SUBJECT:  Sh Avinash Chander is not interested to take any action on DMSRDE corruption cases.

Sir,

I would like to draw your kind attention towards corruption in tunes of crores at Defence Materials & Stores Research & Development Establishment (DMSRDE), Kanpur, an establishment under Defence Research & Development Organisation (DRDO), Ministry of Defence, Government of India.

Dr. Arvind Kumar Saxena was appointed as Scientist ‘C’ on 28.04.1984 in DMSRDE, Kanpur and since then he is continuously posted at DMSRDE, Kanpur since last 30 years. He has not been transferred even for a day from Kanpur and since the date of his posting he is working at Kanpur.  The roots of the Dr. Saxena while working at DMSRDE, Kanpur has become so deep that he was involved in various activities involving the financial & other administrative irregularities.

Dr. Arvind Kumar Saxena, Scientist ‘G’ was appointed as Director, DMSRDE, Kanpur wef 01 January 2011. In spite of the fact that he has been involved in various financial and administrative irregularities , Dr. Saxena was  promoted to the rank of Scientist ‘H’ wef 02 August 2012 and since then he is  holding the rank of Scientist ‘H’ and working as Director, DMSRDE.

The right from his appointment as Director, he was involved in various kinds of administrative & financial irregularities that lead corruption in tunes of crores. Several complaints were made against Dr. Arvind Kumar Saxena to then Defence Minister by some scientists of DMSRDE.

Being a RTI activist and social worker running a website corruptionindrdo.com to expose the corruption in DRDO, also made as far as 12 complaints regarding corruption in procurements of various instruments & materials etc in DMSRDE by Dr. Arvind Kumar Saxena, Director, DMSRDE to CVC, Hon’ble Defence Minister and DGR&D, DRDO. These complaints were filed during 29 Nov 2013 to 11 June 2014. Total cost of store items procured against which complaints were filed is about Rs. 7.5 crore. A complete list of complaints filed by me to CVC and Hon’ble Defence Minister is annexed as Annexure No. -1.

All the aforesaid complaints made have been endorsed by Central Vigilance Commission (CVC). CVC has taken cognizance of aforesaid complaints and registered on prima facia.  These complaints have been forwarded to Chief Vigilance Office (CVO), Ministry of Defence for further enquiry/investigation of the aforesaid complaints. Under the provisions of RTI Act 2005 the CPIO, CVC vide letter no. CVC/RTI/13/1862/241925 dated 18.03.2014 informed to me that his complaints have been forwarded to CVO (MOD) for investigation.

Under RTI Act, CPIO, CVO MOD informed that all complaints have been forwarded to Director, Vigilance & Security, DRDO for further inquiry and asked the consolidated report from DRDO vide their letter dated 04 August 2014.

Meantime, A FFIC was constituted by Shri Avinash Chander, DG, DRDO to inquire the complaints against Dr. Saxena. The Fact Finding Inquiry Committee visited DMSRDE, Kanpur on 13th – 14th, March 2014 for inquiry on the complaint submitted against Dr. Saxena. The said committee submitted its report to Shri Avinash Chander but no action taken by DRDO against Dr. Saxena, Director.

It is very surprising and interesting that Shri Avinash Chander again set up another four members Fact Finding Inquiry Committee  under chairmanship of Dr. D.C. Pandey, Scientist ‘H’ LRDE and three members Sri Hari Babu Srivastava, Scientist ‘G’, Director, LASTECH, Sri Jagdeep, Scientist ‘F’ and Sri R.S. Mehta, Joint Director. The said committee visited DMSRDE, Kanpur recently on 9-10 July 2014. Therefore constitution of two FFIC by Shri Avinash Chander establishes that there were complaints against Dr. Saxena but to give him patronage and support the Shri Avinash Chander set up illegal FFIC. This second FFIC also submitted its report to Shri Avinash Chander but still no action against Dr. A.K Saxena took place by DRDO.

Interestingly, 31st October in the eve of Vigilance week, Sh. R.S. Mehta, Joint Director, Vigilance, DRDO in his address mentioned to audience that how the corrupt practices adopted by Director, DMSRDE and his team in procurement cases.

Sir, it is not understandable that why Shri Avinash Chander constituted two fact finding committees? Why DRDO is silent on corruption cases of DMSRDE, Kanpur? Why Shri Avinash Chander is protecting Dr. A.K. Saxena?

In light of the above mentioned facts, it is requested that speedy action needed to save precious funds of poor tax payers. Dr A K Saxena openly using same corrupt practices in ongoing procurements cases. He told to his beloved team that Dr. V Bhujanga Rao, DG,NS&IC directed that left Rs 13 crores should be spend up to 31st March 2015 positively.

