The complaints, representations of his act & deeds piled in your good office. Hope you also got the fact finding inquiry chairman’s report from Dr S S Negi, Scientist ‘H’, IRDE, Dehradun.
Complaints regarding procurements, exposure of relation with suppliers, manipulation of all rules and regulation for personal gain, encouraging incompetent officials, administration failures, interacting with media without permission, giving false statement to media etc. cases are pending in your table.
Several complaints routing through CVC and Honorable Defence Minister also on the way but it seems like Krishan Bhagwan you are counting 95,96,97,98,99………. and waiting for 100th complaint.
Sir, today I have received a news clip and few photographs of Dr A K Saxena, Director, DMSRDE, Kanpur and information regarding misuse of staff car. Dr A K Saxena, Director, DMSRDE, Kanpur used staff car for to visit outer area of Kanpur with family. Dr A K Saxena forgot the recent Supreme Court’s Order “The use of red lights on the vehicles carrying the holders of constitutional posts will in no mannercompromise with the dignity of other citizens and individuals or embolden them to think that they are superior to other people, more so, because this distinction would be available to them only while on duty and would be co-terminus with their tenure,” it said.
I think you have not conveyed yet the incident of Red Beacon Light with you recently while you are going to attend Director’s conference to Metcalf House.
Therefore, it is requested to take appropriate action against Dr A K Saxena, Director, DMSRDE, Kanpur to honor the Supreme Court of India and save poor tax payers money.

Honorable Sir,
To enhance the knowledge of DRDO scientists and make them updated, Ministry of Defence provide library grant generously. Apart from this the pay commission has recommended special assistance for the purchasing of books/journals to individuals scientist.
The library budget of DRDO’s laboratory is a lucrative assignment for corrupt scientists. The scientist library in-charge has direct access to head of establishment.
The case of corruption in library procurement was first exposed at DIAT, Pune, where then In-charge Library Dr A K Tyagi, Sc ‘F’ did financial manipulation in Library. CVC has been found prima facie material against Dr A K Tyagi. And Regular Disciplinary action was recommended on: 9/9/2013. Consequently DRDO Hqrs finally charge sheeted on 8th October 2013. Charge Sheet signed by Honorable Defence Minister, Sh A K Antony.
The case of Dr A K Tyagi, Sc ‘G’ is not an isolated case but DRDO labs in general have misusing the library grants and if serious enquiry is set up every lab will give foul smell.
The recent example of DMSRDE, Kanpur’s library procurement cases revealed the astonishing facts and figures of library procurement. The RTI helped to expose the corrupt practice prevailing in library procurements.
Enclosed case revealed that the DMSRDE officials are not following the DRDO Purchase Manual -2006. Even after cancellation of Supply Orders on 23 August 2012 the invoices dated 02 May 2012 were accepted while Supply Orders were placed on 27 April 2012. Thereby mischievously & fraudulently the supply of books were accepted in back date to get fatty commission from these vendors. This gross violation of rules & blunder took place even after cancellations of Supply Orders establish conspiracy against Government by Mr. Jitendra Yadav and Dr. A.K. Saxena.
DRDO has become hub of corruption and honorable defence minister is requested to take a strong action to prevent further damage of moral and ethics.

BRIEF FACTS OF THE COMPLAINT
Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur is an establishment under Defence Research & Development Organisation (DRDO), Min. of Defence, DRDO Bhawan, New Delhi.
Dr. Arvind Kumar Saxena, Director, DMSRDE, Kanpur and Mr. Jitendra Yadav, Scientist ‘E’ are posted in DMSRDE, Kanpur. Dr. Arvind Kumar Saxena is Director, DMSRDE with effect from 01 January 2011.
Complainant is retired Government servant from DRDO. Presently complainant is working as RTI activist and social worker to expose the Corruption in DRDO and other Government departments. Complainant is running a website corruptionindrdo.com for posting information related to Corruption and Financial irregularities in various establishments under DRDO.
