Kindly refer to following decisions of Central Information Commission and verdict given in these decisions.
File No. CIC/LS/A/2012/002612 dated 22.3.2013 (Dr. Neelam Bhalla vs. DRDO) Verdict – It is, no doubt, true that DRDO is an exempted organisation yet it has been the consistent view of this Commission that the benefit of exemption extends only to functional / operational matters and not to establishment related routine matters. The legality of this view has not been challenged in the relevant judicial forum so far.

BEL is backbone of our defence services and contributes in specialized system needs of our forces as well as paramilitary forces.

BEL has always been associated with DRDO in several areas and fields and the joint venture has always given great results. But unfortunately corruption is also growing very fast in our defence sector. In DRDO, you must be well aware, how in name of secrecy and R&D unlimited funds are managed. There is no accountability in DRDO and scientists are utilizing their brains and skills to fool our country’s people by applying numerous methodologies, like changing nomenclature of items, changing specifications, rotating the same items as surplus available in labs, in customizing the systems purchased at exorbitant prices. These are common practices in DRDO but with fast development of communication systems and easy access to databases these corrupt practices are starting to get exposed.

Recently after superannuation Sh A .K Musla, Scientist ‘G’, IRDE, DRDO, Dehradun joined Bharat Electronics Limited (BEL), Kotdwara. Please find the RTI application to DRDO and copy of reply by DRDO Hqrs. This practice is adopted by corrupt DRDO scientists; they join various institutions/ organization where commercial interests between both organizations exist. Dr W Selvamurthy (Dr in YOGA from Private Institute) has joined Amity Group as President, Amity Science, Technology and Innovation Foundation (ASTIF) and Chair professor, Life Sciences without obtaining the required NOC from government of India. Recently Defence Minister recommended CBI inquiry against top DRDO officials and Dr W Selvamurthy is one of them.

Sir, I have sent an RTI to Ms. Vanitha Bhandari, MANAGER (HR&A) PIO, Bharat Electronics Limited (BEL) Kotdwara-246149, Dist. Pauri Gharwal, Uttarakhand and till date have received no communication from, BEL Kotdwara.

It is requested that if you could please look into the matter and do needful to stop the corrupt practices prevailing in BEL with the help of DRDO officials. It would be a great contribution towards a corruption free India.

Para (a) Permission will be required for post-retirement commercial employment of a retired officer who was a member of a Group ‘A’ Central Civil Service or held a Group ‘A’ post if the commercial employment is to be taken up within one year of retirement.

Para d) Before an application of the retired officer is considered, an undertaking from the retired officer is to be taken in the form of an affidavit that the factors mentioned in clauses (b) to (f) of the amended sub-rule (3)of Rule 10 of the CCS (Pension) Rules, do not come in the way of considering his application.

As you aware because of this corrupt act honorable defence minister suspended Dr Arun Kumar, Ex DOP, DRDO and matter recommended for further inquiry to CBI on 29th October 2013

नई दुनिया, ग्वालियर। शोध छात्रा के यौन उत्पीड़न में फंसे रक्षा अनुसंधान और विकास संगठन (डीआरडीओ) के वैज्ञानिक प्रभात गर्ग ने मंगलवार को पुलिस के समक्ष समर्पण कर दिया। कोर्ट ने उन्हें दो दिन की पुलिस हिरासत में भेज दिया।

2010 -2011 के दौरान डीआरडीओ में शोध करने आई कर्नाटक की एक छात्रा ने 30 नवंबर को वैज्ञानिक के खिलाफ यौन उत्पीड़न की शिकायत दर्ज कराई थी।

वैज्ञानिक प्रभात गर्ग ने पुलिस को बताया कि वह निर्दोष हैं और साजिश के तहत उन्हें फंसाया जा रहा है, जबकि छात्रा ने आरोप लगाए हैं कि वैज्ञानिक ने शोध पूरा न कराने की धमकी देकर उसके साथ छेड़छाड़ की और प्रेम संबंध बनाने का दबाव डाला।