  Subject: Scraps the promotions for Scientist ‘F’ to Scientist ‘G’ in DRDO year 2011

Hon’ble Sir,

  1. Defence Research & Development Organisation (DRDO) is an organisation under MOD having annual budget of Rs. 15000 crore for FY 2014-2015. This organisation is having about 7500 scientists under DRDS cadre who are comprising of more than 50 scientific disciplines and working in their respective area based on his qualification and discipline.
  2. Prior to the formation of the Recruitment & Assessment Centre(RAC) in DRDO the  recruitments and promotions of scientists in DRDO were made by UPSC. Later on Government of India allowed DRDO to have its own recruitment & assessment body for recruitment and assessment of scientists under DRDS cadre. Consequently an in-house Recruitment & Assessment Centre (RAC) was created in DRDO in 90’s. RAC  conducts recruitment of scientists in DRDO and assessment of scientists for promotion from the grade of Scientist ‘B’ to Scientist ‘H’.
  3. All scientists of DRDO comes under the Defence Research & Development Services(DRDS) cadre and under the provisions of Article 309 of Constitution of India, Government of India framed The Defence Research & Development Service Rules 1979 (DRDS Rules 1979) as Recruitment & Promotion Rules for DRDS cadre.
  4. DOPT, GOI framed Flexible Complementing Scheme (FCS) for faster promotions of scientists working in all S&T Department/Organisations under Central Government. Consequently from past 35 years DOPT issued various OM & Notifications for FCS from IIIrd CPC to VIth CPC.
  5. The OM No. 2/41/97-PICdated 9th Nov 1998  and OM No. AB-1401713712008-Estt(RR)dated 10th September, 2010issued by DOPT are umbrella notifications for FCS.
  6. Vide SRO  11(E) dated 10th August 1990, FCS was introduced in DRDS Rules 1979 and under the provisions of Rule 8(2)(a) of DRDS Rules 1979 it clearly mentioned that promotions from the rank Scientist ‘B’ to Scientist ‘H’ (Outstanding Scientist) are covered under the FCS. Copy of the Rule 8(2)(a) is annexed as Annexure-1.
  7. In DRDO scientists are recruited based on the requirement of various Lab/Estt which were sent to RAC through DRDO HQ and then RAC recruits the scientists based on their discipline, qualifications, experience and other requirement as sought by Labs/Estt of DRDO.
  8. Under the provisions of OM No.AB-1401713712008-Estt(RR)  dated 10th September, 2010of DOPT the promotions under FCS are applicable to the scientist who are working in S&T organisation/department and involved in Scientific &Technological  work. Scientists/ Technical experts doing management/ administrative work in the Ministries should not be considered for up gradation under FCS, they should only be given benefit of up gradation under MACP. Copy of page no. 06 of the OM annexed as Annexure-2.
  9. Procedure of promotion from grade of Scientist ‘F’ to Scientist ‘G’ till 2010 were followed as provided under Rule 8(2)(a) of DRDS Rules 1979 and the same procedure supposed to be followed  in 2011 for promotions from grade of Scientist ‘F’ to Scientist ‘G’but the RAC, DRDO  adopted the new procedure illegally without amending the DRDS Rules 1979 by issuing SRO under the provisions of Article 309 of the Constitution.
  10. DRDS Rules 1979 clearly stipulates that  DRDS Rules can be amended only by issuing an SRO under Article 309 of the Constitution of India. DRDO violated the Article 309 by implementing interview/interaction in promotion of scientist ‘F’ to scientist ‘G’ grade in 2011 without proper amendment in SRO.
  11. In this matter Dr. A.K. Singh, Scientist ‘G’ (then Director, DHRD) issued letter No. DHRD/76145/C/M/01 dated 21 March 2011 on the Subject ” Assessment of Sc ‘F’ for promotion- revised procedure of” to Director, RAC. Copy of the letter dated 21 March 2011 is annexed as Annexure-3.
  12. Dr. A.K. Singh issued the said letter illegally  without issuing of any SRO in the subject matter as in the year 2011 Dr. A.K. Singh himself was appearing in assessment as candidate for promotion from  grade of Scientist ‘F’ to Scientist ‘G’ and wanted to be get benefitted by the said new procedure for assessment.
  13. Based upon the letter of Dr. A.K. Singh dated 21 March 2011, Dr. P.S. Goel, then Chairman, RAC issued his DO letter No. RAC/01/Assessment/PSG, dated 22 March 2011 regarding “Promotions for grade of Scientist ‘F’ to Scientist ‘G”. Copy of the letter dated 22 March 2011 is annexed as Annexure-4.[How quickly the letter by Dr. P.S. Goel was issued on 22 March 2011, this establish planned conspiracy]
  14. Dr. P. S. Goel and Dr. A.K. Singh planned whole conspiracy of the said illegal assessment in the year 2011 in DRDO with help of then Dr. V.K. Saraswat then DGR&D, DRDO.
  15. Dr. P.S. Goel introduced this illegal mechanism to give favour to few incompetent DRDO scientists and for this act in return he got Prof. MGKMenon Chair, RCI, Hyderabad which fed him 84 lakhs per year. It is pure kick back or DRDO should provethe justification of his appointment. Dr. A.K. Singh himself promoted in the year 2011 by misusing this illegal mechanism for assessment in the year 2011.
  16. There was noassessment interview requirement for promotion from scientist ‘F’ to  scientist ‘G’ as per the DRDO service rule-1979-Rule-8(2)(e) till 2011 , but Chairman, Recruitment and Assessment Centre (RAC) of DRDO forwarded name before promotion committee after “ INTERACTION ’’ .
  17. The SRO No. 21 for the amending DRDS Rules 1979 was published in official gazette of Government of India on 23 March 2012. Copy of the SRO 21 dated 23 March 2012 is annexed as Annexure-5.
  18. The list of Scientist ‘F’ that were illegally promoted to  Scientist ‘G’in the year 2011 is annexed asAnnexure-6.
  19. Sir , all these promotion from grade of scientist ‘F’ to  scientist ‘G’ in the year 2011 were illegal and liable to be scrapped as it amounts corruption , nepotism and misuse of power for personal gain by Dr. A.K. Singh being Director, DHRD who issued illegal letter dated 21 March 2011.Therefore promotion of Dr. A.K. Singh, Scientist ‘G’ , Director of Personnel should be quashed/scrapped and through investigation in the matter may be ordered to give justice to the all affected Scientist ‘F’ of DRDO and fix the accountability of the corrupt culprits in the matter.