Technical Library, DMSRDE is having annual budget of about Rs. 1.50 crore for procurement of Printed Journals (Periodicals S&T – Rs. 1.10 crore), Online Science Direct e-Journals (Rs. 25 Lakh) and S&T Books (Rs. 15 Lakh).
Mr. Jitendra Yadav, Scientist ‘E’ was appointed as Head, Technical Library in DMSRDE Kanpur vide Daily Order-I No. 29/AD dated 19.02.2012.
An application under RTI Act 2005 was filed to Mr. Sarvesh Kumar, Scientist ‘F’, Central Public Information Officer, DMSRDE, Kanpur by complainant on 25th July 2013 regarding “Procurement of Scientific & Technical Books in Technical Library of DMSRDE”. Copy of the RTI dated 25th July 2013 is enclosed as Annexure-1.
CPIO, DMSRDE, Kanpur replied by letter No. DMS/0369/RTI/101/41/Letter_2013 dated 26th August 2013. Copy of CPIO reply dated 26th August 2013 is enclosed as Annexure-2. CPIO, DMSRDE provided partial information and it was informed by CPIO that fund expenditure in procurements of S&T Books in Technical Library in DMSRDE in respective years was as follows:
8. Complainant was not satisfied with reply of CPIO and First Appeal dated 07 Sep 2013 was filed to First Appellate Authority, DRDO. By Order No. RTI/02/2091/F/2013/0142 dated 14 Oct 2013, First Appellate Authority DRDO ordered CPIO, DMSRDE to provide full information sought in RTI dated 25th July 2013. Copy of First Appellate Authority Order dated 14 Oct 2013 is enclosed as Annexure-3
9. CPIO, DMSRDE seek additional fee for information vide his letter dated 30 October 2013. Copy of the letter is enclosed as Annexure-4. Vide letter No. DMS/0369/RTI/FAR/2013/0013 dated 14 Nov 2013, CPIO provided information in 60 pages and in covering letter CPIO informed that No supply Order has been placed in FY 2010-2011 and No tender was called during FY 2010-2011 and 2012-2013. Copy of the letter dated 14 Nov 2013 is enclosed as Annexure-5..
1o. The figures in information provided by CPIO were found self-contradictory and false as evident from summary of the information provided by CPIO.
11. On perusal of the documents provided by CPIO, following noticeable information has been found.
a. Seven invoices were found for the financial year 2009-2010 with following details:
Terms & Conditions of Supply Order as per DRDO Manual is enclosed asAnnexure-13.
c. Supply Order-1, Supply Order-2, Supply Order-3 and Supply Order-4 dated 27 April 2012 as mentioned in point(b) above were cancelled after 117 days on 23 August 2012 by Mr. Jitendra Yadav, Head Technical Library due to non-supply of books within delivery period of 90 days. It was mentioned in Para (2) of Terms & Conditions of Supply Order “This supply order shall automatically stand cancelled w.e.f. the next day after the date of delivery mentioned in this order”. Therefore supply orders were automatically stand cancelled after 90 days from issue of Supply Order (27 April 2012) i.e. w.e.f. 27 July 2012. Copies of letters No. TL/0510/WBF-2012 dated 23rd August 2012 issued for cancellation of supply orders to four vendors are enclosed as Annexure-24 to Annexure-27.
d. Twenty two invoices were found for the financial year 2012-2013 with following details:
e. Books were supplied against four supply orders that were cancelled on 23 August 2012. The fake invoices were fabricated from back date but actual supplies of books were made after cancellation of supply order. This smack conspiracy, manipulation and tampering of records for Corruption.
12. During the FY 2012-2013 the following irregularities, gross violations of rules, loss of public fund and Corruption took place in procurement of Books.