शोध की अहमियत को देखते हुए उस दौरान वह शांत रही। लेकिन जब छात्रा को शादी के बाद भी वैज्ञानिक एसएमएस भेजकर परेशान करने लगा तो उसने विश्वविद्यालय थाने में शिकायत दर्ज करा दी। इसके बाद गर्ग गायब हो गए थे लेकिन परिजनों पर बढ़ते दबाव की वजह से उन्होंने समर्पण कर दिया।

Sexual harassment case: DRDE scientist Prabhat Garg surrenders -DNA

Defence Research and Development Establishment (DRDE) scientist Prabhat Garg, against whom a research scholar has levelled allegations of sexual harassment, on Tuesday surrendered before police here.

Police said Garg turned himself in to University Police Station, reportedly after pressure built up on him by police and also his family members.

In her complaint, the research scholar had accused Garg of sexually harassing her during 2010-11 when she was pursuing her work under him at the city-based institution.

Police said the woman discontinued her research due to “uncomfortable situation” she was experiencing under her guide, that is Garg, and also for her marriage.

The woman suffered sexual harassment quietly till her marriage and also because of her career but when Garg allegedly did not spare her even after her marriage, she disclosed the matter to her husband.

The couple then reached Gwalior and lodged a complaint with police who in turn registered an FIR against Garg under sections sections 354 (assault or criminal force to woman with intent to outrage her modesty) and 506-B (punishment for criminal intimidation) of IPC.

Garg was produced before a local court which remanded him two-day police custody.

Don’t delay Light Combat Aircraft project: Anthony to DRDO

NEW DELHI: Defence minister A K Antony on Wednesday directed the DRDO to ensure that the operational deadlines for the Tejas Light Combat Aircraft, first sanctioned 30 years to replace the ageing MiG-21s, are not delayed yet again.

Addressing the parliamentary consultative committee on defence, Antony said the under-development indigenous fighter’s initial operational clearance (IOC) planned for next month and the final operational clearance (FOC) in December 2014 should be “completed on schedule”.With DRDO currently handling as many as 532 projects, the minister asked DRDO to “mainly concentrate on high-end research, particularly in critical and strategic areas”. DRDO should invest more time and resources in fundamental research, lay more emphasis on major mission-mode programmes for the armed forces and pool together resources and talent available in academic and other R&D institutions, he said.

The long-running developmental sagas of the Tejas fighter and Arjun main-battle tank have come to symbolize the huge delays and cost-overruns dogging virtually all major projects of DRDO. While the MPs lauded DRDO’s success in the field of missiles, they were “bitterly critical” of the delay in such projects.

As earlier reported by TOI, the single-engine Tejas is unlikely to become fully combat-worthy anytime before end-2015. When the Tejas project was first sanctioned in 1983, the initial project cost was pegged at Rs 560 crore. The overall programme will now cost upwards of Rs 25,000 crore if the naval variant, trainer and the failed Kaveri engine are also taken into account.

It was in January 2011 that Tejas got IOC-I, which was initially heralded as the “full and final IOC” by the combine of DRDO, Aeronautical Development Agency and Hindustan Aeronautics Ltd till better sense prevailed. The fighter can be certified as fully airworthy only after it passes the IOC-II stage.

The light-weight Tejas will be ready to go to war only after the FOC, which will include integration of all weapons and other systems to ensure it can fire guns, rockets, laser-guided bombs and BVR (beyond visual range) missiles as well as undergo air-to-air refuelling.

India-Israel joint venture to manufacture missiles fails to take off

HYDERABAD: The joint venture between India’s Defence Research and Development Organization (DRDO) and Israeli Aerospace Industry to manufacture Long Range Surface-to-Air Missile (LR SAM) and Medium Range Surface-to-Air Missile (MR-SAM) has turned out to be a non-starter.