Dear Pandey Ji,

As you very well aware the complaints against Dr.Arvind Kumar Saxena, Director, DMSRDE, Kanpur and estimated amount involved in corruption is about 7.5  crore is a tip of ice berg only.

Sh. Avinash Chander (Padam Shree) appointed 1st FFIC under Chairmanship of Dr.S.S. Negi, Scientist ‘H’ as Chairman and Shri Manoj Bali , Scientist ‘G’ and Shri Jagdeep, Scientist ‘F’ as members of FFIC. This FFIC visited DMSRDE, Kanpur on 13-14 March 2014 and submitted FFIC report in a speedy manner in April 2014. This illegal committee submitted fake report as directed by Shri Avinash Chander who patronage Dr. AK Saxena and in lieu of obedience both Dr.SS Negi and Manoj Bali were awarded by big boss.

You are aware that Dr. SS Negi has been appointed as Director, IRDE, Dehradun and Shri Manoj Bali, Scientist ‘G’ is promoted as Scientist ‘H’ superseded 55 senior scientists as his senirity roll no is 71,  despite several honest and eligible scientists have been ignored.

You have been appointed as Chairman of 2nd  FFIC by big boss with same hope that you also show your loyalty and obedience towards him but your honesty came in path and you still not submitted the report to big boss and not giving clean chit to Dr. AK Saxena who is very close friend of mini DG & DOP Dr. A.K. Singh. Thereby your name is not in today list of promotes for the year 2014 for Distinguished Scientist. May be it will come in supplementary list?

You are fully aware that now Government has been changed and our Prime Minister is not happy with DRDO’s Chalta hai attitude,   for FFIC as maximum time for submission report is three months as per DOPT Inquiry Manual, CVC expects preliminary investigation to be completed within three months.

You have visited DMSRDE, Kanpur on 09-10, July 2014 and completed the FFI. Now third month is coming to end soon and Director (Vigilance), MOD has sought Director (Vigilance & Security), DRDO for consolidated report by his letter dated 04 August 2014.

In recent judgment of Madras High Court, Hon’ble justice commented “Scientist have no excuse that they have no administrative knowledge” and thereby two great senior officials have been sentenced three week imprisonment. Although DRDO हाथ क़ानून से भी लम्बे है today they filed SLP in Supreme Court and got time further with the help of poor tax payers money. पर कब तक ?

Don’t worry sir, one chance still there for you with for being DS in case you submit true report solely based on voice of your sole. You remember that “गरीबों की सुनो वो तुम्हारी सुनेगा, इस साल नहीं हुआ लेकिन अगले साल प्रमोशन होगा”.

