Sir,                                                                                                                                                                Yesterday (26th April 2015) The Sunday Standard first page news was “Defence Secret is in Danger”

In this reference, DRDO having lot of examples, DRDO is only one department where you can find contractual manpower above age of 70 or below 18 years. People may be think that because of their high skill expertise DRDO might been engage such manpower,  but matter of fact this practice adopted DRDO is only for those who are having good number of secrets or having evidences of wrong doings of DRDO bosses.

In ASL you will find people working since last more than 10 years after retirements, scientists, Technical Officers, who are experts in manpower/ logistic manipulations while missile firing, even JCDA retired account officer etc who are expertise in bill clearance from CDA. These specialized contractual having good assets that can be verified by agencies.

One major observation on these contract appointments is the not following the proper police verification.

ACEM, Nasik campus one murder was done by a contract’s man who has criminal records.

HEMRL GOCO contract labor business, the police verification was done on single list basis one stamp of Thana solved the problem and best part of this these hundreds of contract labours handle the high class explosive TATB.

For example in ADE, DRDO. Bangalore more than 170 B.Tech contract employees are working in core area for mare Rs 12000 and same time scientists who are getting hefty salaries Rs 80000 to 1.5 Lakhs are looking stores /admin /horticulture /works / security /Library etc

all of us know about DRDL it is a dream job org to every one. but please think about contract employees. My husband is also working in DRDO RCI he is engineering graduate. From past 2 years he is working but he is getting 14k. how we can Liv with family in Hyderabad and this year no increments… we are not dreaming about permanent  job….. my small wish is to get better pay… for the same job a permanent employee getting nearly 4ok but contract employee getting only 12+.but work is same for both. am not asking to give 4o to contract people just i want to say please provide increments at least…this is not only my wish… i hope u can think & talk about this……….

Following one example case of DRL, DRDO, Tezpur for your sharp analysis of this DRDO’s contract business.

  1. Sh.M.L. Roy is an ex-employee of Defence Research Laboratory (DRL), Tezpur who superannuated on 31 Dec 2008
  2. He was posted at Director Secretariat as Personal Assistant/Personal Secretary to Director, DRL, Tezpur prior to his superannuation from DRL, Tezpur.
  3. Right from his superannuation on 31 Dec 2008, he was start working at DRL, Tezpur as contractual Laborer and posted at Director He is engaged in all sensitive work like computerized compiling of materials in Director’s Office, monitoring and maintenance   of important files of Director Office which has already been mentioned in his contract.
  4. Since last 7 years continuously working in DRL, Tezpur as Personal Secretary (PS) to Director, DRL, and Tezpur by means of several private vendors / supplier/security agencies.
  5. M.L. Roy is presently of 65 +years age and not fit for this job as in this sensitive post any private contractual labour should not be appointed while several young skilled manpower is available in DRL, Tezpur.
  6. DRL, Tezpur having permanent staff Sh S K Sharma as PS ‘C’ but he was not assigned the right job.
  7. Interestingly Sh M L Roy working for Rs 5000 – Rs 6000 only as Jan 2015 Salary was Rs 5764.00
  8. Sh M L Roy working as mole for vendors, each and every file of procurements / recruitments/ transfer postings/temporary duties etc. moves from Director’s office.

Sir, it is requested kindly order for extensive survey of to explore the necessity of this contract business in DRDO. Because like Director, DEAL Sh R C Agarwal used these contract labour for kitchen gardening, to clean utensils, to wash his wife’s petticoats etc, when this issue published on website Sh R C Agarwal stopped using these labours. Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect of  repeat order placed by Dr. A.K. Saxena, Director , DMSRDE, Kanpur.

As a matter of fact procurement cases under Global/Open/Limited tender takes longer time in finalization and as only few months left for superannuation (31st July 2015) of Dr. A.K. Saxena, thereby he is issuing repeat orders without any requirements of instrument/equipment/material so that cases may be materialised during his tenure.

Information sought –

  1. The number of repeat order placed in financial year 2013-2014 with repeat order justification.
  2. The number of repeat order placed in financial year 2014-2015 with repeat order justification.
  3. Output of item before placing the repeat order i.e. if item is equipment than logbook of uses, if material than product output.

Sir,

Recently DOP&T published an OM F.No.22/35/2011-EO (SM.II) 24th September, 2014 Sub: Grant of extension/re-employment to Central Government servants beyond the age of superannuation.

In Para 1 of above  – The ACC has observed that in some of the cases, the Departments are not taking timely action to reconstitute the Departmental Peer Review Committee (DPRC) and are unilaterally extending the service of the officers beyond the age of superannuation without first obtaining approval of the ACC.

