Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect to 51 scientist ‘B’ recently recruited through campus selection from various institutions.

1. Please provide the list of Institutes where these campus selections were conducted.

2. Name of DRDO officials who were in the committee of above campus selections.

3. Provide the names from the list of 51 scientists ‘B’ recently recruited whose father/mother is working in DRDO and their post in the organization.

4. Provide the names from the list of 51 scientists ‘B’ recently recruited who are having immediate relatives working in DRDO, name of relative, the relation with newly recruited scientist and their post in the organization. If it is not available then please collect the same from the individual.

Kindly refer to following decisions of Central Information Commission and verdict given in these decisions.
File No. CIC/LS/A/2012/002612 dated 22.3.2013 (Dr. Neelam Bhalla vs. DRDO) Verdict – It is, no doubt, true that DRDO is an exempted organisation yet it has been the consistent view of this Commission that the benefit of exemption extends only to functional / operational matters and not to establishment related routine matters. The legality of this view has not been challenged in the relevant judicial forum so far.

Note: – Above required information is directly related to corruption and does not come under schedule II. As you  are aware recently Defence Minister recommended CBI inquiry to probe recruitment done by RAC.

Constitutional crises in DRDO

DRDO comes under the Ministry of Defence, Government of India and all central government rules are applicable.

However, beginning with 1980 (prior to this DRDO was running under defence secretary) when D G (R&D) post was created and approved by cabinet with status of secretary as independent charge of R&D, foundation were laid for an autonomous & central govt. body both.

Special status was given for program director of IGMDP with permission sign 10 cr papers while directors/lab heads limitation was 2.5 Lakhs.

In the name of science & technology development, recruitments were made to develop defence specific weapons/equipments/infrastructures. A separate recruitment and assessment centre (RAC) was created with consent of UPSC and with approval of government.

The absolute empowerment of secretary DRDO gave the individual to implement his decision and with passage of time the interest of nation was over shadowed. The secretary DRDO made the entire lab directors independent and unaccountable.

Today the scenario is no system exists in DRDO, every director following their own rules, whether it is case of procurements/ recruitments / assessments / maximum time busy with construction/renovations etc.

They don’t bother new born D.Gs, DOP, RTI cell and even Secretary, DRDO. Why? Because they know after few days, Dr Avinash Chandra will be working in contract basis. No one is listening his order as well as his advice. For example, Director, Dr CP Ramanarayanan, GTRE not honoring the order of Dr Avinash Chandra, the new DG Electronics Communication System Sh. S S Sundaram also supporting the acts and deed of Director, Dr CP Ramanarayanan, GTRE (because of regionalism). Transfer case of Mr Sachin GTRE to DEAL is a clear cut example of environment of DRDO; the words uttered by Dr. CP Ramanarayanan are resonating in the ears of all top DRDO Hqrs officials.

Dr Avinash Chandra told a scientist that your request is genuine but I am helpless. The scientist got transfer order one and half year back but the because of the dictatorship of Director, LRDE, Sh S Ravind the transfer is still pending and our  Dr Avinash Chandra, SA, Dr G Malakondaiah, DS & CC R&D (HR & M), and DOP, Dr A K Singh all are helpless. Although Dr G Malakondaiah talked in front of the individual scientist with Sh S S Sundaram (conversation was in Telegu) but it did not turn positive.

Surprisingly, the aim and objective of Rama Rao committee was that the power is decentralized for fast decision on procurement issues, management issues. This would give boost for high productivity or pace in development program. It is looking like a total failure in the beginning itself.

Instead of all this all new DG are too busy to manage big chunks of funds and showing off the power of their new kingdom.