क्योंकि अगले असेसमेंट तक अविनाश चन्दर जी तो होंगे नहीं मोदी जी २ अक्टूबर को झाड़ू लगा कर भारत को स्वच्छ बनाने का अभियान छेड़ रहे , भाई साहेब अब सफाई तो होगी ही उसको कोई नहीं रोक सकता ।

You submit the report to justice with poor tax payers money so that culprits of corruption in DMSRDE could be punished CVC and higher authorities.

  1. Directorate of Quality, Reliability & Safety (QRS) has been created at DRDO HQ, New Delhi vide Govt. of India, MOD letter (NS&M)/QARS/C/M/01/2638/D(R&D) dated 27th September 2012.
  2. RAC issued Advt. No. 110/December 2012 for recruitment of 01 Scientist G with Discipline Mechanical Engg. & Experience in the Quality, Reliability and Safety.
  3. Letter No. DOP/11/110059/QRSM/M/02 dated 14 August 2013 of Directorate of Personnel, DRDO, MOD, New Delhi on the Subject- Appointment of Director, QRS, DRDO HQ, New Delhi.
  4. RAC issued Advt No. 112/ October 2013 for recruitment of 01 Scientist G for DQRS, DRDO with Essential Qualification: At least First class Bachelor’s Degree in Engg./Technology in Mechanical Engg./Aeronautical Engg./ Electrical Engg./ Electronics & Communication Engg. only and Experience: At least 15 years’ experience in areas of quality planning, quality assurance, quality control, and quality improvements.
  5. Recruitment of Sri Saroj Kumar Patel as Scientist G in DRDO against Advt No. 112/October 2013 in March 2014 at seniority no. 486 who joined DRDO on 27 March 2014.
  6. Appointment of Sri Saroj Kumar Patel, Scientist G as Director, Directorate Quality, Reliability & Safety (QRS) with effect from 31 March 2014 vide order No. DOP/05/53269/DQR&S/M/02 dated 31 March 2014.

Kindly provide following information under Section 6 of RTI Act 2005.

  1. The total number of applications received by DOP/DRDO HQ against the letter of DOP dated 14 August 2013 mentioned above at point (iii) and number of candidates appeared in interview/screening for the said post.
  2. Whether any Scientist G serving in DRDO was found suitable for post of Director, DQRS.(Yes/No)
  3. If yes then provide his details like name, seniority & establishment.
  4. File noting for appointment of Sri Saroj Kumar Patel, Scientist G as Director, DQRS, DRDO HQ, New Delhi.
  5. Whether any other names were considered for post of Director, DQRS, DRDO HQ in March 2014 by DRDO.(Yes/No)

माननीय श्री प्रधानमंत्री जी यह एक बड़े खेद का विषय है कि इतने महत्वपूर्ण संगठन के शीर्ष अधिकारी श्री अविनाश चन्दर जी ने सारी नैतिकताओं को दर किनार करते हुए डीआरडीओ में अपनी जागीरदारी चला रखी है।

आपने दिल्ली में जो देख कर जनता को लालकिले से अपना अनुभव बताया कि सब विभागों में अपनी अपनी जागीरदारी चल रही है वह एक पूर्ण सत्य है।

श्री अविनाश चन्दर जी ने अभी कुछ समय पहले एक वैज्ञानिक ‘जी’ पद में बहुत ही मनमाने ढंग सब नियत मानको की अनदेखी कर रिटायर कमोडोर सरोज पटेल की नियुक्ति करी है।

श्री अविनाश चन्दर जी ने रिटायर कमोडोर सरोज पटेल की सिर्फ नियुक्ति ही नहीं करी बल्कि  डीआरडीओ के 507 वरिष्ठ वैज्ञानिक ‘जी’ की वरिष्ठता को दरकिनार करते हुए श्री पटेल को नियुक्ति के चार दिनों में डायरेक्टर के पद में भी बैठा कर वैज्ञानिको का मनोबल  गिरा दिया है।

पूरे देश ने कारगिल जंग के समय डीआरडीओ की असफलताओ को देखा था और सबको जनरल मालिक के शब्द याद है ” डीआरडीओ के वजह से सेना वेपन लोकेटर रडार नहीं प्राप्त हो पाया और जिसके कारण  सेना को अपने इतने जवान खोने पड़े”

आपसे आशा है की निम्न प्रेषित उक्त नियुक्ति की धांधली के पूर्ण विवरण को सी वी सी को जाँच के लिए आदेश देंगे जिससे डीआरडीओ के समर्पित वैज्ञानिको का मनोबल बढ़ सके और वे देश की विकास में भागीदारी में अपना पूर्ण योगदान कर सके।

Recruitment of Sh Saroj Kumar Patel, Scientist ‘G’ and Appointment on post of Director, Directorate of Quality, Reliability &Safety (DQRS), DRDO HQ Complaint against Sh Avinash Chander, DG, DRDO, SA to RM, Secretary, DRD

Sir,

Nepotism, favoritism, corruption and manipulations with vested interest in higher recruitment by misusing powers by HOD are very common practices now days in Government system by different means.

