was supplied by DRDO RTI Cell and First appellate authority reply was also given by DRDO in same format.

Surprisingly the following case of Dr. R G Taware, Ex- Technical Officer ‘B’ was to show the blind act of DRDO’s RTI cell.

Dr. R G Taware, Ex- Technical Officer ‘B’ was illegally dismissed by DRDO management with conspiracy. The conspiracy was proved by single point DRDO used then RRM, Sh Palam Raju for suspension and after dismissal and material fact is that RRM, Sh Palam Raju nor has the power for such approval, because as per Ministry of Defence orders of power delegation by Defence Minster shows he has never delegated such powers to RRM, Sh. Palam Raju specially for DRDO.

Dr. R G Taware, Ex- Technical Officer ‘B’ suspension /dismissal orders one of major allegation was “The tone and tenor of letter of Dr. R G Taware dated 26 Aug 2009”

Dr. R G Taware send an RTI request to CPIO, HEMRL, Pune, information sought that DRDO scientists developed a machine which can measure “The tone and tenor of any letter”, he asked whether scientist got any award and promotions for this great innovation.

The Blind DRDO RTI cell replied in a standard format “ You hereby inform that DRDO is placed in second schedule of RTI Act and exempted from disclosure of Information under Section 24 (1) exceptpertaining to the allegation of corruption and human right violations”( copy enclosed)

 Further after getting above reply from BLIND DRDO RTI Cell, Dr. R G Taware sent first appeal to FAA, DRDO to check their IQ.

Interestingly the height of blindness of DRDO RTI cell or to hell with RTI same standard reply send by FAA on the issue that “You hereby inform that DRDO is placed in second schedule of RTI Act and exempted from disclosure of Information under Section 24 (1) exceptpertaining to the allegation of corruption and human right violations”  (copy enclosed)

Great DRDO RTI cell proved their scientific capability in this RTI application replies – can the common Indian believe these DRDO scientists caliber for defence preparedness ??????????????

Request to provide facility of filing online RTI applications for DRDO

Subject: Request to provide facility of filing online RTI applications for DRDO and give directive to DRDO to Honor the RTI act 2005 in right spirit to promote transparency and accountability in the working of every public authority.

Reference:     (i)  My letter dated 16 April 2014 to Prime Minister with subject        Unconstitutional act of DoPT officials who are managing the Online RTI Portal and supporting corrupt officers of DRDO”