DRDO labs directors, mostly known as distinguished or outstanding scientists but it is astonishing fact that most them are not known in India because they have never published any outstanding paper, not have any patents, if PhD then from deemed universities where they are suppose to feed project funds. Like their big guru Dr W Selvamurthy Ex C C R&D, who is PhD in Yoga and involved in feeding funds to various deemed universities or private institutions. (Famous SASTRA case everyone knows). Rest are following their footsteps like Sh S S Sundaram, new born DG, Sh RC Agarwal, Director, DEAL (2nd extension age 63+ yrs), Sh R K Agarwal another outstanding scientist now start pursuing PhD from Graphic Era, also new born Deemed University at Dehardun because they fed funds in the name of projects and their agents ex DRDO employees are managing the show.

A constitutional crisis was the appointment of RAC Chairman. Dr PS Goel was appointed for period 3rd December 2008 – 2nd December 2011. As per rule search committee for next RAC chairman was supposed to be constituted in June 2011. However, minutes (DOP/05/50219/M/01 7th Dec 2011 disclose that first meeting of newly constituted committee was scheduled for 19 December 2011, it is astonishing fact that DRDO writes its own constitution and shows disrespect to Honorable Raksha Mantri.

Negligence of then SA to RM, not to initiate search committee in time was a planned action. He wanted to push all his close aides to appropriate place/post, who were handling sub contracts signed with foreign firms with different areas and were responsible omission/commission dues. The period of Dec 2011 to June 2012 was the crucial period of assessment/recommendations/selections/promotions. To cash this opportunity   Dr V K Saraswat as chairman RAC recommended those who were not competent for the post of ‘H’. Had there been an independent RAC Chairman, he would kept the national interest in forefront. The example of the case of Sh R K Agarwal, Scientist ‘H’ at DEAL, DRDO, Dehradun, who prepared citation for promotion with a false claim (Copy of his claim) attached and got promoted with the blessing of Sh R C Agarwal, Director, DEAL (2nd extension without any achievement) and Dr V K Saraswat.

The letter no 12/7/2012 EO(SM-II) dated 19th March 2012 of DOPT revealed that appointment of

as RAC chairman was approved by Appointment Committee of Cabinet (ACC). The question is why it was waited up to June 19th, 2012; time was buying to adjust all incompetent senior officials by Dr V K Saraswat.

It is requested to Sh A K Antony, honorable Raksha Mantri order for investigation of assessment year 2012 scientist ‘H’.

As I am aggrieved by decision/no decision of Central Public Information OfficerI hereby file this appeal for your kind decision.

The reply of CPIO, DRDO, is completely confusing, misleading, incorrect, unjustified and willful not give any information, does not following the spirit of RTI Act 2005.

3. Particulars of Decision/Order of CPIO against which appeal:

4. Brief facts leading to appeal:-

Sh. R K Agarwal, Scientist ‘H’, (Out Standing Scientist ) Defence Electronics Application Lab, DRDO, Dehradun was promoted wef 1st July 2012.

In DRDO Newsletter September 2012 page No -14. In which the details of Outstanding Scientists of the DRDO.Sh, R K Agarwal, Outstanding Scientist, DEAL   “his main contribution has been the development of NARAD, the first semi-static and transportable terminals developed in the country. These terminals were immediately deployed in SRI LANKA during operation PAWAN where they have played a vital Role.”

Sh. R K Agarwal claimed false that he worked and contributed in “Project NARAD”, which was the only real-time successful project and was appreciated by user (IPKF).

Sh. R K Agarwal claimed the aforementioned for his promotion to outstanding scientist and it was published in DRDO’s News Letter September 2012 page No -14 (Copy enclosed)

Departmental Part Order for manpower for Project NARAD reference are DO Part-I No.232/AD dated 18/11/1988 and DO Part-I No.238/AD, No.239/AD dated 24/11/1988. There was clear cut mention in the order that Sh. R K Agarwal was not part and parcel of Project NARAD.

The appreciation letter No 35795/Aks/per date 20th April 1990 by Major A K Singh, 57 Mtn Div. Signal Regiment to ShSurendra Pal, Dy. Director, Project NARAD clearly reveals the names of DEAL’s scientists who participated and contributed their best  in the real operation scenario. There is no name of Sh. R.K Agarwal in the appreciation letter.