Based on the practices stated above, the Recruitment Scam-I occurred in DRDO in which several top Scientists including some ex-DGR&D, ex-CCR&D, ex-Directors and their daughters & relatives were involved. Several complaints were made to CVC & Defence Minister regarding Recruitment Scam-I and consequently CVC advices disciplinary action against Dr. Arun Kumar, Ex-DOP under major penalty vide OM No. 010/DEF/039/184877 dated 23.08.2012.(Copy enclosed-I).

Dr. Arun Kumar was suspended on the last day of his superannuation. Similarly some other Scientist Dr. S M Veerbhadrapa, Ex-Director, DTRL then HRD Charge Sheeted and Smt Chandra bano, Scientist ‘F’, DHRD was dismissed from service just 12 days before retirement. Since top ten officials of DRDO involved in Recruitment Scam-I were retired therefore on advice of Director (Vigilance) & CVO, Min. of Defence , then Defence Minister recommended CBI probe in Recruitment Scam-I of DRDO vide Dte (Vigilance), MOD note no.48-55 ante observations of JS & CVO at note 56 ante in November 2013. The news was published in media. Copy enclosed (II).

Shri Avinash Chander then CCR&D(MSS) also played an important role in Recruitment Scam-I while being member of expert committee under Chairmanship of Prof. SK Salwan, he gave clean chit to his friend Dr. Arun Kumar , ex-DOP vide his report dated 08.06.2011.

This case is regarding illegal recruitment with motivated planned conspiracy of Shri Avinash Chander, DG, DRDO and SA to RM, Dr. A.K. Singh, DOP and Smt. Hina Gokhle, Director, DHRD and Dr. RK Jain, Director, RAC and Dr. DN Reddy, Chairman, RAC.

BRIEF FACTS OF THE COMPLAINT

  1. Shri Avinash Chander, DS was Director, ASL, Hyderabad from August 2005 to May 2011. He was appointed as CCR&D (MSS) in DRDO HQ and was holding position of no. 2 after Dr. V.K. Saraswat, then DGR&D and SA to RM. Shri Avinash Chander took over as DGR&D, DRDO and SA to RM wef 31 May 2013 after superannuation of Dr. V.K. Saraswat.
  2. Smt. Tessy Thomas was working in ASL since its foundation and she was subordinate to Shri Avinash Chander when he was Director, ASL, Hyderabad. Smt Tessy Thomas was promoted to Scientist ‘H’/Outstanding Scientist wef 18 October 2013. She was appointed as Director, ASL, Hyderabad wef 25 July 2014.
  3. As a matter of facts, the competent authority in DRDO for appointment of Directors of Lab/Estt and Directorates at DRDO HQ is Shri Avinash Chander DGR&D, DRDO and SA to RM.
  4. Shri Saroj Kumar Patel, husband of Smt Tessy Thomas, OS (now Director, ASL) was serving in Indian Navy as Commodore and retired from Indian Navy on 31 January 2013. To oblige Smt Tessy Thomas, Shri Avinash Chander, then CCR&D(MSS) misused his position and succeeded in creation of a vacancy of Scientist ‘G’ in DRDO HQ and applications for this vacancy of Scientist ‘G’ were sought vide RAC Advt No. 110/December 2012.   5. The Scientist ‘G’ in DRDO is having pay scale of Rs. 37,400-67,000/- & Grade Pay 10,000/-, which is equivalent to rank of Joint Secretary in Indian Administrative Services. Joint Secretary to the Government of India has pay scale in Pay Band – 4:Rs. 37400- 67000; and Grade Pay Rs. 10000.All promotions and appointments to this Joint Secretary rank and post are directly made by the Appointments Committee of the Cabinet (ACC).
  6. The requirement of said vacancy of Scientist ‘G’ was tailor made for Shri Saroj Kumar Patel as  evident from details of Advt. No. 110/December 2012.