MAJOR FINANCIAL IRREGULARITIES & BLUNDERS IN PROCUREMENT OF BOOKS BY MR. JITEDNRA YADAV, SCIENTIST ‘E’ & DR. A.K. SAXENA, DIRECTOR
1) DRDO Manual of Procedures for Management of Libraries and TIC 1999 as amended and Purchase Management 2006 as amended are being used in DMSRDE, Kanpur for procurement of books & periodicals. Rule 4.2 of Chapter 4 (ACQUISITION) of Manual is applicable for procurement of Books & Monographs. Copy of relevant rules of chapter 4 are enclosed as Annexure-50.
2) As per Rule 4.2.2 of this Manual selection of vendors should be made on the basis of their past services provided to the library, distributorship of publishers and infrastructure available with them. In the years 2009-2010, 2010-2011 & 2011-2012 there was almost no supply of books and only three vendors get supply orders in 2009-2010 and supplied books. Also these vendors offered 30% discount on books (Foreign & Indian).
3) In the FY 2009-2010 mode of tendering was limited tender of PM 2006 to get better discount and competition to save public money and this results 30% discount on books.
4) In FY 2012-2013 violations of rules and procedures of procurement of books were grossly violated to achieve fatty commission that results financial loss to exchequer. Supply Orders were issued to vendors without keeping in view the past services of the vendors. This results cancellation of all supply orders that took place on 27 April 2012. Hence these vendors should be blacklisted for further procurement of books in Library. But even after non-supply and automatic cancellation of supply orders after expiry of delivery period of 90 days, the supply orders were issued to same vendors on 17 August 2012.
5) Supply Orders were placed on single tender and 10% discount to pet vendors of Dr. A.K. Saxena, Director and all vendors were from New Delhi only. Adopting the process of single tender with 10% discount without following previously adopted procedure of limited tender where vendors were offering discount of 35% – 40% on purchase of foreign books, resulted huge loss of public money and commission making by Mr. Jitendra Yadav and Dr. A.K. Saxena.
6) Even after cancellation of Supply Orders on 23 August 2012 the invoices dated 02 May 2012 were accepted while Supply Orders were placed on 27 April 2012. Thereby mischievously & fraudulently the supply of books were accepted in back date to get fatty commission from these vendors. This gross violation of rules & blunder took place even after cancellations of Supply Orders establish conspiracy against Government by Mr. Jitendra Yadav and Dr. A.K. Saxena.
7) There was no procedure followed for selection of books. In fact there was no requirement of books from Scientists as no demands were made. There was no procurement of books in past two years and only Rs. 94833.00 was expenditure in purchase of books in FY 2009-2010.
8) It is crystal clear that Corruption took place in FY 2012-2013 where all of sudden books of Rs. 1467810.00 has been procured while in previous years it was “NIL” or very less Rs. 94833.00 only in 2009-10. Demand of books which was NIL (Zero) in 2010-11 and 2011-12 has increased all of sudden near about to the Rupees 15 Lakh. As compared to purchase of books in FY 2009-10 the hike in 2012-13 is about 15.5 times. This indicates that books were purchased without any need and requirement just to earn fatty commission.
9) DRDO is having very old manual issued on 11 January 1999 regarding Management of Library/TIC of DRDO. This manual is called as “DRDO Manual of Procedures for Management of Libraries & Technical Information Centres“. After issuance of Purchase Manual -2006 of DRDO this old Manual became ineffective & obsolete. Most of the DRDO Labs/Estt. are using Purchase Manual for procurement of books, Print Journal and Online E-Journals. DMSRDE is also using PM-2006 from last six years for procurement of books, Print Journal and Online E-Journals as can be verified from records of Technical Library of DMSRDE, Kanpur. All of sudden making purchase of books on the basis of old manual smacks malafide intentions and leads corruption in purchase of books in FY 2012-2013. In fact in year 2012-2013 provisions of DRDO Manual of Procedures for Management of Libraries & Technical Information Centres has not been fully followed. Purchase procedures of DRDO Manual are for small & urgent procurement not for big procurements in tune of lakh or crores.