The DRDO in their RTI reply No.DEAL/RTI/0003/2013 dated 08/04/2013 clearly mentioned that No such document/information is available, means there is nothing available which proves that Sh R K Agarwal was part and parcel of Project ‘NARAD’. It is clear evidence that Sh RC Aggarwal supported Sh R K Agarwal’s false claim for promotion to outstanding scientist because of the only reason of nepotism and castism. (Copy enclosed)

5.  Reasons/Grounds for First Appeal:-

  1. RTI request sent to DoPT and DoPT furnished partly information which is also mark as confidential, but after result it was a open document.(Copy Enclosed)
  2. DoPT transferred my RTI request to Ministry of Defence for rest information vide their letter no F.No/29/38/2013-EOSM-II Dated 15th July 2013.
  3. Subsequently  MOD transferred to RTI Cell, DRDO vide Mof D ID No 21/(3)/2013(1083)/ D/(RTI) Dt 5/7/2013
  4. Subsequently  RTI Cell, DRDO transferred to CPIO,RAC, DRDO vide  RTI/01/2091/P/2013/0178 dated 10th July 2013
  5. Subsequently CPIO,RAC, DRDO informed me vide letter no RAC/03/RTI/95/2013 Dated 1st August 2013 that my application sent back to RTI Cell, DRDO for further action. (Copy enclosed)
  6. Unexpectedly I have received 6th September 2013 a letter from CPIO,DEAL, Dehardun stated that they received a letter from CPIO,RAC, DRDO on 20th August 2013 (no letter no reference) stated that the information (Biodata) of Sh R K Agarwal marked as confidential, hence it cannot be disclosed (copy enclosed)
  7. As Sh R K Agarwal worked in DEAL in various projects and “only those project are classified as secret/confidential which have been sanction under staff project (ARMY/Air force/Navy/ Services   Branch, the rest of the project sanctioned to DRDO comes under R&D Projects.

Sh R K Agarwal himself quote in DRDO News Letter (September 2012) that he was associated with Project “NARAD” his claim was totally false and supported by Sh R C Agarwal, Director, DEAL for his promotion to Scientist ‘H’ and this act come under corruption. (“Whoever does anything with the intention of causing wrongful gain to one person or wrongful loss to another is said to do that thing dishonesty”)

viii. DRDO is protecting Sh R K Agarwal for his false claim and to stop this corrupt practice in DRDO, it is very well require exposing false claims especially in R&D atmosphere because these practices demoralize young scientists. As CPIO, DEAL already committed in one RTI reply no information and document evidence is available in DEAL regarding Sh R K Agarwal’s claim.

6.    Prayer /relief sought for:-

Information sought vide RTI Application dated 28th May 2013 by appellant has been denied on false and invalid reasons by CPIO, DEAL,Dehradun. Therefore, appellant kindly prays to FAA, DRDO to allow this appeal and issue instructions/orders to CPIO,DEAL, Dehradun to provide the information sought as seek by appellant vide his RTI Application dated 28th May 2013 (Copy Enclosed)

7.    Grounds for prayer/relief sought for:-

1.      CIC decisions on notified organisations under Schedule II of  RTI Act 2005 like DRDO

(i)        CIC in its various decisions consistently held that Establishment Matters relating to the organization notified u/s 24 of the RTI Act come within the purview of the Act and information in this regard thereto are not exempted from disclosure.

(ii)       CIC in its various decisions clarified that the exemption u/s 24(1) for DRDO (notified organisation under Schedule II) is only for Scientific/Technical/Strategic/national security information and not for the information of General nature/Estt. Matters/ Routine Correspondence/ all other information for which exemptions u/s 24(1) are not allowed.

(iii)      These decisions of CIC are binding on all notified organisation under Schedule II, as these decisions of CIC has not been challenged till date in any court.

