Defence secretary R K Mathur’s additional charge as DRDO chief extended

An order by the DoPT said Mathur would now hold the additional charge as secretary of DRDO till May 24.

Buying itself more time to choose a full-time head for the Defence Research and Development Organisation (DRDO), the government Tuesday extended the tenure of defence secretary R K Mathur’s additional charge as DRDO head. An order by the DoPT said Mathur would now hold the additional charge as secretary of DRDO till May 24.
“The appointments committee of the Cabinet has approved the extension of additional charge of the post of secretary, Department of Defence Research and Development assigned to Shri Radha Krishna Mathur, IAS, Defence Secretary for a period up to 24.05.2015 or till the appointment of a regular incumbent or till further orders, whichever is the earliest,” the order said. Mathur has been holding the additional responsibility since January 31.

Parliament Question No 789 Regarding DRDO Projects

Dear friends please go through the parliament question 789 asked by Hon  Shri  Nishikant Dubey and others regarding DRDO projects. Our Hon Defence Minister Shri Manohar Parrikar answered the question as a same way like Ex defence Minister Sh A K Anthony because both only read the paper supplied by Dr. J.P. Singh, Scientist ‘G’ Director of Parliamentary Affairs. As a matter of fact Dr. J.P. Sigh is highly qualified scientist of DRDO with M.Sc. (Physics), MLISC and Ph.D. but since several years he is posted at DRDO HQ and looking after Parliamentary Affairs in DRDO. Dr. J.P. Singh was promoted as Scientist ‘G’ wef 01 July 2012 and having seniority no. 346 among all Scientist ‘G’ of DRDO as seniority roll as on November 2013,  still by superseding all his seniors he was appointed as Director, Dte of Parliamentary Affairs , DRDO HQ with blessings of his God Father.

You all be happy to see the answer same old story repeating since last 15 years friends we have great hope from Shri Manohar Parrikar because he is IIT’ans but without investigating the answer supplied by Dr. J.P. Sigh he state read same way like Sh A K Anthony.

It is requested that to our Defence Minister please see the answers earlier given by Sh A K Anthony on same matter. Also request don’t believe the reply given by Dr. J.P. Sigh some time he also not know the real facts, he only does galvanizing the inputs. We want to see the difference between technical qualified politician with other one. (a) whether several projects of the Defence Research and Development Organisation (DRDO) are lagging behind schedule and if so, the details thereof and the reasons for delay in completion of these projects, project-wise;

(b) the details of funds required, budget allocated, released and utilized by the DRDO for the purpose during each of the last three years and the current year, project-wise;

(c) the steps taken / being taken by the Government for completion of such projects;

(d) whether DRDO proposes to open Centre of Excellence in the country and if so, the details thereof; and

(a) & (b): Project-wise details regarding original and revised date of completion, sanctioned cost, expenditure made during last three years and current year along with reasons for delay in completion of major ongoing projects of DRDO is attached at Annexure `A`.

(c): The following corrective/remedial measures have been taken/being taken to complete ongoing projects in-time.

# Consortium approach is being used for design, development and fabrication of critical components

# Three-tier project monitoring approach has been instituted in the major projects.

# Project Monitoring Review Committee (PMRC) and Project Appraisal and Review Committee (PARC) meetings are held regularly to monitor the progress of ongoing projects.

# Concurrent engineering approach has been adopted in technology intensive projects to minimize time-lag between development and productionisation of the systems.

# Information Technology and modern management techniques are being applied.

# Encouraging joint funding by users to ensure their commitment towards earliest completion.

# Promoting synergy and better co-ordination among User Services, DRDO and production agencies through cluster meetings.

(d) Yes, Madam. DRDO has already established seven Centers of Excellence in various disciplines and taken initiative to establish the following four more Centers in the areas of interest to defence.

# Bi-nodal Center of Propulsion Technologies (CoPT) at IIT, Bombay.

# Jagdish Chandra Bose Center for Advanced Technology (JCBCAT) at  Jadavpur University, Kolkata.

# Joint Advanced Technology Center  (JATC) at IIT, Delhi.

# Center for Advanced Materials &  Electromagnetics (CAMEL) at IIT,  Jodhpur.

(e) No, Madam. The present policy relating to appointment of scientists in DRDO is functioning effectively. However, there is shortage of scientists in DRDO as there has been no increase of scientific manpower since 2001 while a number of projects have grown multifold in terms of size and technological complexity over the past fifteen years. DRDO has initiated a Cabinet Note for augmentation of manpower by 1316 posts (1260 scientists and 56 works cadre Officers). These are proposed to be filled in phased manner in three recruitment years.