  1. This malpractice for recruitment of Shri Saroj Kumar Patel was exposed by some senior Scientist ‘G’ of DRDO by writing complaint to Hon’ble Defence Minister in 2013 and therefore the plan of Shri Avinash Chander failed due to seriously  consideration of the matter by Dr. V.K. Saraswat, then DGR&D, DRDO and SA to RM.
  2. Shri Avinash Chander took over as DGR&D, DRDO and SA to RM on 31 May 2013 after superannuation of Dr. V.K. Saraswat. After acquiring full administrative & financial powers in DRDO, Shri Avinash Chander planned the recruitment of Shri Saroj Kumar Patel as Scientist ‘G’ in DRDO and therefore he planned a conspiracy of the illegal & motivated recruitment with help of his subordinates Dr. A.K. Singh, DOP, Smt. Hina Gokhle, Director, DHRD and Dr. DN Reddy, Chairman, RAC and Shri RK Jain, Director, RAC.
  3. Accordingly phase-II of the said conspiracy started by issue of Letter No. DOP/11/110059/QRSM/M/02 dated 14 August 2013 of Directorate of Personnel, DRDO, MOD, New Delhi on the Subject- Appointment of Director, QRS, DRDO HQ, New Delhi. Copy of the letter dated 14 August 2013 along with Proforma for Director, QRS, DRDO HQ, New Delhi is enclosed-IV.
  4. It was clearly mentioned in Para(1) of the letter that “Applications for the post of Director, Quality, Reliability & Safety(QRS) at DRDO HQrs, New Delhi are invited from SC ‘G’ promoted in the year 2013 having sufficient experience in the field of quality, reliability and safety. The Para 1 of letter is arbitrary, discriminatory, unethical and illegal in nature.
  5. No essential qualification, desirable qualification and years of experience were sought and mentioned in said DOP letter for the post of Director, QRS.
  6. Question arises why applications were invited only from the Scientist ‘G’ that were promoted in the year 2013 while in the seniority list of Scientist ‘G’ of DRDO as on 1st November 2013 there were 507 Scientist ‘G’ in total and out of which 114 were promoted in the year 2013 with effect from 01 July 2013? Copy of the seniority list of Scientist ‘G’ is enclosed-V. Why senior Scientist ‘G’ were not eligible for the post of the Director, QRS and under which rule DOP & DHRD decided that only junior most Scientist ‘G’ are eligible for the said post, while in appointments seniority plays an important role and senior most officers always  given priority.
  7. Mere reading of the letter dated 14 August 2013 issued from DOP establishes the conspiracy in recruitment. The letter was issued on 14 August 2013 and it was clearly mentioned in para (2) of the letter, reproduced as it is for ready reference “2. The applications should be duly forwarded/recommended by their respective Directors the enclosed profoma (Annexure-I) and must reach this office latest by 21st August 2013”. Hence only 6 days were provided to all Scientist ‘G’ of 52 Lab/Estt situated allover India right from Leh to Kochi and Vizag to Tezpur. The Para-2 is the clear violation of DOPT norms because period should be minimum 15 days.
  8. As a matter of fact 15 August was National holiday, 16th was Friday, 17-18 August (week end holiday), 19-21 August (three working days). Now three questions arises

(i)                 Why only 04 working days was provided to submit the applications for post of Director, QRS?

(ii)               What was the urgency to keep very short time for submitting applications?

(iii)             Whether it was possible in any circumstances that ink signed copy of the application duly recommended by respective Director be reach with in two-three days by speed post to New Delhi far from various Lab/Estt. Of DRDO.

  1. Answer to the questions raised in point(14) above is that applications were sought within DRDO simply to make formality and have a record that no Scientist ‘G’ applied for the said post or found eligible for the said post. It is matter of investigation by CVC from records that how many applications were received for post of Director, QRS, whether any list were prepared, whether any interview/interaction were organized, whether any committee scrutinized the proforma of Scientist ‘G’ and whether any Scientist ‘G’ was found suitable for the post of Director, QRS, DRDO Hqrs.
  2. In fact said post were preplanned for Shri Saroj Kumar Patel since the December 2012 therefore any Scientist ‘G’ out of 507 Scientist ‘G’ of DRDO was not selected for the post of Director, QRS, DRDO Hqrs and post remain vacant.
  3. Further to accommodate Shri Saroj Kumar Patel in DRDO an advertisement for post of Scientist ‘G’ were again issued by RAC, DRDO vide Advt. No. 112/October 2013 under direct recruitment scheme of DRDO under direction & guidance of Shri Avinash Chander with vested interest. Copy of the Advt No. 112/October 2013 is enclosed-VI.
  4. Shri Saroj Kumar Patel was recruited as Scientist ‘G’ in DRDO against the 01 vacancy of Scientist ‘G’ vide RAC Advt No. 112/October 2013 and joined DRDO at DRDO HQrs, DRDO Bhawan, New Delhi with effect from 27 March 2014 at seniority no. 486 among Scientist ‘G’ of DRDO.
  5. As a matter of fact Shri Saroj Kumar Patel joined DRDO as Scientist ‘G’ on 27 March 2014(Thursday) and appointed as Director, QRS, DRDO HQrs on 31 March 2014(Monday) so he worked only two days 27-28 March 2014 and jumped to post of Director only in service of 04 days. Shri Avinash Chander appointed Shri Patel as Director; QRS ignoring the 485 senior Scientist ‘G’ already available in DRDO and it establish favoritism & nepotism. It can only happened in DRDO.
  6. Now again four question arises