3.      Misuse & wrong interpretation of section 8(1) (j) by CPIO, DRDO HQ: – It appears that either CPIO did not apply his mind on content of information sought or he is supporting corrupt practices of Director, DEAL, Dehradun

Austerity a setback for DRDO projects

A Rs. 1,000-crore or 10 per cent budget cut under the government’s austerity clamp for the second year running has kept the DRDO poorer by about 700 entry-level scientists in the last two years.

This may push back some of its prestigious missile and aircraft development programmes, according to a top DRDO official.

The DRDO’s hiring arm, the Delhi-based Recruitment and Assessment Centre, planned to induct 350 young engineers each year in 2012-13 and 2013-14, mainly for its missile and aeronautics labs.

Admitting a shortage of young scientists, RAC Chairman D.N. Reddy told The Hindu, “We have many new and important projects which will now be delayed for want of manpower.”

Frontline hits of this could be the long-range Agni-VI targeted for 2016, the Light Combat Aircraft set for completion in 2015 and the Futuristic Main Battle Tank.

The 35,000-strong DRDO, with 8,000 scientists, gets 6.5 per cent of the defence budget or about Rs. 10,000 crore; this year, the belt-tightening measures have kept back 1 per cent of the funds.

The hiring proposals were cleared by the Prime Minister’s Office. However, the Finance Ministry’s all-round slash on spending has halted the RAC’s drive until the middle of 2014, Dr. Reddy said.

Instead, it has to be content with about 70 recruits only to fill the vacancies created by retiring staff; half of them go directly into the priority areas of missiles and aircraft.

Only short-term

“The financial implications are only of short duration. After June 2014, we are confident that our needs will be met,” he reasoned on the sidelines of a conference on condition monitoring here on Friday.

Every December, RAC picks the cream of graduates from 16 IITs, the Indian Institute of Science and the Defence Institute of Advanced Technology, Pune. Now the entry-level staff are just a few hundred in number.

Open Letter to Sh Avinash Chandra, SA to RM, DG DRDO

Dear

Shri Avinash  Chandra Ji, after you joined as DRDO boss, honest and neutral official expected and hoped for good decision, good administration, good cohesive  environment, hope you will shake DRDO with your full strength  to get rid of incompetent stuff.

But sorry to say you disappointed the honest scientists/ staff/ officials and they are not finding any reason to stay or giving their 100% output to DRDO.

Avinash ji, collect all your good energy and get rid of the nexus of culprits who are controlling SPIC, CCE, Department of Personnel, RTI Cell, RAC, CEPTAM and some Lab heads.

Every DRDO official knows acts and deeds of these corrupt officials but sake of their carrier not coming forward but sending anonymous or fake signed letters ( inputs are correct) to Prime Minister, Defence Minister and other government agencies and of course to you also, I have also received some from various labs. (Sending bunch to Honorable Defence Minister)

The increasing numbers of court cases are also perfect examples of mismanagement in DRDO.

The decision of giving responsibility of administration/material management to scientists is also going to be a big problem in the coming time.

Perfect administration and perfect procurement is not cup of scientists. They are not able to match with laid down rules of government of India. Day by day increasing number of anomalies / audit objections in recruitments / procurement are going to be a big issues.

Dr. P S Goel’s DO letter implementing of interaction for promotion from  Sc ‘ F’ to Sc ‘G’   without approval from cabinet is a clear cut  case of violation of Article 309 and the repercussion now started in shape of court cases which was hampering the progress of DRDO and created demotivation among senior scientists

Same in RAC/ CEPTAM encouraging recruitment of incompetent / fake degree / diploma appointment of such candidates who are not eligible as per SRO/ appointment on the basis of nepotism/ in this respect you only see the RTI’s on these issues, you will find clear picture of the future of DRDO.