After termination of contractual appoint of  Sh Avinash Chander, DRDO top management was really shocked and disturbed, not for national interest but due to shaking of their equations which they build with passage of time.

It was so sudden that they don’t have time to rebuilt equations; as a result day by day all dirt of DRDO coming out and DRDO management is in chaos.

The Modi government has done the right thing by jolting an ossified bureaucracy

India’s ossified bureaucracy is being shuffled like never before. The most recent development in this realm has been the rather dramatic sacking of Sujatha Singh from the post of the Foreign Secretary and the appointment of S Jaishankar to that position. The rumours about this development were floating around for quite some time. Still, when the decision actually came to replace Singh about seven months before the end of her tenure, it ended up sending shock waves through the complacent Indian foreign policy establishment.

No one seems to be contesting that Jaishankar is a great choice. Yet the critics of the decision have largely focused on bureaucratic niceties by suggesting Jaishankar’s appointment not only curtailed Singh’s career but also ended up blocking the career prospects of some senior Indian Foreign Service (IFS) officers. The reaction of the Congress Party has been rather strange with former information and broadcasting minister Manish Tewari trying to link the action to the Khobragade episode involving an IFS officer who was jailed in the US two years ago for allegedly mistreating her maid. He tweeted: “Is sacking of Foreign Secretary late retribution for her stand on Devyani Khobragade affair? Removal after a Presidential visit ‘coincidental’?”

Such criticisms of the government’s decision are missing the key point. This decision should be viewed as part of a larger, and much needed, bureaucratic shake-up that the Prime Minister is engendering. Just two weeks ago, the government had also terminated the appointment of the Defence Research and Development Organisation (DRDO) chief Avinash Chander, 15 months before his contract was to end.

Prime Ministers till now have devoted, at best, occasional interest in nuclear and strategic policy issues, mainly preferring to delegate substantial levels of policy making discretion to organisations like the Department of Atomic Energy (DAE) and the Defence Research and Development Organisation (DRDO). The conduct of the DRDO has been largely driven by an effort to protect its direct communicative link to the Prime Minister, secure recurrent generous funding, and maintain a high level of autonomy. Given its significant budgetary resources in the context of a developing nation, DRDO has repeatedly failed in delivering quality output. Major projects of the DRDO including the Light Combat Aircraft Tejas, Nag missile, Long-range Surface-to-Air missile project and the Airborne Early Warning and Control System have either not been completed on time or have resulted in huge cost overruns. It took the agency almost a decade and a half to operationalise the Agni-I.

The inattention or inability of the Prime Minister’s office so far to take concrete steps to improve the DRDO’s performance and compel it to cooperate with other defence bureaucratic stakeholders has permitted it a remarkable degree of self-governance in budgetary prioritisation, project design and delivery time-scale planning, and setting operational policy through regular statements outlining the doctrinal meaning of DRDO products. Prime Minister Modi had criticised the DRDO for its chalta hai attitude during an address in Kargil in August last year when he had said, “If a project was conceived in 1992, it should not be the case in 2014 we are still saying it will take some more time.” And in December last year, India’s Parliamentary Standing Committee on Defence had censured the DRDO, accusing it of shoddy research, chronic inefficiency, inordinate delays, corruption and its penchant for reverse engineering. The government seems to have taken the bull by the horns and removed Chander to ensure some semblance of accountability in the organisation.

The appointment of Jaishankar as foreign secretary is also along the same lines that merit would be rewarded. The Indian Foreign Service (IFS) needs to recognise that business as usual is no longer enough. At a time when India’s global imprint is expanding rapidly, a risk-averse foreign policy bureaucracy will not be able to meet the aspirations of the nation. The idea that seniority should determine who should be the nation’s top diplomat is an idea whose time has long gone. But bureaucratic resistance has prevented any substantive reforms in the service. There are hardly any incentives to perform and hardly any penalties for underperformance.

As a result, nearly everyone in the diplomatic service manages to rise to the upper echelons. Despite the fact that the best and the brightest are no longer attracted to the IFS, there have been few attempts to cultivate outside expertise, with hardly any opportunities for lateral entry or temporary rotations. In fact, it was Manmohan Singh who had wanted to introduce lateral entry in the Indian bureaucracy in his first term but the idea was quietly killed by the bureaucracy (who else?). Personnel are scarce and demands are growing on the IFS but Indian diplomats have not managed to transform the service and change its character to suit the needs of the time. Is it any wonder then that ad hocism pervades Indian foreign policy thinking?