The long range missiles were to have been delivered to the Indian Navy by 2012 while the medium range missiles should be in the Indian Air Force weaponry by 2017. However, both the delivery schedules are way behind schedule and show no signs of meeting them even in the near future.DRDO officials are blaming the lack of progress in the joint venture due to lack of transparency and non-transfer of technology by their Israeli counterparts. And the recent trials that were conducted by the Indian defence organization failed to meet the standards of both the IAF and the Indian Navy. The entire cost of Rs 12,500 crore of the joint venture is being funded by India and the inordinate delay and lack of progress in the project has turned into a big cause of worry in the defence ministry.

According to sources, the LR-SAMs project was commissioned in 2006 and the delivery of the missiles to the Indian Navy should have happened by 2012. Similarly, the MR-SAM venture was signed in 2009 and the missiles are to be delivered to the Indian Air Force by 2017. Both both the projects are way behind schedule and show no signs of making progress.

“Frankly speaking, right now, not much is going on in the joint venture due to various issues between the two sides. Expecting Israel to share its technology with India is unfair. But such things should have been clarified before the joint venture was entered into,” said an official.

DRDO is maintaining that it is because of the lack of transfer of technology that the trials conducted so far have ended up as failures. “Industries are merely getting the drawings as to how to produce certain systems and such things are leading to deviations from the laid down specifications because the knowledge to develop the systems is not being imparted,” said sources.

DRDO officials are also attributing the delay to a complicated and long procedure involving shuttling between India and Israel for various stages of development of a system etc. The Hyderabad-based Indian defence organization also reportedly found itself helpless on problems in propulsion system and other related issues while a significant number of parts or systems are yet to be tested following a delay in manufacturing.

However, when quizzed on the issue, DRDO Director General Avinash Chander told the TOI that nothing was amiss. “Everything is going on as per the plan and development trials are on. We shall be able to deliver the MR-SAMs as per schedule. Right now, the contribution from India in the joint venture project is about 20% and would ultimately reach 80% in the final stages.” Regarding the already delayed LR-SAM, DRDO officials declined to come on record.

MR-SAM, one of the major demands of the forces, is to have a range of 70 kms or so, and the IAF is banking on replacing its ageing Soviet-made Pechora SAM missiles with the MR-SAMs. But nobody is sure how long the wait is going to be, and whether the delivery will take place at all.

Scientist held for raping wife in Raipur – Parda Phash

Raipur: It seems that the court’s decision on granting death penalty to the Delhi Gang rape accused is very less, as the male section is not realizing as to what they are turning our society into, by not stopping but continuously committing the most heinous crime that is ‘Rape’. As per reports, a Defence Research and Development Organization scientist Majumdar has been accused of raping his 30-year-old wife in Raipur, today, September 23.

The news was confirmed by Raipur’s Superintendent of Police O P Pal, he said, “A case has been lodged case against Tapas Kumar Majumdar, who is working with food research laboratory wing of DRDO, on the complaint lodged by his 30-year-old wife this evening.”

The complainant who works as a school teacher was married to the scientist in 2011 and she had no information regarding the status of his first marriage. The only thing she knew was that her husband had divorced his first wife, but later on she came to know that he had not divorced his first wife.

The accused has been booked under IPC sections 376 (rape), 419 (cheating by personation), 496 (marrying fraudulently) and 498 (A) (subjecting wife to cruelty).

The police are still investigating into the matter.

Scientist seeks sexual favours, booked in MP – Times of India

BHOPAL: A senior scientist at the Defence Research & Development Establishment (DRDE) in Gwalior has been accused of stalking, blackmailing and seeking sexual favours from a fellow researcher.

A complaint lodged with the police on Saturday.

Scientist Prabhat Garg was harassing his fellow researcher for the last three years, said police. She joined DRDE Gwalior in 2010 to pursue research.

The complainant later got married and settled in Karnataka two years ago. But Garg allegedly continued stalking and making calls and sending texts to her.

She told her husband and subsequently filed a complaint after which Garg was booked.

Superintendent of police Santosh Singh said case is being investigated and a team would be sent to Delhi to question Garg.
