Ego & high handedness of Lab Directors ruined the Defence Preparedness.

Subject: Ego & high handedness of Lab Directors ruined the defence preparedness.

There are several cases of such criminal offences of DRDO Directors where, the day he assumes charge, he becomes an authority without accountability, capable of implementing corruption and nepotism under his control. He deceives the organizational goal.

Dr. Anil Kumar Maini, Director LASTEC, DRDO has set an example of personal vendetta against an honest hard working officer Sh. Prakash Singh, Senior Administrative Officer – II (SAO-II), LASTEC, DRDO

Dr. Maini is frustrated because Sh. Prakash Singh exposed his corrupt practices to CBI. Dr. Maini mislead DRDO Hqrs. managing Compulsory Retirement Orders (CRS) for Sh. Prakash Singh.

After one year, honorable Defence Minister noticed this injustice and Sh. Prakash Singh was reinstated.

For three years in successive prior to 2014 Sh. Prakash Singh was given 65 marks only in APAR. After reinstatement the responsible officer under whom Sh. Prakash Singh reporting Joint Director (AFHQ Cadre) is well versed with the criticality of work assigned to Sh. Prakash Singh and his committed involvement towards day to day administrative work has evaluated him with 90 marks.

When Dr. Anil Kumar Maini came to know about the APAR marks of Sh. Prakash Singh, he was annoyed with the assessing officer, the Joint Director (AFHQ Cadre) and told him to give a justification/presentation in front of board of senior scientists of LASTEC.

Such irresponsible act of Dr. Anil Kumar Maini for ego satisfaction may create a divide in DRDO cadre.

It has been brought to the notice of honorable Defence Minister several times, that administrative responsibilities given to scientists are not being performed according to laid down constitutional provisions. Most of the time, “Chamchas” follow the director’s verbal orders blindly. The DRDO lab directors busy with settle their personal vendetta they don’t have time to see the national interest.

It is requested that appropriate directive may be issued to Dr. Anil Kumar Maini to stop the harassing of honest officials of LASTEC, DRDO.

SUBJECT: Deliberate Violation of FCS Scheme in DRDO

Sir,

1.       Enclosed please find the report prepared to expose the violation of FCS rules by DRDO authorities.

2.       Dr. A K Singh, present Director of Personal was staff officer to CC R&D,HR in 2004 as Sc’E’

3.       In 2007 and 2011 violating all the norms of DoPT as approved by President of India, Dr. A K Singh was promoted firstly as Scientist ‘F’ and  then Scientist ‘G’

4.        Dr. A K Singh was party as DHRD, DRDO Hqrs with RAC Chairman (then) Dr P S Goel who was amended SRO for which he was not authorized and fabricated the condition where corruption/nepotism/ favoritism could flourished.( Copy of letter issued by Dr P S Goel). This clear-cut violation of Article 309 which was supported by Dr V K Saraswat then SA to RM. Dr V K Saraswat was pioneer in misappropriate of Govt funds, misinterpretation of Govt. rules as resulted the honorable defence minister recommended CBI  intervention against him and nine other top ex officials of DRDO.

5.       Dr A K Singh is big inspiration of incompetent scientists for achieving fast promotions without doing scientific work. The 2014 recent assessment call list reflected the Dr A K Singh’s path, Sh Ashok Sharma, Scientist ‘D’ get assessment call in three years residency period, involved full time working as works officer his big scientific achievement is putting Air conditioners in boss place, placing good tiles and other day to day sundry civil works in premises of INMAS and other important places where the key of outstanding APAR found.

6.       Sir, Ask DRDO that how many scientists and officials are not appearing for assessment, the level of humiliation are in peak because of after working delicately for years and years but superseding by those who are incompetent and doing non scientific works.

7.       The case of Dr A K Singh be thoroughly examined in the light of FCS rules and appropriate action may please be taken for manipulation of SRO which deprived many dedicated scientists to get their due credits. It is directly related to performance and output of DRDO.

8.       Sir, for sake of DORO, for sake of our defence preparedness, for sake of dignity of real scientists, it is requested immediate action and directive is needed to stop the violation of FCS rules.