i.            Why Shri Patel was appointed as Director, QRS while he was recruited against vacancy of Scientist ‘G’ not for the post of Director, QRS by ignoring 485 senior Scientist ‘G’ in DRDO?

ii.            What is the specialization of Shri Patel which is not available with 507 Scientist ‘G’ of DRDO, can the conspirators able to justify?

iii.            Why so much favoritism was given to Shri Patel for his recruitment as Scientist ‘G’ and appointment as Director, QRS since October 2012 to March 2014 by Shri Avinash Chander?

iv.            What special benefit DRDO get from Sh Patel’s tailor made appointment?

  1. Keeping in view of the facts mentioned above and the subordination of Smt Tessy Thomas with Shri Avinash Chander right from several years in ASL, Hyderabad, it is crystal clear gross violation of recruitment rules, ethics and procedures took place and the same were not followed in recruitment of Shri Patel as Scientist ‘G’ on 27 March 2014 and further his appointment as Director, QRS on 31 March 2014. This smacks planned conspiracy and criminal misconduct by Shri Avinash Chander, DGR&D, DRDO, Dr. A.K. Singh, Director of Personnel, DRDO Hqrs, Smt Hina Gokhle, Director, DHRD, Dr. RK Jain, Director, RAC and Dr. DN Reddy, Chairman, RAC.
  2. Therefore, it is kindly requested that appointment of Shri Saroj Kumar Patel, Scientist ‘G’ should be cancelled with immediate effect and inquiry be conducted under Prevention of Corruption Act 1988 and CCS (CCA) Rules 1965 against the senior officers of DRDO involved in planned conspiracy of recruitment and appointment of Shri Saroj Kumar Patel as Scientist ‘G’ in DRDO and appointment as Director, QRS, DRDO HQrs.

Sir,

Defence Materials and Stores Research & Development Establishment (DMSRDE), Kanpur is one of the establishments under Defence Research & Development Organisation. Dr. Arvind Kumar Saxena was appointed as Director, DMSRDE, Kanpur with effect from 01 January 2011 and he is posted in DMSRDE, Kanpur since 28 April 1984. In past 30 years he developed deep connections with local vendors and after his appointment as Director since 01 Jan 2011, these pet vendors are playing major role in procurement of stores & items.

  1. As vigilant & patriot citizen of the country, I filed 12 complaints on issues of Corruption against Dr.  Arvind Kumar Saxena, Director, DMSRDE to CVC and Hon’ble Defence Minister with proofs. Details of complaints on Corruption against Dr. Arvind Kumar Saxena is enclosed as Annexure-1.
  2. CVC has informed me vide his various letter & sms that my all 12 complaints have been forwarded to CVO, Ministry of Defence but till date no action has been taken against Dr.  Arvind Kumar Saxena. Copies of letters from CVC are annexed as Annexure-2.
  3. Since copies of all these complaints were also sent to Shri Avinash Chander, DGR&D, DRDO and Scientific Advisor to Raksha Mantri but till date no action has been taken against Dr. Arvind Kumar Saxena by Shri Avinash Chander, DGR&D, DRDO.
  4. The two statutory rules viz CCS (Conducts) Rule 1964 and CCS (CCA) Rules 1965 have been framed by Government of India for maintaining good conduct and discipline. Under Rule 14, Government of India Order on “Inquiry Officers to be senior in rank to the officers enquired against” it is mandatory that inquiry officer –Chairman as well as all members Inquiry Committee should be one  rank senior to the officer whose conduct is being inquired into. This principle has been reiterated in CVC Vigilance Manual, Railway Manual, CPWD Manual and all other DOPT Manuals.
  5. Shri Avinash Chander, DGR&D, DRDO and Scientific Advisor to Raksha Mantri is giving patronage to corrupt practices of Dr.  Arvind Kumar Saxena and promoting corrupt officers in the organisation. One simple example of patronage to Dr.  Arvind Kumar Saxena by Shri Avinash Chander, DG R&D, DRDO is to constitute an illegal Fact Finding Committee in Jan-Feb 2014 for inquiring complaints against Dr. Arvind Kumar Saxena. In this committee Shri SS Negi, Scientist ‘H’ was Chairman and Mr. Manoj Bali, Scientist ‘G’ and Shri Jagdeep, Scientist ‘F’ was members. This Committee was totally illegal as Chairman was of equivalent rank and two members of FFC were very junior to Dr. Arvind Kumar Saxena. This establishes that Shri Avinash Chander, DG R&D, DRDO wilfully constituted an illegal committee for giving patronage & protection to corruption in DMSRDE, Kanpur by Dr. Arvind Kumar Saxena. Intentions of Shri Avinash Chander, DGR&D, DRDO is very open to protect corrupt officer Dr. Arvind Kumar Saxena by any means.
  6. This Fact Finding Committee took only one complaint out of my several complaints and gave false report despite FFC did not interact with me and all proofs were submitted along with complaints. That complaint was regarding procurement of ‘REACTOR. The said REACTOR was procured by DMSRDE in 2012 and REACTOR was supplied to DMSRDE in January 2013. Till date payment of said REACTOR has not been made to the vendor.
  7. In light of the above, in the interest of organisation, I kindly request you to take appropriate action against Dr. Arvind Kumar Saxena, Director, DMSRDE   and issue directives to CVO (MOD) to speed up the investigation on my complaints.