You are under the impression that corrupt CPIO, Dr A K Tyagi is protecting DRDO. It is not true, instead of exposing the corrupt practices, he is trying to bury the information and very soon these corrupt practices will sink the DRDO ship. As you aware CVC already issued advice to CVO, MoD against the Dr A K Tyagi for “Regular Disciplinary action is recommended on: 9/9/2013“and you are not taking any action to remove him for the post of CPIO, DRDO. What does it mean, it means still you are in grip of corrupt officials. A honest advice is first change your staff officer and old staff of Dr Sarswat’s time, than only you will be find some change in DRDO’s scenario.

Avinash ji, we all very well know that you are washing dirty linen of Dr V K Sarswat’s several misdeed which are the outcome of mismanagement of Dr Sarswat, because he was only on? Government agencies very well know about that, and why he was not able to get extension,    Ms R. AMRUTHA VANI, SC ‘F’’s  (‘Below the Bench Mark’) case, Dr Neelam Bhalla’s, Sc ‘F’ (Workplace Humiliation, Harassment, Gender discrimination & Victimisation)  case etc. but problem is that you are dealing all issues with same set of officials ( Dr Sarswat’s  & Dr. W Selvamurthy’s gang) who created and responsible for these kinds of hurdles in DRDO for their own wasted interest.

CEPTAM Director enjoys all type of corrupt practices like he is engaging his wife and relatives in different recruitments boards as experts. Recent CEPTAM recruitment process he introduced mandatory SMS registration (cost Rs 3 to each applicant) for his personal benefit (he worked this out this without proper procedure) and due to this almost thousands of aspirant were not able to get their admit cards. In this process lot of SC/ST candidates also suffered, you can check with records, where Government of India facilitates to SC/ST candidates in recruitments without any fee. Almost 5 lakhs candidates applied nearly one lakh rejected and thousands of candidate could not appear due remote centre problem, candidates were not given asked choice centers, they received admit cards with centers like Goa, Mizoram, Chennai, Patna.

What is the meaning of interaction and what is its need against the rule?  Nothing except the violation of law for corruption. UPSC conducted examinations for thousands participant for few seats then how RAC chairman want to stop the limited scientists opportunities to appear before the committee directly. Intention of Chairman is very clear.

Then Chairman, RAC Dr. P. S. Goel’s letter RAC/01/Assessment/PSG, dated 22-3-11 introduced this mechanism to give favor to incompetent few DRDO scientists  and for this act in return he got Prof. MGK Menon’s chair, RCI, Hyderabad  which fed him 84 lakhs per year. It is pure kick back or DRDO should prove the justification of his appointment.

What is this, is it not corruption? Best part of this type of corruption is money which he is receiving is poor tax payer’s money.

Question is, if he was competent authority to amendment of this kind of mechanism than why later DRDO amended this through Government of India gazette notification. He doesn’t have knowledge of the constitution of India, he is not competent authority to amend the  DRDS rules which are framed under Article 309 of  the constitution of India.

Where is law, where is administration, where is governance, it is happening in every stage in DRTC promotions also, where incompetent fake certificates holders are getting promotions and all relevant benefits, in recruitment of scientists lot of cases are exposed like Arun Kumar’s daughter, Selvamurty’s daughter, A K Bansal’ daughter and now several in queue like Narendra Kumar’s daughter, R B Singh’s son appointment are under lenses

Recently in CEPTAM recruitment   drive nearly 5 lakhs applications was received by CEPTAM, they made almost Rs 15 lakhs or more by introducing mandatory SMS registration, pure corruption by CEPTAM management god only knows who is patronizing this kind of corruption in DRDO. In the Holika Dhahan occasion we congratulate and support our honest Defence Minister Sh A.K. Antony for starting swaha of corrupt officials in our defence sector. We are also thankful to him for taking such exemplary action (suspension just half an hour before his retirement after enjoying extension in service for two years) against Dr. Arun Kumar, Ex-DOP, DRDO.