DRDO, DHRD working under pressure and not able to implement FCS guidelines and other corrective measures due to incompetent senior bosses

DRDS overall DRDO has misused, manipulated and override the Flexible Complimenting Scheme (FCS) guide lines issued by DoPT, GOI. Above graph showing the failure of DRDO, DHRD, total mismanaged the manpower growth, because of dummy RAC bosses and also because of absolute power of Lab Directors.

OM No. AB-14017/36/2011-Estt(RR) dated 21st September 2012 – “FCS should be rigorous with due emphasis on evaluation of scientific and technical knowledge so that only scientists who have to their credit demonstrable achievements or higher level of technical merit are recommended for promotion.”

ANNEXURE-I

Criteria for Identifying Institutions/Organizations as Scientific & Technical Institutions and definition of Activities and Services, Scientists & Engineers and Scientific Posts

(i)     The institutions referred to as S&T would be characterized by pursuit of excellence;

(ii)     They should be engaged in research, design, development or programme implementation (including review, analysis, promotion and aspects of science policy, etc.) which would cover a broad spectrum of pure and applied research but the essential feature would be innovative character and spirit of enquiry that permeates their overall functioning;

(iii)     The scientific culture is characterized by a few salient aspects, namely the persons involved are highly qualified and skilled technical personnel, involved in creative and innovative activity, they are willing to be judged on the basis of merit and competence rather than on the basis of seniority and a hierarchial structure;

(iv)              The criteria could cover the aims and objectives of the institution/ organization, qualifications of the personnel, qualitative requirements for performance of various types of activities, etc.

Scientific Activities and Services:

Scientific activities and Services covered for considering the applicability of the Flexible Complementing Scheme are as under:

(a)    Fundamental/basic research: Original investigation to gain new scientific knowledge, not necessarily directed towards any specific practical aim or application.

(b) Applied Research: Original investigation to gain new scientific or technical knowledge directed towards a specific practical aim or objective.

(c)            Experimental Development: Use of scientific knowledge directed towards producing new or substantially improved materials, devices, products, processes, systems or services.

(d)   S&T activities which are directly linked to R&D in terms of promoting the scientific activities and services.

 Scientists and Engineers: Persons

(a)    who possess academic qualification of atleast Master’s degree in Natural/Agricultural Sciences or Bachelor’s Degree in Engineering/Technology/Medicine; and

(b)   working in those capacities, us or create scientific knowledge, and engineering and technological principles, i.e. persons with scientific or technological training who are engaged in professional work on S&T activities, high level administrators and personnel who plan, direct or coordinate the execution of S&T activities.

Scientific Post is the one, the incumbent of which is a ‘Scientist or Engineer’ defined above in a scientific institution/organization declared as ‘Scientific Department’ as defined and is engaged in the generation, advancement, dissemination, and application of scientific and technical knowledge in the S&T activities.                                                                  ANNEXURE-II

CRITERIA FOR CONSIDERING PROMOTIONS UNDER FLEXIBLE COMPLEMENTING SCHEME

(a)        All officers will be first screened on the basis of gradings in the Annual Confidential Reports (ACRs) for consideration for promotion; the ACRs should be assessed on a 10 point scale giving 10 marks for “outstanding”, 8 marks for “very good”, 6 marks for “good”, 4 marks for “average” and 0 for “poor” and only those officers who satisfy the minimum residency period linked to their performance as indicated in the table below be screened in.

 Exceptionally meritorious candidates with all outstanding gradings  may be granted relaxation in the residency period, the relaxation being not more than one year on any single occasion.  Such a relaxation will be limited to a maximum of two occasions in their entire career.

 (b)        As the procedure adopted for assessment of CRs in various Scientific Departments differ at present, it has been decided that an external member, from Departments of Atomic Energy, Space or DRDO who have developed over the years a fine tuned system of screening in meritorious Scientists may be co-opted in the selection process, till such time a system gets established in other Scientific Departments.  The position will, however, be reviewed after 5 years from the date of issue of this Office Memorandum.

(c)        All officers who are screened-in will be called for an interview.  The performance in the interview will also be graded similarly on a 10 point scale and the eligibility for promotion will be based on the same norms as in the above Table.