I Prabhu Dandriyal, ex DRDO employee and resident of Dehradun, Uttarakhand fighting against corruption since 1999.

When the RTI Act 2005 implemented through our Honorable Parliament, it was a historical decision to empowerment common man of India.

Today, Sh Rahul Gandhi ji, Smt Sonia Gandhi ji daily quoting in election rallies that RTI Act 2005 is their gift to common man of India; it is 100% true that day one common man experiences his strength to correct the corrupt system and RTI Act helped mass common people of India.

Since its inception, I have filed several RTI applications to expose the corruption and slowly the corrective measures are taken by concern departments, but still long way to go on.

Sir, DoPT is the nodal agency for implementing RTI Act-2005 and I was found some officials from DoPT are supporting corrupt officials of DRDO.

Sir, I filed an online RTI application to DRDO for request information in respect of Dr. AK Singh, DOP, DRDO, Ministry of Defence. The information can expose the wrong doings of DRDO officials. But my RTI application was returned by DoPT official unprecedentedly.

My  RTI application MODEF/R/2014/60617 filed online portal on 31/03/214 addressed to Dr. RB Sharma, CPIO, DRDO under department of Defence was returned online on 15th March 2014 with this remark which one is  unprecedented act of portal manager/ in-charge against the guideline.   Remarks :- You have filed more than 40 online RTI applications relating to DRDO on the address of Department of Defence which has been physically transferred to DRDO under intimation to you. DRDO is a separate public authority and is also placed under Second Schedule of the RTI Act, 2005. Therefore, your online RTI applications seeking information in r/o the DRDO and sent to Department of Defence will not be acted upon henceforth. You may directly send your application to the DRDO for the information.

As per Guideline – An applicant who desires to obtain any information under the RTI Act 2005 can make a request through this RTI Online Portal to only the Central Public Authorities of main Ministries/Departments located at New Delhi initially. In the first phase, this facility is available to Ministries/Departments/Apex Bodies mentioned in the list available in ‘GUIDELINES’

It is astonishing fact that DoPT official mentioning   that DRDO placed under Second Schedule of the RTI Act, 2005 but they forget they are not exempted for corruption and human right violation matters; it seems that the officials involved are biased and supporter of corrupt official of DRDO.

I request you kindly take appropriate corrective measure  take action against officials who are involved in unconstitutional act and give strength to claim of UPA government that RTI- Act 2005 is really empowered the common man and fix those who are diluting the effectiveness of  strong RTI Act -2005.

MOU Business of DRDO

Like the MoU signed with Crowe And Company, LLC 975 Bacons Bridge Rd, Summerville, South Carolina 29485-4118 United States, DRDO is habitual to signed MoU’s and compromising the vital defence information to foreign origins.

For Air force application /telemetry and tele-command application 8 -18 GHz is vital frequency band as it covers two octaves.

MTRDC, DRDO, Bangalore based on Air force requirement signed MoU for development of micro wave tube with M/s Thomson – CSF, USA ignoring their own competence and capabilities of BEL, Bangalore.

One such tube supplied to DEAL, DRDO, Dehradun never worked and late Sh K N Rao, Scientist ‘G’ succumbed to injury due to mounting pressure of timely delivery of the project.

All these MoU’s are futile exercises only thing that the persons behind these MoU’s gets short term personal gains.