Sir, there are so many other corrupt DRDO senior officials who deserve the same action from your side. These officers exploit DRDO by inducting incompetent family members in different levels, involving procurement businesses as the name of ex- air chief name is accused. If DRDO is investigated, you will find that SPIC, ASL, DRDL, HEMRL, GTRE, TBRL and lots of other DRDO labs are busy in the same manner. We have already shared some information with IB, CBI and other agencies. The family members, relatives and friends of these corrupt DRDO officials are enjoying shares of DRDO funds.

There are many more secrets of incompetent DRDO officers mishandling constitutional valid rules for their wasted interest.

RAC of DRDO established to accelerate the recruitment process of potential scientists. However, unfortunately RAC is losing its utility and working as it is now a tool for corrupt senior DRDO officials to encourage corrupt and incompetent stuff in DRDO and it is also being used for demoralizing the honest and real R&D scientists. The increasing representations and court cases are the live examples of these acts.  We think that by now, you are also fed up by answering a lot of honorable parliament members, who are regularly asking the exodus of DRDO scientists.

Recently, as per sources, in one court case, a scientist accused that the thenRACChairman Dr. P.S. Goel unconstitutionally cleared screening committee’s list. The claim is that the list was not signed by the members. It is not surprising because Dr. P.S. Goel has already violated Article 309 by issuing a letter for modifying the SRO on his own without approval of cabinet vide letter no.RAC/01/Assessment/PSG dated 27, March 2011. This was blindly done to give benefits to some incompetent DRDO officials out of way; in return, Dr. P.S. Goel got DRDO chair which costs nearly Rs. 83 lakhs per year on the poor tax payer.

Dr. R.C. Aggarwal, Director DEAL, DRDO gave unceremonious favor to another Agarwal, a scientist of his lab for the post, outstanding scientist. This outstanding scientist had been claimed that “his main contribution has been the development of NARAD, the first semi-static and transportable terminals developed in the country. These terminals were immediately deployed in SRI LANKA during operation PAWAN where they have played a vital Role.”  We are waiting for RTI reply on this subject from DRDO, but we know personally this claim is totally false and used to make him an outstanding scientist.

Another great job was done by DRDO when DRDO ignored your power delegation orders No 36(3)/ 2009-D(O&M), Govt. of India, Min of Def, dated 1 June 2009 and No 36(3)/2012-D(O&M), Govt. of India, Min of Def, dated 5 Nov 2012. . DRDO took approval to suspension/dismissal of honest officials from RRM and in this respect they also filed affidavit in the honorable courts that they got approval from RRM on the subject matter.

Sir this is the tip of the iceberg and the main reason of the exodus, court cases and unproductiveness of DRDO.

Sir, in the DRDO scenario a lot of evil things are waiting for your Holika Dhahan like

  1. Arun Kumar’s daughter’s illegal appointment.
  2. Selwamurthy’s daughter’s illegal appointment.
  3. T.Chandrabanu’s illegal appointment
  4. Prof S K Salwan’s , illegally given DRDO chair (ignored the age limit)
  5. Vasudev’s illegal stay and involvement in SPIC (the IB already reported his daughter’s involvement)
  6. Dr Prahlada ’s VC, DIAT appointment  (ignored his all corrupt activities including remark for SC candidate)
  7. DLRL security surveillance procurement which was submitted with evidences to you only an eyewash inquiry was done by DRDO officials)

2. It is the appellant’s contention that Ms. Geeta, daughter of Dr. W. Silvamurthy, former Director, DIPAS, DRDO, New Delhi, was selected as Scientist ‘c’ in 2004. It is his allegation that said Ms. Geeta was not qualified to be selected as Scientist ‘E’ as she did not hold the Ph.D degree at that time. He also alleges that she obtained the Ph.D. Degree from Bharathiar University, Coimbatore, in an irregular manner. In this connection, vide RTI application dated 7.10.2011, the appellant had sought information on 05 paras. This was responded to by the CPIO vide letter dated 2.11.2011 wherein he refused to disclose any information on the ground that DRDO is an exempted organisation.