 (d)        Field experience in research and development and/or experience in implementation of such scientific projects is compulsory for promotion of scientists recruited to the posts in the secretariat of the Scientific Ministries/Departments to higher grades under FCS.  Field experience of atleast 2 years and 5 years respectively will be essential for promotion to Scientist F and Scientist G grades respectively.  However, during the transitional period, Committee may relax this requirement in case of meritorious candidate

There are several examples of relaxation in residency period three or four times in entire service of scientists who are working as non technical and non scientific assignments and getting out standing calls.

It is observed that in the DRDO organization scientists who were deprived from normal promotion are not aware of the proper FCS guidelines and also not know how to get justice or leave to the GOD.  Some scientists in DRDO tried their grievances through SA to RM or Defence Minister few got success but their success not known to other deprived scientists.

Can anyone believe that 729 deprived scientist are able to deliver their 100% output, this figure is approx 10% of total scientists of DRDO. 10 % unsatisfied work force is acceptable in any organization. Ab to jago Chander ji , apka contract to abhi pakka hai, teen saal to pure karne hain to kuch to DRDO ka bhala karte jao.

Recently one Scientist D from DRDE represented case to DG, DRDO that the APAR was tempered the given marks was  86 and  tampered with whitener and put 80 marks, it is common practice in DRDO, how can a young  scientist know about these heinous games by their superiors. Same things are also happening in DRTC also; when some official obtained APAR by RTI request this whitener game was exposed.

I request to these deprived scientists that they can ask their APARs by RTI request. APAR is very well in preview of RTI act, no exemption or schedule –II is applicable in this matter.

I am enclosing Honorable Nainital High court Judgment where anyone can ask assessment call, if his junior is called for assessment, please go through the judgment.

I am enclosing a representation of a scientist which was a successful example of fight for dignity.

In DRDO the scientists who were engaged in sundry works like stores procurement/ works/ security/ staff officer of establishment heads and able to lure boss by any means like putting AC’s in boss private house and support all domestic helps are the winner of outstanding APAR.

So overlook these kinds of officials and represent your case with scientific and technical contribution and serve our great country.

Sub:     Assessment – 2013: Non Appearance of my name in the list of Scientists in the grade of Scientist ‘F’ from DRDL for consideration for promotion to the next higher grade.

Sir,

Based on the recommendations of a Special Assessment Board, I was promoted from the grade of Scientist ‘E’ to the grade of Scientist ‘F’ in the Year 2008, though it should have been effective from 01st July 2007.

2.         This contention apart, I have completed 5 years of residency period (2008 – 2012) in the grade of Scientist ‘F’. I was anticipating appearance of my name in the List of Scientists in the grade of Scientist ‘F’ from DRDL for consideration for promotion to the next higher grade in the Fax dated 11th April 2013, sent by Director, RAC, Delhi to Director, DRDL. However I was disappointed.

3.         I would like to bring the following facts, related to my case, to your kind notice:

i)                    Non communication of ‘Below the Bench Mark’ (90%) grading in the Appraisal Year 2008. Since the said CPAR would have to be considered for assessing my suitability, the same is liable to be ignored in view of not communicating the ‘below bench mark’ CPAR.

ii)                  Further, the said CPAR (pertaining to the year 2008) grading carried out by I.O, R.O & Head of the Lab/Establishment by one Single Officer – all rolled into one, is not permissible as the very purpose of ensuring that the assessment of an officer is made dispassionately would be defeated. Thus, on this ground too, the said CPAR would have to be ignored as being illegal.

iii)                Eligible criteria for Assessment for promotion of Scientist ‘F’ to Sc ‘G’ in terms of CPAR/APAR minimum average marks for residency periods of 5 years and more do not have statutory force as the same is not contained in the SRO. When the field is governed by a statutory rule, the executive instructions have to be subservient to the former.

4.         Considering a minimum average mark of 85% as notional Bench Mark for consideration for promotion from Scientist ‘F’ to ‘G’ for a residency period of 5 years (Application of the criteria for consideration for promotion from Scientist ‘E’ to ‘F’), you are requested to ignore my CPAR pertaining to the Appraisal Year 2008 and include my name in the list of Scientists in the grade of Scientist ‘F’ in DRDL for consideration to the next higher grade and release the same at the earliest.

1.      Whether she and her company is competent for such tie with Indian Defence Premier Organization DRDO, Ministry of Defence, GOI.