In Para 4 of above –  It is also reiterated that in absence of specific approval of ACC towards extension of his services beyond the date of superannuation, an officer should stand retired on his date of superannuation and under no circumstances should the Ministry/Department concerned extend his services beyond superannuation unilaterally without the approval & ACC.

Sir, with reference to above OM it is clear that ACC has observed that in some cases officials/scientists got service extensions without first obtaining approval of the ACC, and after straight order no one is retired on his date of superannuation.

It shows that system is having still few strong manipulators who are protecting individuals and putting some weird excuses so that above order is not executed after 46 days. It is really very astonishing facts that after your strong message some of rotten minded officials are not working in the national interest.

On 31st October 2014 evening when DRDO & DAE people got message that you have not granted extensions to scientists after series of recommendations of their so called superiors, they welcomed your decision and distributed sweets and celebrated the closing of extension era.

To maintain their spirit and boosting their moral it is requested that weed out those few officials from your system who are the obstacle of our country’s development and execute the above DOP&T OM urgently.

The cases of extensions without approval of ACC should be cancelled immediately and these scientists should be superannuated with effect from the date they got extension.

  3. Please provide  the names of  individuals who were retired from service as per Para- 4 of above referred OM – that in absence of specific approval of ACC towards extension of his services beyond the date of superannuation, an officer should stand retired on his date of superannuation.
  4. As per Para- 1 of above referred OM  – (The ACC has observed that in some of the cases, the Departments are not taking timely action to reconstitute the Departmental Peer Review Committee (DPRC) and are unilaterally extending the service of the officers beyond the age of superannuation without first obtaining approval of the ACC.) As per above statement it is  understood that ACC found such cases where individuals were given service extension without getting first obtaining approval of the ACC. Provide the action taken by PMO on these illegal service extensions till date.

Attention of all the Ministries/Departments is invited to the Government of India (Transaction of Business) Rules which prescribe that the ACC is the competent authority to decide the cases of extension in service beyond the age of superannuation. Attention is also invited to DoPT’s OM. No. 26012/6/2002-Estt, (A) dated 09.12.2002 on the subject mentioned above laying down instructions/criteria for grant of extension in service to the categories of personnel referred in proviso to F.R. 56(d). The ACC has observed that in some of the cases, the Departments are not taking timely action to reconstitute the Departmental Peer Review Committee (DPRC) and are unilaterally extending the service of the officers beyond the age of superannuation without first obtaining approval of the ACC.

2. It has also been observed that Ministries/Departments often submit proposals late to the EO Division as a result of which submission of cases for consideration of the ACC also gets delayed.

3. In view of the above, all the Scientific Ministries/Departments are hereby advised to take timely action for constitution of the DPRC for considering the cases for extension of service of specialists in medical or scientific fields, beyond the normal date of superannuation and ensure that proposals seeking approval of the ACC be invariably submitted at least two months in advance of the date of superannuation.

4. It is also reiterated that in absence of specific approval of ACC towards extension of his services beyond the date of superannuation, an officer should stand retired on his date of superannuation and under no circumstances should the Ministry/Department concerned extend his services beyond superannuation unilaterally without the approval & ACC.

Cabinet nod must for service extension of scientists

NEW DELHI: The Centre has made approval of appointments committee of the cabinet (ACC) mandatory for extending the service of scientists employed with the government, beyond their superannuation.

“All the scientific ministries/departments are hereby advised to take timely action for constitution of the departmental peer review committee (DPRC) for considering the cases for extension of service of specialists in medical or scientific fields, beyond the normal date of superannuation and ensure that the proposals seeking approval of the ACC be invariably submitted at least two months in advance of the date of superannuation,” the department of personnel and training said in an order.

The order pointed out cases where scientific ministries and departments have not taken timely action to reconstitute the DPRC, an expert body which meets biennially to consider cases of extension to scientists retiring over the next six months. The recommendations of the DPRC are then sent to the establishment officer for final approval by the ACC.
The note said an officer, in the absence of a specific approval of ACC towards extension of his services beyond the date of superannuation, should stand retired on the day of his superannuation. “Under no circumstances should the ministry/department concerned extend his services…unilaterally without the approval of ACC,” it said.

No extensions sans ACC okay: Government to DRDO

NEW DELHI: In a message to the Defence Research Development Organisation that has over a dozen scientists working on tenures beyond 60, the government has frowned at the tendency of giving extensions to scientists without consulting the Appointments Committee of Cabinet (ACC).

Prime Minister Narendra Modi is said to be unhappy with DRDO’s functioning and had recently advocated that five out of the 52 DRDO labs be manned by young scientists after reports with the government revealed that as many as 358 scientists had quit DRDO between 2009 and 2013.