3. Hence, the present appeal.

4. Shri Mishra submits that he has not received a copy of the appeal memo and, therefore, it is not possible for him to respond to it off-hand. Besides, he also submits that Chairman, RAC, had conducted an inquiry into the matter and in report dated 24.12.2010 had held that the process of recruitment was in order. The Commission cannot comment on the validity of allegations made by the appellant. Even so, in my opinion, the requested information cannot be denied to the appellant only for the reason that DRDO is an exempted organisation. In fact, transparency demands that the records relating to the inquiry conducted by Chairman, RAC, are allowed to be inspected by the appellant or his representative. I order accordingly.

The officer has been found guilty of appointing his senior’s daughter without following the due process.

The Central Vigilance Commission (CVC) has advised the initiation of major penalty proceedings against an additional director rank officer and his superior, a director, with the Defence Research Development Organisation (DRDO). The officer has been found guilty of appointing his senior’s daughter without following the due process. The proceedings have been advised after a complaint filed by the Ministry of Defence (MoD) was probed by the CVC.

The CVC has recommended the penalty against A.K. Bansal, who was at that time additional director (Recruitment and Assessment Centre) (Scientist F) and Arun Kumar, director, (RAC) (outstanding scientist). Bansal illegally facilitated Kumar’s daughter’s appointment.

The Recruitment and Assessment Centre (RAC) of DRDO looks after the recruitment and promotion of scientists in the organisation.

The CVC in its memorandum dated 23.08.2012 has stated, “The case has been examined by the commission. On facts of the case, the commission in agreement with MoD, advises initiation of major penalty proceedings against Dr. Arun Kumar, Senior Scientist, DRDO, and Shri A.K. Bansal, Additional Director, RAC.”

The CVC has also asked the ministry to reconsider the appointment of Swati Shrivastava, daughter of Arun Kumar, who is working as Scientist C in DRDO. “Further, the commission advises the ministry to reconsider the appointment of Ms. Swati Srivastava, daughter of Dr. Arun Kumar.”

“This is a clear case of corruption and misuse of position to appoint close relatives,” an employee of DRDO stated on the condition of anonymity.

Arun Kumar is serving as Director (Personnel) in the DRDO headquarters at present. A.K. Bansal, who retired in 2009, was till last month working with the Institute of Defence Scientists and Technologists (IDST), a registered body of retired DRDO professionals, which claims to provide consultancy, expertise and assistance to DRDO.

The DRDO had earlier tried its best to stonewall an RTI (Right to Information) query filed by an employee of the organisation, seeking to inspect the records related to the employment of Dolly Bansal, daughter of A.K. Bansal. DRDO, while refusing to allow the inspection of records, had said that it was an exempted organisation under the RTI Act.

However, the Central Information Commission rejected the DRDO’s contention and said that since it was related to alleged irregularities in the selection of Dolly Bansal as a scientist and there was no harm in the inspection of the available records.

When contacted, DRDO spokesperson Ravi Kumar Gupta said that the organisation follows a transparent and fair policy of recruitment: “It may be a matter of difference of perception (the findings of CVC). Decisions by RAC related to recruitment are taken by a chairman who is independent of the scientific advisor. However, whatever action is required to be taken, will be taken.”

3. During the hearing, the appellant submits that the DRDO had advertised posts of Scientists ‘B’ in 2004 for which qualification was M.Sc. Bio Technology. Ms. Srivastava was M.Sc. in Environmental Biology. Thus, she was not qualified for the job. Yet due to the influence of his father Dr. Arun Kumar, who was then Deputy Director in DRDO, she was fraudulently selected as Scientist ‘B’
4. Shri Mishra submits that there is no one single file relating to this selection. In fact, there were about ten thousand candidates and to cull out Ms. Swati Srivastava’s record would be a herculean task. Further, the record is ten year old.