10) Fatty Commission in Procurement of books in FY 2012-2013: Books of Rs. 1467810.60 were purchased at discount of 10% only while in year 2009-2010 the discount on books was 30%. Even in FY 2011-2012 the offered discount by vendors were 35% and now days vendors are offering 40% discount on foreign books. Therefore books were purchased at very high prices on very low discount of 10% only with gross violation & spirit of Purchase Procedures to get maximum discount in open competition under limited tender to save public money. Therefore Rs. 440343.00 (30% of 1467810.00) had taken as fatty commission by Mr. Jitendra Yadav and Dr. A.K. Saxena, Director, DMSRDE.
11) Fraudulent supply of books with fake invoices: In FY 2012-2013 four vendors submitted invoices dated 02 May 2012 against the supply orders dated 27 April 2012 while these Supply orders were cancelled on 23 August 2012 by Mr. Jitednra Yadav, Scientist ‘E’ , Head, Technical Library. The supply on 02 May 2012 was impossible as it takes at least 5 days to reach speed post from DMSRDE dispatch section to the respective vendor. The details /entries of invoices shows that these invoices were not diarised at Director Office central registry and directly entertained by Head, Technical Library. Besides the verification records like receiving of invoices & books at Technical Library, envelops of invoices, CRV, payments by ACDA & records at Finance Division will disclose the whole conspiracy made in procurement of books in back date even after cancellation of supply orders.
12) Splitting of consolidated demand of books in four parts: Dr. Arvind Kumar Saxena split the consolidated demand of books in four parts and misused his official position & powers so that he can get fatty commission from his pet vendors. The books should be procured in one consolidated demands with proper negotiations with vendors to get maximum discount offered in open market. Four supply orders were issued on 27 April 2012 to four vendors that were not made any supply in past four financial years in DMSRDE. This splitting of books demand leads loss to public fund and Corruption of Rs. 440343.00 by Mr. Jitendra Yadav and Dr. A.K. Saxena, Director, DMSRDE. Sprit of Purchase Rules and CVC Guidelines is that “The proposals shall not be split merely to bring them within the delegated powers”.

Limited tender enquiries will be issued to vendors registered with R&D Labs/Estts, DGS&D, NSIC, other Government departments and to the firms of national repute who will be registered before their bid is considered as per Para 3.2.2. Such tenders may also be invited from the Government designated agencies. While inviting limited tender enquiries, due care will be observed in selecting vendors, especially in the case of traders who are not the actual manufacturers/authorized agent, to ensure better after sale service. (Rule 7.6.1 PM 2006)
Seven firms were mentioned in demand to which tender enquiries were sent. Out of these Modern Scientific Centre, Kanpur, Dhankar Enterprises, Kanpur, Manglam Traders, Kanpur, Scientific Aid and Omega Furnace Industries, Banglore were registered in July 2013 at DMSRDE.
In this case two firms Dev Industrial Enterprises, Mumbai and Inschem, Lucknow are non-registered firms.
As per PM 2006 Rule 7.6.1 “Limited tender enquiries will be issued to vendors registered with R&D Labs/Estts, DGS&D, NSIC, other Government departments and to the firms of national repute who will be registered before their bid is considered as per Para 3.2.2. Such tenders may also be invited from the Government designated agencies. While inviting limited tender enquiries, due care will be observed in selecting vendors, especially in the case of traders who are not the actual manufacturers/authorized agent, to ensure better after sale service”.
Dhankar Enterprises is not registered for Scientific Equipment/Instruments at Commercial Tax Department, Uttar Pradesh then how tender inquiry was sent to Dhankar Enterprises. Copy of registration enclosed.

No VAT /Tax was claimed in SO as basic cost of item was 1681500.00 only.
