Shri Avinash Chander, DS & CCR&D (M&SS) was appointed as Secretary Department of Defence Research & Development-cum Director General, Defence Research & Development Organisation and Scientific Advisor to Raksha Mantri vide order No.12/9/2013-EO(SM.1) dated 31st May 2013 of DOPT. Dr. VK Saraswat was SA to RM, DGR&D, DRDO and Secretary (DR&D) from 01st September 2009 to 31st May 2013. Shri M. Natrajan was SA to RM, DGR&D, DRDO and Secretary (DR&D) from 31st August 2004 to 31st August 2009.

In reference to the above kindly provide the following information under RTI Act 2005.

INFORMATION SOUGHT

  1. Provide copy of Minute Sheet & File Noting of the Appointments Committee of the Cabinet (ACC) approval for appointment of Shri Avinash Chander as Secretary Department of Defence Research & Development-cum Director General, Defence Research & Development Organisation and Scientific Advisor to Raksha Mantri with effect from 31st May 2013.

Please refer to Appointment Committee of the Cabinet letter no 12/9/2013- EO (SM-I) dated 31 May 2013 in respect of appointment of Sh Avinash Chander, DS, CC R&D (M&SS) as Secretary, DRDO cum DG,DRDO and Scientific Adviser to Raksha Mantri for period of three years.

In Para 2 of this letter “The appointment of Sh Avinash Chander beyond his date of retirement i.e. 30.11.2014 would be on contract basis with the same terms and conditions as he would be entitled to Secretary (DRD) before the date of retirement.”

In reference to the above kindly provide the following information under RTI Act 2005.

Height of Nepotism

Today 10th January 2014 at 1200 Hrs Sh R C Agarwal, Director, DEAL rushed to IRDE to have meeting with Chairman ASCODAR to influence him and his team members.

He requested to Chairman, ASCODAR to sealed Sh R K Agarwal, Scientist’H’ as Sh R K Agarwal is his blue eyed boy.

The committee was influenced to use a word “Normalization” of APAR Marks.

The aim was to create an impression that the hatred shown by Sh R K Agarwal towards Schedule Cast community is shadowed by the word “Normalization”.

However, the intention of Sh R K Agarwal and Sh R C Agarwal and their hatred towards Schedule Cast community is not over sighted.

They have to assured and submit their apology to Sh Jagdish Kumar, T O ‘C’ and his spouse because last eight months they gone through mental agony. The way Sh R K Agarwal downgraded APAR marks without mentioning a single reason.  Sh Jagdish Kumar, T O ‘C’ got clear signal that in early years during 2005 to 2007 when Sh R K Agarwal his recommended authority deprived him from promotion.

It is very common in DRDO because of absolute power of DRDO Directors and his trusted men (Chamchas) ignore all laid down rules of government of India.

However, honorable supreme court taken very serious view on the irresponsible senior officials who have tried to play with the provision of Indian Constitution.

It is requested to Honorable Raksha Mantri to look into the matter and give necessary directive to SA to RM.

Kindly refer to following decisions of Central Information Commission and verdict given thereof in these decisions.

  1. File No. CIC/LS/A/2012/002612 dated 22.3.2013 (Dr. Neelam Bhalla vs. DRDO) Verdict – “It is, no doubt, true that DRDO is an exempted organisation; yet it has been the consistent view of this Commission that the benefit of exemption extends only to functional / operational matters and not to establishment related routine matters. The legality of this view has not been challenged in the relevant judicial forum so far”.
  2. CIC/LS/A/2010/000107 dated 26.4.2010 (Ms. K. Surya Kumari Vs DRDO), CIC/SM/C/2008/00054/LS dated 29.01.2010 (Shri Prabhat Vs DRDO) and CIC/LS/A/2012/002487 dated 31.12.2012 ( Ms. Savitha Vs DRDO)

In its various decisions CIC consistently held that Establishment Matters relating to the organization notified u/s 24 of the RTI Act come within the purview of the Act and information in this regard thereto are not exempted from disclosure.

In light of the above decisions of CIC, Kindly provide the following information under Section 6(1) of RTI Act 2005. 

INFORMATION SOUGHT

  1. Whether Mr. Suresh Chand, Chief Admin Officer (CAO) was an employee of TBRL, Chandigarh. (Yes/No)
  2. If answer to point (1) is yes then provide the following information.

      i.            The date on which Mr. Suresh Chand was retired from TBRL.

    ii.            Whether a lady other than his wife claimed on his retirement pensionery benefits on the day of  his retirement.(Yes/No)

  iii.            Whether pension of Mr. Suresh Chand was withhold.(Yes/No)

  iv.            If answer to point (iii) is yes then provide the reasons for withholding of his pension.

    v.            Was the case of withholding of his pension and reasons thereof was referred to DRDO HQ/Vigilance for inquiry?(Yes/No)

  vi.            If answer to point (v) is yes then what is the status of his pension and retirement benefits?