Bureaucracies, if not competently led and directed, tend to morph into interest groups with a focus on preserving their own institutional privileges. In democracies, effective political control and guidance is absolutely critical if the role of bureaucracies is not to become corrosive on policymaking. It is in the nature of bureaucracies to be risk-averse. Leave them alone and they will muddle along the path of least resistance, trying to increase their power by resisting change. The Modi government is right in shaking things up and making Indian bureaucracies more accountable and effective. But much more remains to be done!

DRDO chief booted out 16 months before end of tenure

The government on Tuesday sacked Defence Research and Development Organisation (DRDO) chief Avinash Chander, putting up the exit order on the Department of Personnel and Training website even before informing him.
“I am hearing this from you. It has come as a shock to me. I haven’t received any order from the government,” Chander told HT exclusively.

The appointments committee of the cabinet (ACC) approved the termination of Chander’s contract with effect from January 31, a good 16 months before it was to end. Strangely, the ACC order was taken off the DoPT website later in the day.

The sacking was first reported by HT on its website.

“It is the government’s decision to end my contract but I had no indication this was coming. No idea why it has happened,” the 64-year-old added.

The reasons for Chander’s unceremonious exit could not be immediately ascertained but the DRDO had in August come in for sharp criticism from Prime Minister Narendra Modi over delays and cost overruns in key military programmes. Modi had said India had the potential to be a world leader in the defence sector but was being held back by a “chalta hai” attitude.

In another snub to him, the NDA government had last year turned down a DRDO request for grant of extension to four senior scientists who had attained the age of retirement.

Chander had retired on November 30, 2014 but was to hold charge till his contract expired on May 31, 2016. This was in line with his appointment order issued on May 31, 2013. The government had even issued an order on November 27 last year saying Chander would “continue to be in operation” for the next 18 months — making his sacking on Tuesday all the more unexpected.

As chief of India’s premier defence research agency, Chander also held the posts of scientific adviser to the defence minister and secretary, department of defence R&D. He is credited with shaping India’s strategic missile programme.

The DRDO was set up in 1958 to develop indigenous military technology and cut back on arms imports. But India holds the dubious distinction of being the world’s largest weapons importer, sourcing 70% of its defence requirements from abroad.

A search panel headed by the cabinet secretary will pick Chander’s replacement from among top DRDO scientists.