Actual cost of item is Rs. 560000 + VAT 5.5% (560000*5.5% = 30800) . Thus total cost is 590800. But SO was placed for Rs. 1681500.00. Hence item was purchased at very high price and commission of Rs. 1681500 – 590800 = 1090700.00 was made by Dr. AK Saxena, Director, DMSRDE, Kanpur. However, every Director of DRDO Labs has fixed their own agent (supplier) who can supply from needle to missile components or any high tech components/systems. In fact to this agent is always behind each and every supply national or international. This agent searches the world market and identifies a manufacturer / suppliers and obtains the details & specification and passed to Director for further procurement.
The following case is the example of modus oprendi of procurement case which directly benefit the lab director.
DMSRDE wanted to procure 50 Lit. High Temperature Reaction System.
Dr A K Saxena, Director, DMSRDE, DRDO , Kanpur discussed this requirement with his pet supplier M/s Manglam Traders, Kanpur
Mr Anish Gupta from M/s Manglam Traders sends a mail to Dr A K Saxena on 6th December 2011
Subject: “Offer for High Temp. Reaction Unit”
“The line diagram attached is not exactly as per their offer, they have forwarded us understand it will be somehow like the same. As per our line of requirement they will send us in 2 to 3 days.” Attached two file with this mail
4. Dr A K Saxena forwarded this mail to Sh J N Srivastava , Scientist ‘F’ indenter on 22 Dec 2011. 5. The DMSRDE_Techno-Commercial_Reaction-unit-50 lit proposal was originally send by the manufacturer “De Dietrich Process Systems India Pvt. Ltd, Mumbai” REF: DDI/DMSRDE/534. DATE: 30th Nov 2011. In thirteen page proposal with specification and terms of condition and in page ten of price quoted Rs 62,50,000/- .
6. In DRDO procurement policy lab Directors have power to sign up to 50 lakhs only. Since the cost was escalating the limit, so Dr A K Saxena asked M/s Manglam to split the quote. 7. As desired by Dr A K Saxena, Mr Anish, partner of M/s Manglam again send a mail on 27th Feb 2012

13 Reactor was deliberately split into two parts in budget forecast and two separate FBE numbers allotted to bring the purchase within Director’s power by Dr A K Saxena. 14. Two Technical Evaluation Committees one headed by Dr. D N Tiphati and the other by Mr. Darshan Lal clear the split cases and Dr. Sarfaz Alam Chairman of Store Purchase Committee clears these split cases on the same day. 15. Mr J N Srivastava, Scientist ‘F’ indenter protests by saying that “The splitting of one item into two is against the purchase procedure of DRDO and CVC’s guidelines“. Dr A K Saxena forced him to process case in split way because of DRDO Directors having absolute power and absolute power means absolute corruption.. 16. However on 12th October 2013, Dr A K Saxena sends a memo DP/15 to Mr J N Srivastava strangely enquiring as to why this case of reactor was split and not purchased as a single unit. Dr A K Saxena is not satisfied with the reply of Mr J N Srivastava that he was instructed by Dr. Ashok Rajan the programme Director to indent and instead pressurizing Mr J N Srivastava to justify the unjustable. 17. Till date the reactor was not assembled and poor tax payer money was wasted, although the payment was not cleared but manpower cost of project was wasted in the interest of Dr A K Saxena. 18. Poly-di-methyle-saline (PDMS) cannot be processed and converted into Polycarbosailine as a product without assembling both the parts of reactor. 19. Poly-di-methyle-saline (PDMS) already purchased worth lakhs of rupees from Dr A K saxena’s pet supplier (Mr Anish Gupta) The PDMS case will send separately. 20. Dr A K Saxena violated all the laid down DRDO procurement rules mentioned above. 21. It is requested that the case may thoroughly examined keeping mind to cost to benefit ratio and the role of DRDO Hqrs rep and PCDA (R&D) involvement. Fix the accountabilities and booked the culprits at the earliest.