Honorable Sir,

  1.  www.corruptionindrdo.com continues to expose the corruption/nepotism prevailing in DRDO since the last four years. DRDO’s honest officials send corruption inputs from all DRDO establishments and with help of RTI’s and from internet information, the corruption inputs are regularly passed to the government and relevant agencies like CVC, IB, CBI etc.
  2. www.corruptionindrdo.com’s efforts recognized by honest officials of DRDO and website regularly getting corruption/nepotism inputs from each and every corner of the country. On basis of the points raised by the website, DRDO also took several corrective measures and constituted inquiry committees for examining the truths.
  3. In my 16th April 2014 letter I have requested Honorable Prime Minister to kindly take appropriate corrective measures against officials who are involved in unconstitutional acts and give strength to RTI- Act 2005. It has really empowered the common man. Also, fix those who are diluting the effectiveness of  the strong RTI Act -2005.
  4. The online RTI portal “Guideline – An applicant who desires to obtain any information under the RTI Act 2005 can make a request through this RTI Online Portal to only the Central Public Authorities of main Ministries/Departments located at New Delhi initially”. In the first phase, this facility is available to Ministries/Departments/Apex Bodies mentioned in the list available in ‘GUIDELINES’, but there is no list available in RTI portal. Like Defence Ministry having several offices in  New Delhi
  5. Sir, I have received a letter from DoPT Letter No.6/1/2014-IR dated 6/6/2014 copy to Sh Kaushal Kishor Pandey, SO, PMO, New Delhi in respect of reply my letter dated 16 April 2014 to Prime Minister with subject “Unconstitutional act of DoPT officials who are managing the Online RTI Portal and supporting corrupt officers of DRDO”
  6. In DoPT letter Sh R K Girdhar, Under Secretary (RTI) stated that “if you not satisfied with the reply of CPIO, may filed appeal before the first appellate authority in the same public authority u/s 19(i) of the RTI Act 2005” it seems that the letter forwarded by PMO was not even read by Sh R K Girdhar. It shows the seriousness of DoPT regarding RTI issues or Sh R K Girdhar just trying to shield the nodal officer.
  7. I have enclosed the remark of nodal officer not CPIO that they have returned with “You have filed more than 40 online RTI applications relating to DRDO on the address of Department of Defence which has been physically transferred to DRDO under intimation to you. DRDO is a separate public authority and is also placed under Second Schedule of the RTI Act, 2005. Therefore, your online RTI applications seeking information in r/o the DRDO and sent to Department of Defence will not be acted upon henceforth. You may directly send your application to the DRDO for the information.”
  8. Sh R K Girdhar, just overlooked the letter contents and send regular fixed reply without applying any mind. I don’t know RTI Act 2005 is a serious responsibility or just for feeding papers.
  9. Sir, after exposing the corruption / nepotism of DRDO’s senior officials because RTI Act-2005. Some officials suspended, some got charge sheet and some are in queue. Now DRDO officials are trying to make a wall for RTI Act 2005. Recently an unconstitutional letter issued by Dr. R B Sharma, CPIO, DRDO, Hqrs Cell on 8th March 2014 to all establishment/Lab show that they clearly made their policy not to give any RTI reply. (Copy enclosed) As per Sh R K Girdhar in one RTI reply in reference to that “any CPIO can compel to other CPIO not to give information under RTI” he stated that “There is no such policy of compelling or a CPIO being compelled by other PIO for not providing information to the information seeker. A PIO can be penalized by Information Commission under Section 20 of the RTI Act, 2005.”
  10. Further in 28th May 2005 a meeting was held under DRDO transparency officer Dr. Sudershan Kumar, DS and CC R&D (PC & SI). In that he told to all DRDO’s CPIO not to supply any information under RTI Act-2005. It can be verified by records of DRDO RTI cell that no information was passed after this decision to any RTI applicant.
  11. DRDO is in neck deep corruption/ nepotism/ favoritism and the reason being this DRDO is unproductive since last 15-20 years, don’t believe their data and dabas because when our forces will be ready to accept those then only our country will believe on DRDO, otherwise it will  be only ok for 26 January  republic show  tableau .
  12. In view of the above, I request you Sir, the RTI is the only effective way to restrict corruption in DRDO. Please give directives to DRDO & DoPT to honor the RTI act 2005 in the right spiritto promote transparency and accountability in the working of every public authority.

Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of Dr S K Salwan, Ex Lab Director of DRDO who was appointed to –Dr B D Nagchoudhuri Chair for three years at a total cost of 83.064 Lakhs. The appointment was made by Ex DG, DRDO Dr V K Saraswat in a discretionary manner on nomination basis, The DRDO Chair was not reserved for Ex DRDO employees and no public notice was issued seeking applications for this highly paid post by DRDO authorities. Instead of paying monthly remuneration to Dr S K Salwan, DRDO released the first installment of Rs 27.688 on 28 April 2011 advance to Dr S K Salwan without deducting tax at source.  Dr S K Salwan joined on 2 May 2011 and as per audit report such seeking of paid expertise of ex employees on nomination basis is against the General Financials Rules of Govt. of India. Audit report says appropriate recoveries need to be effected forthwith. The above information related to clearly case of corruption and not exempted under section 24 (1) of RTI Act 2005.

  1. Please provide total amount released to Dr S K Salwan against his appointment to Dr B D Nagchoudhuri Chair
  2. Please provide total amount tax deducted from remuneration of Dr S K Salwan
  3. As suggested by Audit to appropriate recovery from remuneration of Dr S K Salwan. The total amount recovered by Dr S K Salwan.
  4. Present status of financial clearance with Dr S K Salwan, whether all amounts is cleared or pending.
  5. If pending than please provide total amount and then recovery initiation status.

Respected Madam,

Today in Neemuch, MP you address in a big gathering that you gave the power of RTI Act to common man to fight against corruption. Very well said it is very effective Act for exposing corruption prevailing in our country. I am using this common man power to expose corruption prevailing in DRDO, Ministry of Defence.

Today I am writing this letter to you some officials from DoPT are making mockery of RTI Act. They are trying to dilute the effectiveness of RTI Act power by helping corrupt official of DRDO, Ministry of Defence. My RTI’s exposing the DRDO, Ministry of Defence corrupt officials.

RTI online portal administrators are returning my all RTI applications one by one with sundry remark which are again violation of RTI Act-2005 section 6(3)

I am enclosing my RTI applications which were return back to me for your kind perusal.

Although you are quite busy with your election campaign our good wishes with you and request you to kindly take it seriously because it will become backbone of your faithful followers.   Fix those who want to weaken your sincere efforts toward nation.