A government note sent on Friday to nine ministries and departments which have specialists in scientific or medical fields, including DRDO and Department of Space, the Department of Personnel and Training has said that the ACC headed by the prime minister has observed that in some cases, departments have unilaterally extended the service officers beyond the age of superannuation without obtaining the approval of ACC.

“It is reiterated that in absence of specific approval of ACC towards extension of services beyond the date of superannuation, an officer should stand retired on his date of superannuation and under no circumstances should the Ministry/Department extend his services beyond superannuation unilaterally without approval of ACC,” the note says. This also comes on the heels of the success of the Mars Orbiter Mission where Modi had praised scientists at ISRO for the feat.

In Friday’s note, the policy drawn up by the NDA government in 2002 was pointed to, which said that any tenure extensions to scientists should be “only in really exceptional circumstances” and only if the retiring specialist “is not just one of the outstanding officers but is really head and shoulders above the rest”.

That policy also said that too many cases of extensions are likely to cause “frustration and affect morale of upcoming scientists who have exposure to latest technological developments.” In 2012, DRDO admitted that 37 scientists — 12 of whom were in distinguished category — were on extended tenures. This was despite the Rama Rao Committee, which carried out the first external review of DRDO in 2008, calling for a younger profile of top scientists. DRDO secretary Avinash Chander is also working on an extension.

ET had reported on August 23 that Modi was not happy about this situation and had sought all details after he was told about the high attrition rate among younger scientists. Kindly provide me with the following information requested under the purview of the Right to Information (RTI) Act, 2005 in respect of Dr. V. Bhujanga Rao, Distinguished Scientist is holding the post of DG, (NS&M) in DRDO. He got extension two times in the service beyond the age of superannuation under the 2nd and 3rd proviso of FR 56(d) and various OMs issued by DOPT, MOP PG&P. Details of the extensions granted to him by ACC are given below.

Extension-I for 60 -62 years 0 -1 Nov 2011 to 31 Oct 2013

Extension-II for 62-64 years – 01 Nov 2013 to 31 Oct 2015

The procedure for grant of extension to the Scientists is laid down in DoPT DO letter No. 28/19/2000-EO(SM-II) dated the 10th July, 2000, OM No. No. 26012/6/2002-Estt. (A) dated 9th December 2002, OMNo. 26012/8/2011-Estt. (A) dated 16 May 2011, OM No. 26012/12/2013-Estt.(A) dated 13 June, 2013 and OM No. 26012/7/2013-Estt.(A.IV) dated 26 Jun 2013.

The DPRCs must give detailed justification for such extension based on merits of the case, the international stature of the person recommended and also indicates whether this will block promotion opportunities of others in the Department. (Para3 of OM No. 26012/8/2011-Estt. (A) dated 16 May 2011)

Hello,

Kindly provide me with the following information requested under the purview of the Right to Information (RTI) Act, 2005 in respect of FR 56 (d). Fundamental Rules (FR) are statutory rules framed in exercise of the powers conferred by the proviso to Article 309 of the Constitution, by the President.

There is provision to grant extension in the service beyond the age of superannuation under the 2nd and 3rd provision of FR 56(d).

DOPT vide OM No. No. 26012/6/2002-Estt. (A) Dated 9th December 2002, fixed the Proforma for sending proposals for approval of Department of Personnel & Training for grant of extension to Government servants beyond the age of superannuation.

It has been observed that DRDO is not adherence to this Proforma for sending the proposals to DOPT and using a different Proforma having 10 points only while Proforma set by DOPT is having 13 points. (Copy of both DOPT & DRDO Proforma are enclosed for ready reference).

DOPT is also accepting the proposals of DRDO in another Performa framed by DRDO itself which left very vital information in its Proforma.

Kindly provide the following information under RTI Act 2005.

  1. Sri P. S. Subramanyam, Director of Aeronautical Development Agency (born 28.06.1950) was on extension up to 64 years till 30 June 2014. Government of India has given one more year extension to him beyond the age of 64. Provide copy of File Noting of Screening Committee headed by the Cabinet Secretary and File Noting of Appointment Committee of Cabinet (ACC) for granting the extension in service after superannuation age of 64 years to him.
  2. Copy of service extension rules / provisions of which service may be granted by Government of India to a Scientist working under Central Government beyond the age of 64 years.
  3. DRDO sending proposals for approval of Department of Personnel & Training for grant of extension to Government servants beyond the age of superannuation with their own performa other then FR 56 (d) provide the copy of approval of competent authority for DRDO performa.
  4. As per provision to Article 309 of the Constitutionno organization having no power to amend Statutory Fundamental Rules. Provide the grounds on basis of which DOPT is accepting the proposals in modified Proforma of DRDO.
  5. Number of posts of Distinguished Scientist fixed by the Government in DRDO.