5. No doubt, DRDO is an exempted organisation, yet in my opinion, there is no harm if the appellant or his representative is given inspection of the entire records relating to the selection of Ms. Swati Srivastava as Scientist ‘B’. As regards the difficulty expressed by Shri Mishra in tracing out the relevant record, I appreciate the same and yet I expect him to cull out the record for appellant’s inspection.

Ms. Swati Srivastava, Dr. Arun Kumar and RAC board Chairman and Members did dishonesty and cheated all the participants who applied for the post and forged the official documents to select as a Scientist “B” to Ms. Swati Srivastava.

In the Director, DRDO fax message 03/8/2004 for RAC Adv.No.66,item.34, eligibility subject showing Biotechnology. RAC,DRDO document of assessment sheet dt. 26/9/2004 for adv.66 subject of Ms. Swati Srivastava forgely filled in Biotechnology list.
However , as per the DRDO letter RTI/01/2091/p/2011-12/005 dt. 6/4/11, Ms.Swati Srivastava subject is environment biology. Therfore Ms. Swati Srivastava without fulfill the eligibility qualification got the scientist “B” post in DRDO on forged documents of the RAC. (Recruitment and assessment centre of DRDO)

8. Brief facts of the case:-
I submitted my RTI application before the CPIO, DRDO, New Delhi on dt.03-10-2011. Cause for put up this application was the allegation of the corruption / misuse of the office during the selection of the scientist. CPIO reply is not satisfactory and not as per the law because the RTI is related with the allegation of the corruption and not exempted under section 24(1) of the RTI Act-2005.
In his reply CPIO mislead to me with the reference of Supreme Court civil Appeal no – 6454. However in this Supreme Court civil Appeal no – 6454,clearly mentioned that- “37. The right to information is a cherished right. Information and right to information are intended to be formidable tools in the hands of responsible citizens to fight corruption and to bring in transparency and accountability.
The provisions of RTI Act should be enforced strictly and all efforts should be made to bring to light the necessary information under clause (b) of section 4(1) of the Act which relates to securing transparency and accountability in the working of public authorities and in discouraging corruption.”

I was not satisfied with the reply of CPIO,DRDO HQ, New Delhi, after that I submitted an appeal before FAA to take the information but the FAA / Transparency officer of DRDO dismissed the appeal and failed to provide the information with the ref. of second schedule of the RTI Act & section 24(1) of the RTI Act-2005.

9. Reasons/grounds for this appeal:-
1- That the RTI application is related with the public information because 63 participant were applied for the above mentioned scientist post after the publication of the advertisement in employment news paper .

2- That this information is directly related with the corruption and misuse of the office and not come under section 24(1) of the RTI Act because the required qualification for the post was M.Sc- Biotechnology, where as the qualification of Swati Srivastava is M.Sc in Environmental Biology. Her father Dr. Arun Kumar ,was the Addl.Director of the DRDO at that time. One RAC interview board external member of Ms. Swati Srivastava was her teacher. However Ms. Swati Srivastava was not completing the minimum eligibility qualification as published, then also she was selected with the criminal conspiracy of her father with board members of the RAC. Ms. Swati Srivastava, Dr. Arun Kumar and RAC board Chairman and Members did dishonesty and cheated all the participants who applied for the post and forged the official documents to select as a Scientist “B” to Ms. Swati Srivastava.

3- That the main object to take this information is to provide as an evidence before High Power Investigating Officer/ Commissions / High Courts in the interest of law and justice.

10. Any other information in support of appeal:-
This RTI information is required to proof a corruption during the selection. Secondly, In a RTI reply of the CPIO, DRDO HQ vide his letter no rti/01/2091/p/2011-12/005 dt 6/4/11 Ms Swati subject is environment biology however as per the seniority list for promotion as published on july 2010 page no.45 of DRDO official document Ms. Swati subject is M.Sc- Biotechnology.