5. Brief facts leading to appeal:-
(a) An application under Section 6(1) of RTI Act 2005 dated 20 August 2013 was submitted to CPIO, PCDA (R&D), New Delhi for providing information regarding “Bills passed by PCDA (R&D) forwarded by DMSRDE, Kanpur“. Copy of the RTI Application dated 20 August 2013 is enclosed as Enclosure-3.
(b) Central Assistant Public Information Officer (CAPIO), PCDA (R&D), New Delhi transferred the application u/s 6(3) of RTI Act 2005 vide letters cited above.
(c) Under the provisions of Section 6(3) of the RTI Act 2005, the application under RTI Act was illegally transferred by CAPIO, PCDA (R&D), New Delhi with malafide intentions under planned conspiracy with Director, DMSRDE, Kanpur and CPIO, DRDO HQ, New Delhi.
(d) Appellant is intensely upset by the decision of CAPIO, PCDA (R&D), New Delhi and this leads to appellant to file an appeal u/s 19(1) of RTI Act 2005.
6. Reasons/Grounds for First Appeal:-
First Appeal is submitted to First Appellate Authority on following reasons/grounds.
(a) PCDA (R&D), New Delhi is a Public Authority under Central Government of India. As per information available on website of PCDA (R&D), New Delhi “The organisation of PCDA (R&D) is responsible for payment, accounting and internal/local audit functions relating to DRDO“.
(b) PCDA (R&D), New Delhi is the sole custodian of the information sought under RTI Application dated 20 August 2013. Therefore transfer of application under Section 6(3) of RTI Act 2005 is illegal.
(c) Under the provisions of Section 5 (2) of RTI Act, CAPIO is not authorized for transferring the application under Section 6(3) of RTI Act 2005 to any other public authority. CAPIO can only receive the application and forward to CPIO.
(d) Under the provisions Section 5 of RTI Act, only CPIO is authorize to transfer the application under Section 6(3) of RTI Act 2005.
(e) Vide CIC decision in case No. CIC/SS/A/2012/003779/LS dated 27 August 2013 (J.K. Mittal vs. Delhi Police/PHQ), Hon’ble CIC held “CPIO is the fulcrum of the RTI regime. As per section 7(1), it is the mandate of the CPIO to provide information requested for by an informationseeker.RTI application can be transferred only by the CPIO to another CPIO and not by ACPIO”.
(f) The application under Section 6(3) of RTI Act 2005 should be transferred within five days from the date of receipt of the application under the provisions of Section 6(3) of RTI Act. As mentioned above the application dated 20.08.2013 was received in office of PCDA(R&D) on 26.08.2013 therefore the application should be transferred up to 01 September 2013 but transfer of application u/s 6(3) of RTI Act on 06.09.2013 and 18.09.2013 is illegal under the provisions of RTI Act 2005.
(g) Therefore, transfer of application under Section 6(3) of RTI Act 2005 by CAPIO is illegal. Hence both letters issued by CAPIO, PCDA (R&D), New Delhi are illegal and invalid under the provisions of RTI Act.
(h) Appellant is deeply distressed by invalid & illegal decision of CAPIO, PCDA (R&D), New Delhi hence the First Appeal u/s 19(1) of RTI Act 2005 before First Appellate Authority (FAA).
7. Prayer /relief sought for:-
RTI Application dated 20 August 2013 submitted by appellant to CPIO, PCDA (R&D) has been illegally transferred under planned conspiracy of Public Authority of DMSRDE and Public Authority at PCDA including CPIO, CAPIO, PCDA(R&D), Main Branch, New Delhi.
Therefore, appellant kindly prays to FAA, PCDA(R&D) , New Delhi to allow this appeal and issue orders to CPIO, PCDA(R&D) , New Delhi to provide the full information as sought/seek by appellant vide his RTI Application dated 20 August 2013 under the provisions of Section 7(1) of RTI Act.