RTI- CUSTOM – Misuse of CDEC

Hello,

Kindly provide me with the following information requested under the purview of the Right to Information (RTI) Act, 2005 in respect of CDE Certificate NO. Deal/4043/2007-2008/84 DATED 18/01/2008 issued by DEAL(Defence Electronics Application Lab), DRDO, Dehradun in favor of Synergy Measurement Technologies SDN BHD 17, Jalan Dessa Mesra, Taman Desa 58100 KUALA LUMPUR, MALAYSIA against their Supply Order No LP -122/2007-2008/12/DEAL dated 31 October 2007. Against this CDEC of DEAL, DRDO, Min of Def Synergy Measurement Technologies Indian office reps (Agilent Technology) cleared whole consignment including items import for NIT Jalandhar. It is observed that this practice is commonly adopted by importers in the shadow of DRDO CDEC they are clearing their other consignments.

  1. Please provide the list of items cleared against CDEC NO. Deal/4043/2007-2008/84 DATED 18/01/2008 of DEAL, DRDO, Min of Def.
  2. Please provide custom duty amount deposited by M/s Synergy Measurement Technologies against the consignment of NIT, Jalandhar.
  3. If not deposited then copy of action taken till date.

Hello,
Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005 in respect  of LRSAM Project, DRDL’s demand of  Design, Manufacturing, Supply, Erection and Commissioning of Detachable Integrated Logistics Store Enclosure vide Demand No. DRDL/LRS/26/98P/13/049 Demand Dated 31/12/13. It is observed that M/s Trinetra Constructions already started construction on the site against above demand well before (almost two months) supply order is not given to firm. The firm already erected the structure and work in progress the store was constructed and wall plaster is in progress.

The demand was raised vide Demand No.  (DRDL/LRS/26/98P/13/049) dated 31.12.13  by sh V. Venkateswarlu , Scientist – D, LRSAM Project, DRDL SO Value with TAX (Rs.) 29925000.00 Firm Name M/s Trinetra Constructions  Address 17-1-388/77/B, Lakshmi Nagar Colony, Saidabad , HYDERABAD The firm submitted the Bank Guarantee of  Rs 2850000  vide Andhra Bank  Guarantee No.35214IGPER0004 dated 13.03.14 As per the bank guarantee dates  and enclosed photo of constructions anyone can understood the work was started very early before the date of bank i.e 13.03.14. Your rep Sh   Ved Veer Arya , IDAS, finance officer , missile complex ( DRDL,ASL, was participated in the processing of the case. The matter is directory related with corruption and it seems that PCDA rep closed his eyes because the rate of construction of required store Enclosure is five time higher.

  1. Names and address of  firms who were invited for said demand as the case was dealt in limited tender mode
  2. The copies of quotations received from firms against said demand
  3. Copy of authority letter (other than supply order) given to M/s Trinetra Constructions enters and starts the construction the restricted area by competent LRSAM officials.
  4. Date of starting construction by M/s Trinetra Constructions against above said demand.
  5. Certified copies of last three years (April 2010 to March 2013) orders given by DRDL to M/s Trinetra Constructions.
  6. Provide the number of supply orders placed to M/s Trinetra Constructions in April 2011 to March 2014 processed by CDA, Hyderabad.

Note : Matter is directly related to corruption and not exempted under Section 24 (1) as a proof the photos of above said   Detachable Integrated Logistics Store Enclosure are enclosed.

Please follow the provision of section 6(3) of the Act.

It is very interesting case of VRS of Dr Anil Kumar Maini, Director, Lastec , where senior DRDO scientists are busy for managing extension per extension 60 ke 62 aur 62 ke bad 64 aur 64 ke bad 65 and so on.

But other hand like Dr Anil Kumar Maini, Director, Lastec silently quitting before 8 months of his superannuation

Dr Anil Kumar Maini, Director, Lastec, DRDO was the main accused in complaint of Sh Prakash Singh, SAO –II and DRDO sacked Sh Prakash Singh with comments “Sh Prakash Singh was sacked the allegation leveled by him was baseless”

Defence Minister A K Antony reinstated Sh Prakash Singh and ordered CBI intervention but Dr Anil Kumar Maini’s case was in pipeline with CVO, MoD.