vii.             Whether his pension & retirement benefits has been restored partially after inquiry/ non enquiry. (Yes/No)

viii             Whether Director, TBRL refer the case of Mr. Suresh Chand to CVC besides DGR&D, DRDO for information under new  Transparency Law of Govt of India.(Yes/No)

Dated 16.02.1955: Procedure for dealing with requests from Government servants for permission to remarry while first wife is still living, provide following information.
 i.            Whether TBRL/DRDO received any request from Mr. Suresh Chand, CAO regarding permission to remarry while first wife is still living. (Yes/No)

Dear Mr Anil Kumar,

BEL is backbone of our defence services and contributes in specialized system needs of our forces as well as paramilitary forces.

BEL has always been associated with DRDO in several areas and fields and the joint venture has always given great results. But unfortunately corruption is also growing very fast in our defence sector. In DRDO, you must be well aware, how in name of secrecy and R&D unlimited funds are managed. There is no accountability in DRDO and scientists are utilizing their brains and skills to fool our country’s people by applying numerous methodologies, like changing nomenclature of items, changing specifications, rotating the same items as surplus available in labs, in customizing the systems purchased at exorbitant prices. These are common practices in DRDO but with fast development of communication systems and easy access to databases these corrupt practices are starting to get exposed.

Recently after superannuation Sh A .K Musla, Scientist ‘G’, IRDE, DRDO, Dehradun joined Bharat Electronics Limited (BEL), Kotdwara. Please find the RTI application to DRDO and copy of reply by DRDO Hqrs. This practice is adopted by corrupt DRDO scientists; they join various institutions/ organization where commercial interests between both organizations exist. Dr W Selvamurthy (Dr in YOGA from Private Institute) has joined Amity Group as President, Amity Science, Technology and Innovation Foundation (ASTIF) and Chair professor, Life Sciences without obtaining the required NOC from government of India. Recently Defence Minister recommended CBI inquiry against top DRDO officials and Dr W Selvamurthy is one of them.

Sir, I have sent an RTI to Ms. Vanitha Bhandari, MANAGER (HR&A) PIO, Bharat Electronics Limited (BEL) Kotdwara-246149, Dist. Pauri Gharwal, Uttarakhand and till date have received no communication from, BEL Kotdwara.

It is requested that if you could please look into the matter and do needful to stop the corrupt practices prevailing in BEL with the help of DRDO officials. It would be a great contribution towards a corruption free India.

Para (a) Permission will be required for post-retirement commercial employment of a retired officer who was a member of a Group ‘A’ Central Civil Service or held a Group ‘A’ post if the commercial employment is to be taken up within one year of retirement.

Para d) Before an application of the retired officer is considered, an undertaking from the retired officer is to be taken in the form of an affidavit that the factors mentioned in clauses (b) to (f) of the amended sub-rule (3)of Rule 10 of the CCS (Pension) Rules, do not come in the way of considering his application.

1. Please provide the list of Institutes where these campus selections were conducted.

2. Name of DRDO officials who were in the committee of above campus selections.

3. Provide the names from the list of 51 scientists ‘B’ recently recruited whose father/mother is working in DRDO and their post in the organization.

4. Provide the names from the list of 51 scientists ‘B’ recently recruited who are having immediate relatives working in DRDO, name of relative, the relation with newly recruited scientist and their post in the organization. If it is not available then please collect the same from the individual.

With reference to your Minute Sheet No. AE/Gen Admin/13/0578 dated 26 September 2013 and modified Minute Sheet No. AE/Gen Admin/13/0578 dated 04 October 2013, signed by Dr. D.N. Tripathi, Addl Director (Admin.) on behalf of Director.

  1. It has been ordered by these Minute Sheets that “wef 01.10.2013 all officers and employees are informed to park their vehicles in the Parking Area constructed near CSD Canteen” and “above Minute Sheet is related to the officers/employees who goes to CSD Canteen for purchasing items by their vehicles”.
  2. Facts narrated above in points (1) and (2) establish that CSD Canteen building exists in DMSRDE and CSD facility is available in DMSRDE

  10. DMSRDE CSD Canteen is a profitable unit which earning good amount of money by getting commission/profit in sale of store items at canteen. In which account this money is being deposited and the name of officers who are authorize/responsible to withdraw the money.
  11. Provide type /nature of purpose for which the fund of CSD can be utilized.
  12. Can CSD fund be utilized for purchase of item/store/services that are not used by CSD Canteen instead used by DMSRDE officials like furniture, construction of aluminum, partitions, distribution of gifts etc.?

The information sought in this RTI Application is on Establishment Matter and as such not exempted u/s 24 of the RTI Act.

Besides Information sought is pertaining to allegations of Corruption and as such not exempted u/s 24 of the RTI Act 2005.