Under the provisions of Section 7(1) of the RTI Act the information should be provided to appellant with in the thirty days of the receipt of the application. Since the RTI application was received by CPIO, PCDA (R&D) on 26.08.2013 and information sought in the application should be provided by CPIO to appellant till 26.09.2013.
Since the application dated 20.08.2013 was illegally and willfully transferred by CAPIO, PCDA(R&D) with malafide intentions & motives to CPIO, DRDO HQ, DRDO Bhawan, New Delhi. Therefore CPIO and CAPIO both are liable to be imposed penalty u/s 20(1) of the RTI Act and disciplinary action u/s 20(2) of RTI Act by Hon’ble CIC.
8. Grounds for prayer/relief sought for:-
Gross Violation of Section 6(3) of RTI Act 2005 in transfer of application to CPIO, DRDO HQ
a. Provisions of Section 6(3) of RTI Act are reiterated here for your kind information.
Where an application is made to a public authority requesting for an information,—
(i) which is held by another public authority; or
(ii) the subject matter of which is more closely connected with the functions of another public authority,
The public authority, to which such application is made, shall transfer the application or such part of it as may be appropriate to that other public authority and inform the applicant immediately about such transfer: Provided that the transfer of an application pursuant to this sub-section shall be made as soon as practicable but in no case later than five days from the date of receipt of the application.
b. PCDA (R&D), New Delhi is a Public Authority under Central Government of India. As per information available on website of PCDA (R&D), New Delhi “The organisation of PCDA (R&D) is responsible for payment, accounting and internal/local audit functions relating to DRDO”.
c. PCDA (R&D), New Delhi is the sole custodian of the information sought under RTI Application dated 20 August 2013. Therefore transfer of application under Section 6(3) of RTI Act 2005 is illegal.
d. The information sought by appellant is not held by DRDO and DMSRDE, Kanpur as information about bills and payments related to vendors who supplied store and services to DMSRDE is held only by PCDA(R&D) for Audit purpose.
e. Therefore PCDA (R&D) is sole custodian of information sought and CPIO, CAPIO or Public Authority could not transfer the application u/s 6(3) of the Act.
CAPIO is not authorize for transfer of application u/s 6(3) of the RTI Act 2005
a. Under the provisions of Section 5 (2) of RTI Act , CAPIO is not authorized for transferring the application under Section 6(3) of RTI Act 2005 to any other public authority. CAPIO can only receive the application and forward to CPIO.
b. Under the provisions of RTI Act, only CPIO is authorize to transfer the application under Section 6(3) of RTI Act 2005 to CPIO of other Public Authority.
c. Vide CIC decision in case No. CIC/SS/A/2012/003779/LS dated 27 August 2013 (J.K. Mittal Vs. Delhi Police/PHQ), Hon’ble CIC held “CPIO is the fulcrum of the RTI regime. As per section 7(1), it is the mandate of the CPIO to provide information requested for by an information seeker . RTI application can be transferred only by the CPIO to another CPIO and not by ACPIO“.
d. Vide the CIC decision mentioned in point(c) above, Hon’ble CIC gave verdict that “As per Section 5(2), APIO is empowered only to receive RTI applications and then transmit them to the CPIO concerned. On the other hand, CPIO is empowered not only to receive RTI applications directly but also to respond tothem. Hence, the functions of the CPIO and APIO are distinct and not co-equal”.
3. Planned conspiracy of CPIO,CAPIO & Public Authority at PCDA(R&D) with Director, DMSRDE, Kanpur and CPIO, DRDO HQ, New Delhi
It is quite evident that information sought should be provided by PCDA(R&D) as this public authority has not been placed under Second Schedule of the Act, thereby PCDA(R&D) is bound to provide the information sought to the appellant within 30 days of receipt of the application under Section 7(1) of the RTI Act.