PIL- Grounds

GROUNDS

  1. BECAUSE, Shri Avinash Chander , DS was granted extension for two terms, 60 years to 62 years (01 Dec 2010 -30 Nov 2012) and 62 to 64 years(01 Dec 2012 to 30 Nov 2014). Extension in the service beyond the age of superannuation covered under the 2nd and 3rd proviso of FR 56(d) and various OMs issued by DOPT. The procedure for grant of extension to the Scientists is laid down in DOPT DO letter No. 28/19/2000-EO(SM-II) dated the 10th July, 2000, OM No.  26012/6/2002-Estt. (A) dated 9th December 2002, OM No. 26012/8/2011-Estt. (A) dated 16 May 2011, OM No. 26012/12/2013-Estt.(A) dated 13 June, 2013 and OM No. 26012/7/2013-Estt.(A.IV) dated 26 Jun 2013.
  2. BECAUSE, the second extension in service beyond the age of 62 years of Sri Avinash Chander was wholly illegal as it does not fulfil the provisions and conditions of FR 56(d) and various OMs of DOPT mentioned above. The first condition that was violated is “International Stature” of the Scientist. The second condition that was violated is “whether this extension will block promotion opportunities of others in the Department”. (Please refer to Para 3 DOPT OM No. 26012/8/2011-Estt. (A) dated 16 May 2011)
  3. Because, Shri Avinash Chander is not having International Stature in field of Science & Technology and therefore ACC should not rant him extension beyond age of 62 years after superannuation upto 64 years under the gross violation of the third proviso to FR 56(d).
  4. Because, the number of posts of Distinguished Scientists are fixed by Government under the provisions of DRDS Rules 1979 and it was 8-10 as in year 2012 when extension in service beyond 62 year to 64 year age was granted Sri Avinash Chander. All the Distinguished Scientists in the year 2012 were on extension so it blocked promotion opportunities of other senior scientists in the department as until they will not retire the Outstanding Scientists below the age of 60 years could not get promotion as vacancy of Distinguished Scientists have been fixed by the Government.
  5. Because, the extension in service beyond the age of 62 years to Shri Avinash Chander was illegal, therefore his appointment to the post of Secretary, DRD is wholly illegal and unjustified.
  6. Because, pay scale of Distinguished Scientist is Rs 75,500-80,000/- (HAG+ Scale) and pay scale of Secretary, DRD is Rs 80,000 (fixed).Therefore appointment from Distinguished Scientist to Secretary is promotion cum appointment as pay scales have been changed. No Government servant who is on extension of service after the prescribed date of retirement should be promoted to another post during the period of extension of service.(Please refer DOPT Handbook- Age of Retirement/Extension)
  7. Because, the appointment of Sri Avinash Chander as Secretary, DRD was at the time when he was on extension in service 62-64 years so technically it was promotion cum appointment. Since no Government servant who is on extension of service after the prescribed date of retirement should be promoted to another post during the period of extension of service, hence appointment of Sri Avinash Chander as Secretary, DRD is illegal.
  8. Because, in reply to Unstarred Question NO-2871 put by Sri E.M. Sudarsana Natchiappan, MP in Rajya Sabha on 06.09.2012 on Appointment of Secretaries on contract basis, it was informed by Hon’ble Shri V. Narayanasamy, Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office that “there is no policy formulation for appointing the Secretaries in Union Ministries and Departments on contract”.
  9. Because, The Department of Personnel and Training (DoPT), in its reply to Lok Sabha MP Asaduddin Owaisi, has stated that “Government servants are allowed to continue in service after 60 years in rare and exceptional cases.” It is relevant to mention here that the news was published on 28 May 2012 in Hindustan Times stating “Contractual appointment post-retirement not in rules” based on reply given by DOPT, Ministry of Personnel in 15th Lok Sabha.
  10. Because, there were several young and more qualified Scientist than Sri Avinash Chander in the list for consideration before ACC but they were ignored by ACC. The appointment of Shri Avinash Chander who was having just 1.5 year in his retirement even after second extension in service is wholly unjustified.
  11. Because, orders for regular appointment and contractual appointment could not be clubbed in one order as both are totally distinct action as per recruitment rules. DOPT should initiate the case of contractual appointment separately when Shri Avinash Chander being at verge of his retirement and Government should feel his requirement in absence of suitable leadership in the existing Scientists in the department.
  12. Because, an official appointed on contract after retirement cannot function as Head of Office for all administrative & financial matters in the department. Since it is apparent from his appointment letter that he will exercise all administrative and financial powers on contractual appointment as he was having in his regular appointment before retirement.
  13. Because, presently there are more than a dozen Distinguished Scientists in DRDO from various disciplines like Missiles, Aeronautics, Combat Vehicle, Armament and Electronics & Computer Science. DRDO is having seven Director General and six Chief Controller R&D in HAG+ Scale, hence there was no need and necessity  to appoint Shri Avinash Chander on contract in advance prior to 1.5 year of his retirement on 31 May 2013 by ACC.
  14. Because, decision of ACC to give appointment on contract to Shri Avinash Chander on 31 May 2013, i.e. 1.5 years prior to his retirement shows malafide intentions as on 31 May 2013, how can ACC decide that there will be no alternate to Shri Avinash Chander who can hold the position of Secretary, DRD, DGR&D and SA to RM after his retirement on 30 November 2014. While holding the position of Secretary, DRD, DGR&D and SA to RM, he was purely involved in Administrative work as he was not associated directly with any project/programme of DRDO. In present organisation structure of DRDO all seven Technological clusters are headed by seven Director Generals who are eminent Distinguished Scientists and  experts of their S&T discipline.
  15. Because, the appointment is politically motivated, made with non-application of mind hence malicious and liable to be quashed.
  16. Because, more qualified, having more technical contribution credential and young scientist having enough long tenure was in list but they were ignored by ACC.
  17. Because, Government has not laid down any criteria for selection and appointment of Secretary, DRD till now in past several years and making appointment in arbitrary manner. Transparency is not being maintained in appointment of Sri Avinash Chander as Secretary, DRD and decision was taken by ACC in arbitrary manner.
  18. Because, DRDO is having annual budget of Rs. 15283 crore and more than 30000 official working in the organisation then a person appointed on contract should not exercise the administrative and financial powers.
  19. Because, true and proper facts about integrity of Sri Avinash Chander was not submitted by department to ACC hence the decision to appoint him as Secretary, DRD was not just & proper.
  20. Because, performance of Sri Avinash Chander being Secretary, DRD from 31 May 2013 to 30 Nov 2014 should be re-assessed and should be considered by new ACC (after formation of new Government) keeping in view his integrity in administrative and financial matters at the time  of giving contractual appointment to him after his retirement on 30 November 2014. Hence issuing order for appointment on contract in advance on 31 May 2013 is wholly illegal & unjustified.
  21. Because, there are half a dozen complaints on malpractices and corruption against Shri Avinash Chander are pending before Government. Therefore it was no appropriate to appoint him on contract without disposal of complaints and vigilance clearance.
  22. Because, there is no the provision for appointment on contract of any scientist in HAG+ Scale s of DRDS Rules 1979 (R&P Rules of DRDO Scientists) , hence appointment on contract of Shri Avinash Chander  is illegal.
  23. Because, under the provisions of  DOPT OMs No. AB.14017/34/2008-Estt. (RR) (Pt.) dated 17th June, 2013 and AB.14017/34/2008-Estt. (RR) (Pt.) dated 16th June, 2014 regarding need for contract appointment in the Ministry/Department, there is no provision for contract appointment in SAG/HAG Scale . These two OMs of DOPT clarified that till date Government has not finalised the policy/rules for appointment on contract in SAG/HAG scale. PRAYER