Dr Anil Kumar Maini, Director, Lastec, DRDO was submitted his VRS paper silently and got sanction by competent authority and leaving DRDO on 31st May 2014. Dr A K Singh extended his all efforts to arrange farzi vigilance clearance like in the case of top corrupt DRDO official Dr W Selvamurhty’s vigilance clearance. The local DRDO vigilance cell’s vigilance clearance was put with pension paper and till date Dr W Selvamurthy not got vigilance clearance from CVO, MoD. As everyone knows that CVO, MoD raised note sheet with request of action against 10 top DRDO officials from CBI and Defence Minister A K Antony approved, so how can Dr W Selvamurthy got vigilance clearance from CVO, MoD at the time of his superannuation.

DRDO RTI Cell Trying to take shelter of High Court Order

DRDO RTI cell doing propaganda that Honorable High Court declared DRDO 100%   exempted  organization from RTI Act-2005 and started giving denial  to each and every RTI request without seeing the merit and facts that the request pertain to corruption. And best part of this now they are stop writing “except information pertaining to the allegations of corruption and human rights violations”

RTI cell including First appellate authority also cited the Delhi High Court Judgment passed in WP © 83/2014 DR. NEELAM BHALLA .. Petitioner Through: Mr. R. Sathish, Advocate. Versus UNION OF INDIA & ORS ..Respondents Through: Mr. Neeraj Chaudhari, Advocate for R-1 and 2.

In this judgment is nothing new every one clearly knows DRDO was an exempted organization under Section 24 of the Right to Information Act, 2005. In other words, the Act would apply to DRDO only to the extent of information pertaining to allegations of corruption and human rights violations.

In DR. NEELAM BHALLA case  DR. NEELAM BHALLA  prayer to honorable court that information supplied by then CPIO, DRDO  Sh Bundella was incorrect and inaccurate and court says

“4. It is a matter of fact that Shri Bundela had provided inaccurate and incorrect information to the appellant but Shri Bundela’s contention that he had transmitted information as received by him from CPIO of RAC cannot be disregarded. It is important to bear in mind that Shri Bundela was not the holder of information. The holder of information was CPIO, RAC. Whatever information was W.P.(C) No. 83/2014 Page 1 of 4 forwarded to Shri Bundela by CPIO, RAC, he transmitted the same to the appellant.

6. Even so, before parting with this matter, I would like to caution Shri Bundela to exercise due diligence in responding to the RTI application in future.”

4. Having heard learned counsel for the petitioner, this Court is of the view that once the CIC has held that DRDO is an exempted organisation under Section 24 of RTI Act and the information sought does not pertain to corruption and/or human rights violation, it was not open to the CIC to carve out any further exemption.

But in whole judgment there is nothing new and not giving extra immunizing to DRDO from RTI act, if there is any extra facilitation in judgment than DRDO should quote specifically that.

under Section 24(4) of the Act which envisaged that nothing contained in this Act shall apply to such intelligence and security organizations A combined reading of these provisions would reveal, only that information is exempted, which is directly effecting and co-related to the “Intelligence” and “Security” of that organization of the State and not otherwise.

The matters pertaining to recruitment/appointments and day to day administrative nature information, where it is also found that DRDO top officials did lot of irregularities. Therefore honorable defence minister approved CBI intervention against 10 top DRDO officials including 2 ex- DRDO chiefs one Dr V K Saraswat and other one Sh M Natrajan  for their ugly acts.

It was establish facts till date all senior officials of DRDO who were fixed by CVC and CVO, MOD were exposed with the help of RTI’s only.

So DRDO officials are afraid of RTI’s if they are honest then why they worries from RTI’s . The Ex CPIO, DRDO Dr A K Tyagi who is facing charge sheet in corruption case was the big manipulator and protector of corrupt officials.

I request to DRDO RTI cell you people are serving to our nation; please not to protect culprit’s corrupt officers, your younger generation will ask you what did you contributed for justice. Now in the age of IT revolution era kid can explore what are the score of my grandpa, because these documents are alive forever.

I want to appeal all information seeker from DRDO please don’t dishearten from these act of these corrupt DRDO officials who are taking false shelter.