Under the planned conspiracy of two public authorities PCDA(R&D) and Director, DMSRDE, Kanpur the CPIO did not provided the information to the appellant and illegally manages to transfer the application to CPIO, DRDO HQ (Public Authority – DRDO) through his CAPIOMr. D.S. Sheoran, Accounts Officer.
Dr. A.K. Saxena, Director, DMSRDE, Kanpur is involved in corruption and trying his all the best that evidences of his corruption could not be disclosed to the appellant. In promoting the corrupt practices of Dr. A.K. Saxena, Director, DMSRDE the officials at ACDA, AO (R&D), DMSRDE, Kanpur are involved. Thereby they ignored serious lapses in purchases at DMSRDE during tenure of Dr. A.K. Saxena from 01.01.2011 to till date.
I would like to expose the movement of application submitted under RTI Act by Appellant at PCDA (R&D), New Delhi. The copy of application was send to Shri VK Singh, ACDA, AO (R&D), DMSRDE, Kanpur. In the AO(R&D) Office at DMSRDE, Kanpur , one Shri Anurag Srivastava, AAO is posted since last more than 10 years in the same office however all other officials were transferred on rotation basis as per transfer policy of PCDA(R&D).
Shri Anurag Srivastava is having close association with Dr. A.K. Saxena , Director, DMSRDE on basis of casteism as both belongs to same cast known as Kayastha. Dr. A.K. Saxena managed stay of transfer/posting of Shri Anurag Srivastava several times using his official position.
On receiving of copy of application under RTI Act submitted by Appellant, Shri Anurag Shrivastava along with Shri V.K. Singh met to Dr. A.K. Saxena, Director, DMSRDE in his office and also to Shri Sarvesh , PIO, DMSRDE, Kanpur. All of them planned a conspiracy to transfer the application to CPIO, DRDO HQ so that CPIO, DRDO deny the information under the shadow and shelter of Section 24(1) of the RTI Act 2005. Thereby their corrupt & anti-national activities could not be exposed.
4. Letters issued by CAPIO, PCDA(R&D) are illegal under RTI Act 2005
The application under Section 6(3) of RTI Act 2005 should be transferred within five days from the date of receipt of the application under the provisions of Section 6(3) of RTI Act. As mentioned above the application dated 20.08.2013 was received in office of PCDA(R&D) on 26.08.2013 therefore the application should be transferred up to 01 September 2013 but transfer of application u/s 6(3) of RTI Act on 06.09.2013 and 18.09.2013 is illegal under the provisions of RTI Act 2005. Therefore the both the letters issued by CAPIO dated 06.09.2013 and 18.09.2013 are illegal & invalid as per provisions of Section 6(3) RTI Act 2005.
5. Letters signed by Shri D.S. Sheoran, Accounts Officer, CAPIO, PCDA(R&D)
As per the information available on PCDA (R&D) website pcdarnd.gov.in, Mr. D.S. Sheoran, Accounts Officer is CAPIO in main office. Both the letters dated 6.09.2013 and 18.09.2013 are signed by Mr. D.S. Sheoron, Accounts Officer, CAPIO.
6. Information sought is pertaining to allegations of corruption
Dr. A.K. Saxena , Director, DMSRDE, Kanpur is involved in corruption, financial irregularities , violation of purchase rules as specified in Purchase Management 2006 and misuse of financial power vested to him by DRDO HQ. The information sought will expose the corruption in DMSRDE and nexus between DMSRDE and ACDA, AO(R&D) Office, DMSRDE, Kanpur.
Appellant is surprised from the action and role of PCDA(R&D), CPIO and CAPIO on application dated 20.8.2013 by transferring the application to CPIO, DRDO HQ under gross violation of Section 6(3) of RTI Act and verdict in various decisions of Hon’ble Central Information Commission. It appears that like ACDA, DMSRDE, Kanpur the officials at PCDA (R&D), New Delhi are working under pressure of Dr. A.K. Saxena, Director, DMSRDE, Kanpur.