It is, therefore, most respect fully prayed that this Hon’ble Court may Graciously be pleased to:-

  1. Issue a writ, order or direction in the nature of MANDAMUS commanding/directing the Respondent No. 1 & 2 to cancel the appointment on contract after retirement of Shri Avinash Chander as Secretary, DRD cum DGR&D and SA to RM.
  2. Issue a writ, order or direction in the nature of MANDAMUS commanding  to  direct the Respondent No. 1 for investigation/probe in all the complaints cases of malpractices and corruption against Shri Avinash Chander by petitioner and other complainants.
  3. Issue interim orders to respondent no. 1 to keep away Shri Avinash Chander from working as Secretary, DRD, DGR&D and SA to RM till the finalization of this PIL.
  4. issue such other writ, order or directions as this Hon’ble Court may deem fit and proper having regard to the facts and circumstances of the case; AND

to award cost of the PIL to the Petitioner.

DRDO, DG is on Contractual Appointment – Who will see the pain of CMSDS, KolKata

The employees of CMSDS, DRDO unit in Kolkata are not getting salary for last 8 moths and the authority is totally silent over this issue, in spite of all number of requests they are quite. Because the whole DRDO machinery was busy for ensuring to continue  their DG’s contractual appointment.

Why because the Sh Avinash Chander will going to save all corrupt and incompetent scientists like he is uttering that the Rath costing 2.5 crores plus 1 year hard work of 50 technical force, this all was done from scrap and waste material of R&D(E), Pune.

Wait Mr Chander Bombay High Court will going to show you your right place. The poor tax payers money spending on such task without taking proper approval from Ministry.

So friends of CMSDS, DRDO, Kolkata don’t worry Sh Manohar Parrikar ji  will take your problem, Modi Ji also look in to this matter because he shows his concern for young scientists, stopped extension business of DRDO but forgot contract business, Chair business, IDST business and more game plans of these oldies of  DRDO scientific ……….. of DRDO.

Avinash Chander to continue as DRDO chief till May 2016

Avinash Chander 28 novNew Delhi: India’s premier defence and research organisation DRDO’s chief Dr Avinash Chander was to retire on November 30 but will continue to occupy the position on a contractual basis till May 2016.

“The President is pleased to retire Dr Avinash Chander, Secretary, Department of Defence Research & Development (DOB: 06.11.1950), in the Ministry of Defence from Government Service with effect from 30.11.2014 (AN) on attaining the age of superannuation,” an official statement said on Friday.

It said “the appointment of Chander beyond his date of retirement, November 30, for 18 months would be on contract basis, with the same terms and conditions as he would be entitled to Secretary (DRD) before the date of retirement.”

His contractual term will end on May 31, 2016. Asked if this was the first time a DRDO chief will go on contract, sources said there had been instances when chiefs have been given “extraordinary” extensions.

The DRDO chief also holds the post of Scientific Adviser to the Defence Minister and the Secretary of Department of Defence Research and Development.

Chander joined DRDO in 1972 after completing graduation in Electrical Engineering from Indian Institute of Technology (IIT), Delhi.

He obtained MS in Spatial Information Technology from Jawharlal Nehru Technological University (JNTU), Hyderabad. Chander is the chief architect of Agni series of ballistic missile systems.

Development of Agni range of missiles under a highly-restrictive international control regimes was possible only out of his technology forecast, perspective planning and relentless efforts, DRDO officials said.
